The Constitution mandates that "Governors, Regents, and Mayors respectively as heads of provincial, regency, and municipal governments are elected democratically". In other words, the regional head is actually mandated to form a regional government as a democratic self-governing unit. The research method used is normative legal research and the types of data used are secondary data, consisting of primary legal material (various forms of legislation), secondary legal materials (data collection of scholarly work and the results research related to local election and anti-fraud systems), and tertiary legal materials (materials providing information on primary legal materials and secondary legal materials, such as dictionaries and encyclopedias). Data analysis technique used is technical qualitative analysis. In running the government mechanism, the regional head should be able to implement anti-fraud system. Anti-Fraud system is a system that monitors regulations or other mechanisms that produce some forms of report. In this case, the system offered in fact can have implications on anti fraud related to the position of regional head as a role model, that is, by bringing a great personality and optimization of thinking and action.

Abstract The Corruption Eradication Commission (KPK) has become a super institution with extraordinary restraint. With the new Corruption Eradication Commission Law, some people think that the KPK has been weakened, which has been an institution loved by the public, even though the government denies that the new KPK Law has not weakened the KPK at all. One of the new things is the formation of the KPK Supervisory Body, one of which has the authority to grant permission to the KPK to conduct searches, which in fact has an impact on the problems at hand. The method used is a normative legal research method. The approach used is a statutory approach. The data used are secondary data obtained by literature study and primary data obtained by conducting interviews with related party respondents. There has been a shift in the meaning of Barriers to Justice as stated in Article 221 of the Criminal Code with Article 221 of the Corruption Eradication Law where Article 221 of the Criminal Code views Obstruction of Justice as a material offense while for Article 21 of the Corruption Eradication Law, Judicial Obstruction is seen as a formal offense. On the other hand, the actions of the Supervisory Board in granting licenses for searches, confiscation, etc. are not automatically considered a disturbance of justice unless it can be proven that the elements of wrongdoing committed by the Supervisory Board can be proven.   Keywords : Corruption, Authority, Obstruction Of Justice.   ABSTRAK Komisi Pemberantasan Korupsi (KPK) telah menjadi lembaga super dengan pengekangan yang luar biasa. Dengan adanya Undang-Undang KPK yang baru, sebagian orang menilai telah terjadi pelemahan KPK yang selama ini menjadi institusi yang dicintai masyarakat, padahal pemerintah membantah bahwa Undang-Undang KPK yang baru sama sekali tidak melemahkan KPK. Salah satu hal baru yaitu adalah pembentukan Badan Pengawas KPK yang salah satunya memiliki kewenangan untuk memberikan izin kepada KPK untuk melakukan penggeledahan, yang ternyata berdampak pada permasalahan yang sedang dihadapi. Metode yang digunakan adalah metode penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan statutori. Data yang digunakan adalah data sekunder yang diperoleh dengan studi pustaka dan data primer diperoleh dengan melakukan wawancara dengan responden pihak terkait. Telah terjadi pergeseran makna Hambatan Keadilan sebagaimana tertuang dalam Pasal 221 KUHP dengan Pasal 221 Undang-Undang Pemberantasan Korupsi dimana Pasal 221 KUHP memandang Obstruksi Keadilan sebagai delik material sedangkan untuk Pasal 21 Undang-Undang Pemberantasan Korupsi, Obstruksi Peradilan dipandang sebagai delik formal. Di sisi lain, tindakan Dewan Pengawas dalam pemberian izin penggeledahan, penyitaan, dan lain-lain tidak serta merta dianggap sebagai gangguan keadilan kecuali dapat dibuktikan bahwa unsur-unsur perbuatan salah yang dilakukan Dewan Pengawas dapat dibuktikan. Kata Kunci: Korupsi, Otoritas, Obstruksi Keadilan.

Regional finance is the most important thing and becomes the pulse in carrying out all regional government affairs. Regulation in the financial sector is important because many regional heads carry out transportation for corruption because they are wrong in managing and making policies that have no legal basis. In this paper, we try to examine problems such as the changing room for discretion and the discretionary limitation in managing regional finances. This type of research used in this paper is normative legal research, that is research conducted or based on written regulations and other legal materials related to secondary data. In this legal research is used to discuss: statute approach, comparative approach, and conceptual approach. The data analysis technique in writing uses data management in essence the activities to make a system of written legal materials. The results of this paper describe how you should use discretion. This concept of discretion comes in the middle of a weak system of registration of invitations and legal vacuum. In essence, government officials take discretionary measures if they ask for various terms and discussion spaces from the discretion itself that has been regulated in government administration laws. These restrictions on the use of discretion indicate that not everything can be taken as a discretionary measure. Using ermessen freis or discretion basically covers the use of ermessen freis cannot replace with the prevailing legal system (positive legal rules) and the use of ermessen freis is only in the public interest.

