The article is devoted to the issues of improving the development of staff capacity and human resource management in the National Police of Ukraine. It is analyzed the domestic and foreign experience of personnel management in the police as an important factor in achieving the strict observance of human rights by police, the implementation of their service function, the formation of new motivation of professional development for police, the development of communication skills and other professionally important individual psychological qualities. The purpose of the article, in accordance with a clearly formulated and properly updated thematic problem, is a research of problematic aspects of administrative and legal providing the training for the National Police of Ukraine and ways’ identification of their improvement on the base of analysis of national and international legislation and generalization of its implementation. The new requirements facing law enforcement managers today require the mastering modern approaches to personnel management. In the middle of the world's progressive concepts of police management in democracies is a human, the policeman, who is considered as the greatest value. The effective management systems are focused primarily on professional and personal growth, development of general and special skills of police officers so that they will be maximally used in professional activities, will be useful to society, contribute to the effectiveness of the law enforcement system. Of course, it is extremely difficult to achieve 100% job vacancies, but there are things that the leadership of the Ministry of Internal Affairs and the National Police can do today to solve the problem of staffing. Summarizing the above, it should be noted that the issue of improving staff policy in the police is relevant, as currently there are not clearly such aspects as: professional selection of candidates for police service and holding vacant management positions; motivation, stimulation and personal development of staff. Therefore, in order to fully implement the requirements of the Law of Ukraine “On the National Police of Ukraine” and increase the efficiency of staff management of the National Police, it is advisable to develop Regulations on the Personnel Department of the National Police of Ukraine to regulate staff issues.

The article is focused on studying the phenomenon of the administrative and legal status of the National Police as a subject of Ukrainian state policy implementation in human rights and freedoms. The author outlines the essence and content of the administrative and legal status of the National Police of Ukraine through the leading categories of "law" and "freedom", which are important for the democratic processes developing in Ukrainian society. The administrative and legal status of the National Police of Ukraine is considered as a set of characteristics and powers entrusted in the state legislation, a set of the following components: target – determined by the mission of the police to promote the state policy implementation in the fight against crime and peacekeeping, enforcement of rights, public and state interests; organizational – characterizes the structure of the National Police, consisting of a central police control facility, which consists of organizationally integrated structural units that ensure the implementation of the police tasks in human rights protection; competent – related to the definition of tasks, functions, rights, and duties, as well as the degree of responsibility of the law enforcement and its units and employees, determining the focus of their activities on the protection of the individual and the guarantee of the legitimacy of counteracting the state on the part of the person to protect their rights and freedoms. In practice, the implementation of the new administrative and legal status enables law enforcement to approve the law, enhance the communication and legal culture of police officers, overcome the traditional politicization and militarization of law enforcement by updating the organizing strategies of human rights activities, strengthen the state and professional discipline, make the police activities transparent, improve the control system and responsibility of police structures and professionals for malpractice.

