Tradition, Sovereignty, and Conservation: The Controversy Surrounding the Wind River Indian Reservation Game Code

Abstract In December 1983, a highly publicized slaughter of over fifty elk at Wind River Indian Reservation reignited a dispute between the reservation’s resident tribes—the Eastern Shoshone and Northern Arapaho nations—over wildlife management. In response to diminished big game populations, the Eastern Shoshone Tribe had passed hunting regulations in 1980, but the people of the Northern Arapaho Tribe refused to do so, effectively derailing any attempt to manage wildlife at Wind River. After the Bureau of Indian Affairs imposed a game code on the reservation in 1984, the Northern Arapaho Tribe initiated a legal battle that culminated in the 1987 case of Northern Arapahoe Tribe v. Hodel. The court ruled that because the treaty rights of the two tribes overlapped in the area of wildlife management and because research conducted by the U.S. Fish and Wildlife Service at the request of both tribes had revealed a need for hunting regulations, the U.S. government had the power to impose the Wind River Reservation Game Code. Although the tribes jointly manage wildlife today and big game populations now thrive at Wind River, it is important to examine the controversy that involved conflicting visions of and concerns about cultural traditions, tribal sovereignty, and wildlife conservation principles and practices. Exploring how Eastern Shoshones and Northern Arapahos viewed those subjects differently and how their longstanding rivalry at Wind River shaped this conflict highlights some problems with the simplistic and romanticized concept of the “Ecological Indian.”

In the United States, wildlife conservation was established by hunters for hunters because of hunters. In the late 19th century, Theodore Roosevelt complained that commercial hunters had decimated wildlife—that a comparatively small population of “market” hunters profited while the nation was stripped of hunter-target species (S. Fox 123). To address these concerns, he founded the Boone and Crockett Club (BCC) in 1897, with the following mission: “[T] o promote the conservation and management of wildlife, especially big game, and its habitat, to preserve and encourage hunting and to maintain the highest ethical standards of fair chase and sportsmanship in North America” (“About the B & C Club”). “Conservation” is a utilitarian, human-centered term promoting the protection of wildlife and wilderness for human use. Accordingly, the BCC promoted laws protecting “every citizen’s freedom to hunt and fish,” and established wildlife as “owned by the people and managed in trust for the people by government agencies” (“About the B & C Club”). As a result of the BCC, the U.S. government was placed in charge of managing wildlife on behalf of hunters.

Public wildlife management in the United States is transforming as agencies seek relevancy to broader constituencies. State agencies in the United States, while tasked with conserving wildlife for all beneficiaries of the wildlife trust, have tended to manage for a limited range of benefits in part due to a narrow funding model heavily dependent on hunting, fishing, and trapping license buyers. To best meet the needs, interests, and concerns of a broader suite of beneficiaries, agencies will need to reconsider how priorities for management are set. This presents an opportunity for conservation program design and evaluation to be elevated in importance. We argue that success in wildlife conservation in the U.S. requires assessment of both decision-making processes and management results in relation to four questions: conservation of what, under what authority, for what purposes, and for whom?

Zimbabwe's approach to wildlife conservation started to change radically just over 30 years ago. Recognition of the fact that wildlife will only survive outside protected areas if the people who share the habitat are given responsibility for and derive benefits from wildlife has had positive effects for the conservation of the macrofauna. Our novelty of research lies in the application of scientific tools to analyze a possible reload. We used the complementarity principle of N. Bohr, the principle of spontaneous emergence of I. Prigogine, the principle of incompatibility L. Zade, the principle of managing uncertainties, the principle of ignorance of individual opinions and collective ideas, the principle of conformity, the principle of diversity of development of a complex system, the principle of unity and mutual transitions, the principle oscillatory (pulsating) evolution – showed instability in the management of society by mondialist-compradors and a possible countdown of the transition from the sensual age to the ideation nnuyu, and in our case – from consumerism to communitarianism. From the apparent modern triumph of consumerism over communitarianism, we are not interested in a fact-problem, but in the idea of transforming reality that can stop the process of obscuration. Discussion and Conclusion. In the Middle Ages, during the construction of the project “Holy Russia”, communities were created according to the principle of “big”. Around the devotee of piety, voluntary monastic settlements were created, which grew into suburbs. Of these, the ascetic-hesychast stood out, who went into the forest and chopped down a new temple. To the righteous people flocked, yearning for a just life. This is how a new community was created. There was a new prayer book and then the big man blessed him to organize other settlements. The state should be interested in finding new forms of solutions for educational, economic, technical, cultural and food programs, therefore the initiative of communitarianists should not be punished, but supported. Today, foreign investors are becoming owners of not only factories, but even entire branches of domestic industry and are able to significantly influence domestic politics in our country. The growing number of immigrants as a destabilizing factor is becoming increasingly important. In such a situation, the fate of the country depends on the ability of the people to a new unification. It is necessary to unite on the basis of religious and cultural traditions on the principle of professional fraternities; if only there would be more centers of spiritual culture, but not by the principle of quantity, as is always the case with officials, but by the qualitative qualification of the “big man” as a center of creative and integrative power. From the foregoing, the idea of building ideational (communitarian) cohorts is born, which, through their ascetic life and creative work, should set a new vector for historical development (“salt”) consumer society.

