Indonesia is the biggest archipelago country in the world, the government has tried to prosper the people by issuing policies on regional autonomy. Regional autonomy in its development is widespread in all fields, one of them in education. Autonomy Education gained much support among the people, thus giving birth to Decentralization of Education, namely to give up government responsibility according to the needs and capabilities of each region. The effort has been regulated in Law Number 20 Year 2003 on National Education System supported by Government Regulation no. 55 of 2007. However, these efforts have not been fully realized, so that sometimes cause gap and prolonged criticism. Therefore we as a policy-bearer must prioritize the principle good governance in Decentralization of Education. The religious and religious education policies contained in Government Regulation No. 55 of 2007 are intended to help realize the goals of education in Indonesia, giving the right of autonomy in the form of decentralization of education to each school in each region to manage the institution. If the school is religious based, it is given the freedom to manage according to the teachings of the religion. But to realize this policy requires strong observers and willing to act, the principle of autonomy, flexibility, participatory and initiative can be used as a basis in realizing these goals as a whole.

Abstrak Penyelenggaraan pemerintahan diperlukan sebuah jalannya manajemen pemerintahan yang maksimal guna dicapainya penyelenggaraan pemerintahan yang baik (good governance) untuk mewujudkan kesejahteraan masyarakat dan merupakan tuntutan konstitusi pada Pembukaan Undang-Undang Dasar 1945 Alenia keempat. Pasal 31 Undang-Undang Dasar 1945 mengamatkan bahwa Pendidikan merupakan hak setiap warganegara dan pemerintah dan pemerintah daerah menjamin terselenggaranya sistem pendidikan nasional sesuai Undang-Undang Nomor 20 Tahun 2003. Penelitian ini bertujuan untuk menguji dan menganalis pengaruh implementasi kebijakan pengawasan, kompetensi aparatur, dan budaya organisasi terhadap kinerja pengawasan bidang pendidikan dasar. Metode yang digunakan dalam penelitian ini adalah kuantitatif dengan kuesioner terbuka dan tertutup. Hasil penelitian ini menunjukkan bahwa ada hubungan yang positif dan signifikan antara implementasi kebijakan pengawasan, kompetensi aparatur dan budaya birokrasi terhadap kinerja pengawasan bidang pendidikan dasar baik secara parsial maupun secara simultan. Kata Kunci: Pengawasan, Kompetensi Aparatur, Budaya Organiasi, Kinerja Pengawasan. Abstract The administration of government requires a way of maximizing government management in order to achieve good governance in order to realize the welfare of the people and constitute demands of the constitution at the Preamble of the fourth Alenia 1945 Constitution. Article 31 of the 1945 Constitution states that Education is the right of every citizen and the government and regional government guarantees the implementation of the national education system in accordance with Law Number 20 of 2003. This research aims to examine and analyze the effect of the implementation of supervisory policies, apparatus competencies, and culture organization of supervision performance in the field of basic education. The method used in this research is quantitative with open and closed questionnaires. The results of this study indicate that the causality relationship partially or simultaneously between the Implementation of Supervision Policy, Apparatus Competency and Bureaucratic Culture to the Supervision Performance of the Basic Education Sector is entirely positive and significant. Studies on religious education teacher’s competences in Aceh could not be separated from studies on state’s intervention toward education. State hegemony occurs in the form of regulation formalization which regulates efforts for improving qualification and competence of teachers. The research showed that the presence of Act No. 14, 2005 and the Government Regulation No. 74, 2008 had been used as legal reference to encourage the improvement of Aceh religious education teachers’ qualification and competence. This is a qualitative study in which triangulation in data collection was used. The data was then collected through documentations, observations, and deep interviews. This work emphasizes that improving teachers’ competences in Islamic education system in Aceh was in accordance to and did not contradict with national education system and moreover strengthen the content of Act No. 14, 1005 and Government Regulation No. 74, 2008. Qualification and competence of religious education teachers in Aceh underwent improvement better than previous term. However, teachers experienced that socialization process and implementation of regulation has yet to receive upmost attention. The study also suggests that religious education teachers’ qualifications and competences will significantly contribute to the development of religious education quality, thus Islamic education transforms intently in national and state relations order.

