Enforcement of the Act No. 11 of 2012 on Juvenile Justice System provides protection of the rights of juvenile who commit criminal acts use the diversion approach to realize the concept of Restorative Justice. To figure out the implementation of the Act, it is necessary to study with the socio-legal research method in the Police District, the State Attorney and the District Court at Malang. The results of these studies found that the application of diversion has been effective although there are still some obstacles. One of the toughest obstacles to implementing a diversion to fit is the unavailability of places to educate, nurture and put the brat as stated in the law. The study also found that in Malang at least there are some organizations / institutions in applying the diversion of government supporters, among others: BAPAS and P2TP2A.

Diversion Efforts can only be carried out in cases of Children in conflict with laws that threaten their crimes under 7 (seven) years and do not constitute a repeat of a criminal act. In contrast, the juvenile justice system requires deprivation of liberty principle and punishment related to the latest findings. This research uses the normative legal research method, using the law method, research method, and comparative method. From this research, we know that diversion in the juvenile justice system cannot be done in every child's case; it can only be done in the case of children who meet the requirements of a case protected under 7 (seven) and not a repeat of follow up. Not all cases of children go through a process of diversion. Children who have a conflict with the law are directly threatened with criminal punishment. However, there has been a reconciliation between the perpetrators and the victims, so that the deprivation of liberty principle, and criminalization, is the latest result, which is not successful. Therefore, diversion shall not be used again to protect children.Keywords: Diversion, Children, Liberty

Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak menyatakan anak yang berkonflik dengan hukum selanjutnya disebut anak yang telah berumur 12 (dua belas) tahun, tetapi belum berumur 18 (delapan belas) tahun yang diduga melakukan tindak pidana. Maka dilihat dari usia anak tersebut haruslah mendapatkan perlakuan yang khusus terhadap anak yang melakukan tidak pidana. Sebagaimana dalamUndang-Undang Sistem Peradilan Pidana Anak disebutkan bahwa hakim wajib mengupayakan diversi paling lama 7 (tujuh) hari setelah ditetapkan oleh ketua pengadilan negeri sebagai hakim.Padadasarnya konsep pertanggungjawaban dari sebuah perbuatan pidana adalah ditanggung oleh pelakunya tanpa membebani pihak lain yang turut bertanggungjawab, namun dalam hal penyelesaian tindak pidana harus melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait, sehingga terdapat perluasan konsep pertanggungjawaban pidana. Penelitian ini bertujuan untuk menjelaskan dan mengkaji sejauh mana orang tua dapat dimintai pertanggungjawaban terhadap tindak pidana yang dilakukan oleh anak dan konsep pertanggungjawaban pidana terhadap orang tua dalam tindak pidana yang dilakukan oleh anak dan apakah ada hubungan antara diversi dengan pertanggungjawaban terhadap orang tua. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan penelitian hukum kepustakaan.The Act Number 11, 2012 on the Juvenile Justice System state that a child who is in conflictwith the law hereinafter called as a child who ages 12 (twelve) years old, but not yet 18 (eightteen) year of age alleged to have committed a crime. Therefore, it is seen from the age of the child it should be treated specifically for youth offenders, it can be seen from the obligation for the judge to conduct a diversion for the child’s case. As mention in the The Act on Juvenile Justice System that the judge is obliged to conduct a diversion for a maximum of 7 (seven) days after being stipulated by the head of the district court sitting as a judge. Basically, the concept of criminal liability from the criminal act is borne by its perpetrator without burdening the other party responsible, but in the case of the settlement of the crime must involve the perpetrator, the victim, the family of the perpetrator or victim, and other related parties, and hence there is an extension of the concept of criminal liability. This research aims to explain and explore to which extent parents could be held liable for crimes committed by juvenile and the concept of criminal liability of parents towards crimes committed by their childrenand whether there is a relationship between diversion with responsibility to parents.This is doctrinal legal research or library research.

