Legal Interpreting and Social Discourse

Legal interpreting covers a broad spectrum of interpreting activities related to law. This chapter takes a sociopolitical point of view to discuss interpreting in legal matters in judicial as well as extrajudicial settings. Based on international regulations and democratic ideals, it shows the importance of interpreting for equal access to law, with a focus on the possibilities and scope of action available to interpreters rather than the restrictions. By presenting the legal activities and text types that occur, the chapter develops strategies for interpreters for use in different settings and situations to ensure the best possible communication for all participants. In this context, the chapter also addresses the demand for multipartiality and equiproximity between the interpreter and the other participants in the communication process.

The article presents an analysis of the heading complex in the novel by I. Savych “Imaginary Interlocutor”. The author of the article analyses and classifies the headings of the novel: the general title and the titles of its eighteen chapters. The main principle of the classification is correlated with the traditional components of the text: thematic content, problems, plot, character system, details, time and space, etc. under analysis is also “the energy” of the headings: connection of the whole novel and its chapters with other works of Russian and foreign literature of different times. The other aspect of the analysis of the novel discussed is epigraph which functions in several coupling systems: with the novel context, with the text of the novel and its chapters, with different epigraphs. The author of the research considers communicative types and functions (informative and form-meaning ones) of epigraphs in literary interpretation. In O. Savych’s novel meaningful information of the epigraph is a prospective message concerning thematic, plot and conceptual moments of the book. Special attention is paid to the form-building function in the text. Types of the epigraphs in the novel are different according to the source. Epigraph, as an element of O. Savych’s text is multifunctional. Its main and universal function is dialogical: epigraph is one of ways to make a monologue dialogical, to present a different from the author’s point of view. Thus, the system of the author’s thought, their literary orientation are revealed. While the division of the novel into 18 chapters gives to the novel the character of completeness, enhances its inner unity, epigraphs outline the open character of the text borders. The analysis of the heading complex allows to make some conclusions about the nature of O. Savych’s book and its place in Russian literature of 1920 – 1930 years.

AbstractThis article seeks to explain some of the ramifications of globalization processes for the pressing problem of increasing global poverty. It distinguishes two competing approaches to explaining the causes of poverty-related injustice and justifying conceptions of obligations towards the poor. A first approach, the assistance approach, is mainly directed at identifying inappropriate worldwide income and asset distribution; the other, the causal approach focuses on the effects international regulations have on people’s lives. This article explains that both approaches depend on the interpretation of the current state of economic and political interdependence. It is argued that both conceptions have their pitfalls, but that from a theoretical as well as pragmatic point of view, it makes sense to defend an ‘integrated’ perspective that also takes into account the responsibility of non-state actors.

Overcoming cognitive dismoderate intercourse in children is actually achieved by placing children in a gambling situation where choosing artists are oriented not on the acting abilities of their comrades but on their personal qualities, in their daily behavior, there is a dialogue-reflection, which involves changing positions and reflections from the point of view of the other in order to correctly read the feedback in the communication process. The parent gives a lesson to students with a preventive educational nature based on perceptual reflection. By choosing the artists, children are oriented not on the acting abilities of their comrades, but on their personal qualities that appear in their everyday behavior, there is a dialogue-reflection involving changing positions and reflections from the point of view of the other in order to correctly read the feedback in the process of communication and interpersonal interactions. The parent in the lesson, it is the parent who stands before the students and reads an unfamiliar story of a preventive nature. After reading the story, the parent and the children together make an analysis of what the heroes are in the story, making it a characteristic of every hero. Collectively, a child is selected as a director, with the assistance of which children choose which artist to offer their peers. As a consequence of the suggestions, children have the right to accept or not the role they have suggested if they do not agree with the role they choose to play themselves. Which character to represent personally. Once the roles are selected, action is taken. A preventative gaming situation with a story-storyline is done preventively, and after choosing the roles, the children together read the tale of roles with an artistic accent of the voice. The parent as a pedagogue asks the following questions to the children after pre-role reading: Write to which character do you see your acquaintance and why (according to the first criteria - relation to others based on reflection)?. Describe a case or situation with a similar problematic context defining the role (negative or positive) in which you see your acquaintance (on a second criterion - analyzing different behavioral reactions in a similar context of interactions)? How do they see and appreciate your comrades?; What do others think about you?; What qualities do you most appreciate ?; How did you feel in this role? (on the third criterion - explaining the specificity of the real judgment for himself on the basis of reflection in the interlocutor's view, by changing positions and reflections from the point of view of the other). How do you think, why did you suggest this role? Why did you play this role? Fourth criteria - correct reading of the feedback in the process of communication. Indicator one is to the first question, indicator two is to the second question. The attitudes in the processes of perception of the world by the children from inside to outside and from inside to outside are considered. The research is in the field of socio-pedagogical sciences.Very often, the difference in perceptual attitudes in children leads them to misinterpretation of behavioral signals in the person of the person with whom they communicate; prevention of cognitive dismoderate intercourse, a cause of aggressive manifestations in children of primary school age.

