Article 7 of the Law Number 11, 2006 on Aceh Governance states that the Aceh Province and districts or municipalities Governments have the authority to regulate and manage government affairs in all public sectors except for government affairs which are under the authority of the Government. It is further stated that the central authority includes government affairs of national issues that are foreign policy, defense, security, judiciary, monetary and fiscal matters, and certain affairs in the field of religion. It can be concluded that the Job Creation Act in its approach contradicts the principle of autonomy because the regulation is centralized.

The Job Creation Act which was ratified on 5 October 2020 was met with the agitation of rejection in the form of demonstrations in almost all parts of Indonesia. There are many misunderstandings in the interpretation of this law, one of which is the assumption that the law will harm workers and society. This study aims to identify the causes of negative public opinion on the Job Creation Act, what forms of socialization are carried out by the government, and how the public gets information about the law. This research uses a qualitative approach. The data was taken through a questionnaire distributed to 22 respondents who were randomly selected from the Job Creation Act demonstrators in November 2020 in front of the DPRD Building of South Kalimantan Province. The results showed that respondent’s negative opinion on the Job Creation Act was caused by a lack of knowledge about the contents of the law and the lack of government socialization to the public. The strategy that can be taken by the government to create positive public opinion is to involve community groups, students, public figures, religious leaders, community leaders, and influencers as communicants or messengers in the socialization of the Job Creation Act.

Salah satu point penting yang diatur dalam perjanjian Helsinki terkait dengan penegakan hukum di Aceh adalah diberlakukannya Qanun dengan tujuan untuk menghormati tradisi sejarah Islam dan adat istiadat rakyat Aceh yang mayoritas muslim. Selain itu, untuk mensinergikan antara Qanun dengan pengadilan, maka di Provinsi Aceh dibentuk suatu sistem peradilan Syar’iyah yang tidak memihak dan independen, termasuk pengadilan tinggi yang tetap merupakan bagian dari sistem peradilan Republik Indonesia. Pembentukan Pengadilan Syar’iyah di Provinsi Aceh merupakan salah satu upaya untuk membuat kekhususan sebagaimana diatur dalam perjanjian Helsinki pada tahun 2005.  Namun, dalam dataran teknis pengaturan manajemen pengadilan Syar’iyah juga masih terkendala khususnya oleh karena adanya dua aturan hukum yang berlaku yaitu Qanun yang dibuat oleh Dewan Perwakilam Rakyat Daerah Provinsi Aceh dan undang-undang yang dibuat oleh Dewan Perwakilan Rakyat beserta Presiden. Hal tersebut berakibat Undang-Undang Pemerintahan Aceh yang mengatur tentang teknis pengaturan pengadilan Syar’iyah dan pembuatan Qanun juga banyak di lakukan judicial review ke Mahkamah Konstitusi. Tulisan ini bertujuan untuk melakukan analisa tentang efektifitas pemberlakukan Qanun dan pengadilan Syar’iyah di Provinsi Aceh pasca di undangkannya Undang-Undang Pemerintahan Aceh. Adapun tulisan ini dibuat dengan menggunakan metode penulisan normatif dengan pendekatan studi historis dan pendekatan studi kasus. Hasil penelitian menunjukkan bahwa pengadilan Syar’iyah yang telah dibentuk di Provinsi Aceh meski pada awalnya mengalami kendala namun dapat berjalan baik. Adanya kekhususan yang diberikan kepada Provinsi Aceh merupakan bagian dari upaya untuk menjalankan amanat konstitusi khususnya Pasal 18B UUD 1945.Kata kunci: Qanun, Pemerintahan Aceh, Mahkamah Syar’iyah, Mahkamah Konstitusi. Abstract One crucial point stipulated in the Helsinki agreement related to law enforcement in Aceh is the enactment of the Qanun with the aim of respecting Islamic historical traditions and the customs of the Acehnese people who are predominantly Muslim. Besides, to synergise between the Qanun and the court, in the Province of Aceh a Syar'iyah justice system was formed which was impartial and independent, including a high court which remained part of the judicial system of the Republic of Indonesia. The establishment of the Shariah Law in Aceh Province was one of the efforts to make it specific as stipulated in the Helsinki agreement in 2005. However, in the field of technical management of the Syariah court management is also still constrained especially due to the existence of two applicable laws namely the Qanun made by the Aceh Province Regional People's Representative Council and laws made by the House of Representatives and the President. This resulted in the Law on the Government of Aceh governing the Syar'iyah court and the Qanun being judged by the Constitutional Court. This paper aims to analyse the effectiveness of the implementation of Qanun and the Syar'iyah court in Aceh Province after the enactment of the Law on the Governing of Aceh. The writing is made using normative writing methods with historical study approaches, and case study approaches. The results of the study showed that the Syar'iyah court which had been formed in the Aceh Province even though initially had problems but could work well. The specificity given to the Aceh Province is part of an effort to carry out the mandate of the constitution, especially Article 18B of the 1945 Constitution.