Children are a trust and gift from God who has dignity and dignity as a whole human being. In order to safeguard his dignity, the child is entitled to special protection, especially legal protection in the justice system. In realizing the maximum child protection, requires a policy that supports the realization of maximum protection, with the issuance of Law Number 11 Year 2012, concerning the Juvenile Justice System. This is done because Indonesia as a State Party in the Convection of children's rights governing the principle of legal protection against children have an obligation to provide special protection for children in conflict with the law. In Article 7 Paragraphs 1 and 2 of the Law on the Juvenile Justice System, article 7 (1) At the level of investigation, prosecution and examination of cases of children in the district court must be endeavored Diversion, (2) Diversion as meant in paragraph (1) is carried out in the case of acts crimes committed: (a) are threatened with imprisonment of less than 7 (seven) years and (b) do not constitute repeat offenses. This study intended to examine and analyze the form of legal construction of the Juvenile Justice System specifically implementing diversion for victims with demands of less than 7 years. The research method uses a statutory approach, a case approach, and a comparative approach to the number of cases by reviewing and analyzing legislation, journals, cases, data and direct interviews. According to the results of the study, it is found that the implementation of legal penal system of the Juvenile Justice System (1) child cases is increasing, (2) diversion is carried out since the investigation up to the court, and there are still many that are done at a higher level, (3) have an understanding, that diversion must be sought, has a meaning that can be done at various levels so that diversion occurs at several levels, and often occurs at the Court level.

Child imprisonment turns out to not be able to prosper children and interfere with children's growth and development. Children's rights are recognized globally through the Convention on the Rights of the Child through Presidential Decree Number 36 of 1990 concerning Ratification of the Convention on the Rights of the Chilid (Convention on the Rights of the Child). The research method used is normative juridical using a statutory approach and a case approach. How is Bapas' war in resolving children in conflict with the law, through a diversified approach at the stage of investigation, prosecution and examination in court, as well as whether the obstacles in solving children's cases conflict with the law through diversion at the stage of investigation, prosecution and trial in court. The role of Bapas Class II A Serang in Resolving Children in Conflict with the Law through Diversion at the stage of Investigation, Prosecution and Court Examination, is to make Community Research Reports and supervise children in conflict with the law.

The protection of children becomes the responsibility of all parties, namely family, community and government. Indonesia through the Act No. 11 Year 2012 on Juvenile Justice System provides protection namely diversion which should be emphasized as a penal mediation which can be used to solve a juvenile cases. There are two main problems; firstly, how is the penal mediation process in the juvenile justice system; secondly, how is the implementation of the penal mediation which is based on Pancasila? The research method used in this paper was normative juridical research method. The approach used in this study is socio legal approach and the data analysis method used a qualitative analysis. The results that in penal mediation in the juvenile cases namely diversion  aims to achieve restorative justice. The diversion process is very important and must involve the parties in order the mediation be effective. This process is what distinguishes from the treatments of juvenile’s cases before Act No. 11 Year 2012.  In the previous times, penal mediation was not acknowledged so law enforcement procedure is always ends at Juvenile court. Penal mediation in juvenile justice system must be based on Pancasila as the philosophical foundation of Indonesia, which means diversion process must be in accordance with the values of Pancasila, which are are religious moral values; humanistic values; nationalistic values, democratic, and social justice.

