The Interpreter, the Scientist, and the Analyst

Stanley Fish and Bernhard Schlink agree that there can be no rule for finding a correct legal interpretation. Each, however, offers a negative rule to recognize incorrect interpretations. Schlink asserts that incorrect interpretations can be eliminated through the scientific method of falsification. Fish claims that any interpretation not concerned with the author’s state of mind must be rejected. Unfortunately, Fish’s insistence on authorial intent could be read as downplaying the role of the interpreter. Although interpretation is objective in that it involves the examination of an object, it is not merely objective. Communication is collaboration; interpretation needs an interpreter. It is intersubjective. But interpretation cannot be relegated entirely to the intersubjective “symbolic” order where language and law is located. The symbolic can never be disentangled from the orders of the “imaginary” and the “real” that are its logical boundaries. Interpretation has a subjective aspect because it requires the creative act of the interpreter’s imagination. Schlink recognizes that a subjective moment of hypothesis formation is essential to interpretation but tries to distinguish it from a subsequent objective or intersubjective testing process. There is no rule that can disprove our legal interpretations. This is why judging is always a moral act.

Например горы возвышенное и самое ценное в человеке, а полная луна – счастливое душевное состояние человека, а превращение безоблачного неба в бущующий вид – указывает, как неспокойно в душе главного героя, его беспокойные мысли, как бушует его внутренний мир, а ласточки неспокойно летающие, предвещают несчастье, птицы улетающие раньше времени, превращение зелёной травы, деревьев в пепел предвещают ужасы войны. The landscape description is used in the work as an additional tool for aesthetic values and helps to reveal the images of heroes, and in the development of the action of the work/ The writer in the novel subtly uses the landscape description. The mountains are the sublime and the most valuable in a person, and the full moon is a happy state of mind of a person, and the transformation of a cloudless sky into a raging view indicates how restless the soul of the protagonist is, his restless thoughts. How his inner world is raging, and the swallows are restlessly flying, foreshadow the misfortune, the birds flying away ahead of time, the transformation of green grass, trees in the forehead the horrors of war. This article describes the idea of the story "Do not kill" which is given instead of the epilogue in the novel "When the mountains fall" which was written by Ch.Aitmatov. It considers the role of a story that calls to live in peace and to end wars that are occurring in the world. Keywords: Landscapе, novel, idea, legend, epilogue, hero, main event.