<p>Abstract<br />Government has the legal responsibilities in the implementation of national education system to carry out the mandate set out in Section 31 of the Constitution of the Republic of Indonesia 1945 related to the intellectual life of the nation. This is confirmed and applied by The Indonesian Government Regulation 47/2008 regarding compulsory education and Indonesian Government Regulations 48/2008 related to the funding education of elementary school (SD) to high school (SMP) free made by the government through the School Operational Assistance (BOS) to make the education system based on the national human values and justice according to Pancasila ad realize the human rights set out in the Constitution Indonesian 1945 Article28 c paragraph(1) and Article 28d paragraph (3) stated that every citizen has the right to obtain equal opportunities in government. The free primary education can not be realized in a fair and equitable for the presence of education autonomy, every area is not the same policies and management education in many schools that are not transparent even still many schools to collect funds for the reason given by the government budget for operational costs is not enough.In addition, the9-year basic education which should be free up to secondary education (high school) born by either the state of infrastructure, teachers’ salaries, electricity, telephone, computer, books, stationery without distinguishing between public and private schools.<br /><em>Keywords: national education, justice, humanity,Indonesian contitution 1945</em></p><p>Abstrak<br />Pemerintah memiliki tanggung jawab hukum dalam implementasi sistem pendidikan nasional sebagai amanah (mandat) dari Pasal 31 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yakni hak mendapatkan pendidikan yang layak. Mandat tersebut diturunkan dalam Peraturan Pemerintah Nomor 47 Tahun 2008 tentang wajib belajar dan Peraturan Pemerintah Nomor 48/2008 tentang Pendanaan Pendidikan dari Sekolah Dasar ( SD ) hingga Sekolah Menengah ( SMP ) yang gratis ditanggung oleh pemerintah melalui Bantuan Operasional Sekolah ( BOS ) dalam rangka untuk menciptakan sistem pendidikan berdasarkan pada nilai-nilai kemanusiaan nasional dan keadilan dalam Pancasila, serta dalam rangka penegakan Hak Asasi Manusia berdasar Pasal 28C ayat (1) dan Pasal 28D ayat (3) dimana setiap warga negara memiliki kesempatan yang sama dalam pemerintahan. Pendidikan dasar gratis tidak dapat dicapai secara adil dan merata karena setiap daerah miliki kebijakan dan manajemen pendidikan yang berbeda, adanya ketidaktransparanan sekolah dalam mengelola dana, dan faktor alasan ketidakcukupan dana yang diberikan oleh pemerintah kepada sekolah. Pendidikan Dasar 9 (sembilan tahun) seharusnya gratis sampai pada Pendidikan Menengah Pertama (SMP) baik dalam hal infrastruktur pendidikan, honor guru, biaya listrik, telepon, pengadaan komputer, buku-buku tanpa ada pembedaan sekolah publik dan sekolah swasta.<br /><em>Kata kunci: Pendidikan Nasional, Keadilan, Kemanusiaan, UUD 1945</em></p>

Normative research concerning Configuring the Replacement of Regulations on the Registration of Land Rights by addressing the issue of ideology and Raison de Etre's rule of law gave the conclusion, that the Registration of Mastering Rights by the State should respect and recognize individual rights to land. From the analysis and discussion that discusses, conclusions can be drawn, that is the Right to Mastery over the Land held by the Government agrees if it has the power to connect the economic sector. More details can be found: Registration of land rights cannot be agreed with political policies on land use. In the implementation of PP 10 of 1961 the government seized people's land rights, then redistributed the people who needed it as agricultural land (in addition, this program of land redistribution was communicated to the government as an asset with public reasons; it found different political attitudes when implement PP 24 of 1997, namely: by regulating the fundamentals of a new government-finance and vice versa with the Pancasila Philosophy as a principle of Efficiency-Justice Actually it was implemented at the beginning of Repelita I by enacting Law No. 1 of 1967 (Foreign Investment) A comparable increase is needed with the people's prosperity which is relatively difficult to achieve (PP 10 of 1961) which seeks to increase government original income (PAD).

Abstrak: Pemerintah Desa yang ada sekarang ini adalah Pemerintahan Desa yang sesuai dengan jiwa UUD Negara RJ 1945 yang selanjutnya disingkat (UUDNRI Tahun 1945) yaitu memperhatikan dan menghormati hak asal usul yang bersifat istimewa. Oleh karenanya mempunyai keharusan bahwa dalam melaksanakan pembangunan disegala bidang guna memcapai hasil yang optimal, mau tidak mau harus mengikutsertakan masyarakatyang ada di desa, pemerintah desa sebagai penyelenggara pemerintahan terendah yang langsung berhadapan dengan masyarakat sebagai pelaksana pembangunan agar semakin mampu menggerakkan masyarakat untuk berpartisipasi dalam pembangunan.Metode yang digunakan dalam penelitian ini adalah penelitian empiris dengan metode pendekatan perundang-undangan (StatuteApproach), pendekatan konseptual (ConceptualApproach) dan pendekatan lapangan. Pelaksanaan desentralisasi dalam negara kesatuan berarti memberikan hak untuk mengatur dan mengurus kepentingan dan aspirasi masyarakat setempat pembentukan daerah otonom dan penyerahan kewenangan secara hukum dari pemerintah pusat ke pemerintah daerah untuk mengatur, mengurus dan/atau bagian dari urusan pemerintahan tertentu. Untuk itu daerah otonom diberikan kewenangan untuk membentuk peraturan daerah. Penelitian ini merupakan penelitian hukum normatif yang membahas tentang urgensi pembentukan peraturan daerah pada era otonomi daerah ialah sebagai rule dari pelaksanaan otonomi daerah, utamanya menyangkut urusan-urusan pemerintahan sebagaimana dimaksud pada Undang-Undang Pemerintahan Daerah dan Peraturan Pemerintah Nomor 38 Tahun Tahun 2007 tentang Pembagian Urusan Pemerintahan antara Pemerintah, Pemerintahan daerah Provinsi, dan Pemerintahan Daerah Kabupaten/Kota. URGENCE FOR ESTABLISHING REGIONAL REGULATIONS IN THE ERA REGIONAL AUTONOMY The implementation of decentralization in a unitary state means giving the right to regulate and manage the interests and aspirations of the local community, the formation of an autonomous region and the delegation of legal authority from the central government to the regional government to regulate, manage and/or part of certain government affairs. For this reason, autonomous regions are given the authority to form regional regulations. This research is a normative legal research that discusses the urgency of the formation of regional regulations in the era of regional autonomy, namely as a rule for the implementation of regional autonomy, especially regarding government affairs as referred to in the Regional Government Law and Government Regulation Number 38 of 2007 concerning Division of Affairs. Government between the Government, Provincial Government, and Regency/City Regional Government. And the ideal concept of regional regulations in the era of regional autonomy was returned to the formal and material principles of the formation of laws and regulations as contained in Law Number 12 of 2011 concerning the Establishment of Legislations.

