Halal logo is designed to protect consumers from fraud and mislabelling. However, over the years, there has been a controversy surrounding the use of a false halal logo to attract Muslim consumers to buy certain goods. The act of unethical business practice to attract consumers to buy their goods have caused some misunderstanding among consumers regarding the halal status of such goods. Therefore, the law is the most important mechanism in protecting the rights and interests of consumers to claim compensation if their rights have been violated. Under the Consumer Protection Act (CPA) 1999, it puts a responsibility on suppliers and manufacturers to ensure that the goods supplied are the same as specified. However, the question arises as to the extent to which consumers have the right of redress under the CPA 1999 in the issue of supplying false halal logo goods. By using the content analysis method, this article aims to analyze the scope and provisions of the CPA 1999 that govern matters relating to the supply of goods. The discussion of this article reveals that Part VI and VII of the CPA 1999 contains several loopholes that must be addressed in order to provide better rights of redress to consumers on the issue of supplying false halal logo goods.

INDONESIAN JURISPRUDENCE: ISLAMIC LAW TRANSFORMATION IN LAW SYSTEM OF INDONESIA.: This study discusses about the idea of Islamic law renewal in Indonesia, as well as the figures, and it makes the term of Indonesian Jurisprudence and its formalization into the law system of Indonesia. The purpose of this study is to find the answer of these following points: Firstly, the interpretation or definition of Indonesian Jurisprudence concept; secondly, the figures who proposed Indonesian Jurisprudence and the result of their thoughts; and the third, the formalization of Jurisprudence concept with Indonesian nuance in the law system Indonesia. This study was a library research with a content analysis method. The results of this study are: (1) Indonesian Jurisprudence could be interpreted as a Jurisprudence concept that is more Indonesian local-based; (2) Hasbi As-Shiddiqi and Hazairin are two figures who proposed Indonesian Jurisprudence model, apart from other intellectuals. Hasbi is one of modernists who offered his ideas comprehensively, started from his “Indonesian Jurisprudence” concept until the law renewal including its principle and method. Meanwhile Hazairin offered the development of a new heritage system which interpreted and elaborated based on Al-Qur’an scriptural perception and Sunnah which is not a patrilineal system but bilateral (family model); and (3) formalization of Indonesian Jurisprudence concept produces some ordinance regulation products which are important formally and materially, such as Ordinance of Islamic Marriage Law, and also other rules under the Ordinance, such as Government Law, President Instruction, and Supreme Court Law, as well as Islamic Law Compilation and Sharia Economic Law Compilation

The authors point to the plurality of forms of consumer protection. Private law form of consumer protection is individual protection in civil proceedings. The protection of the collective interests of consumers in most European legal systems is achieved through litigation. The Consumer Protection Act entrusts the protection of the collective interests of consumers to administrative bodies, which is realized in administrative proceedings, whose rules are characterized by considerable differences in relation to the rules provided by the Law on General Administrative Procedure. A significant unit is dedicated to the mechanism of alternative dispute resolution, especially arbitration and mediation. The shortcomings of the Law on Consumer Protection regarding certain contradictory provisions are pointed out. The legislator stimulates alternative dispute resolution, and on the other hand stipulates that contracting one of these methods does not affect the right to judicial protection. The paper also analyses the inspection.

The experts of the Islamic law methodology (Ushuliyyin) have inherited the ta'wil method; a method of discovering the esoteric meaning in the textual disclosure.  The application of ta'wil method must be exactly based on predetermined rules of play. The mistake of understanding a method will have negative impact toward the law product. This phenomena was worried about by the ushuliyyin very much. This research is a library study with content analysis method. This study concludes that ta'wil according to ushuliyyin that is, the abrogation of a pronouncement of the meaning of zhahir to another meaning which is not quickly captured, because there is a proposition that the meaning is meant by the pronouncement. Evidence of ta'wil in the form of nash, qiyas, luhgawiyyah, 'aqliyyah, and' adad ('urf), and the argument disputed is the wisdom of al-tasyri' (maqashid al-syari'ah) which is practiced only by ulama ushul al-Hanafiyyah. Ta'wil covers the furu' problems. Ushuliyyin finds some form of ta'wil, among which specializes in general pronouncing (takhshish al-'am), limiting the mutlaq (taqyyid al-mutlaq), transfer the utterance from the essential meaning to the majazi, or from the obligatory meaning of the sunnah. Generally the ta'wil method is still considered relevant to the renewal of Islamic law.