Regulations are chosen as a means to realizizing public policy by the Government. Law Number 11 of 2020 concerning Job Creation (Job Creation Law), as an omnibus law, was formed to create a conducive climate for investment by reforming regulations in the field of business licensing. In its journey, the Job Creation Law is inseparable from various polemics, starting from the reporting stages of the material regulated in it, including efforts to liberalize food import policy. Allegedly, the presence of the Job Creation Law is injustice and negates the little people. The progressive law put forward by Satjipto Rahardjo adheres to the understanding that law is said to be progressive when the law favors the weak, the law must be pro-justice and pro-people. Based on the study and analysis of progressive law on the Job Creation Law, it can be said that the content of the Job Creation Law in agriculture which is an effort to liberalize food imports is also not in line with progressive law because it does not pay attention to the interests of small farmers because it reduces farmers' right to life.

Abstrak: Qanun merupakan pengganti dari istilah peraturan daerah yang dikhususkan untuk Provinsi Aceh sebagai salah satu bentuk otonomi khusus. Di dalam hierarki peraturan perundang-undangan, Qanun merupakan  salah satu peraturan perundang-undangan yang tata urutannya di bawah Undang-Undang. Oleh karena qanun merupakan peraturan perundang-undangan sejenis perda, maka pemerintah memiliki kewenangan untuk membatalkannya jika qanun tersebut bertentangan dengan ketentuan peraturan perundang-undangan yang lebih tinggi. Pada pertengahan tahun 2016, Kementerian Dalam Negeri (Kemendagri) Republik Indonesia telah membatalkan 3.143 Perda karena dianggap menghambat pertumbuhan ekonomi daerah dan memperpanjang jalur birokrasi. Selain itu, peraturan tersebut juga dianggap menghambat proses perizinan dan investasi serta menghambat kemudahan berusaha. Dari jumlah tersebut terdapat 65 qanun Aceh yang ikut dibatalkan, yang terdiri dari 6 Qanun Provinsi dan 59 Qanun Kabupaten/Kota. Mengenai kewenangan siapa yang sebenarnya berwenang menguji Perda/Qanun tidak ada sebuah kesepakatan pendapat diantara para pakar.  Abstract: Qanun is a substitute for the term regional regulation that is specific to Aceh Province as a form of special autonomy. In the hierarchy of statutory regulations, Qanun is one of the statutory regulations whose ordering is under the Law. Because the qanun is a kind of legislation, the government has the authority to cancel it if the qanun is contrary to the provisions of the higher statutory regulations. In mid-2016, the Ministry of Home Affairs (Kemendagri) of the Republic of Indonesia canceled 3,143 regional regulations because they were considered to hamper regional economic growth and extend the bureaucratic path. In addition, the regulation is also seen as hampering the licensing and investment processes and hampering the ease of doing business. Of these, there were 65 Aceh qanuns that were canceled, consisting of 6 Provincial Qanun and 59 District / City Qanun. Regarding the authority of who actually has the authority to examine the Perda / Qanun there is no agreement of opinion among experts.

The conduct of foreign affairs is an executive act of government in which neither the Queen nor Parliament has any part. It is the Government which represents the State and determines its policy, though Parliament has the right and the power to control the Executive, to withhold confidence in it, to refuse to grant the financial resources required to carry out its decisions, and thus to deprive the Government's foreign policy of efficacy. Hence the Government must be certain that its foreign policy has the support of Parliament. The affairs which the Crown conducts comprise the whole catalogue of relations with foreign nations which includes the declaration of war and peace, of belligerency and neutrality, and the recognition of foreign States and of their extinction. The law can control the conduct of foreign affairs if and in so far as the prerogative has been superseded by legislation, but even where this has happened there usually remains a residue of prerogative power vested in the Executive.

Nagan Raya salah satu Kabupaten yang ada di Provinsi Aceh yang mempunyai ekosistem gambut, dalam rangka pemeliharaan ekosistem gambut sebagaimana diatur di dalam Pasal 33 Peraturan Pemerintah Nomor 71 Tahun 2014 tentang Pengelolaan dan Perlindungan Ekosistem Gambut menyebutkan “pemeliharaan ekosistem gambut sebagaimana dimaksud dalam Pasal 17 ayat (1) huruf  b dilakukan melalui upaya pencadangan ekosistem gambut dan pelestarian fungsi ekosistem gambut sebagai pengendali dampak perubahan iklim. Pemerintah Kabupaten Nagan Raya telah menetapkan ekosistem gambut dengan fungsi lindung dalam Pasal 27 ayat (2) Qanun Kabupaten Nagan Raya Nomor 11 Tahun 2015 tentang Rencana Tata Ruang dan Wilayah Kabupaten Nagan Raya kawasan lindung gambut sebagaimana dimaksud pada ayat (1) seluas 11.380,71 ha terletak di Kecamatan Darul Makmur, berada di Gampong Babah Lueng, Kuala Seumayam, Pulo Kruet, dan Sumber Bakti. Praktinya, ekosistem gambut tersebut telah dimanfaatkan sehingga fungsi dari kawasan tersebut telah beralih. Hasil penelitian ini menunjukkan bahwa upaya pencadangan dan pelestarian fungsi ekosistem gambut di Kabupaten Nagan Raya tidak dilakukan secara maksimal sehingga eksploitasi rawa gambut masih terus terjadi pada ekosistem gambut dengan fungsi lindung.Nagan Raya is one of regencies in Aceh Province that has peat ecosystem region, concerning the protection of peat ecosystem as regulated in Article 33 of the Government Regulation Number 71, 2014 regarding Ecosystem Management and Protection of peat states that an effort of taking care peat ecosystem as worded in Article 17 ( 1 ) point b is done through the reservation of peat ecosystem and conservation function as controller of climate change impact. The District Government of Nagan Raya has determined that the protection function of peat ecosystem  and sustainability function into Article 27 ( 2 ) Nagan Raya District Local Law (Qanun) Number 11, 2015 regarding spatial planning and Nagan Raya District Area of peat ecosystem as meant by versus ( 1 ) with its width 11.380,71 ha located in Kecamatan Darul Makmur is widespread in Babah Lueng Village, Kuala Seumayam, Pulo Kruet and Sumber Bakti. In practice, the peat areas in Babah Lueng Village, Kuala Seumayam, Pulo Kruet and Sumber Bakti has been converted by palm plantation and people amongst the plantation area hence the function of the area has been transformed. The research shows that an effort of conserving and reserving the peat ecosystem in Nagan Raya District has not been optimal hence its exploitation is still taking place at the ecosystem and its protection function.

