Imagine a short video from a film critic highlighting the latest superhero summer blockbuster. First, we see a few seconds of the big action finale from the copyrighted film. The superhero flies through the air, zipping between skyscrapers at breakneck speed. The video cuts to a clip of the critic, in closeup, yawning for several seconds. Then, it cuts back to the film, and we see the superhero engaged in the film’s climactic battle, pummeling the villain with superhuman strength. Next, it cuts back to the critic, who is now asleep and snoring loudly. The video ends. Is the resulting video a work of criticism? It may depend on whom you ask. For a court assessing criticism for fair use purposes, the answer is currently unclear. In recent years, the rise of online social media platforms and increased access to the tools of creative expression—smartphone cameras, and photo and video editing software, to name a few—have led to the proliferation of audiovisual criticism on the internet. Online audiovisual criticism is now so ubiquitous that numerous YouTube channels dedicated to film and television criticism boast viewership in the hundreds of millions. Yet, as new technologies have lowered the barriers to entry for creators of works of criticism, these technologies have also fostered a creative evolution of criticism in ways that present novel questions for copyright law. On YouTube and other video sharing sites, reaction videos have become a popular form of audiovisual criticism. Reaction videos are online videos that contain, quite simply, “footage of people reacting to things.” Reaction videos traditionally include footage of the video participant intercut with or superimposed over the pre-existing, and often copyrighted, video footage to which they are reacting. This reaction is frequently extemporaneous, though it need not be, and it may or may not include other graphical, visual, or audio elements that lend emphasis and context to the participant’s commentary. Because reaction videos utilize film-specific conventions and techniques to enhance their commentary, reaction videos sometimes criticize the underlying copyrighted work in a non-spoken, visual manner. Criticism is a classic form of fair use—an affirmative defense to copyright infringement. However, the traditional analysis for fair use criticism has focused heavily on a work’s text or dialogue, with less emphasis placed on a work’s non-textual or non-spoken elements. As reaction videos and other forms of online audiovisual criticism rise in popularity, courts assessing these videos as works of criticism for fair use purposes have struggled to apply the traditional fair use framework to these types of online criticism. This Note argues that the traditional legal framework for analyzing a work of alleged criticism as fair use is particularly constraining for YouTube reaction videos and other audiovisual forms of criticism that largely critique or comment on an original work in a non-spoken, visual manner. It discusses the emphasis that the current fair use jurisprudence places on spoken and written critical elements when undertaking a fair use analysis of a work of criticism, then advocates for a new conception of fair use criticism that incorporates film-specific analytical techniques and concepts when analyzing the critical elements of online audiovisual works. Part I discusses the statutory codification of the fair use doctrine in copyright law and how the doctrine has been shaped through the years by subsequent judicial interpretation. Part I also discusses the history of YouTube reaction videos as a unique audiovisual format. Part II explores the ways in which courts have recently applied the fair use doctrine to alleged works of audiovisual criticism and the emphasis courts place on spoken and written critical elements. Part III argues that courts assessing online audiovisual works as alleged works of criticism should incorporate analytical tools and interpretive theories commonly utilized in film studies contexts—including an analysis of editing, shot composition, and camera movement—when parsing alleged works of audiovisual criticism for transformativeness under factor one of the fair use test. Finally, Part IV uses a recently decided fair use case out of the Southern District of New York as a real-life example to explore how a court could apply film-specific analytical tools to more accurately identify and assess the critical elements of a work of audiovisual criticism for fair use purposes.

A previous article by this author discussed an emerging phenomenon on the Internet. That is, how the law, by denying copyright protection to certain kinds of digital works, may have restricted access to such works instead of liberating them, as was initially intended by the judiciary. This absurd conclusion has resulted from owners whose works are no longer protected by copyright law, who have resorted to restrictive contractual provisions on-line to control access and use of their works. And in turn, owners of such content are still able to generate revenue by charging a subscription fee for the right to gain access to the information contained therein. The result is particularly troubling to end users of digital content. If copyright law is no longer applicable, then what of the Fair Use/Fair Dealing defences available to users of these works? Does this mean that these defences are not applicable either? Are users of such content completely at the mercy of the owners’ terms and conditions of use as dictated by click-on agreements and Rules of Use posted on Web sites? This article discusses the application of Fair Dealing and Fair Use to Internet-based works, by examining the legislative and judicial responses to the ambiguities in their intellectual property protection which new technologies create.