This study aims at examining the use of metadiscourse markers in literary criticism texts to identify the role of the reader and how these markers are used to produce more persuasive essays. The data of 72,727 words from 17 texts were written by three well-known authors, namely, T.S. Eliot, Virginia Woolf and Stanley Fish. Hyland’s (2005) model of interpersonal metadiscourse markers was used to analyze the data. The analysis revealed that metadiscourse markers are used by literary critics to create coherent and persuasive texts. It was found out that the theory of criticism adopted by the literary critics does not affect the use of metadiscourse markers only maybe in terms of relying more on logos, ethos or pathos. The results of this study comply with those of previous research showing that metadiscourse markers are frequently used in literary criticism texts. This study will contribute to both the literary genre and the genre of critical essays by identifying the linguistic features to be used to produce more effective and convincing literary criticism texts. It will also help future critics to write more persuasive texts by highlighting the means that enable them to influence their readers and to produce more coherent and convincing texts. Введение. Раскрывается понятие топонима как маркера географического пространства и роль топонимики в системе наук. Определяется роль топонима, входящего в структуру фразеологической единицы (ФЕ), и культурологическая ценность самого устойчивого оборота с компонентом-топонимом. Обосновывается актуальность исследования, его цель и новизна. Материал и методы. Материалом послужили топонимические фразеологизмы современного английского языка (213 единиц), исследованные посредством методов статистического и лингвокультурологического анализа. Результаты и обсуждение. В топонимических фразеологизмах вербализации подвергаются различные сегменты объективной реальности, репрезентирующие материальный и духовный мир человека. Топонимические фразеологизмы раскрывают отношение человека к окружающей его действительности, отношение к окружающим его людям и к самому себе. Они также анализируют внешние и внутренние стороны человеческой личности, акцентируя внимание на внешнем виде человека, особенностях его голоса, походки, умственного склада ума, на морально-нравственных качествах и характере человека, создавая при этом определенный позитивный или негативный образ. Заключение. Топоним является маркером национальной культуры, поскольку отражает природно-географические особенности страны, историко-культурную специфику этноса, ее населяющего; связан с менталитетом и особенностями характера нации, ее психологией и социально-бытовыми факторами. В английских ФЕ с компонентом-топонимом также находит отражение национально-культурное своеобразие жизни народа. Топонимические фразеологизмы современного английского языка распределяются по двум большим группам: ФЕ, отражающие материальный мир человека, и ФЕ, отражающие духовный мир человека. Фразеологизмы, характеризующие материальный мир человека, можно распределить по десяти подгруппам, большинство из которых соотносятся с бытом человека. Топонимические фразеологизмы, характеризующие духовный мир человека, включают шесть подгрупп, представляющие отношение человека к действительности и людям. Introduction. The concept of a toponym as a marker of the geographical space and the role of toponymy in the scientific system are revealed. The role of the toponym included as a component of the phraseological unit and the cultural value of these idioms are determined. The relevance of the research, its purpose and novelty are substantiated. Material and methods. The research material is the phraseological units of the modern English language with a toponym as a component (213 units). The methods of the study are the statistical method and the method of the linguacultural analysis. Results and discussion. Toponymic phraseological units reflect and verbalize the various segments of the objective reality including the material and spiritual world of a personality. Toponymic phraseological units reveal a person’s attitude to the reality surrounding him/her, a person’s attitude to the people near him/her and the attitude to self. They also analyze the external and internal aspects of the personality, focusing the view on the appearance of a man or woman, on his/her voice, on gait, on mental state of mind, on the moral qualities and the character of a personality. The image of a personality creating by phraseological units can be positive or negative one. Conclusion. Any toponym (especially if it belongs to the “native” culture) has a national identity. It reflects (except the historical, territorial and geographical peculiarities of the nation), the national mentality, character, and specific features of the people’s life. The English phraseological units with a toponym as a component reflect the national identity as well. These idioms are divided into two large groups: 1) those which show the material comforts of the everyday life and 2) those which tell us about the inward habits of the people. Toponymic phraseological units of the second group include six subgroups. Subgroups including the idioms reflecting the people’s attitude to the social reality and to the other people prevail.

The intergenerational transmission of attachment patterns is one of the most reliable yet least understood findings of attachment research. The aim of this report was to examine the capacity of maternal mind-mindedness to account for the relation between adult attachment state of mind and infant attachment security. Sixty-four foster children (aged 6–30 months) participated with their foster mothers. The mother’s tendency to use mental features in describing her child (mindmindedness) was negatively related to the security of both maternal state of mind and infant attachment. Further, mind-mindedness accounted for the totality of the predictive power of state of mind on infant attachment. The results suggest that age-appropriate representations of the child may help explain intergenerational transmission, through their interplay with parental interactive behaviours.

This essay addresses the question: when should pre-citation interest be awarded in actions for unjustified enrichment in Scots law? The answer depends mainly on the definition of the elements of enrichment liability, the manner of acquiring the enrichment, the type of enrichment-debtor, and his or her state of mind. The essay argues that (a) generally the actual interest earned (or saved) should be awarded, aided by a rebuttable presumption that interest was earned at a specified rate; (b) interest should normally be awarded at market rates where the defender knows that s/he holds the money or asset unjustifiably; and (c) in enrichment by interference with the pursuer's rights to money or other assets, an interest award might represent the time-value of exercising those rights during the period of interference.

According to the National Sample Survey Organization (NSSO), not more than 14% of business establishments are run by female entrepreneurs in India, especially in rural areas. Entrepreneurship is not an easy step for women. It was traditionally considered as a man's bastion, but now with the due course of time, women are coming in the limelight to fulfil their aspiration as it is a fruitful opportunity where educated or illiterates can do wonders to achieve their dreams. Entrepreneurship is the state of mind which every woman has in her but has not been capitalized in India in a way it should have been. With the drastic change in modernization, people are more comfortable to accept the leading role of women in society, with some exceptions.