The scientific article is focused on the legal regulation of administrative supervision of the National Police of Ukraine. The purpose of the study is to define the concept and features of police administrative supervision and develop propositions for amending the existing legislation regulating law enforcement activity. The relevance of the chosen topic is the fact that police officers’ powers to monitor the rule of law in the fields of economy and public administration can directly affect the rights and freedoms of individuals and the legitimate interests of legal entities. The scientific novelty of the study lies in the doctrinal definition of the concept of police administrative supervision and its features and the development of propositions for amending the Law of Ukraine "On the National Police". The publications of scholars who studied the problems of police administrative supervision in various sectors of the economy and public administration were studied. The norms of legislative acts that establish the supervisory powers of the police are analyzed. It is concluded that police administrative supervision is systematic monitoring of the compliance with Ukrainian legislation in the fields of economy, public administration, public life, and the application of coercive measures to offenders to stop the offense and bring them to justice. Features of police administrative supervision, such as regularity, legality, formality, publicity, have been identified. Police administrative supervision is protective. Its purpose is to stop and prevent violations of Ukrainian law. Administrative supervision over the compliance with the law is carried out in the areas of public order and public safety, public administration, business, drug trafficking, firearms and ammunition, road safety, and other sectors of the economy and public administration. It is offered to make appropriate amendments to the Art. 2 of the Law of Ukraine "On the National Police". The article deals with the research of the issues of pension provision for police officers as a component of their social security. Since the category of police employees is new to Ukraine, its significance for labour law and, accordingly, the value of the police for the society, whose citizens they protect, has been characterized. An analysis of statutory acts regulating the pension provision for law enforcement bodies' employees has been carried out. The concept of a seniority pension for police officers has been defined as a monthly payment from the Pension Fund of Ukraine intended to compensate for lost pay and allowances and granted upon resignation for the purpose of maintaining living standards of citizens having the seniority of a specified duration in law enforcement bodies, the National Police, the Court Protection Service, the State Fire Protection Service, the State Service of Ukraine for Special Communications and Information Protection, bodies and divisions of the Civil Protection Service, the Tax Police or the State Penitentiary Service of Ukraine, whose occupational incapacity is presumed to set in before they reach the retirement age established by law for awarding an old-age pension. The author proposes the adoption of a new law on pensions precisely for police officers. For in contrast to the definition of Militia (the name the police were called in the Soviet Ukraine and during a number of the post-Soviet years) as an armed body of the executive branch, the Law of Ukraine "On the National Police" defines the police as a central body of the executive branch that serves the society by ensuring the protection of human rights and freedoms, combating crime, maintaining public security and order. According to the author, the legal regulation of the pension provision for servicemen and police employees by a single statutory act (law) does not correspond to the realities of today. Conclusions have been formulated on supplementing the Law of Ukraine "On the National Police" with the provision that restrictions of guarantees of social and legal security of the law enforcement bodies' employees shall not be allowed when adopting laws and bylaws, as well as when making decisions by law enforcement agencies of the state. Special attention has been paid to calculating the amount of police officers' seniority pension. The procedure for determining the amount of pension depending on the length of service has been analysed. The author believes that lowering the limit of the seniority pension for law enforcement bodies' employees, including police employees, initially from 90 down to 80 per cent and then from 80 down to 70 per cent of their pay and allowances is a violation of the Constitution of Ukraine. Constitutional rights and freedoms are guaranteed by the state and cannot be revoked when adopting new laws or amending existing ones. No narrowing of the content and scope of existing rights shall be allowed. The author proposes to work out a new Procedure for recalculating pensions granted to police officers. Outdated statutory acts governing the procedure for recalculating pensions granted to law enforcement bodies' employees contain controversial provisions, have conflicting points, do not comply with the Constitution of Ukraine and the realities of today, and are therefore subject to repeal.

The author has studied the peculiarities of academic motivation of final-year cadets (n=323) of higher education institutions with specific educational conditions. It has been determined that the dominant motivation for their professional training is internal motivation. They make independent decisions about their professional activities and seek to continue their service within the National Police. Adequate and situational types of professional motivation are typical for cadets. Respondents are aiming for theoretical knowledge. The motives for the professional activities of final-year cadets do not affect their motivation to acquire theoretical knowledge, but they affect the acquisition of professional skills and abilities. The “romantic halo” of the profession remains in the perception of the profession by final-year cadets, but the material component also becomes important. The status of the profession in society and its material remuneration, as well as the curiosity of the chosen profession have significant influence on the motivation of future professional activities of fourth-year cadets. The motivating factor for internally motivated cadets is a sense of effectiveness, as well as status and state’s high salary for labor of law enforcement professionals. Externally positively motivated cadets in case of the decrease in the status of the profession, unrealized career ambitions or the reduction of the material rewards of law enforcement officers may begin to perform their duties formally or may leave the service. Externally negatively motivated cadets are not interested in performing professional duties. On the basis of the obtained data, the author has concluded on the importance of mentoring in the process of professional development of young specialists and the continuation of professional training in the system of postgraduate education and service training of police officers. The author has emphasized the importance of further motivation of final-year cadets within professional activity, in particular the introduction of a “motivational” package for police officers by the state.

The article reveals the role of the prosecutor's office of Ukraine in the process and in order to ensure guarantees of the independence of judges and the authority of the judiciary. A study of the legislative framework of Ukraine proves that the role of the prosecutor's office in the process of ensuring guarantees of the independence of judges and the authority of justice is regulated by the provisions of the Constitution of Ukraine, the Law of Ukraine «On the Prosecutor's Office», the Law of Ukraine «On the Judicial System and the Status of Judges», the Code of Professional Ethics and Conduct of Prosecutors, the Criminal Procedure Code Of Ukraine, the Criminal Code of Ukraine, as well as other regulatory documents. It was found that the judge, performing professional activities in the direction of the administration of justice, is independent of the various influences, pressure or interference, which are illegal. The legislation of Ukraine determines that the principle of the independence of the judge indicates that the judge is not obliged to provide explanations regarding the nature and content of the cases being pending, with the exception of cases established by law. State authorities, local self- government bodies, officials and officials of these bodies, individuals and legal entities and associations of such persons should respect the independence of judges and in no case should encroach on it. It was determined that one of the principles on the basis of which the professional activities of the prosecution authorities are based is the principle of respect for the independence of judges. It has been proved that the High Council of Justice always adheres to the position of unconditionally ensuring the independence of judges and establishing this direction as a priority type of activity for law enforcement agencies, in particular, for the prosecutor's office. Fast and quality investigation of crimes related to the professional activities of judges will, first of all, contribute to the observance of constitutional law regarding the principle of access to justice.. It is noted that the prospects for further research in this direction are the study of the legal basis for the observance of the principle of the rule of law and legality by the judiciary in the context of performing professional activities.

