Occupational safety during work with pesticides: the state of legal provision

The article is devoted to the analysis of the current state of legal protection of labor protection when performing work with pesticides, as well as the formulation on its basis of conclusions and proposals aimed at improving the current legislation in this area. It is established that the process of updating labor legislation is currently underway in Ukraine. In particular, through the adoption of regulations governing the rules of labor protection when working with certain types of chemicals (for example, ammonium nitrate). As a result of the study of current legislation in the field of labor protection when working with pesticides, it was concluded that the basic documents (State Sanitary Rules 8.8.1.2.001-98 «Transportation, storage and use of pesticides in the national economy» and State Sanitary Rules and Norms 8.8.1.2.3.4-000-2001 «Permissible doses, concentrations, quantities and levels of pesticides in agricultural raw materials, foodstuffs, air of the working area, atmospheric air, water of reservoirs, soil») are not able to regulate properly appropriate relations due to the obsolescence of their provisions. The main shortcomings of State Sanitary Rules 8.8.1.2.001-98 are determined: references in its content to already invalid regulations on labor protection, inconsistency with modern developments in the field of hygiene and toxicology of pesticides; unreasonably detailed regulation, which results in an excessive burden on business entities and leads to formalism in the implementation of the provisions of this document by employers; incorrect «rigid» regulation of the choice of personal protective equipment for work with pesticides. The directions of improvement of the legislation in the field of labor protection at performance of works with pesticides are defined. Among them: introduction of a risk-oriented approach to the organization of labor protection, including in the field of agriculture; borrowing positive international experience in the field of awareness of stakeholders on the hygienic regulation of pesticide use, the necessary safety measures for work with the use of such substances. It is necessary to carry out work to analyze the harmful factors of accidents during the production, operation and transportation of raw materials in oil and gas fields and assess their compliance with the requirements of the standards of the Republic of Kazakhstan. The main goal of labor protection is to create safe working conditions for employees, as well as to prevent personnel from illnesses. In this regard, it is necessary to have a system of accounting, analysis and assessment of the state of labor protection, as well as management of labor protection. This article proposes ways to quickly assess the state of health and safety at work by calculating a number of occupational risk indicators based on information available in the modules for assessing occupational safety by industrial risk indicators. The efficiency of using the OSH management systems software proposed by the authors is based on a specific task from four main modules "Employees", "Events", "Equipment", "Ecology" and a number of submodules. In addition, this work uses matrix methods for assessing risks in the "Probability or Consequences of an Event" coordinate system, "Elmeri" system, "Fine Kinney" method, "Risks". Modern expert methods are compared and presented under the title "Five stages of assessment"

This article suggests ways to quickly assess the state of labor protection and ecology by calculating a number of indicators of industrial risk based on the information available in the modules for assessing labor protection by indicators of industrial risk. The efficiency of using the software proposed by the authors for the occupational health and safety management system based on a specific task from the modules "Personnel", "Events", "Equipment" and "Ecology", consisting of four main modules, is proved. In addition, this paper compares the matrix methods of risk assessment in the coordinate system "probability of an event or consequences of an event" of prevention and assessment of occupational risks for employees used in domestic and foreign practice in the occupational safety management system.Work on identifying harmful factors of accidents during the extraction, use and transportation of raw materials at industrial enterprises and assessing compliance with the requirements of the standards of the Republic of Kazakhstan should be carried out continuously. The main goal of the labor protection service is to create safe working conditions for employees at industrial enterprises, as well as to prevent occupational diseases of employees. In this regard, a system of accounting, analysis and assessment of the state of labor protection, as well as labor safety management, should work.

