This study discussed the scope of criminal law considerations for defendants exposed to the Coronavirus through legal studies and health literacy in Indonesia. This article also tries to understand the criminal sanctions carried out by defendants exposed to COVID-19 by examining the potential for criminal justice with considerations and consequences for the rights of citizens to obtain health protection. This study concludes that punishment for criminal acts related to criminal cases must be limited considering that prosecution and criminal sanctions can only be given as light as possible where the condition of the community does need help because of their right to obtain health insurance for the population as regulated in the Law on Health and Human Rights. With a set of rights inherent in the nature and existence of humans as creatures of God Almighty are His gifts that must be respected, upheld, and protected by the state. After reviewing several international and national publications active discussing criminal law and the control of COVID-19, we got all this data. We hope that all this qualitative data can be used for future studies related to health rights and criminal law.

Perumusan masalah:Bagaimana penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan Dikaitkan Dengan Ajaran Perbarengan Dalam Hukum Pidana? Bagaimana kepastian hukum penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dari sudut pandang keadilan ? Bagaimana implikasi hukum penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dalam pembaharuan hukum pidana?Tujuan Penelitian Untuk menjelaskan penerapan konsep lex spesialis systematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan Dikaitkan Dengan Ajaran Perbarengan Dalam Hukum Pidana Untuk menjelaskan kepastian hukum penerapan konsep lex spesialis systematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dari sudut pandang keadilan.Untuk menjelaskan implikasi hukum penerapan konsep lex spesialis systematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dalam pembaharuan hukum pidana Jenis penelitian hukumnya adalah secara normatif . Kesimpulan Penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan Dikaitkan Dengan Ajaran Perbarengan Dalam Hukum Pidana terdapat dalam beberapa dakwaan yang terhadap terdakwa yang diperiksa pada persidangan. Hal ini dapat dilihat pada contoh kasus putusan Nomor: 16/Pid.Sus-PK/2018/PT.DKI dengan kronologinya: Terdakwa Nur Alam selaku Gubernur Sulawesi Tenggara didakwa sebagai yang melakukan, menyuruh melakukan perbuatan yang secara melawan hukum melakukan perbuatan memperkaya diri sendiri atau orangt lain atau suatu korporasi yang merugikan keuangan Negara atau perekonomian Negara. Kepastian hukum penerapan konsep lex spesialis systematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dari sudut pandang keadilan yaitu bahwa Kebijakan hukum pidana melalui implementasi asas kekhususan sistematis (systematische specialiteit) merupakan upaya penting dalam harmonisasi dan sinkronisasi antar undang-undang yang terkandung sanksi pidana didalamnya, baik itu yang bersifat pure criminal act ataupun hukum pidana administrasi (administrative penal law). Asas kekhususan sistematis terdapat pada pasal 14 UU Tipikor. Interpretasi terhadap pasal ini tidak seragam sehingga seringkali mengakibatkan terjadinya kriminalisasi kebijakan pejabat. Sehingga masih belum mencapai keadilan. Implikasi hukum penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dalam pembaharuan hukum pidana bahwa penegak hukum, JPU dan hakim,baik di tingkat pertama, banding, maupun kasasi, dalam menyikapi perkara pidana yang mempertemukan dua ketentuan hukum pidana khusus secara sistematis.ABSTRACTThe development and renewal of criminal law has increased with the application of the incorporation of law in the resolution of criminal cases. This can be seen in the example of case ruling Number: 16 / Pid.Sus-PK / 2018 / PT.DKI with its chronology: Defendant Nur Alam as the Governor of Southeast Sulawesi was charged as the one who committed, ordered to do an act that unlawfully commits an act of enriching oneself or any other person or corporation that is detrimental to the State's finances or the State's economy. Legal certainty The application of the concept of systematic specialist lex to law enforcement of corruption in the mining sector from the perspective of justice is that the criminal law policy through the implementation of the principle of systematic specificity (systematische specialiteit) is an important effort in the harmonization and synchronization between the laws contained in criminal sanctions therein , both those that are pure criminal act or administrative criminal law. The principle of systematic specificity is found in article 14 of the Corruption Law. The interpretation of this article is not uniform so it often results in the criminalization of official policies. So it still hasn't reached justice. Legal implications of the application of the concept of a systematic lex specialist on law enforcement for criminal acts of corruption in the Mining sector in the renewal of criminal law that law enforcement, prosecutors and judges, both at the first level, appeals, and cassation, in addressing criminal cases that bring together two specific criminal law provisions systematic.