The future of the children will determine the future of the nation. The increasing problem of juvenile delinquency in this globalization and information technology era, requires the state to give more attention to the child's future. Application of the criminal justice system for children in Indonesia is as stipulated in Law Number 3 of 1997 potentially detrimental to the child's interests. In practice, the judicial system had many problems, among them is a violation of the rights of children, such as: physical and psychological violence, as well as deprivation of the right to education and welfare. It happened because the juvenile justice system is against to national and international regulations on the protection of children’s rights. Besides that, theory of punishment for the juvenile delinquency still refers to the concept of retribution for the crimes. This concept is not very useful for the development of the child, so the concept need to be repaired with the concept of restorative justice. With this concept, the criminal justice system for the juvenile delinquency, leads to the restoration of the state and the settlement pattern, involving the perpetrator, the victim, their families and engage with the community. This is done with consideration for the protection of children against the law. Children are the future of  mankind, our nation and country. Based on this strategic position, the state and the law must provide special protection for children. However, in finding themselves,in some occasions children can stumble and make mistakes, which unfortunately can be in the form of run-ins with the law. Act Number 11 of Year 2012 regarding the Criminal Justice System for Juvenile presented the concept of diversion, which is an approach to resolve juvenile cases in order to achieve restorative justice. Diversion is the of process diverting child cases out of the usual system of criminal justice. However, diversion cannot be used to resolve all and every child cases. In a case of drug abuse, as seen in the Verdict of Surabaya District Court Number 111/Pid.Sus-Anak/2014/PN.Sby, diversion is attempted to resolve the case. But in two similar cases, namely in the Verdict of West Jakarta District Court Number 47/Pid.Sus-Anak/2017/PN.Jkt.Brt and Number 53/Pid.Sus-Anak/2017/PN.Jkt.Brt, diversion was not attempted resolve the children in those cases and as stated on the verdict, those children were convicted. Why is there a difference in the resolution of the court against children who committed drug abuse between the Verdict of Surabaya District Court Number 111/Pid.Sus-Anak/2014/PN.Sby, the Verdict of West Jakarta District Court Number 47/Pid.Sus-Anak/2017/PN.Jkt.Brt and the Verdict of West Jakarta District Court Number 53/Pid.Sus-Anak/2017/PN.Jkt.Brt?

Ide Diversi pada awalnya dicanangkan dalam United Nation Standard Minimum Rules for the Administration of Juvenile Justice atau dikenal dengan The Beijing Rules. Diversi merupakan pemberian kewenangan kepada aparat penegak hukum untuk mengambil tindakan atau kebijaksanaan dalam menangani atau menyelesaikan masalah pelanggar anak dengan tidak mengambil jalan formal, misalnya dengan menghentikan atau tidak meneruskan/melepaskan dari proses peradilan pidana. Dengan diundangkan Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak pada tanggal 30 Juli 2012, dan mulai berlaku 2 tahun kemudian, maka Indonesia secara sah sudah memiliki suatu peraturan yang memberikan perlindungan hukum terhadap anak yang berhadapan dengan hukum dengan salah satu metodenya adalah Diversi. Selanjutnya sebagai Peraturan Pelaksana dikeluarkannya Perma Nomor 4 tahun 2014 tentang Pedoman Pelaksanaan Diversi Dalam Sistem Peradilan Anak, dan Peraturan Pemerintah Nomor 65 tahun 2015 tantang Pedoman Pelaksanaan Diversi dan Penanganan Anak yang Belum Berumur 12 tahun. Pada prinsipnya Diversi dengan pendekatan keadilan restoratif untuk memberikan jaminan perlindungan hukum terhadap anak yang berhadapan dengan hukum untuk menghindari stigmatisasi terhadap anak serta diharapkan anak dapat kembali ke dalam lingkungan social secara wajar. Keadilan Restoratif adalah suatu proses dimana semua pihak yang terlibat dalam suatu perkara pidana bersama-sama menyelesaikan masalah serta menciptakan suatu kewajaran untuk membuat segala sesuatunya menjadi lebih baik dengan melibatkan korban, anak dan masyarakat dalam upaya mencari solusi memperbaiki dan menentramkan hati dengan tidak berdasaarkan pembalasan.   The idea of Diversion was originally proclaimed in the United Nations Standard Minimum Rules for the Administration of Juvenile Justice, otherwise known as The Beijing Rules. Diversion is the granting of authority to law enforcement officials to take action or policy in handling or resolving problems of child offenders by not taking a formal path, for example by stopping or not continuing / releasing from the criminal justice process. With the enactment of Act No. 11 of 2012 concerning the Child Criminal Justice System on 30 July 2012, and entered into force 2 years later, Indonesia has legally established a regulation that provides legal protection for children facing the law, with one of its methods called Diversion. Furthermore, as the Implementing Regulation, the issuance of Supreme Court Regualtion No. 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Justice System, and Government Regulation No. 65 of 2015 concerning The Guidelines for the Implementation of Diversion and Handling of Children Under 12 Years Old. In principle, Diversion with a restorative justice approach is to guarantee legal protection for children facing the law to avoid stigmatization of children and it is expected that children can return to the social environment fairly. Restorative Justice is a process where all parties involved in a criminal case together solve a problem and create a fairness to make things better by involving victims, children and the community in an effort to find solutions to improve and reassure by not responding to retaliation.