Abstract Next generation assembly/package development challenges are primarily increased interconnect complexity and density with ever shorter development time. The results of this trend present some distinct challenges for the analytical tools/techniques to support this technical roadmap. The key challenge in the analytical tools/techniques is the development of non-destructive imaging for improved time to information. This paper will present the key drivers for the non-destructive imaging, results of literature search and evaluation of key analytical techniques currently available. Based on these studies requirements of a 3D imaging capability will be discussed. Critical breakthroughs required for development of such a capability are also summarized.

This essay makes two points about digital collections. The first recognizes problems that emerge as archives present indigenous content online. In uploading indigenous songs, speeches, and documents, an archive allows that material to move from a local space with limited access to an international repository with many points of access. This chapter examines conflicts that can occur with this action, including those involving copyright law, fair use, and ethics. A second point of this chapter revolves around technology and repatriation. If repatriation means the return of material to a country of origin, then online archives never fully commit to this task. The material typically remains preserved on servers and in its original forms away from indigenous communities. Despite these ethical, legal, and technological concerns, archives should encourage the creation of digital collections as part of repatriation given the desire by many indigenous communities to preserve and promote their traditions.

The article draws attention to the problem of the presence of metals: germanium (Ge), tellurium (Te), thallium (Tl), and others (Cd, Ba, Co, Mn, Cr, Cu, Ni, Pb, Sr, and Zn) in selected waste of electrical and electronic equipment (WEEE). As a result of the growing demand for new technologies, the global consumption of TECs has also been increasing. Thus, the amount of metals in circulation, of which the impacts on the environment have not yet been fully understood, is constantly increasing. Due to the low content of these metals in WEEE, they are usually ignored during e-waste analyses. The main aim of this study was to determine the distribution of Ge, Te, and Tl (and other elements) in ground sieve fractions (1.0, 0.5, 0.2, and 0.1 mm) of selected electronic components (solar lamps, solar cell, LED TV screens, LCD screens, photoresistors, photodiodes, phototransistors) and to determine the possible tendency of the concentrations of these metals in fractions. This problem is particularly important because WEEE recycling processes (crushing, grinding, and even collection and transport operations) can lead to dispersion and migration of TCE pollutants into the environment. The quantitative composition of e-waste was identified and confirmed by ICP-MS, ICP-OES and SEM-EDS, and XRD analyses. It was found that Ge, Te, and Tl are concentrated in the finest fractions of ground e-waste, together with Cd and Cr, which may favor the migration of these pollutants in the form of dust during storage and processing of e-waste.

Apathy, a common neuropsychiatric symptom associated with dementia, has a strong impact on patients’ and caregivers’ quality of life. However, it is still poorly understood and hard to define. The main objective of the ECOCAPTURE programme is to define a behavioural signature of apathy using an ecological approach. Within this program, ECOCAPTURE@HOME is an observational study which aims to validate a method based on new technologies for the remote monitoring of apathy in real life. For this study, we plan to recruit 60 couples: 20 patient-caregiver dyads in which patients suffer from behavioral variant Fronto-Temporal Dementia, 20 patient-caregiver dyads in which patients suffer from Alzheimer Disease and 20 healthy control couples. These dyads will be followed for 28 consecutive days via multi-sensor bracelets collecting passive data (acceleration, electrodermal activity, blood volume pulse). Active data will also be collected by questionnaires on a smartphone application. Using a pool of metrics extracted from these passive and active data, we will validate a measurement model for three behavioural markers of apathy (i.e., daytime activity, quality of sleep, and emotional arousal). The final purpose is to facilitate the follow-up and precise diagnosis of apathy, towards a personalised treatment of this condition within everyday life.