There are various pros and cons to the criminal law policies by the Indonesian government in the context of dealing with covid 19. So it is necessary to have a study related to the effectiveness of implementing these various policies. The author's background is to discuss the formulation of the problem in this article: What is the criminal law policy during the covid 19 pandemic? And how is the effectiveness in the implementation of these policies? This article uses a normative juridical research method that examines various positive laws from the applicable laws and regulations, and then it is analyzed in analytical descriptive. The Indonesian government has established various policies to prevent the covid 19 transmission. The guidelines consist of: the formation of various legal regulations related to the covid pandemic; a policy of criminal sanctions for violators of social policies during the covid 19 pandemic; prisoner assimilation policy; electronic trial of criminal cases during the covid 19 pandemic; corruption prevention policies; policies on workplaces in public areas. Regarding the effectiveness of implementing these policies, it can be said that the execution tends to be less optimal because the policies are contrary to one another. So this article provides suggestions to the government and the community should have mutual support for the implementation of criminal law policies during the COVID-19 pandemic can be effective.

Indonesia is a Legal State whose all aspects of citizens' lives are always rules and norms, be it sanctions or legal responsibilities that participate in growing in society. Responsibilitycan not only be imposedon the wrong-maker but the victim can shoulder this. From the statement, there are problems, namely the legal protection of victims of fetal abortion rape reviewed from a human rights perspective and criminal sanctions againstfetal abortion perpetrators based on human rights. This study aims to determine how the law of covering rape victims who perform fetal abortion. This writing uses the normative legal writing method where the writing is about principles, norms, and rules. In this writing the rape victim who decided to abort her fetus, this certainly makes the responsibility carried also by the victim who abortions her fetus caused by rape and makes the pregnancy that is not stopped that leads to abortion. Surely this is very contrary to the criminal law as well as the human rights of thefetus. Thispaper describesthat the responsibility of rape victims to the fetus abortion can be seen in terms of the human rights of a fetus and the victim himself.

<table width="595" border="0" cellspacing="0" cellpadding="0"><tbody><tr><td valign="top" width="387"><p><em>This article aims to answer whether vaccination is a right or an obligation and how criminal law and Qiyas Shafi’i Mazhab views the basic provisions of criminal law against vaccination objectors. By combining doctrinal and socio-legal research method, this article concludes that vaccination is an obligation because a person's personal right to choose health services, especially COVID-19 vaccination has turned into a public right. Vaccination is the government's obligation to protect public health as part of meeting health needs, following the mandate of the constitution and human rights. According to the relative punishment theory, the application of criminal sanctions is an effort made to maintain public order and peace of society, not as a means of repaying the perpetrator's mistakes. Thus, the sanctions imposed on the perpetrator are solely to provide fear so that they do not repeat their actions and other people do not follow them. There are three main objectives of relative theory, namely prevention, prevention, and reform. Whereas Qiyas Shafi'i Mazhab puts forward the application of qiyas as a justification for imposing criminal sanctions against vaccination objectors. Because a person is prohibited from doing something that endangers himself and others, punishment according to the Qiyas Shafi'i Mazhab can be applied. There are similarities between criminal law and Qiyas Shafi'i Mazhab to a view of the obligation to vaccinate, that is, both allow the reduction of individual human rights for the sake of common interests. Ultimately, this article recommends the need to regulate the handling of COVID-19 vaccination objectors through act so that vaccination and law enforcement can run comprehensively, not partially </em></p></td></tr></tbody></table>

Laws are the norms that govern all human actions that can be done and should not be carried out both written and unwritten and have sanctions, so that the entry into force of these rules can be forced or coercive and binding for all the people of Indonesia. The most obvious form of manifestation of legal sanctions appear in criminal law. In criminal law there are various forms of crimes and violations, one of the crimes listed in the criminal law, namely the crime of Human Trafficking is often perpetrated against women and children. Human Trafficking is any act of trafficking offenders that contains one or more acts, the recruitment, transportation between regions and countries, alienation, departure, reception. With the threat of the use of verbal and physical abuse, abduction, fraud, deception, abuse of a position of vulnerability, example when a person has no other choice, isolated, drug dependence, forest traps, and others, giving or receiving of payments or benefits women and children used for the purpose of prostitution and sexual exploitation. These crimes often involving women and children into slavery. Trafficking in persons is a modern form of human slavery and is one of the worst forms of violation of human dignity (Public Company Act No. 21 of 2007, on the Eradication of Trafficking in Persons). Crime human trafficking crime has been agreed by the international community as a form of human rights violation.