Summary: My comment is basically restricted to the situation in which less-able students find themselves and refers only to literature in German. From this point of view I am basically able to confirm Marsh's results. It must, however, be said that with less-able pupils the opposite effect can be found: Levels of self-esteem in these pupils are raised, at least temporarily, by separate instruction, academic performance however drops; combined instruction, on the other hand, leads to improved academic performance, while levels of self-esteem drop. Apparently, the positive self-image of less-able pupils who receive separate instruction does not bring about the potential enhancement of academic performance one might expect from high-ability pupils receiving separate instruction. To resolve the dilemma, it is proposed that individual progress in learning be accentuated, and that comparisons with others be dispensed with. This fosters a self-image that can in equal measure be realistic and optimistic.

The paper considers a point of view, based on the conception of the broad understanding of taxons. According to this point of view, rhyncholites of the subgenus Dentatobeccus and Microbeccus are accepted to be synonymous with the genus Rhynchoteuthis, and subgenus Romanovichella is considered to be synonymous with the genus Palaeoteuthis. The criteria, exercising influence on the different approaches to the classification of rhyncholites, have been analyzed (such as age and individual variability, sexual dimorphism, pathological and teratological features, degree of disintegration of material), underestimation of which can lead to inaccuracy. Divestment of the subgenuses Dentatobeccus, Microbeccus and Romanovichella, possessing very bright morphological characteristics, to have an independent status and denomination to their synonyms, has been noted to be unjustified. An artificial system (any suggested variant) with all its minuses is a single probable system for rhyncholites. The main criteria, minimizing its negative sides and proving the separation of the new taxon, is an available mass-scale material. The narrow understanding of the genus, used in sensible limits, has been underlined to simplify the problem of the passing the view about the genus to the other investigators and recognition of rhyncholites for the practical tasks.