Analysis of the approaches of the International Labour Organization to the addition of conventions is motivated by the need for a theoretical and methodological analysis of the foundations of budgeting to ensure safe work (including personal protective equipment, training, compliance with the regulatory requirements of legislation in the field of labor protection, etc.). Assessment of the current practice of formation of the occupational safety costs in Kazakhstan is offered. The issue on potential economic costs within the framework of the conventions of the International Labour Organization ratified by Kazakhstan, in particular the recommendations to the conventions № 187, 162, 155, 167, 148, is considered. After analyzing the international experience, it was concluded that it is required to revise a number of guidance documents on labor protection and safety in Kazakhstan, namely, full transparent reporting of the employers to the regulatory body in matters of industrial injuries, the state of the working environment and conditions, as well as the costs of organizational measures and protective equipment. The article introduces a new concept of «five-partism» instead of the existing «tripartism», and, also within the framework of economic costs and an ergonomic management approach, the concept of «circular financial model of the country» is introduced. In the process of study the empirical data was used, such as conventions, and, accompanying recommendations, laws on the ratification of the convention of the Republic of Kazakhstan. The issue on labor economics, including occupational risks, injuries and post-rehabilitation is studied in the leading journals of the international institutes for occupational safety and hygiene. Despite the abundance of economic literature on safety problems, functional and methodological approaches to control, budgeting, modeling and optimization of occupational safety and health costs are not sufficiently studied. Many problematic issues of the theoretical and practical significance are covered in the fragments and remain open, including the introduction and use of risk-oriented management of the sustainability of the organization of labor protection and safety by budgeting and planning costs for employee safety.

Objective: Analysis of labor legislation on labor protection in the Russian Federation and the People’s Republic of China with the aim of constantly improving working conditions, ensuring safety and harmlessness of operations which are unsafe and harmful to health, mechanization and automation of heavy manual labor, as well as the implementation of safe and civilized production. Methods: An analysis of legislation on labor protection was applied in terms of employment, labor contracts, working hours and rest breaks, wages, labor protection, social insurance, vocational training, etc. Based on its results, negative and positive consequences of legislation on labor protection in China and Russia were identifi ed. Results: The constitutions and labor legislation of both countries contain the rights of workers to legal protection, including the right to work in conditions that meet safety requirements, there are standards for investigating accidents at work, and special attention is paid to the labor protection of women and children. It was revealed that in the Russian Federation, in contrast to China, a greater number of regulatory laws and regulations were developed, and special labor assessments were effectively regulated, therefore, the safety level in the Russian workplace is higher. Practical importance: In accordance with the legislation on labor protection, state bodies, economic departments, enterprises and their leaders at all levels must take various organizational and technical measures to create safe, hygienic and comfortable working conditions for workers which prevent and eliminate accidents, industrial poisoning and occupational diseases, protect the health and safety of workers, maintain and improve their long-term working capacity, avoid unnecessary losses of social labor and material benefi ts. Constantly improving labor legislation allows working safely and protects the legal rights of employees.

According to the structure of the objects served, operating organizations have geographically remote workplaces. These traditionally include organizations in the telecommunications industry, electric power, gas industry, oil industry, and others. With the development of telecommunication channels and electronic data transmission technologies, more and more enterprises in the world use the labor of workers who work remotely. There is a trend in the world to increase the number of jobs that operate remotely from each other. This is due to global cooperation, territorial unevenness in the distribution of qualified human resources, as well as different costs depending on the region for the organization of jobs. In the context of the spread of COVID-19 and other infections, industrial communications via telecommunications channels in some cases become the only possible and safe way. Despite the territorial remoteness of workplaces from each other, the requirements of labor legislation for training and testing the knowledge of labor protection requirements for employees remain. The article presents a map of creating a value stream in the process of testing knowledge of labor protection requirements in the Volgograd branch of PJSC «RTK». The map visualizes the process and shows operations that create value for the company when checking the employee’s knowledge of occupational safety requirements. The analysis of the transport component during the verification of knowledge of labor protection requirements is given. The article presents the necessary and sufficient types and methods of transmitting information in the process of checking knowledge of labor protection requirements. It is concluded that it is expedient for remote workplaces to switch from face-to-face testing of knowledge of labor protection requirements to remote testing.

In conditions of exceeding the maximum permissible levels of power frequency electric field, the staff must use personal protective equipment. Requirements for such means are regulated by the system of occupational safety standards. The goal of this work is analyzed new requirements for power frequency and induced personal protective equipment in the regulatory interstate standards GOST 12.4.172 and GOST 12.4.283. The personal protective equipment new requirements for various types of work are substantiated to electrical personnel health safety during the maintenance and operation of power grid facilities. Increasing requirements for personal protective equipment improves the staff protection at ground potential and at wire potential, including in emergency situations such as induced and step voltage.