AbstrakArtikel ini membahas dua permasalahan pokok: pertama, kriteria yang digunakan oleh pembentuk undang-undang di bidang politik dalam menetapkan suatu perbuatan sebagai perbuatan pidana (kriminalisasi); dan kedua, fungsi sanksi pidana dalam undang-undang di bidang politik. Terkait dengan kriminalisasi, undang-undang di bidang politik yang termasuk ke dalam hukum administrasi, maka pertimbangan dari pembuat undang-undang tentu saja tidak sekedar kriminalisasi sebagaimana diatur dalam ketentuan hukum pidana dalam arti sebenarnya. Hal tersebut disebabkan adanya pertimbangan-pertimbangan tertentu. Pertama, perbuatan yang dilarang dalam hukum pidana administrasi lebih berorientasi pada perbuatan yang bersifat mala prohibita, sedangkan dalam ketentuan hukum pidana yang sesungguhnya berorientasi pada perbuatan yang bersifat mala in se. Kedua, sebagai konsekuensi dari adanya penggolongan dua kategori kejahatan tersebut, maka pertimbangan yang dijadikan acuan juga akan berbeda. Untuk yang pertama (mala prohibita), sanksi pidana itu dibutuhkan untuk menjamin ditegakkannya hukum administrasi tersebut. Dalam hal ini sanksi pidana berfungsi sebagai pengendali dan pengontrol tingkah laku individu untuk mencapai suatu keadaan yang diinginkan. Sedangkan untuk yang kedua (mala in se), fungsi hukum pidana dan sanksi pidana lebih berorientasi pada melindungi dan mempertahankan nilai-nilai moral yang tertanam di masyarakat tempat di mana hukum itu diberlakukan atau ditegakkan. Kata Kunci: Kebijakan, Kriminalisasi, Undang-Undang PolitikThis article discusses two main problems: firstly, the criteria used by the legislators in the field of politics in determining an act as a criminal act (criminalization); secondly, the function of criminal sanctions in legislation in the field of politics. Associated with criminalization, legislation in the field of politics that is included in administrative law, the consideration of the legislators of course not just criminalization as stipulated in the provisions of criminal law in the true sense. This is due to certain considerations. Firstly, the act which is forbidden in the administration of criminal law is more oriented to act is malum prohibitum offences, whereas in actual criminal law provisions in the act are mala in se offences. Secondly, as a consequence of the existence of two categories of classification of the crime, then consideration will also vary as a reference. For the first (mala prohibita), criminal sanctions are needed to ensure the enforcement of the administrative law. In this case the criminal sanction serves as controller and controlling the behavior of individuals to achieve a desired state. As for the second (mala in se), the function of criminal law and criminal sanctions is more oriented to protect and maintain the moral values that are embedded in a society where the law was enacted or enforced.

 Reproductive rights are fundamental rights and freedoms relating to reproduction and reproductive health that vary amongst countries around the world, but have a commonality about the protection, preservation and promotion of a woman‘s reproductive health rights. Reproductive rights include the right to autonomy and self-determination , the right of everyone to make free and informed decisions and have full control over their body, sexuality, health, relationships, and if, when and with whom to partner, marry and have children , without any form of discrimination, stigma, coercion or violence. The access and availability of reproductive health services are limited due to geography and other issues, non-availability and refusal of reproductive health services may lead to serious consequences. The State need to ensure accessibility, availability, safe and quality reproductive health services and address the lifecycle needs of women and girls and provide access of every young women and girls to comprehensive sexuality education based on their evolving capacity as their human rights, through its inclusion and proper implementation in school curriculum, community-based awareness program and youth led mass media. It is necessary for strengthening compliance, in a time-bound manner, with international human rights standards that Nepal has ratified that protect, promote, and fulfill the basic human rights and reproductive health rights in Nepal and also need to review standards and conventions that Nepal has had reservations about or those that have been poorly implemented in the country.

Based on international standards adopted within the framework and under the Organisation of the United Nations, all national legislations recognise several different types and forms of criminal acts regarding misuse of narcotics. It is the matter of various activities of unauthorized production, traffic and other forms of inciting or enabling others to come into possession of narcotics for immediate use, which seriously endangers the health and life.Depending on the needs of each individual state, the distinction is made between the offenses, for the perpetrators are given different types and measures of penalties and other criminal sanctions. A similar situation exists in the Republic of Serbia.The paper analyzes the system of criminal offenses in various types and forms of manifestation in the theoretical and practical sense for whose offenders that are prescribed serious criminal sanctions.