Türkiye, Cumhuriyet tarihinin en yoğun zorunlu göç dalgasını 2011 yılından bu yana süren Suriye Savaşı ile yaşamaktadır. Suriye vatandaşlarının geçici koruma statüsü altında Türkiye toplumuna her açıdan entegrasyonları günümüzün ve geleceğin politika öncelikleri arasında düşünülmelidir. Öte yandan ülkeye kabul edilen sığınmacıların kendi kültürel kimliğini kaybetmeden içinde yaşadığı ev sahibi topluma uyumu, ortak yaşam kültürünün gelişmesi açısından önem arz etmektedir. Bu makalede, "misafir" olarak kabul edilen Suriyeli vatandaşların Türk toplumunca kabul edilmeleri ve dışlanma risklerinin azaltılmasına yönelik devlet politikaları ortaya konularak, üye ve aday ülkelere göçmenlerin dışlanmasını önlemek için Avrupa Birliği (AB) tarafından sunulan hukuki yapı ve kamu hizmeti inisiyatifleri incelenmekte, birlikte yaşam kültürü çerçevesinde Suriyeli vatandaşlara yönelik  toplumsal kabul düzeyleri ele alınmaktadır. Çalışma iki ana bölümden oluşmaktadır: göçmen ve sığınmacılara karşı toplumsal dışlanmayı engellemek için benimsenen yasa ve uygulamaların etkisi ve İstanbul-Sultanbeyli bölgesinde Suriyeli sığınmacılarla ilgili toplumsal algı çalışmasının sonuçları. Bölgede ikamet eden Suriyelilere yönelik toplumsal kabul düzeyinin yüksek olduğu görülürken, halkın Suriyelileri kendilerine  kültürel ve dini olarak yakın hissetmesi toplumsal kabul düzeyini olumlu etkilemektedir. ABSTRACT IN ENGLISHAn evaluation of the European Union and Turkish policies regarding the culture of living togetherThis article aims to determine the level of social acceptance towards Syrians within the context of cohabitation culture by evaluating EU’s legal structure and public service initiatives in order to prevent Syrian refugees from being excluded in member and candidate countries and by revealing government policies on acceptance of Syrians as “guest” by Turkish society and minimizing the exclusion risks of them. This article consists of two main parts, one of which is based on the effects of law and practices preventing refugees and asylum seekers from social exclusion, and the other is on the results of social perception on Syrians in Sultanbeyli district of Istanbul. At the end of 5-years taking in Syrian War, it is obvious that most of more than 3 million Syrian with unregistered ones in Turkey are “here to stay”. From this point of view, the primary scope of policies should be specified in order to remove side effects of refugee phenomenon seen as weighty matter by bottoming out the exclusion towards those people. To avoid possible large-scale conflicts or civil wars in the future, the struggle with exclusion phenomenon plays a crucial role regarding Turkey’s sociological situation and developing policies. In the meaning of forming a model for Turkey, a subtitle in this article is about public services for European-wide legal acquis and practices carried out since 1970s in order to prevent any exclusion from the society. On the other hand, other subtitles are about legal infrastructure and practices like Common European Asylum and Immigration Policies presented in 2005, and Law on Foreigners and International Protection introduced in 2013. In the last part of the article, the results of a field survey carried out in a district of Istanbul were used to analyze the exclusion towards refugees in Turkey. A face-to-face survey was randomly conducted with 200 settled refugees in Sultanbeyli district of Istanbul, and their perceptions towards Syrian people under temporary protection were evaluated. According to the results, the level of acceptance for Syrians living in this district seems relatively high. The fact that Turkish people living in the same district feel close to Syrian refugees culturally and religiously affect their perception in a positive way: however, it is strikingly seen and understood that local residents cop an attitude on the refugees’ becoming Turkish citizens.

This research deals with the development of  self concept of Hiroko as the main character in Namaku Hiroko by Nh. Dini and tries to identify how Hiroko is portrayed in the story, how she interacts with other characters and whether she is portrayed as a character dominated by ”I” element or  ”Me”  element seen  from sociological and cultural point of view. As a qualitative research in nature, the source of data in this research is the novel Namaku Hiroko (1967) and the data ara analyzed and presented deductively. The result of this analysis shows that in the novel, Hiroko as a fictional character is  portrayed as a girl whose personality  develops and changes drastically from ”Me”  to ”I”. When she was still in the village  l iving with her parents, she was portrayed as a obedient girl who was loyal to the parents, polite and acted in accordance with the social customs. In short, her personality was dominated by ”Me”  self concept. On the other hand, when she moved to the city (Kyoto), she was portrayed as a wild girl  no longer controlled by the social customs. She was  firm and determined totake decisions of  her won  for her future without considering what other people would say about her. She did not want to be treated as object. To put it in another way, her personality is more dominated by the ”I” self concept.

