Abstract. The article explores the issues of the emergence and development of historical parks in Ukraine. There are four periods of formation and development of historical parks in Ukraine: the first ‒ from the times of Kievan Rus to the middle of the 17th century (the origin of park building), the second ‒ from the middle of the 17th century before the revolution of 1917 (construction of mainly private palaces and park ensembles), the third ‒ from 1918 to 1991 (soviet period), the fourth ‒ from 1991 to the present (the period of independence of Ukraine). The definition of the concept «historical park» is given. The park is a work of art. A unique situation in human practice: to create a living and perfect work of art at the same time. Gardens and parks provide this opportunity. The park is history. The historical park preserves and broadcasts this history to us ‒ it is an object of cultural heritage, our common heritage. Sometimes the park is also a museum-reserve and bears the function of preserving heritage. Historical gardens and parks often acquire the status of monuments. Monuments of landscape gardening art are historical and cultural monuments that organically include plants, landscape features (hills, water sources and waterfalls, stream or river valleys, stones, rocks, distant landscape perspectives, sometimes wetlands), architectural structures, sculptures, flower beds, etc. Historical parks of cities include palaces and manor complexes, botanical gardens, city parks and memorial parks, as well as parks-monuments. In total, there are 88 historical parks-monuments of landscape gardening art of national and 426 local significances in Ukraine. Parks-monuments of landscape gardening art of local importance include: parks of culture and recreation, arboretums, woodlands used as recreation parks, and other objects. In particular, in the Odessa region there are 22 parks-monuments, in the city of Odessa ‒ 5 parks-monuments of gardening art (T. Shevchenko Park, Dyukovsky Garden, City Garden, Victory Arboretum, Park named after Savitsky). The article highlights the main problems in the restoration work of historical parks and solutions. The history of the emergence and development of parks in Ukraine is analyzed. It was concluded that the historical parks are multifaceted and interesting not only for architectural ensembles, but also for their biocenosis.

Gadamer’s hermeneutic philosophy avoids the problem of literary objectiveness altogether. His approach witnesses the general fact that an indifference towards literary objectiveness in particular, leads to a peculiar neglect of par excellence literariness as such. It seems obvious, however, that the constitutive aspects of the crisis of literary objectiveness cannot be shown to contain the underlying intention of bringing about this situation. At this point, one can identify what could probably be the most important element in a definition of literary objectiveness. In contrast to ‘natural’ objectiveness and objectiveness based on various societal conventions, the legitimacy of a literary work is solely guaranteed by its elements being organized in accordance with the rules of literary objectiveness. Thus when the crisis of literary objectiveness intensifies, literariness will also find itself in a crisis. This crisis detaches new, quasi-literary formations from various definitions of literariness. When literary objectiveness ceases, however, to be understood as a system constituted by various objective formations aiming to correspond in one way or another to the ‘world’, scientific analysis of literary objectiveness will be rendered impossible. The crisis of literary objectiveness thus brings about the crisis of the theory of literature and the philosophy of art. Gadamer explicitly argues that the scientific approach proves to be inadequate in the analysis of artistic experience. This attitude results in the categorical rejection of a scientific orientation (and so in a complete indifference towards literary objectiveness), but he seems to overemphasize an otherwise correct thesis on the non-reflexive character of artistic experience. It is the anti-mimetic and Platonic character of Gadamer’s aesthetic hermeneutics that determines the status of literary (artistic) objectiveness in his system of thought. What is of crucial importance, however, is to point out that this aesthetics entails a fundamental reduction of the significance of literary objectiveness. As soon as the essence of aesthetic object-constitution is taken to be re-cognition (plus the emanating aesthetic possibilities), the absolutely natural interest in the original object represented by a work of art.Undoubtedly, Gadamer’s conception answers a number of questions that tend to be ignored by other theories. It is just as obvious, however, that Gadamer completes here the aesthetic devaluation of the objective domain. It is not the characteristics of the ‘original’ that constitute the image, but in effect the image turns the original into an original. Paraphrasing this claim one arrives at a near paradox: not objectiveness makes a work of art possible, but a work of art lends objects their objectiveness.

The establishment of the Military Aviation 110 years ago, a historical event with reference to the audacious flight made by the engineer Aurel Vlaicu, on the Cotroceni land, with the Vlaicu airplane no. 1 on June the 17th, 1910, the founding of the first Civil Pilot Schools and, later on, of the first Military Flight Training School, specialized aeronautical institutions that will initiate the training of military pilots, represents the starting point that will generate major debates in the leadership and political factors of the Armed Forces, regarding the theoretical and practical methods for the development of this new reality at the beginning of the twentieth century, the selection of the human resource excellently trained and motivated to carry out fearlessly and courageously dangerous activities in the field of air weapons, but also the taking of some measures to regulate the status, the obligations and rights of the aeronautical personnel, aspects that will find their solution by developing innovative legal instruments, adapted to the requirements of the times, which will decisively influence modern developments in the fundamental area of Air Law.