Background: The public's lack of understanding of the different professions of dental artisans, dental technicians, and dentists has an impact on the practice that exceeds the authority carried out for years without any legal consequences borne by dental artisans. Although the regulations concerning work that can be done by dental artisans have been clearly explained in Permenkes No. 39 of 2014 this is still violated by dental artisans. In this case, the people are victims because of ignorance and high local wisdom in certain areas. Method: This study uses a type of normative juridical legal research. Normative legal research is research that focuses its study by viewing the law as a whole system rule which includes a set of principles, norms, and rules of law, both written and unwritten. Results: Giving the right to claim compensation to the patient is an effort to provide protection for each patient for a result that arises both physically and non-physically due to a mistake or negligence by health personnel. Conclusion: Dental workers can be charged with the Criminal Code article 359, 360, 361, namely whoever is due to his mistake (negligence) causes other people to be injured, severely disabled, or even die. In addition, the Consumer Protection Act No.8 of 1999 Article 4 of the Consumer Protection Law has the right to comfort, security and safety in consuming goods and/or services that can be used.

Purpose of the study: The main purpose of this study is to provide a new, macro-level model of strategic staffing to bridge the gap in the knowledge regarding how practices within recruitment and selection systems can work to provide a competitive advantage among various sectors. This study identifies the various methods of recruitment and selection process through a systematic review of literature, which would be the right fit for attracting and selecting employees in an organization. Design/methodology/approach: Content analysis method is adopted to review the literature and subcategories were formed to analyze the research. Literature was collected from 40 articles of a reputed journal from 2010 to 2018. Main findings: The review of literature revealed that the recruitment and selection process is carried out in organizations by adopting latest technologies like online portals, outsourcing, job fair, campus interviews, and mobile recruitment applications. The representation of this practice is to find the best candidate for an organization. Besides adopting the latest technology, consideration of the expatriate factor would lead to an effective way of recruitment practices in finding out the right candidate for the right job and thus create a healthier work environment. The expatriate factors have not been considered well in the Indian context, but have been given importance in the global context in the process of recruitment and selection. Social Implications: Highlighting the significance of various recruitment practices results in the selection of the right person in the right job, which enhances a healthier working environment in organizations, in turn rendering high quality products and services to the society. Originality of the study: Prior research has studied various factors that influence internal recruitment, external recruitment, and selection process. This study is an attempt to analyze the expatriate factors and other factors through the content analysis method.

University of Indonesia is granted as the number one campus based on the Webometrics rank. It cannot be separated from the way University of Indonesia in building a strategic content for its website thus can fulfill the four points score indexes of webometrics such as Presence, Impact, Openness, and Excellence. Never theless the way the website serves the menu and information can build the right point of the scores. At the same time, Dian Nuswantoro University is granted as the 31st rank for the Webometrics index. Hence, by analyzing the website content of University of Indonesia, later it can be a guideline for Dian Nuswantoro University in developing a better content. This research uses the Positioning Strategy Theory. This is a descriptive quantitative research with a content analysis method. The results shows that the University of Indonesia uses the functional concept positioning strategy as its website content strategy.