Since the enactment of Law No. 30 of 2014 concerning Government Administration, there have been many dynamics of changes in judicial practice in state administrative courts, especially in relation to the object of dispute. One of them is regarding Decisions with Potential Legal Consequences as regulated in Article 87 of the Government Administration Law. The problems that arise are related to the accountability of officials, and also to the declarative decisions and constitutive decisions that are regulated in Article 54 of the Government Administration Law. In this paper it is found that officials who issue declarative decisions are not necessarily free from administrative responsibility and the validity of their decisions is determined by the validity of constitutive decisions (as decisions that have the potential to have legal consequences) on which the declarative decisions are issued. This paper uses a normative-legal research method, namely using secondary data in the form of primary and secondary sources of law, both applicable laws and related literatures.

The risk from environmental cleaners is very high considering the work they do, where their work is always related to cleaning the garbage that is within the Bali Provincial Forestry and Environment Service. In this regard, the purpose of this study is to reveal the health and safety insurance for cleaners in the Bali provincial forestry office and the government 's legal protection on guaranteeing the implementation of occupational health and safety for cleaners at the Bali Provincial Forestry and Environment Service. This research method is empirical legal research. Primary data is obtained through field research, secondary data is obtained from books, laws and regulations. The legal materials obtained are then classified and combined as well as analyzed systematically and presented descriptively. This study concludes that the regulation regarding health insurance for workers in the Bali Provincial Forestry Service is in accordance with the regulations stipulated by Law no. 13 Year 2003.

AbstractThe granting of autonomy to the regions is intended to provide democratic space and public participation. Legal certainty in the administration of regional government specifically related to taxes is very crucial, especially for economic development, as it affects the investment climate. Any discrepancy between regional and central policies is seen as an obstacle in optimizing investment performance in the regions. The Government has proposed a Bill on General Provisions and Tax Facilities for Strengthening the Economy or also known as the Omnibus Bill on Taxation which regulates, among other things, regional tax and levy. The method used in this study is the type of legal research (normative) and carried out by examining library materials or secondary data in the form of various legal references, including primary, secondary, and tertiary materials. A descriptive technique is used in analyzing legal materials that have been collected. Writer opines that the Omnibus Bill is expected to provide business certainty, in the hope that it can increase investment. However, the discussion of the Omnibus Bill must be carefully done. There has to be a certainty and clarity of the intervention procedures of the central government so that it is carried out in a clear legal corridor.  AbstrakPemberian otonomi kepada daerah dimaksudkan untuk memberikan ruang demokrasi dan partisipasi masyarakat. Kepastian hukum dalam penyelenggaraan pemerintahan daerah merupakan hal yang sangat penting terutama dalam pembangunan di bidang ekonomi karena hal tersebut mempengaruhi iklim investasi. Adanya ketidaksinkronan kebijakan daerah dengan pusat dinilai sebagai hambatan dalam optimalisasi kinerja investasi di daerah. Pemerintah telah mengajukan Rancangan Undang-Undang Ketentuan Umum dan Fasilitas Perpajakan Untuk Penguatan Perekonomian atau RUU Omnibus Perpajakan yang salah satunya mengatur tentang pajak daerah dan retribusi daerah. Metode yang digunakan dalam penelitian ini adalah jenis penelitian hukum (normatif) dan dilakukan dengan menelaah bahan pustaka atau data sekunder berupa berbagai acuan hukum, baik bahan hukum primer, sekunder, maupun tersier. Teknik deskriptif digunakan dalam menganalisis bahan hukum yang telah dikumpulkan. Penulis berpendapat bahwa Omnibus Law Perpajakan dapat memberikan kepastian berusaha sehingga investasi semakin meningkat. Namun demikian, pembahasan RUU Omnibus Law harus dilakukan dengan cermat dan hati-hati. Harus ada kepastian dan kejelasan prosedur intervensi dari pemerintah pusat sehingga pelaksanaannya berada dalam koridor hukum yang jelas.