The grown demand of current and future development of new technologies for high added value and strategic metals, such as molybdenum, vanadium, and chromium, and facing to the depletion of basic primary resources of these metals, the metal extraction and recovery from industrial by-products and wastes is a promising choice. Slag from the steelmaking sector contains a significant amount of metals; therefore, it must be considered to be an abundant secondary resource for several strategic materials, especially chromium. In this work, the generated slag from electric arc furnace (EAF) provided by the French steel industry was characterized by using multitude analytical techniques in order to determine the physico-chemical characteristics of the targeted slag. The revealed main crystallized phases are larnite (Ca2SiO4), magnetite (Fe3O4), srebrodolskite (Ca2Fe2O5), wüstite (FeO), maghemite (Fe2.6O3), hematite (Fe2O3), chromite [(Fe,Mg)Cr2O4], and quartz (SiO2). The collected slag sample contains about 34.1% iron (48.5% Fe2O3) and 3.5% chromium, whilst the vanadium contents is around 1500 ppm. The Mössbauer spectroscopy suggested that the non-magnetic fraction represents 42 wt% of the slag, while the remainder (58 wt%) is composed of magnetic components. The thermal treatment of steel slag up to 900 °C indicated that this solid is almost stable and few contained phases change their structures.

The application of varnishes on the surface of metal objects has been a very common practice since antiquity, both for protective and aesthetic purposes. One specific case concerns the use of tinted varnishes on copper alloys in order to mimic gilding. This practice, especially flourishing in the 19th century for scientific instruments, decorative objects, and liturgical items, results in large museum collections of varnished copper alloys that need to be preserved. One of the main challenges for conservators and restorers deals with the identification of the varnishes through non-invasive and affordable analytical techniques. We hereby present the experimental methodology developed in the framework of the LacCA and VERILOR projects at the Haute École ARC of Neuchâtel for the identification of gold varnishes on brass. After extensive documentary research and analytical campaigns on varnished museum objects, various historic shellac-based varnishes were created and applied by different methods on a range of brass substrates with different finishes. The samples were then characterized by UV imaging and infrared spectroscopy before and after artificial ageing. The comparative study of these two techniques was performed for different thicknesses of the same varnish and for different shellac grades in order to implement an identification methodology based on simple non-invasive examination and analytical tools, which are accessible to conservators.

The new technologies born from academic research can be very promising, yet they are often very early stage. University spin-off companies are uniquely positioned to tackle the risks associated with new technologies emerging from academia by developing proofs of concept, functioning prototypes, and new products. While these enterprises start from a solid research and development foundation, they face their own unique set of challenges—they are strongly anchored in the scientific and technological expertise that is typically backed by intellectual property but often lack the business experience needed to develop and market products demanded by customers. University spin-offs have access to substantial non-dilutive funding that can be utilized for advancing product development. While the relentless pursuit of these funds builds a company's credibility and improves its position for negotiating future private investment, university spin-offs would greatly benefit from an early focus on complementing their technology teams with their business teams. These new enterprises should consider pursuing private investment in parallel to utilizing sources of non-dilutive funding. Timing of private investment is extremely important to maximize the value of the opportunity, and, therefore, building relationships with investors early on and getting ready for executing an investment round can greatly increase odds for success. While there is no single path to formulate, pursue, and adapt successful financing strategies, lessons can be learned from real-life cases of university spin-offs that continue their journeys towards ultimate success.

<p>The tall building world is seeing a trend pushing building heights and slenderness ratios to levels previously unseen. The design of these buildings for both strength and serviceability is typically governed by the dynamic response of the building to wind. Comfort of building occupants during relatively low return period wind events is a key challenge, and engineers are increasingly turning to damping technologies to limit building accelerations rather than adding stiffness or mass. Large tuned mass dampers (TMDs) are a commonly used solution.</p><p>This paper suggests that integrating viscous dampers within a tall building’s structure can deliver a cost- effective alternative to TMDs, delivering high performing buildings with additional benefits in terms of robustness and space efficiency.</p><p>Two case studies are presented. Firstly, measured data from a tower in New York with viscous dampers integrated into the structure is provided, comparing design stage predictions to real-life performance. Furthermore, a case study for a super-slender tower is described, demonstrating the potential for enhanced performance and significant cost and space savings using integrated damping.</p>