Up to this contemporary era, the concept of maṣlaḥah developed by several leading Moslem scholars seems to be rather theocentric in a way that it is transfixed on the maṣlaḥah considerations contained in the texts (naṣṣ). This means that the concept of maṣlaḥah has so far been shadowed in the textual confinement so that the resulting maṣlaḥah becomes an old-fashioned, stagnant, and less-able concept for responding to the times’ challenges. This study aims to open up discourses and opportunities for the development and reformulation of maṣlaḥah in the current contemporary era. This qualitative study is library research. The data used were obtained from book literatures, journals, and other writings related to maṣlaḥah and were analyzed using a content analysis method. The discussion was done by describing the historical data of previous thoughts on maṣlaḥah from the process of textual confinement to logic determination which was then formulated with the reality of today's modern era life. The results of this study indicate that: 1) from its historical aspect, the reformulation of maṣlaḥah is one which has so far only been assessed in the perspective of Shāri' (the Law Maker), hence, it is necessary to reformulate it in the perspective of mujtahīd by referring to maṣlaḥah associated with the issues’ reality context, 2) there is a need to incorporate the concept of ethics and humanity into the structure of maṣlaḥah, and 3) there present a necessity to formulate a collective-based ijtihād in probing of maṣlaḥah to create a scientific maṣlaḥah-based ijtihād methodology.Hingga pada era kontemporer sekarang ini, konsep maṣlaḥah yang dikembangkan oleh beberapa tokoh ilmuwan Muslim tampak lebih bersifat teosentris yang terpaku pada pertimbangan maṣlaḥah yang terdapat pada teks (naṣṣ). Artinya, konsep maṣlaḥah selama ini masih terbayang-bayang dalam kungkungan teks sehingga maṣlaḥah yang dihasilkan menjadi konsep yang jumud, stagnan, dan kurang bisa merespon tantangan zaman. Penelitian ini berusaha membuka wacana dan peluang terhadap perkembangan dan reformulasi maṣlaḥah pada era kontemporer saat ini. Penelitian ini adalah sebuah studi pustaka (library research) yang dilakukan dengan metode kualitatif. Data yang dipakai berasal dari literatur buku, jurnal, dan tulisan-tulisan lain yang berkaitan dengan maṣlaḥah dan dianalisa menggunakan metode content analysis. Pembahasan dilakukan dengan mendeskripsikan data sejarah pemikiran maṣlaḥah dari proses kungkungan teks hingga determinasi akal yang kemudian diformulasikan dengan realitas kehidupan era modern saat ini. Temuan penelitian ini menunjukkan bahwa: 1) reformulasi maṣlaḥah dari aspek sejarah adalah maṣlaḥah yang selama ini hanya dinilai dalam perspektif Syari’, karena itu perlu mereformulasinya dalam perspektif mujtahid dengan mengacu kepada maṣlaḥah yang dikaitkan dengan konteks realitas permasalahan, 2) perlu untuk memasukkan konsep etika dan kemanusiaan dalam struktur maṣlaḥah, dan 3) perlu untuk mereformulasikan ijtihād berbasis kolektif dalam pengambilan maṣlaḥah guna menciptakan metodologi ijtihād berbasis maṣlaḥah yang ilmiah.

There are several methods in determining lineage (al-Nasab) in Islam such as al-firasy, iqrar, bayyinah, qiyafah and qur'ah.  Islamic countries like Maghribi and Indonesia has been one step forward in strengthening the country’s Judicial Institution by implementing other option besides al-firasy for the matter of lineage determination especially for the offspring who does not have right in lineage through only al-firasy or in other word, a child that born out of wedlock. Therefore, observations are done to see Islamic views that are used by judicial system in Maghribi and Indonesia in drafting the law and deciding the implementations of methods for cases involving lineage determination. This observation also includes the comparisons on how the law is implemented legislatively on the Islamic society in Maghribi and Indonesia. Literature review method is used and the analysis details is via content analysis method. This is an initiative to assist further discussion on the issue of lineage determination in Malaysia. Terdapat beberapa kaedah penetapan nasab dalam Islam seperti al-firasy, iqrar, bayyinah, qiyafah dan qur’ah. Negara-negara Islam seperti Maghribi dan Indonesia telah terkehadapan dalam memperkukuhkan institusi kehakiman dengan mengambil kaedah lain selain al-firasy untuk urusan penasaban anak, terutama bagi anak yang tidak mempunyai hak penasaban melalui al-firasy semata-mata atau lebih tepat, anak tidak sah taraf. Justeru, penelitian dilakukan untuk melihat hujah syarak yang diguna pakai oleh kehakiman Maghribi dan Indonesia dalam menggubal undang-undang dan memutuskan penggunaan sesuatu kaedah dalam kes pensabitan nasab. Penelitian ini juga merangkumi perbandingan bentuk perlaksanaan di sudut perundangan berkaitan penasaban dalam masyarakat Islam di Maghribi dan di Indonesia. Metode kajian literatur digunakan dan perincian analisa data melalui kaedah analisis kandungan. Usaha ini adalah untuk membantu ke arah perbincangan lanjut mengenai isu penasaban di Malaysia.

