Customary law grows out of the social practices which a given jural community has come to accept as obligatory. It is a pervasive normative order, providing the regulatory framework for spheres of human activity as diverse as the family, the neighbourhood, the business of merchant banking, or international diplomacy. This article looks at the customary laws of sub-Saharan Africa. It deals with the preservation of the law in an oral tradition and how it has been influenced by certain social, economic, and political structures. This focus requires, in turn, that particular attention be paid to factors influencing the production of texts on customary law. Because information on the subject is limited, outdated, and somewhat subjective, readers must be made aware of how changes in the theories of jurisprudence and anthropology have affected ideas and preconceptions.

In August 1993 and February 1994 I conducted two interviews with a woman in Buhweju, a county in southwestern Uganda. The interviews were part of a series concerning the social and political history of Buhweju, which is now part of Bushenyi District. In the precolonial period, Buhweju was a small autonomous polity ruled by an hereditary “king;” in the colonial period it was subsumed into the neighboring kingdom of Nkore, which became known as Ankole. The first interview, like most of my interviews, focused on the history of the family of the interviewee, and she said that her paternal grandfather, whose name was Mpamizo, had been a Hima, or pastoralist. In Buhweju, and elsewhere in Ankole, this meant, and still means, very much more than simply being a keeper of cattle. The agriculturalist Iru and pastoralist Hima share the same language and much of the same culture, but speak and behave differently in a number of significant ways (diet and mode of subsistence being prominent among these), so that whether one is a pastoralist or an agriculturalist is very apparent to any other member of society. The woman to whom I was talking is very evidently an Iru, an agriculturalist, in her manner and in the way she lives, as is her husband, and so I was surprised to hear that her grandfather was a Hima, a pastoralist. It was partly for this reason that I went back to talk to her again: but on the second occasion, there was an important shift in her presentation of Mpamizo—a dissonance in her account of the past. Mpamizo, she now said, was an Iru. This dissonance is the subject of this paper, for it holds important lessons both about society in Buhweju and about the ways in which we interpret oral accounts of the past.

Abstract Purpose Family involvement is a key element of Domestic Homicide Review (DHR), the form of Domestic Violence Fatality Review (DVFR) found in England and Wales. Family involvement is framed as having dual purposes: first, as a benefit to DHRs, enabling a fuller picture of victims’ experiences; second, as a benefit to families themselves, notably as a therapeutic or cathartic opportunity. However, these dual purposes have been little considered. This conceptual article responds to this absence by interrogating the purpose, process and outcomes of family involvement within DHRs. Method To explicate purpose, process and outcomes, we synthesise policy, practice and the extant empirical and theoretical literature relating to family involvement in DHRs. We supplement this by engaging with a broader body of emerging research on family involvement in other review systems, analysing this through a lens of citizenship and participation. Results Family involvement in DHRs is little explicated and there is a need to better engage with how family are involved in DHRs, as a way of increasing transparency for family rights. By way of response, a tentative conceptual framework is proposed which situates family involvement as demonstrative of systems- and relational-repair. Conclusions The article concludes by arguing for greater attention to the Theory(s) of Change underpinning both the place of the family and their testimony, as well as the DHR system as a whole. Such clarity would benefit family, both as the subject of professional interactions but, critically, as agents in the DHR process in their own right.