AbstractBuilding function feasibility certificate is a certificate that is regulated by the regional government except for special function buildings by the government to declare the proper functioning of a building both administratively and technically, before its utilization. The research method used is normative legal research using a practical legal approach. The results of the study indicate that the building-worthy certificate or the term SLF has a legal basis in its arrangement. Pada tahun 2016 Menteri Dalam Negeri membatalkan 3.143 Peraturan Daerah bermasalah. Kemudian pada tahun 2017 Mahkamah Konstitusi mengeluarkan sebuah Putusan yang mencabut kewenangan Menteri Dalam Negeri untuk membatalkan Peraturan Daerah. Akan tetapi masih ada Pemerintah Daerah yang melaksanakan Peraturan Daerah yang dibatalkan oleh Menteri Dalam Negeri sebelum keluarnya Putusan Mahkamah Konstitusi. Penelitian ini bertujuan, untuk menganalisis kekuatan eksekutorial Keputusan Menteri Dalam Negeri yang membatalkan peraturan daerah sebelum Putusan Mahkamah Konstitusi serta untuk menganalisis kedudukan peraturan daerah yang dibatalkan oleh Keputusan Menteri Dalam Negeri yang masih dilaksanakan oleh Pemerintah Daerah setelah Putusan Mahkamah Konstitusi. Metode penelitian yang digunakan adalah penelitian hukum normatif. Sumber data penelitian adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Hasil penelitian menunjukkan bahwa pertama. Menteri Dalam Negeri masih dapat melaksanakan Keputusan untuk membatalkan Peraturan Daerah karena Putusan Mahkamah Konstitusi tidak berlaku surut, namun idealnya yang lebih berhak membatalkan Peraturan Daerah adalah Mahkamah Agung. Kedua, Kedudukan Peraturan Daerah yang dibatalkan oleh Keputusan Menteri Dalam Negeri yang masih dilaksanakan oleh Pemerintah Daerah setelah dikeluarkannya Putusan Mahkamah Konstitusi maka Peraturan Daerah tersebut tidak langsung batal karena ada mekanisme yang harus dilakukan yaitu pencabutan. Selama belum ada pencabutan, maka Peraturan Daerah dimaksud tetap ada tetapi tidak bisa dilaksanakan. Disarankan kepada Pemerintah Pusat agar merevisi Undang-Undang Nomor 23 Tahun 2014 khususnya pasal yang mengatur tentang pembatalan Peraturan Daerah dan apabila mengeluarkan suatu peraturan perundang-undangan harus berpedoman pada hierarki peraturan perundang-undangan yang berlaku saat itu.In 2016 the Minister of Home Affairs canceled 3,143 problematic Regional Regulations. Then in 2017 the Constitutional Court issued a Decision revoking the authority of the Minister of Home Affairs to cancel the Regional Regulation. However, there are still Regional Governments who carry out Regional Regulations that have been canceled by the Minister of Home Affairs before the decision of the Constitutional Court is issued. This study aims to analyze the executorial power of the Decree of the Minister of Home Affairs which overturned regional regulations before the Constitutional Court Decision and to analyze the position of regional regulations which were canceled by the Decree of the Minister of Home Affairs which was still implemented by the Regional Government after the Constitutional Court Decision. The research method used is normative legal research. The source of research data is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that : first, The Minister of Home Affairs can still implement the Decision to cancel Regional Regulations because the Constitutional Court Decision does not apply retroactively, but ideally the more entitled to cancel Regional Regulations is the Supreme Court. Second, the position of the Regional Regulation which was canceled by the Decree of the Minister of Home Affairs which is still carried out by the Regional Government after the issuance of the Constitutional Court Decision, the Regional Regulation is not immediately canceled because there is a mechanism that must be done, namely revocation. As long as there has been no revocation, then the Regional Regulation in question still exists but cannot be implemented. It is recommended to the Central Government to revise Act. No. 23 Year 2014 specifically the articles governing the cancellation of Regional Regulations and when issuing a law and regulation must be guided by the hierarchy of legislation in force at that time.

The Drive Thru program is an innovation developed by the Population and Civil Registration Office of Blitar Regency in the e-KTP service, which has the aim of improving the quality of e-KTP services in Blitar Regency and as a breakthrough in population administration services during the Covid-19 pandemic. This study aims to determine the mechanism of the Drive Thru Program e-KTP service by the Department of Population and Civil Registration of Blitar Regency. The research method used is descriptive qualitative research method. Sources of data in this study are primary and secondary data sources. The data analysis technique used is a theoretical taxonomy assessment technique, where the researcher provides an overview of the fact assessment on each indicator of the concept under study which is detailed theoretically. For data collection techniques include interviews, observation and documentation. The results showed that of the 5 (five) dimensions that the researcher used in the study, only one dimension that showed good performance was contained in the Empathy dimension. Meanwhile, in the other 4 dimensions of performance, many obstacles occur, especially in indicators of physical appearance, clarity of procedures, response to complaints, and guarantee of punctuality. Most of these obstacles are related to infrastructure which is closely related to budget constraints. Efforts made to overcome these obstacles are still in the planning stage by increasing the budget allocation to add mobile service cars, repair service counters, increase the number of digital comment boxes, improve internet networks, and create standard operating procedures (SOPs). It is recommended to the Government to immediately make regulations related to the Drive Thru Program e-KTP Service in the regions and to improve communication between regional apparatus organizations in the regions.Keywords: e-KTP, Drive Thru, Service, Blitar Regency