Traditionally, the thrust of library and information managers was on managing in-house technical operations of the libraries without taking much consideration of the outside world. However, during the last two-three decades there have been many changes in library's overall external environment that have affected the internal environment and management of libraries and their services to a great extent. Earlier, more emphasis was on developing the libraries for the future rather than meeting the present information needs of users, but now users are more demanding; they have higher expectations from libraries, and they compare value/benefits received every time in comparison to efforts they have put into getting the desired information/information service(s)/product(s). As such, the interest of information professionals in marketing library services has been rising. Marketing can simply be defined as an approach that integrates external environment and internal environment in understanding and satisfying customer needs. In service organizations, management and marketing integrates and good service are not different from good marketing efforts. In other words, in-service set up marketing is the state of mind and management is a way forward to actions. The creation of Section on Management and Marketing in IFLA at the international level signifies such importance and integration of management and marketing in recent times. Rejean Savard (2006) describes the history of the Section and reviews its activities in the initial years. The chapter emphasizes recent activities and contributions of the IFLA Section on Management and Marketing Section in encouraging good marketing efforts in libraries the world over.

Stalking and querulousness describe problem behaviours characterized by persistently pursuing a person or a cause in such a manner, or to such an extent, that the behaviour creates fear, distress, or disruption to those involved or targeted. An obvious obsessive or fixated quality is associated with both behaviours, and personality traits of rigidity and rumination are frequently observed, though the state of mind rarely conforms to that found in obsessional disorders. Stalkers and querulants rarely regard their behaviour as unjustified, let alone irrational, and few see their persistence as senseless. They may resist the impulse or urge to pursue their victims or cause on occasion but, for the most part, devote themselves wholeheartedly to their objectives. This chapter explores the epidemiology ad phenomenology of stalking and querulousness and the role of (forensic) psychiatry in responding not only to the perpetrators of these behaviours, but also to the unfortunate victim’s of their disordered attention.

Corporate social responsibility (CSR) image positively affects customer outcomes. Despite researchers’ interest in the investigation of company favoring outcomes still, there is a need to further examine the psychological mechanisms that generate these outcomes. Customer engagement (CE) is a state of mind that drives customer behavior. The role of CE has been fully ignored in CSR literature. We suggest that CSR engenders CE and examine the mediating role of CE between CSR and behavioral outcomes. A survey of 455 customers of banking services in Pakistan provided empirical evidence for hypothesis testing. Structural equation modeling was used to analyze the data. We find that CSR image induces CE that gives rise to behavioral responses i.e., customer loyalty, word-of-mouth (WOM) and customer feedback. This is the first study to examine the impact of CSR on customer feedback and to investigate the mediating role of CE.

This book investigates the post-revolutionary rituals and discourses of enchantment, a category of mystical experience uniquely capable of producing new forms of popular power and social affiliation. American Enchantment views this phenomenon as a response to a signature problem in post-revolutionary culture: how to represent the people in the absence of the king’s body and other traditional monarchical forms. In the early United States, this absence inaugurates new attempts to conjure the people and to reconstruct the symbolic order. For many in this era, these efforts converge on enchantment. This pattern appears in works by Charles Brockden Brown, Washington Irving, Catharine Sedgwick, and Nathaniel Hawthorne, as well as in the rites of George Washington’s presidency, the religious prophecy of the Second Great Awakening, the tar and featherings of the Whiskey Rebellion, and other ritual practices such as romance reading. Recognizing the role of enchantment in constituting the people overturns some of our most commonsense assumptions: above all, the people are not simply a flesh-and-blood substance but also a supernatural force. This project makes a significant contribution to interdisciplinary scholarship on the symbolic foundations of sovereignty by arguing that the new popular sovereignty is no longer an embodied presence fixed in space—in a king, nor even in a president, an individual, a group of persons, or the state—but a numinous force dispersed through time. That is, the people, counter to all traditional thought, are a supernatural and temporal process.