This study is to determine the law to the boycott of Israeli goods based on the discipline of jihad fi sabilillah. The boycott of Israeli goods is a campaign to avoid purchasing particular goods from the producers that support the Zionist Regime through their financial, investment and moral. It is driven by the Muslims to support the Palestinian people and protest the Zionist Regime who killed Palestinians and confiscated their lands, especially in series of intifada by Palestinian and the attacks on Gaza. This study evaluates the boycott’s law from the perspective of Fiqh al-Jihad and looking into the changes between fard ain and fard kifayah influenced by certain factors and conditions. This is due to the confusion among people about the jihad in Palestine, especially when involving the boycott. Thus, an enlightenment on the issue is very important to be evaluated scientifically. The study employed qualitative research using documentary reference method as the primary method. The data were analyzed using content analysis method by applying Usul Fiqh as the basis of the discussion while referring to the debates of the existing fiqh (jurisprudence). The results showed that in general, the law to the boycott of Israeli products and those who support them become fard ain on every Muslim. Keywords : Boycott, Palestine, jihad, fard ain, fard kifayah Abstrak Kajian ini adalah untuk menentukan hukum boikot barangan Israel berdasarkan kepada disiplin jihad fi sabilillah. Boikot barangan Israel merupakan satu kempen pemulauan pembelian barangan khususnya ke atas barangan pengeluar-pengeluar yang menyokong rejim Zionis Israel melalui sokongan dana, pelaburan dan moral. Ia digerakkan oleh umat Islam untuk memberikan sokongan kepada rakyat Palestin dan membantah perbuatan rejim Zionis yang membunuh rakyat Palestin dan merampas tanah-tanah mereka terutamanya dalam siri-siri intifadah dan serangan ke atas Gaza. Kajian ini menilai hukum boikot daripada perspektif fiqh al-jihad dan melihat perubahan-perubahan hukum fardu ain dan fardu kifayah berikutan faktor-faktor keadaan dan tempat. Ini berikutan berlaku kekeliruan terhadap kedudukan jihad di Palestin khususnya yang melibatkan boikot. Justeru, satu pencerahan berkaitan isu ini amat penting untuk dinilai secara ilmiah. Kajian berbentuk kualitatif dengan menggunakan kaedah rujukan dokumen sebagai kaedah utama. Data dianalisis menggunakan kaedah analisis kandungan dengan mengaplikasikan kaedah usul fiqh sebagai teras utama di samping merujuk kepada perbahasan-perbahasan fiqh yang sedia ada. Hasil kajian menunjukkan secara umumnya, hukum boikot barangan Israel dan pendukung-pendukungnya menjadi fardu ain ke atas setiap umat Islam. This article or writing aims to discuss the Fiduciary Guarantee Law which has provided rules regarding the execution of the Fiduciary Guarantee object, but the fact is that in the field executions carried out by financial institutions do not comply with the applicable laws and regulations. carried out by financial institutions deviations and acts against the law occur. The obligation to register fiduciary guarantees is strengthened by the existence of PMK RI Number 130/PMK.010/2012 concerning Registration of Fiduciary Guarantees for finance companies that carry out consumer financing for motor vehicles with the imposition of fiduciary guarantees. The discussion focuses on how the provisions of Indonesian National law regulate the execution of fiduciary guarantees on movable objects against defaulting debtors? and how is the execution mechanism of fiduciary guarantees on movable objects against defaulting debtors. The procedure used to collect data in this study is in the form of documentation, namely the guidelines used in the form of notes or quotes, searching for legal literature, books and others related to the identification of problems in this study both offline and online. Analysis of legal materials is carried out using the content analysis method (centent analysis method) which is carried out by describing the material of legal events or legal products in detail in order to facilitate interpretation in the discussion. This paper will then be analyzed qualitatively. The purpose of this study is to find out the provisions of Indonesian National law governing the execution of fiduciary guarantees on movable objects against defaulting debtors and the mechanism of execution of fiduciary guarantees on movable objects against defaulting debtors. This study concludes that Fiduciary is the transfer of ownership rights to an object on the basis of trust provided that the object whose ownership rights are transferred remains in the control of the owner of the object. Article 1 of Law Number 42 of 1999 concerning Fiduciary Security (Law Number 42 of 1999 concerning Fiduciary Guarantee ). While Fiduciary Guarantee is a guarantee right on movable objects, both tangible and intangible and immovable objects, especially buildings that cannot be encumbered with mortgage rights as referred to in Law Number 4 of 1996 concerning Mortgage Rights which remain in the control of the Fiduciary Giver, as collateral for the repayment of certain debts, which gives priority to the Fiduciary Recipient over other creditors.
