School Physical Education works with a range of contents that aim to contemplate Movement Corporal Culture, among these are Struggles. Using literature in order to understand how research deals with this topic is essential for understanding its strengths and limitations. Following the integrative review method, this study’s purpose was to identify possible contributions of Struggles over integral human formation of students, into Educational Sports context. A preliminary literature search identified 192 articles published between 2015 and 2020. Studies were evaluated within three categories: Struggles into school environment, teacher formation and Educational Sport aspects. Review resulted to 6 articles according to inclusion and exclusion criteria. Despite limitations around studies on area, results indicate Struggles content is recognized both in educational legislation and by researchers of this field; Physical education professionals have various difficulties for applying Struggles in their classes, mainly alleging problems in their teacher formation; and Educational Sports aspects appear in a non-convincing way, without empirical deepening, nor research applied to this specific theme. It is concluded that Struggles use is possible at school, but it requires confrontations, and Struggles contextualization inside Educational Sport principles is still vaguely explored, making it a field of possibilities for future researches.

This research contributes to the knowledge and understanding of some aspects of the professional practice of primary education teachers in the Region of Murcia (Spain), and its possible effect on the creation of situations of educational exclusion. For this purpose, an instrument called EPREPADI-1 (Scale of Perception of Primary Education Teachers on their Training and Professional Practice in relation to Pupils with Disabilities) has been developed. The design and structure of the instrument includes important aspects that seek to highlight teachers’ views and knowledge of educational legislation (international, national and regional), their views on nomenclatures (such as those of persons with disabilities and inclusive education), as well as their assessment of the use of language of denial in relation to pupils with lower functional performance. Furthermore, after the statistical tests carried out for the validation of the scale (Kendall’s W test and Cronbach’s Alpha), values were obtained that give the instrument excellent validity and reliability (both for the group of experts and also for the pilot group), which is why its use and application is recommended.

This paper introduces the stages and specific problems of Soviet educational legislation. First, the Legislation of the Soviet Union established many vital institutions, such as the system of equality between men and women in education. Secondly, the Soviet legislature and the Soviet Union also institutionalized Marxist ideas about freedom of learning and the overall development of human beings. Thirdly, in the practice of the Soviet Union, how to balance the relationship between freedom, equality and efficiency has become a topic worthy of subsequent discussion. Moreover, Soviet legislation influenced subsequent international human rights legislation and laid the foundation. On this basis, the subsequent international human rights legislation has been further improved.

Background: In a society increasingly marked by the logic of contemporary capitalism, education becomes an instrument for the reproduction of alienated labour forces. Objectives: To provide an overview of the characteristics of subjectivity and attitudes of the postmodern subject based on the studies of Fredric Jameson and David Harvey; unveiling the development of techniques for producing more effective ways of subjecting the company culture to neoliberal rationality described by Pierre Dardot and Christian Laval and their influences on the formation of contemporary identities; reflect on the role of education, in particular of scientific education, in overcoming the state of alienation brought about by the capitalist system of neoliberal societies. Design: Articulation between exploratory and bibliographic research, articulated with the theoretical frameworks of Paulo Freire’s critical theory and pedagogy.  Settings and Participants: Given the typology of the research carried out, articles, books and documents about the capitalist system in neoliberal societies, the educational legislation and Paulo Freire’s pedagogy. Data Collection and analysis: Critical reflection on the texts consulted and included in the research. Results: There is a relationship between the subjects constituted from the marketing logic and the role of the school as a reproducer of mechanisms of subjugation to the hegemonic capitalist system; there is also the business and industrial influence in the development of educational policies throughout the history of education. Conclusions: As a possibility of transforming this scenario of alienation from the educational system to hegemonic power, the Freirean conception of emancipatory critical humanist education is presented, in addition to the reproduction of capitalist logic, based on the awareness of subjects based on dialogical pedagogy and the appropriation of the scientific knowledge as a transformer of reality.

The article is devoted to the problems of legal regulation of the functioning of private universities in Ukraine on the example of one of the first such educational institutions – Kharkov Humanitarian University "People's Ukrainian Academy". The article presents a historical retrospective of the main legal conflicts in the activities of the PUA, which were not only resolved in its favor, but also formed the basis for the correction of the current legislation by amending the regulations governing the activities of educational institutions in Ukraine. The relevance of this topic is mainly due to the need to amend the current legislation in order to ensure the equality of the legal status of educational institutions based on various forms of ownership and which are still in a state of intense competition for consumers of educational services. The analysis of the current educational legislation presented in the article testifies to the continuing normative consolidation of preferences for state educational institutions, which leads to legal discrimination of private universities. This, in turn, not only contributes to a decrease in the quality of educational activities of private educational institutions, but can also lead to their self-liquidation. The article also emphasizes the need to continue work on the correlation of educational and civil legislation. For this purpose, as well as to improve the overall qualitative characteristics of the functioning of the Ukrainian educational industry, the emphasis is placed on the need to systematize the norms of educational legislation as one of the forms for its improvement. At the same time, one of the main means of conceptual renewal of the system of educational legislation of Ukraine is its early codification, which should lead to the creation of a single systematized act – the Code of Ukraine on Education.