The borders of visual art on the eve of the 20th-21st centuries are being extremely expanded both at the empirical and theoretical levels and so is the agenda of contemporary philosophy of art. Is the unprecedented polyphony of discourses a methodological drawback or is it a heuristic opportunity that can help to broaden our knowledge about the essence of art and the notion of a work of art? What is visual art and what is artwork speaking the 21st century language? The study examines the current trends and innovations in the visual arts field and how they can be interpreted. Authors come to conclusion that the times of normative or negativist approaches are over. The plethora of transformations is a value-in-itself and can be seen as a legitimate methodological situation, namely, as a meta-relativist turn. Examples that are presented in the paper deal with different sides of “a work of art formula”: span of discourse, artist, audience, art space, art market, new technologies, etc. Those cases demonstrate the ambivalence of current visual art practices that can be interpreted either as complete negation of the preceding standards or as new discourses that are equally legitimate with the older ones. Meta-relativist approach treats all existing discourses and practices as equally legitimate and thus provides the method to broaden our understanding of the essence of art and definition of an artwork. The study suggests that it is a contemporary tool for further intra- and inter-disciplinary dialogue.

By the authors of this scientific article was revealed the evolution of educational services as a legal category since the times when writing have been invented and till the European integration processes in modern Ukraine. In the article was emphasized that the process of providing educational services is now mostly perceived as studying, which is a consequence of the long term use of the irrelevant terminology in the legislation of Ukraine and the lack of a legally defined definition of educational services until the adoption of the Law on Education in 2017. By the authors were determined that the expectations of providers and consumers of educational services can differ significantly in content, completeness, quality, applied efficiency of these services, forms of their provision, etc. The genesis of understanding educational services definition was described and its characteristics due to the historical and legal stages of receiving the status of educational institutions. The ways of providing educational services in terms of their economic and legal nature have been determined. The features inherent in educational services, acquired as a result of long-term development of social relations, are distinguished. The modern Ukrainian educational legislation base and providing the educational services were analyzed. It is determined that most of the legislation governing the process of providing educational services can be characterized by the general declarative norms. The authors suggested improving the conceptual and categorical apparatus and some norms of the national legislation on the providing of educational services in accordance with their current development and emphasize their economic character as a result of economic activity. Also, the article deals with that the legislative definition of the educational services definition and it was noted by the authors the only focus of the educational services on achieving the expected results of studying without the formalization of them, which can make the role of consumers of these services into a passive participant in educational relations. В данной статье автор анализирует роль традиционного носителя музыкально-исполнительского искусства в социуме. На примере кобзарей и кобызистов раскрываются выполняемые ими функции в традиционном обществе. Описываются исторические особенности кобзарства, их жанры и традиции, с отсылкой к известным этнографам Ф. Колессе и Т. Шевченко. Автор обосновывает общее тюркское происхождение украинской кобзы и казахского кобыза. В статье дается характеристика деятельности кобызистов, с учетом работ известных этнографов А. Х. Маргулана и А. Ф. Эйхгорна. Рассматриваются примеры слепых кобызистов в истории казахского общества (Нышан, Шоже), а также описана династия исполнителей на кобызе, начиная с Ыхыласа Дукенова. Автор сопоставляет общее и особенное в истории развития народного искусства игры на кобзе и кобызе, показывает возможности поддержки и возрождения этого искусства в современном обществе. Предлагается введение статуса традиционного носителя музыкально-исполнительского искусства и его предназначения в современном обществе, дается авторская дефиниция вводимого термина. In this article, the author analyzes the role of the traditional carrier of musical and performing arts in society. He considers the creativity of kobzars and kobyzists to reveal the functions performed by them in the traditional society. It describes the historical features of kobzarstvo, their genres and traditions, with reference to the famous ethnographers F. Kolessa and T. Shevchenko. The author bases the general origin of instruments of ukrainian kobza and kazakh kobyz. The article gives a general description of the activities of kobyzists, with reference to the famous ethnographers A. H. Margulan and A. F. Eichhorn. Presented the examples of the blind kobzarey players in the history of the kazakh society (Nyshan, SHozhe). The author presents information from the primary source about the persecution of kobyzists in the difficult soviet period for national music and reveals the chain of succession of performing on kobyz from the classic of kobyz art, Yhylasa Dukenov. The author compares the general and special in the history of development of kobzars and kobyzists, shows the possibilities of supporting and reviving these folk music trends in modern society. It is proposed to introduce the status of the traditional “carrier” and its purpose in modern society, and the author's definition of the term is given.

