Deregulation is the basis for creating a national business model that should be close to European ones. Business climate in Ukraine has been characterized by unstable position that did not give opportunities to develop the national economy. Investors and entrepreneurs, during the period of independence, have noticed the cyclical character of the supporting level for doing business, it means that most state regulators justified their relevance, but many of them are ineffective, or are not relevant. The impossibility of business transparency has led to the reduction in the number of business units, as well as investment resources. The creation of favorable investment climate is the main task and object of the investigation for many scientific works. Transparency of the market, minimization of regulatory barriers and control bodies, as well as fair rules for organizing and doing business, can radically change the environment for business. Despite the attitude to Ukraine by foreign investors as for the country with significant business prospects, the level of foreign investment attraction remains low. Theoretically, it is assumed that with advantageous geographical provisions, industrial base and significant land resources, Ukraine has been able to triple capital in the conditions of existence of the favorable primary model of business management. The agrarian and energy industries could become dominant in attracting external capital. However, the recent years showed the significant reduction in foreign investment in the economy of Ukraine, and business players on the national market are trading, partially industry and construction, which also work at a small level of profitability, and the current economy state proves that these sectors cannot significantly effect on its development in perspective. Thus, searching for possible ways to improve the business environment, where the key indicator is the deregulation of business processes, remain relevant and should become the basis for economic reform without which Ukraine will not be able to become a highly competitive state, and therefore economic uncertainty will continue to affect its development negatively.

The article is devoted to the issues of actualization of problems and novelties in the context of theoretical and legal segments of the bankruptcy procedure. The activities of economic entities are influenced by external and internal factors, but the issues of their solution remain in most cases in the discussions of politicians, scientists and representatives of the business environment. The effectiveness of legal entities has recently proved that the application of bankruptcy proceedings has intensified. However, remediation issues do not always have and receive adequate support. The consequence of these phenomena is the cessation of activities not only of small and medium-sized businesses, but also of individual large businesses. The main task of modern enterprises on the verge of bankruptcy is to develop tools and tools that allow to predict and analyze potential crises, to design options for their resolution and the appropriate information and economic base of management. Practical entrepreneurial activity proves that a number of issues remain unresolved and need more in-depth research and attention. This phenomenon indicates the modernity and relevance of the study given the realities of the functioning of legal entities. The article draws attention to the legislative regulation of bankruptcy procedures, identifies the priorities of legislative initiatives. The question of the scientific position of scientists concerning the characteristic of the conceptual categories "bankruptcy" and "remediation" is investigated. The author's vision of the essential characteristics of these categories is given, the substantiation of expediency of their adaptation in activity of domestic enterprises is given. A package of anti-crisis management measures has been developed taking into account the current realities of doing business. Proposals for improving the legislative regulation from the standpoint of reorganization procedures are presented. The development, approval and adaptation of the "Regulations on the stages of remediation" is proposed. From the author's point of view, it is expedient to include in the structure of the legislative regulator: conceptual apparatus for reorganization procedure, definition of methods and techniques of evaluation of clearly defined criteria with establishment of their normative limits, coverage of monitoring procedures.

AbstractUkraine faces a threat of full-fledged default and deep financial and political crisis. The current deep recession is the country's second major economic crisis in ten years. Ukraine was severely affected by the global financial crisis in 2008, with its economy shrinking by 15% in 2009. The economy remained weak in the aftermath, as former government caused the business climate worsening. The lack of reforms limited growth of GDP to just 0.3% in 2012 and remained static in 2013. By the end of 2013, Ukraine was already on the brink of collapse. The conflict in the eastern part of the country has further exacerbated the recession. Today the sources of economic growth in Ukraine have been exhausted, and the country is strongly increasing its debts trying to attract foreign investment. The government’s reform efforts have so far failed to significantly improve the country’s business climate. Ukraine is ranked 83rd out of 189 countries in the latest World Bank's ‘Doing Business’ 2016 index. This score is the second worst in Europe. Ukraine is still considered the most corrupt country in Europe as well (rated at number 142 out of 175 by Transparency International in 2014). The persistent state of war has disrupted industrial production, which is mainly located in the eastern part. The article elucidates recent events in Ukraine as well as gives a brief historical overview. The influence of misleading governance of economic situation is revealed. The positive scenario, in which Ukraine overcomes default, is unlikely to happen unless the firm measures are to be taken.

Subject The business climate in Kazakhstan. Significance Kazakhstan is improving its score as a business environment but much remains to be done. Corporate regulation has improved and anti-corruption efforts have been undertaken, albeit with uneven effect. Major privatisations often do not happen or end up redistributing assets within Kazakhstan. A recent restructuring of ministerial responsibilities seems likely to complicate rather than simplify the task of attracting foreign investment. Impacts Aside from structural issues, unanswered but increasingly urgent questions of political succession will weigh on investor interest. The low level of economic diversification limits the pool of investor opportunities. Kazakhstan will continue to be the main regional magnet for FDI but Uzbekistan may start catching up.

The article seeks to explore the nature and content of benchmarking to provide insights to such distinctive features of benchmarking as on-going (continuous) character of the process; the need to study, adopt and adapt the best practices; self-improvement; and the due regard to business (operational) processes. The study offers a classification of benchmarking projects by the criteria of relevance of their results and the implementation timeline. Thus, each competitive position is linked to a corresponding degree of business processes upgrade (Level 1); competitiveness increase (maintenance) (Level 2) and improvement of a competitive position (Level 3) along with revealing the backbone principles of competitive benchmarking as to competitive positions. Within the scope of this research, benchmarking of competitive positions has been carried out through analysing continuous improvement of small and medium-sized business performances.  The study presents a methodological framework on the use of a combination of key metrics (indicators) that take into account the external and internal business environment impact factors to assess the effects of the key factors of business success on small and medium-sized business performance indicators. Apart from that, an original approach has been developed to identify a competitive position level for small and medium-sized businesses to support their management decision-making process which accommodates the benefits of a multifaceted assessment and benchmarking of external business units and SMEs by the four groups of business units and six groups of reference indicators. The study also provides sound reasoning to management diagnostics procedures to enhance competitive positioning of small and medium-sized businesses through the implementation of an integrated set of indicators of integrity and adequacy of the competitive positioning model. Based on benchmarking, a range of management tools was generalized. The proposed methodology on identifying the business development level was tested on JSC "Cherkasy Liubava knitwear". A number of promising areas to develop competitive positions of small and medium-sized enterprises in the textile industry have been identified. The study argues that inefficient and ineffective implementation of benchmarking projects might result from the inability to "minimize restrictions (barriers)" caused by the wrong choice of the reference business unit.