The controversy surrounding the Second Amendment—“the right of the people to keep and bear arms”—is, to a large extent, historical in nature, redolent of other matters in this country’s legal and constitutional past. But the historical analogies that might support the Amendment’s repeal do not permit easy conclusions. The issue demands that legal historians venture beyond familiar territory to confront unavoidable problems at the intersection of theory and practice and of constitutional law and popular constitutionalism. An interdisciplinary analysis of Lichtman’s Repeal the Second Amendment illuminates the political, legal, and constitutional dimensions—as well as the perils—of undertaking the arduous amending process permitted by Article V of the U.S. Constitution.

In South Africa, communal rural community development has, for the most part, been viewed as an add-on, rather than as an integral value in the broad spectrum of conservation activities being practised in the country. This paper, therefore, argues for the reality-based adoption of an extension of existing conservation paradigms to incorporate the development of communal rural communities as an integral part of the overall wildlife conservation and management policy in South Africa. The answer to the seeming contradiction in the focus of wildlife conservation and rural development lies in the devel- opment of wildlife management programmes based on multi-disciplinary and multiinstitutional interaction, by also harnessing scientific knowledge and skills found in the social sciences. In this manner, the present largely lip service related to so-called com- munity participation in wildlife management can be changed into programmes which really achieve conservation-based community development enhancing survival for both the communities and their inherent natural resources.

The research in this paper leads to peace education in Poso. Local wisdom approach focus to achieve it. Local wisdom in question is a tradition of cultural in sintuwu maroso and padungku. Researchers considered that culture sintuwu maroso and padungku a primal's hospitality owned Poso then and now. The distinctive feature of this research center at the local wisdom area. That approach is not without reason. Social unrest conflicts that have occurred in Poso, leaving wounds that are difficult unresolved grudges. Seventeen years ago the conflict was going on, now remaining trauma and feels haunted. Yet the return of all refugees to their original place, not awakening back all the buildings or houses in the former debris destruction mass, separation is expressly settlements Islamic-Christian, social community is still limited, and military approach that is very dominant, not apart from monitoring the author. Watched it is balanced with the security situation, a conducive atmosphere andhospitality of the people of Poso today. Objectives achieved in this study were (1) to find out how the understanding and meaning of the Poso community’s hospitality (2) to find out ways of appreciation and practice of cultural sintuwu maroso and padungku as a form of tradition's hospitality in Poso and (3) to determine the role and the application of hospitality in traditions of cultural sintuwu maroso and padungku for peace education in addressing the conflict in Poso. The data collection process is conducted qualitatively. Interviews and observations is his method, followed by a description of the data. Analysis of data using analytical approachto Theology-CRE (Christian Religious Education). This approach was chosen because they are the research student of CRE. After conducting research and data analysis as a whole, the picture of hospitality in Poso this time will be presented in a straightforward and unequivocal. Likewise, appreciation and practice of cultural sintuwu maroso and padungku in everyday life. In the end, the author proposes an approach to education for peace in Poso, that is approach through cultural traditions in sintuwu maroso's hospitality and padungku Key words: Hospitality, Sintuwu Maroso, Padungku, Peace Education.

Poaching is one of the greatest immediate threats and a serious conservation challenge facing wildlife in Borneo. Medium- to large-sized mammals, while charismatic, are hunted for consumption and sale. This study focuses on wildlife hunting and utilization of selected communities in a remote area in Sarawak, conducted using interview surveys within communities who hunt wildlife in Ulu Baleh. The calculated hunting pressure index in Ulu Baleh (2.24) is considered low compared to other parts of Sarawak. Local communities are dependent on wildlife protein and medicine. Even though the common hunting offtake included the bearded pig and deer species, for the hunter’s own consumption, hunters were opportunistic in taking non-target species and selling surplus meat. Lack of awareness of the implications of unsustainable hunting and difficulty in monitoring by the relevant authorities appear to be the main challenges to wildlife conservation in the area. This paper highlights the lack of research documenting wildlife utilization in the Ulu Baleh region and the implication of these results are particularly important for future adaptive wildlife management, especially for species of conservation importance in Sarawak.

Today’s ideological division on the U.S. Supreme Court is also a partisan division: all the Court’s liberals were appointed by Democratic presidents, all its conservatives by Republican presidents. That pattern never existed in the Court until 2010, and this book focuses on how it came about and why it’s likely to continue. Its explanation lies in the growing level of political polarization over the last several decades. One effect of polarization is that potential nominees will reflect the dominant ideology of the president’s political party. Correspondingly, the sharpened ideological division between the two political parties has given presidents stronger incentives to give high priority to ideological considerations. In addition to these well-known effects of polarization, The Company They Keep explores what social psychologists have taught us about people’s motivations. Justices take cues primarily from the people who are closest to them and whose approval they care most about: political, social, and professional elites. In an era of strong partisan polarization, elite social networks are largely bifurcated by partisan and ideological elites, and justices such as Clarence Thomas and Ruth Bader Ginsburg live in milieus populated by like-minded elites that reinforce their liberalism or conservatism during their tenure on the Supreme Court. By highlighting and documenting this development, the book provides a new perspective on the Court and its justices.

This chapter analyzes dissenting opinions from the U.S. Supreme Court’s rulings in Windsor and Obergefell. Although the procreation argument was used sparingly by the Court, it does appear in modest form. More important are the justices’ uses of the themes of power, privilege, and liberty to justify maintaining the silences surrounding their antigay animus. For the dissenting justices the Court’s rulings in both cases signify an expansion of “We the People” that is unacceptable, a move from which they explicitly distance themselves and represent themselves as victims of a powerful minority. Their masculine heterosexual privilege was compromised, and the dissenting justices took it personally.