Batam City, which is one of the cities whose rules are slightly different from other cities inIndonesia, is about administrative procedures for land ownership registration, but for permits toallocate land, it is still held by the Batam Entrepreneurs Agency, abbreviated as BP Batam. InBatam City, the provision of KSB is actually given to residents due to various things. To get KSBthe community needs to fulfill the procedure first. This is what makes the writer interested intaking the title of Juridical Review of Ready-to-Build Courts in Batam City. The purpose of thispaper is to find out that the Ready-to-Build plot can be owned by land users (general public) inBatam City. The legal research method used in this study is normative legal research. Normativeresearch in it is also permitted to use scientific analysis of other sciences (including empiricalscience) to explain the legal facts examined by scientific work and juridical thinking (dankenjuridical). Retrieval Data used is by using secondary data, where documentation and recordingtechniques are through the file system. The Research Result for Ready-to-Build Plots in BatamCity may be owned by individuals, but the provision of KSB can be given to the community.People who get it while the people who get the plot still have not built a plot even though theprovisions in the temporary agreement agreed upon by the applicant with the BatamEntrepreneurial Agency the applicant must immediately build a building on the land.

<p class="Abstrak">Sistem Informasi Geografi (SIG) dengan layanan informasi pengelolaan lahan yang cocok sehingga lahan akan bernilai ekonomi, oleh karenanya penelitian ini membahas pemetaan dan pengkajian potensi sumber daya lahan pesisir dalam mendukung usaha budidaya, pariwisata, konservasi, dan daerah tangkapan ikan yang berkelanjutan. Metode penelitian secara deskriptif memakai pendekatan survei untuk pengamatan wilayah penelitian dan pengumpulan data sekunder serta pendekatan analisis spasial untuk parameter dan kriteria kesesuaian lahan. Teknik pengolahan dan analisis data ini menggunakan <em>software</em> SIG yakni <em>ArcGIS</em> 10.1 dengan model <em>skorin</em>g dan <em>overlay</em>. Hasil penelitian dengan studi kasus Kepulauan Padaido ini dapat disimpulkan bahwa saat ini dengan adanya SIG yang dibangun, Pemerintah Daerah Biak Numfor sudah dapat mengolah lahan pesisir untuk dimanfaatkan sesuai dengan potensi lahan yang seharusnya, seperti potensi lahan untuk usaha budidaya rumput laut seluas 13.269,41 ha atau 94%, untuk budidaya teripang seluas 7.069,91 ha atau 83%, sebagai aktifitas pariwisata pesisir seluas 7.778,45 ha atau 86%, sebagai kegiatan konservasi seluas 2.957,54 ha atau 163%, untuk daerah tangkapan ikan karang seluas 2.078,92 ha atau 80%, dan sebagai daerah tangkapan ikan pelagis 1.585,61 ha atau 87%.</p><p class="Abstrak"> </p><p class="Abstrak"><em><strong>Abstract</strong></em></p><p><em>Geographic Information System (GIS) with suitable land management information services so that the land will be of economic value, therefore this study discusses the mapping and assessment of the potential of coastal land resources in supporting sustainable aquaculture, tourism, conservation, and fishing grounds. The descriptive research method uses a survey approach for observation of research areas and secondary data collection as well as a spatial analysis approach for land suitability parameters and criteria. This data processing and analysis technique uses GIS software namely ArcGIS 10.1 with a scoring and overlay model. The results of the study with the Padaido Islands case study can be concluded that currently with the GIS being built, the Regional Government of Biak Numfor has been able to cultivate coastal land to be used according to the potential of the land that should be, such as the potential land for seaweed cultivation business area of 13,269.41 ha or 94%, for sea cucumber cultivation covering 7,069.91 ha or 83%, as coastal tourism activities covering 7,778.45 ha or 86%, as conservation activities covering 2,957.54 ha or 163%, for reef catchments covering 2,078.92 ha or 80%, and as a pelagic catchment area 1,585.61 ha or 87%.</em><em></em></p><p> </p>