Background Psychological and psychiatric support of work activity of law enforcement officers is an inalienable component of the effective and professional operation of the system of internal affairs bodies. Improvement of this work is impossible without increasing the effectiveness of the psychological selection of candidates for work. Method Methods of research were "Freiburg personality inventory" (FPI) - Option «B», «Minnesota Multiphasic Personality Inventory» – MMPI. The study group included 158 respondents: 79,1 % (125 people) of men and 20,9% (33 people) of women. To analyze the results obtained, we used the methods of descriptive statistics, frequency analysis, and Kendell rank correlation. Results Particular attention should be paid to the fact that while comparing the scales of the diagnostic scales of the FPI and MMPI technique, it would be logical to expect the presence of correlations between the scales similar in their diagnostic orientation to such correlation links neither within the male or female gender it was not found (τ-b ≤0,17;p ≥0,06). This unexpected fact, as well as the lack of systematic and gender-wide universality of the revealed correlation links between the indicators of the FPI and MMPI methods, point to a rather serious content heterogeneity of these psychological tests. Conclusion The results of the analysis do not provide an opportunity to justify the FPI test for wide use in practical activities for the professional selection of law enforcement officers.

The article deals with defining directions for improving the training of specialists for pre-trial investigation bodies of the National Police. Every year, more demanding demands are placed on law enforcement activities of state bodies, in particular the National Police, which in turn requires an increase in the amount of knowledge required by police officers. Increasing the intellectual level of criminals, using offenders more sophisticated methods and means of committing offenses, careful training, masking criminal acts require adequate response of law enforcement agencies, which in turn requires appropriate training of Interior Ministry employees. An analysis of the publications which initiated the solution of this problem showed that today there is a lack of thorough research on the directions of improving the training of specialists for the bodies of pre-trial investigation of the National Police, which determines the relevance of the investigated problems. At present, within the structure of higher education institutions of the Ministry of Internal Affairs of Ukraine, the specialization of training police officers is focused only on the process of training police officers of criminal police (Dnipropetrovsk State University of Internal Affairs - financial and economic security; Odessa State University of Internal Affairs - units of counteraction etc.). In turn, the process of training specialists for pre-trial investigation bodies does not have such an extensive system of training areas. As a result of the conducted research, it is concluded that there is an urgent need to improve the training of specialists for pre-trial investigation bodies of the National Police. The main directions for improving the training of specialists for the pre-trial investigation bodies of the National Police should be: 1) increasing the requirements for the quality of legal education and professional training of future employees of investigative units; 2) introduction of training of experts for pre-trial investigation bodies according to the profiles assigned by the Ministry of Internal Affairs of Ukraine; 3) introduction of an effective model of conducting binary classes with the involvement of experienced staff of pre-trial investigation bodies in the process of training specialists for such bodies.

ABSTRACT Objectives: This article aims to explain the causes of criminal acts of violence that occur in cases of violence involving the masses and explicate the concept of preventing violent crimes involving masses who have a transcendental paradigm. Methodology: This research was qualitative nondoctrinal research. The strategy of applying Preventive Law with a Transcendental paradigm as a concept of preventing criminal acts of mass violence with religious nuances is as a way to reduce the emotions of the masses and eliminate the intention of the masses to commit acts of violence. The sources of data were in the form of research and interviews of cases of mass violence. The data analysis used interpretation techniques based on the (premise) stage of mass violence, according to Niel Smelser and transcendental preventive patterns in accordance with the literature reviews of books and scientific journals. Results: The results showed that violence is an act against the law (onrechtmatige daad), where it is the human state of nature. In the crowd, people will imitate other people's actions, lose control, and take aggressive actions. The law is a tool for social engineering to prevent crime, maintain an orderly society, and provide protection for citizens. Law enforcement is prioritized using soft methods (the soft hand of society) to prevent violence from happening with a transcendental paradigm approach to restoring human nature, according to Surah Ali Imran (3) paragraph 110, namely amar ma'ruf, which contains transcendental ethical values. Functions: This research is useful in the implementation of the Transcendental Preventive Law for law enforcement officers, in this case, the National Police, as an effort to break the 4th stage, namely the stage before triggering incidents occur. It is intended that at the time of mass violence, the Preventive Transcendental Law can cool down the emotions of the masses while at the same time restore human awareness that peace, compassion, and the world and its contents are a gift that must be accountable to God Almighty. Originality/Novelty: Transcendental Preventive Law is an effort to prevent violent crime in mass violence that is based on transcendental principles, by giving a religious touch to remind the masses that violence is a sinful act and to remind the existence of God Almighty.
