This chapter focuses on the evolution of the concept of corporate personality in English law. Recent developments in experiments with legal organizational forms are injecting diversity into the relative monoculture of the corporate form. Two threads are of particular interest in this chapter. The first concerns the creation of hybrid legal structures for “social enterprise.” The second stems from a revival of interest in cooperative structures, particularly in tandem with the digital economy. The chapter places these two threads in dialogue with Simon Deakin’s recent stimulating argument that the commons provides the most convincing conceptual foundation for understanding corporate governance.

The paper shows that the main limit to the growth of "digitalization" in the XXI century may be not so much the limits of technology development, but rather the difficulties with staffing such a knowledge-intensive process as digital development. This problem is mainly associated with a decrease in the rate of growth of the World's population, which is determined by other social, economic, and factors. The personnel problem of the development of the digital economy is based on the need to maintain the number of researchers and the intensity of solving the problems of economic and social development through the creation and implementation of digital technologies. Solving this problem in the coming decades may face a chronic shortage of specialists to implement the most ambitious plans.

Globalization has created complex production chains, in which many countries contribute to the creation of added value. Globalization influences almost all aspects of life, but the way this evolution is felt differs from one country to another, from one region to another, from one individual to another. Globalization is an objective process that is taking place with astonishing speed, covering all the states of the world. It was determined and favored by the ultra-fast advances of technology, especially information technology, but also by the manifestations of the digital economy or information economy. Digitization has fundamentally changed the way companies operate while providing new entities with opportunities for survival and development. Websites have become powerful advertising and commercial tools, being used in all areas of activity. In the digital economy, the creative industries revolve around dynamic, innovative and often unorthodox collaborations, whereby numerous large, small and micro-businesses come together for the duration of a project, then disband and form new partnerships for the next project. Research designs must therefore address multiple contexts and levels presenting an analytical challenge to researchers. In this project we extend work that investigates the significance of emergence in theorising entrepreneurship into an exploration of how to articulate the creation and flow of value and effective ontology in a creative landscape.

The implementation of this Program requires high-quality interaction between the state, business and science, since its implementation requires the formation of at least a dozen leading national companies high-tech industrial enterprises that develop end-to-end technologies and manage digital platforms, which will carry out their activities on world markets and form a strategic ecosystem, research structures and leading industry enterprises that ensure the systematic development of the digital economy of Russia. The Program implementation indicators show that the effectiveness of innovation development in theindustrial sector of digitalization determines the creation of future markets, allowing industrial enterprises to create the image of the future of the regions, to carry out complex innovative activities. The relevance of theimplementation of the State Program Digital Economy of the Russian Federation, which includes the processes of innovative development of the region on the basis of NTI, is that digitalization and the creation of innovations, allows enterprises to gain leadership among similar manufacturers, producing products with asignificant degree of knowledge intensity, forming new product and technology markets. Digital technologies and innovative development of the region on the basis of NTI is the creation of a network integration grouping of the industrial complex on the basis of an innovative ecosystem. A significant result of this study is the formation of a model of the innovation ecosystem of the region based on NTI. The model shows that the development of NTI startups is carried out with the help of the regional infrastructure of innovation support, the main element of which is the innovative regional clusters representing the regional ecosystem of innovation support. The main importance in the ecosystem is played by the network connections of participants in innovation activities and their organizational and technological capabilities (points of industrial technological growth and development). The main subject of the research is the key competencies of innovation-active enterprises in the digital economy. Approach to the identification of core competencies of the enterprises on the basis of the inverse engineering of the requirements to competencies satisfying valuable characteristics of a product is formulated. It is proposed to consider the network enterprise as an intermediate link upon transition from the creation of the traditional enterprise to virtual. Decomposition of the value chain of the product into activities corresponding to the core competencies in the context of the network enterprise participants is executed. The technique of assessment of requirements to core competencies of the enterprises on the basis of comparison to the value offer on the creation of an innovative product is developed. Criteria of optimization of the network enterprise structure on the basis of estimates of the level of requirements to core competencies are developed. The distinctiveness of the study consists in the use of expert assessment methods, fuzzy logic, multisets, and multi-criteria optimization during its conducting. The practical implementation of the research results presented in this article will improve the efficiency of innovatively active enterprises.