The Krueng Peusangan watershed in the Aceh Province, Indonesia, has an important role in the daily life of residents in the surrounding areas. The watershed serves as a supply of clean water, shelter, food sources, and sources of income for hundreds of thousands of people. Forest encroachment activities, mining, plantations, and land conversion have interrupted the watershed balance. These various activities cause threats of loss of forest area, biodiversity extinction, water crisis, flooding, human-animal conflict, and also global warming and food crisis. Therefore, this article analyses the law and policies issued by the Central, Provincial, and Regency/City Governments related to the management of the Krueng Peusangan Watershed and to examine the legal framework needed for watershed protection and management. This type of research is normative legal research using the regulatory, conceptual, and case approaches. The results revealed that the existing legal framework has not fully protected watershed rescue. The policies issued are still partial and have not been integrated on a regional or sectoral basis. This paper suggests that the Government of Aceh and Regency/City Governments to revise several Qanun, i.e., the Mid-Term Development Plan Qanun, the Watershed Management Qanun, Strategic Environmental Assessment Qanun, Qanun of Environmental Protection and Management Plan, and laws and regulations in the environmental, forestry, plantation and mining sectors.

The law arrangement of franchise law was first explicitly regulated by the Government Regulation No. 16 of 1997 which is then updated by Government Regulation No. 42 of 2007 to be created in an agreement that at least contains clauses as stipulated by Article 5 of the Government Regulation. However, franchise arrangements also associated with a variety of other laws and regulations applicable in Indonesia. This article is going to state that the importance of partnerships with small and medium enterprises as an effort to encourage the involvement of the wider economic community.

The establishment of the KPPU is to control the implementation of the Act. No. 5/1999 on Concerning the Ban on Monopolistic Practices and Unfair Business Competition in Indonesia. Various duties and authority of the KPPU contained in Article 35 and Article 36 of the Act. But in reality, KPPU does not have executorial rights so that the various decisions of the commission often could not be implemented. Therefore internally strengthening of institutional existence by way of amending the Law Commission is very appropriate to be used by the government and parliament agenda. Externally, stakeholder participation is something very urgent and that the KPPU’s strategic optimally capable of performing their duties according to its motto: “Healthy competition Welfare of the people”.

In Russia, the reform of the regulatory guillotine is being implemented in the field of control and supervisory activity. It should result in a new regulatory system formed according to the principles specified in the key federal laws: «On state control (supervision) and municipal control in the Russian Federation» (Law on Control) and «On mandatory requirements in the Russian Federation» (Law on Mandatory Requirements) adopted in August 2020. In the field of industrial safety, this process was launched by the Decree of the Government of the Russian Federation № 1192, which will come into force on January 1, 2021. The main provisions are discussed in the article, which are related to the Law on Control and the Law on Mandatory Requirements. The Law on Control establishes the priority of preventive measures aimed at reducing the risk of causing harm in relation to the control activities, the grounds for carrying out control (supervisory) activities, the types of these activities in the forms of interaction with the controlled person and without such, the procedure for presentation of the results of control (supervisory) activity. The Law on Mandatory Requirements establishes that the provisions of regulatory legal acts should enter into force either from March 1 or September 1, but not earlier than 90 days after their official publication, and their validity period should not exceed 6 years. The drafts of regulatory legal acts developed by the federal executive bodies are subject to regulatory impact assessment. With a view to ensuring systematization of mandatory require ments, their register is kept. The federal executive body prepares a report on the achievement of the goals of mandatory requirements introduction. By January 1, 2021, 10 resolutions of the Government of the Russian Federation, 48 federal norms and rules in the field of industrial safety and 9 other regulatory legal acts of Rostechnadzor should be adopted. The drafts of all the documents are already prepared, some of the acts are completing the process of discussion and approval.