Madrasah Diniyah Takmiliyah (MDT) is a non-formal education which is the solution of the lack of hours of religious study at school. The Historically, this solution is to accommodate the numerous demands of various elements of society that have been raised through; demonstrations, rallies, suggestions, and even pressure on the government. Madrasah education Diniyah Takmiliyah (MDT) in the history of education entirely an initiative of the Muslim community. The Unit MDT Education with a strong legal umbrella among such as;the provisions in the Act No. 20 of 2003 on National Education system, Government Regulation No. 55 of 2007 on Religious Education and Religious Education, Government Regulation No. 48 of 2008 concerning education funding , as well as the Minister of Religious Affairs regulation No. 13 of 2014 concerning Islamic Religious Education. In Kabupaten Rejang Lebong MDT are 15 institutions. Where the community's response to MDT is perceived as lacking, the management of MDT management is very simple and even tends to be traditional, the holding factor of MDT is strong enough and the factor of inhibiting the low awareness of the community and the difficulty of getting the fund, and the solution for the society to address the lack of religious learning hours at the majority school of apathetic parents religious learning outcomes at school, a small part of sending their children to the MDT, and a few more parents teaching their own children at home. This research is a field research associated with various existing literatures, the aims to contribute to the public as general, STAIN Curup, and Local Government Rejang Lebong Regency.

This article aims to describe the National Education and Islamic Education Policy established by the government from the time of President Habibie in 1998 to President Jokowi in 2014 in the reform era. In detail, this text wants to reveal several things, namely: First, the meaning of reform; Second, what are the forms of national education policies and Islamic education in the reform era during the era of President Habibie, President Abdurrahman Wahid, President Megawati, President Susilo Bambang Yudhoyono to President Joko Widodo Volume I. This research method uses literature study or literacy. The results of this literature study show broadly that; During the Habibie era, the most striking policy was educational autonomy, where there was decentralization. Some education policies have begun to be handled by the regions, such as teacher regulation, teacher payroll, some local content curricula, all handled by the regions. After that, during the time of President Megawati, Islamic Religious Education became a compulsory subject in public universities, due to the new National Education System in 2003. During the time of President Susilo Bambang Yudhoyono, the welfare of teachers and lecturers began to be taken into account by providing certification and other honorary benefits, in addition to optimizing the 20 percent budget for education. Meanwhile, during President Jokowi's Volume I, a striking policy was the development of the latest curriculum, namely the 2013 Curriculum (K-13).

The method used in this research is quantitative with open and closed questionnaires. The results of this study indicate that the causality relationship partially or simultaneously between the Implementation of Supervision Policy, Apparatus Competency, and Bureaucratic Culture to the Supervision Performance of the Basic Education Sector is entirely "positive and significant." Thus, the four hypotheses of this research are "accepted." Then, the results of the distribution of scores indicate that all dimensions of the variable values ​​are higher than 90% and can be categorized as "Good." Based on the two analyzes, it can be stated that the Supervision Performance of the Basic Education Field held by the City of Depok, West Java Province is "Good." Conclusion This study shows that the Performance of Oversight in Basic Education goes well. This is evidenced by all four accepted hypotheses, and a positive and significant causality relationship. This was obtained by models and concepts in the field of education supervision. With the findings of the Actual Oversight Model, it is recommended for the government that this model can be used as input for the supervision policy formulation, Work Standards Criteria (KSK), and Education Supervision Performance Indicators (IKPP). According to the law of national education system number 20 year 2003, religious education of madrasah diniyah is a part of national educational system. consequently, madrasah diniyah is not only fully as the responsibility of moslem community to establish, maintain, and develop, but it also a kind of the government’s responsibility and duty. historically, in the early existence, madrasah diniyah comes from-by and for the people. but, now, the government is legally demanded to manage madrasah diniyah in a parallel with the community’s aspiration and needs. this article tries to elaborate how people respond madrasah diniyah as the formal religious educational institution and how is the strategy for developing madrasah diniyah in line with the implementation of national education system law, number 20 year 2003. by taking case of madrasah diniyah al fatah, one of madrasah diniyah in demak, this article comes to conclusion that there are any situational responses to the issue of institutionalization of madrasah diniyah.
