The article analyzes the legal problems of regional investment policy formation. The legal bases of attracting investors in the conditions of decentralization are determined. The institutional basis of creating an investment climate in Ukraine, the experience of other countries in creating attractive conditions for investors are studied. Recommendations for improving the national investment legislation taking into account the European experience have been developed, namely the creation of new legislative acts is proposed, which will allow creating favorable conditions for investors. Recommendations for the formation of the business reputation of the region are given.

The improving investment climate objective requires a comprehensive approach to the regulatory framework enhancement. Policy Framework for Investment (PFI) is a significant OECD’s investment tool which makes possible to identify the key obstacles to the inflow foreign direct investment and to determine the main measures to overcome them. Using PFI by Russian authorities would allow a systematic monitoring of the national investment policy and also take steps to improve the effectiveness of sustainable development promotion regulations.

The article highlights the issues of methodological tools for evaluating the efficiency of regional investment policy. The article provides international experience of investment policy evaluation and presents the evolution of approaches to evaluating the investment policy of Russian regions and the investment climate. Four approaches are outlined on the basis of domestic methods analyzed: cost-result, rating, integral and complex (qualitative and quantitative). The approach based on evaluation of investment performance and the costs incurred is widely used in Russia. The conclusions are drawn from the research findings: the existing approaches to evaluating the efficiency of investment policy at the regional level have disadvantages and use restrictions. The concluding part contains outlined actions aimed at improving the tools and methods for evaluating the efficiency of investment policy of regional units.

The development of the digital economy leads to the emergence of a new concept of “digital asset”. It is very important to ensure state regulation of relations related to the use of digital currency and their involvement in civil and commercial legal relations today. Thus, Ukraine will get closer to the technological leaders of the economic sphere. In addition, the IT sector will create additional motivation for Ukrainian and foreign professionals based on the favorable conditions that are created. Issues related to solving the problem of anonymous unregulated cross-border transfers, corrupt settlements, money laundering are those that are currently being considered and require the adoption of a legal act. Existing approaches are analyzed to determine the digital asset among scientists. The analysis showed that there is currently no single approach to the definition of virtual assets and cryptocurrencies. The existing substitution of concepts in the definition and this topic needs to be refined by scientists – practitioners. The paper gives examples of states that have created regulations that allow to reveal the understanding of the components that should have the regulation of cryptocurrencies. In particular, the paper points to the models of legislation of such states as the Republic of Belarus, Great Britain and the United States. Special attention is paid to attempts to legalize cryptocurrencies in Ukraine. In addition, existing bills aimed at regulating legal relations regarding the circulation, storage, possession, use and conduct of cryptocurrency transactions are subject to analysis. The main factors of application of effective regulatory approaches to cryptocurrency transactions are determined. It is argued that the creation of a transparent and effective system of regulation of legal relations in the use of virtual assets should lead to a positive investment climate in Ukraine.

This article deals with the problems of forming the legislative mechanism of creation and state support of the legal investment order, which should ensure the functioning of the investment market in the mode of observance of the principle of freedom of investment activity and at the same time real providing the national economy with investments in the necessary quantitative and qualitative parameters for the expanded reproduction of competitive socially-based production, without the use of excessive enforcement mechanisms labor, intellectual, financial and natural resources of the country and ensure the state of investment security. Analysis of scientific research. It is significant that public procurement has been the subject of scientific research by experts in commercial law: D.V. Zadikhaylo, V.K. Mamutov, O.P. Podserkovniy, V.A. Ustimenko, V.S. Shcherbinа, etc. The purpose of this scientific article is to identify the key problems of the formation of the legislative mechanism for the creation and state support of the legal investment order, which should ensure the functioning of the investment market and ensure the state of investment security. Article’s main body. The concept of national investment security, which is part of the national economic security of the country as a whole, is to systematically prevent the threat of a critical shortage of investment resources through the creation and state support of an appropriate legal investment order. The lack of a clear and systematic definition in the legislation of Ukraine of the legal mechanism of state regulation of economic relations, including investment, is a disadvantage, which frankly reduces the state’s ability to effectively influence economic processes and, consequently, its ability to fulfill its functional responsibilities in the sphere of economy. The investment component is a special subsystem of economic security that creates prerequisites for the best use of socio-economic relations in the development and scientific and technical restoration of productive forces of society through active investment activity. In studying the structure of the investment component we propose to take into account: inclusion of the investment component in the system of economic security of Ukraine; differentiation of the investment component by different levels of economy (country, region, industry, enterprise); the property of synergism, that is, the investment component of the economic security of the country is not a mere set of investment components of the economic security of regions and enterprises; formation of an investment component under the influence of many objective factors; the occurrence of various risks as a result of appropriate conditions. Conclusions and prospects for development. That’s why there is a need to develop and substantiate a system of initial concepts related to the economic and legal support of the implementation of the investment policy of the state: the investment market, the investment policy of the state, the legal investment policy of the state, the legislative investment policy of the state, the mechanism of formation of the legal investment policy, investment order and national investment security, etc.

Decentralization of public administration of national economy led to strengthening of the role of regional authorities in economic processes regulation. Distinctions in social and economic development of each region dictate need of formation of the balanced regional investment policy. The article examines the relevant issues related to the investment projects, the creation of investment programs and to carrying out the investment policy on the municipal and regional levels. Any municipality has to solve a lot of problems concerning a decent level of economic and social development of the area and the life standard of their residents. In conditions of the constant shortage of financial resources needed to solve the objectives, the investment policy becomes the major tool. Its main aim is not only to attract extra resources but also to distribute them properly. It requires both some certain legal conditions which allow correct evaluation of the social and economic situation in the municipalities, investment climate, conditions for the investment activities infrastructure development and the properly developed business, investment and corporate culture of the population.For most of the Russian territories the problem of attracting investments into the real production sector remains urgent. The solution of this problem requires rational approach to the determination and selection of the most appropriate investment directions and the evaluation of the perspective investment projects development – suggestions and activities aimed at the achievement of the particular economic, social, ecological and other objectives requiring capital funds.The relevance of the examined problem leads to another important issue connected with the training of a highly skilled personnel capable of giving proper evaluation of the political situation in the country, specific features of tax policy, microeconomic indexes of the certain area and other factors essential for the investment activity.

The COVID-19 pandemic interrupted many trends that had developed before it and again updated the issue of modernizing the Russian economy, restarting the mechanisms of economic growth and sustainable socio-economic development. The key to resolving these issues is to increase the investment activity of the business. The investment climate is one of the key characteristics that testify to the freedom of entrepreneurial activity, the ease of opening and conducting business, the quality of regulatory procedures in the economy, the effectiveness of business entities, and the provision of equal opportunities for the development of the private sector. A favorable investment climate reveals the potential for the development of private companies. The article considers the system of state procedures in the field of improving the national investment climate, gives a brief description of the main tools and projects to improve the investment climate, analyses the changes in the main target indicators of investment attractiveness of the Russian Federation.