There are actual problems connected with definition of the legal nature of the delegate’s mandate are considered in this article. Interaction of the delegate with voters largely determined determine by the legal nature of delegate’s mandate. The purpose of this study is to determine the relationship of the delegate and voters in the system of people’s representation in the Soviet period of development of our country. In most constitutions of foreign countries, a norm has been enshrined that characterizes the nature of the relationship between delegate and voters. In the Constitution of the Russian Federation, such a norm is absent, and it has not found its fixing either in federal or in regional legislation. The official interpretation of the nature of the delegate mandate by the Constitutional Court of the Russian Federation was not given. Therefore, to justify and understand the legal nature of the delegate mandate in the Russian Federation, it is necessary to analyze the state of this issue in the Soviet period. Despite the fact that the Soviet period gravitated to the imperative nature of the delegate mandate, nevertheless, only certain components of the imperative mandate were fixed in the legislation. In the “late Soviet” period, very democratic principles were enshrined in the legislation, but the question of the nature of the delegate mandate was not properly updated. Civil society during this period of time was more interested in the very right to participate in elections and the possibility of actually replacing a delegate mandate. In this connection, the status of deputies continued to “act by inertia”. Normative consolidation was found by all the main components of the imperative mandate, in connection with which, the idea of a “free” mandate is practically not traced.

Basic shape is one of the most important components of the learning design process. Using Western design thinking to understand shape, color and composition layout and attempting to reinterpret the application of traditional calligraphy from a design point of view—whether it is the expression of form or the meaning of content—are both important aspects of design thinking. The writing patterns of traditional calligraphy and the design creation of modern experiments may have different biases. If the artistic value of "the brush and ink of the time" is compared to the science and technology of innovation as the main appeal, the expressiveness of the traditional writing mode is obviously difficult to achieve. Using science and technology as an option for design creation is a difficult way to proceed; however, technology, ideas and thinking can still be in sync with the cultural issues of an entire era. This is also the test of the times to which contemporary creations are subjected. There are infinite possibilities for development, and it is worthwhile to explore these possibilities together with artistic aspirants. On the other hand, if we follow the well-beaten path of the status quo, the creativity of traditional calligraphic art will wither, it will deviate from the larger environment of the era in which it operates, and it will inevitably be neglected and pushed out by other art categories. The design and creation process uses the traditional calligraphy characters and drums as the theme, assisted by digital tools in the creation, and finally transforms the traditional calligraphy visual form into an expression of the art of science and technology.

The article presents a comparative analysis of fortification art monuments in such East countries from Ancient Egypt to medieval China. An attempt is made to identify the main stages of the fortification development from a stand-alone fortress (citadel, fort) to the most complex systems of urban and border fortifications, including moats, walls and gates, battle towers. It is shown that the nature of these architectural structures is determined by the status of the city or settlement, its natural landscape, building structures and materials, the development of military and engineering art. The materials from poliorceticon (Greek: poliorketikon, poliorketika), illustrate the main types of siege machines and mechanisms. The advantages and disadvantages of boundary shafts and long walls (limes). The most striking examples are the defensive systems of Assyria, New Babylon, Judea and Ancient China.

In the Arab world, the recognized children of elite men and slave women could adopt the status of their father, ignoring the slave origin of the mother, owing to a system of patrilineal transmission. This regime co-existed with negative stereotypes toward slaves and blackness, despite the very fact that—as this study of notable families in Tetouan between 1859 and 1956 demonstrates—skin color was not the determinant factor to form part of this group. Rather, it was based on the social definition of filiation, leading to legal disputes between family members to delineate the boundaries of kinship.

Transportation infrastructure in mountainous terrain and through river valleys is exposed to a variety of landslide phenomena. This is particularly the case for highway and railway corridors in Western Canada that connect towns and industries through prairie valleys and the Canadian cordillera. The fluidity of these corridors is important for the economy of the country and the safety of workers, and users of this infrastructure is paramount. Stabilization of all active slopes is financially challenging given the extensive area where landslides are a possibility, and monitoring and minimization of slope failure consequences becomes an attractive risk management strategy. In this regard, remote sensing techniques provide a means for enhancing the monitoring toolbox of the geotechnical engineer. This includes an improved identification of active landslides in large areas, robust complement to in-place instrumentation for enhanced landslide investigation, and an improved definition of landslide extents and deformation mechanisms. This paper builds upon the extensive literature on the application of remote sensing techniques and discusses practical insights gained from a suite of case studies from the authors’ experience in Western Canada. The review of the case studies presents a variety of landslide mechanisms and remote sensing technologies. The aim of the paper is to transfer some of the insights gained through these case studies to the reader.