AbstrakHegemoni kolonialisme dalam budaya poskolonial merupakan alasan penelitian inikemudian mengkaji wacana kolonial dalam novel Max Havellar (MH) khususnya dampakditimbulkannya. Dampak dimaksud adalah posisi keberpihakan pemikiran tersirat darikarya tersebut. Hasil pembahasan menunjukkan, secara temporal maupun permanen MHmenyuarakan ketidakadilan dalam kondisi-kondisi kolonial menyangkut penindasan sangpenjajah terhadap terjajah. Hanya saja, upaya mengatasnamakan atau mewakili suarakaum terjajah terbukti mengimplikasikan ciri ideologis statis kerangka kolonialisme(orientalisme); yakni cara pandang Eropasentris, di mana “Barat” sebagai self adalah superior,dan “Timur” sebagai other adalah inferior. Dalam konteks poskolonialisme, MH dengan sifatkritisnya yang berupaya “menyuarakan” nasib pribumi terjajah, justru menampilkan stigmapenguatan kolonialitas itu sendiri secara hegemonik. Artinya, “menyuarakan” nasib pribumidimaknai sebagai keberpihankan kolonial yang kontradiktif, di mana stigma penguatankolonialitas justru lebih terasa, ujung-ujungnya melanggengkan hegemoni kolonial. Tidakmembela yang terjajah, tetapi memperhalus cara kerja mesin kolonial.AbstractThe hegemony of colonialism in the culture of postcolonial society is the reason this studythen examines the colonial discourse in the novel Max Havellar (MH) in particular the impactit brings. The impact in question is the implied position of thought in the work. The resultsof the discussion show that, temporarily or permanently, MH voiced injustice in the colonialconditions regarding the oppression of the colonist against the colonized. However, the effort toname or represent the voice of the colonized has proven to imply a static ideological characterin the framework of colonialism (orientalism); ie Eropacentric point of view, in which “West” asself is superior, and “East” as the other is the inferior. In the context of postcolonialism, MH withits critical nature that seeks to “voice” the fate of the colonized natives, actually presents thestigma of strengthening coloniality itself hegemonicly. That is, “voicing” the fate of the pribumiis interpreted as a contradictory colonial flare, where the stigma of strengthening colonialityis more pronounced, which ultimately perpetuates the hegemony of colonialism. No longerdefending the colonized, but refining the workings of the colonial machinery.

Al-Qusayr is located 40 km south of modern al-Wajh, roughly 7 km from the eastern Red Sea shore. This site is known since the mid-19th century, when the explorer R. Burton described it for the first time, in particular the remains of a monumental building so-called al-Qasr. In March 2016, a new survey of the site was undertaken by the al-‘Ula–al-Wajh Survey Project. This survey focused not only on al-Qasr but also on the surrounding site corresponding to the ancient settlement. A surface collection of pottery sherds revealed a striking combination of Mediterranean and Egyptian imports on one hand, and of Nabataean productions on the other hand. This material is particularly homogeneous on the chronological point of view, suggesting a rather limited occupation period for the site. Attesting contacts between Mediterranean merchants, Roman Egypt and the Nabataean kingdom, these new data allow a complete reassessment of the importance of this locality in the Red Sea trade routes during antiquity.

The role of arthroscopy in incipient and mild arthrosis, even combined with proximal tibial ostetomy, is well known and well documented. On the other hand, its role in the treatment of advanced arthrosis of the large joints, especially the knee, is a subject of controversy. The proponents of the use of arthroscopy in advanced arthrosis claim that meniscectomy, synovectomy, ostophytectomy, chondral lesion stabilization, arthroscopic release, plica and loose body removal greatly improve the quality of life for most patients, especially if followed by the use of viscoelastic injection, by diminishing pain and improving joint range of motion. The opponents claim that, even though the advantages are clear in the cases that refuse arthroplasty, in all the other cases the surgical indication should be total knee arthroplasty, as the clinical relief is temporary, but with all the risks of a surgical intervention. We have conducted an overview of the recent literature, in order to find objective evidence to sustain either point of view. We focused on articles published that included an objective measurement of before and after clinical status through clinical scores and objective measurements. We also focused on the follow-up period and on the evolution of the pathology after arthroscopy.