Penelitian ini dilakukan dan bertujuan untuk: 1) Untuk mengetahui implementasi diversi dalam sistem peradilan anak di Kantor Polres Gowa; 2) Untuk mengetahui dan menganalisis faktor-faktor apa saja yang menjadi kendala dalam penerapan diversi kepada anak-anak yang menghadapi hukum di Kantor Polres Gowa. Jenis penelitian ini adalah penelitian hukum empiris. Hasil penelitian menunjukkan bahwa: 1) Penerapan diversi kepada anak-anak yang berhadapan dengan hukum di kantor Polres Gowa telah dilakukan secara finansial, hal ini terlihat dari kasus anak-anak yang berhadapan dengan hukum yang ditangani sejak 2017 hingga 2019 terdapat 94 kasus dan dapat diselesaikan 93 kasus; 2) Faktor penghambat dalam penerapan diversi di Kantor Polres Gowa adalah bahwa hukum hanya memberikan batas waktu 30 hari untuk upaya diversi, faktor sumber daya penyelidik masih kurang jika dibandingkan dengan jumlah kasus yang ditangani. Faktor masyarakat yang terkadang tidak menginginkan perdamaian atau permintaan dari korban atau keluarga korban yang meminta kompensasi yang terlalu besar. The research was conducted and aimed at: 1) To find out the implementation of the application of diversion in the juvenile justice system at the Gowa Regional Police Station; 2) To find out and analyze what factors are the obstacles in the application of diversion to children who face huku at the Gowa Police Station.This type of research is empirical legal research. The results showed that: 1) The application of diversion to children facing the law at the Gowa police station had been carried out financially, it was seen from the cases of children facing the law handled since 2017 until 2019 there were 94 cases and could be resolved diversely 93 cases; 2) The inhibiting factor in the application of diversion in the Gowa Regional Police Station is that the legal factor only gives a 30-day time limit for diversion efforts, the investigator's resource factor is still lacking when compared to the number of cases handled. Community factors that sometimes do not want peace or requests from the victims or the families of victims who ask for compensation that is too large so the perpetrators cannot.

Anak sebagai generasi penerus bangsa sudah selayaknya mendapatkan perhatian khusus. Hal tersebut bertujuan dalam rangka pembinaan anak untuk mewujudkan sumber daya manusia yang berkualitas. Maka dari itu, diperlukan pula sarana dan prasarana hukum yang mengantisipasi segala permasalahan yang timbul. Sarana hukum ini bertujuan untuk mengantisipasi stigma atau cap jahat yang ditimbulkan ketika anak berhadapan dengan hukum, sekaligus memulihkan dan memasyarakatkan kembali anak tersebut. Salah satu solusinya adalah dengan mengalihkan atau menempatkan pelaku tindak pidana anak keluar dari sistem peradilan pidana serta memberikan alternatif bagi penyelesaian dengan pendekatan keadilan demi kepentingan terbaik bagi anak, yang kemudian dikenal dengan pendekatan restorative justice. Restorative justice yang merupakan implementasi konsep dari diversi telah dirumuskan dalam sistem peradilan pidana anak, namun sistem yang baik haruslah diiringi dengan suatu sikap yang dijiwai kehendak untuk memandang dan berkeyakinan bahwa dunia ini selalu menjadi lebih baik. Selain itu, hendaknya prinsip the best interest of the children selalu diutamakan ketika menangani anak yang berhadapan dengan hukum. Children as the nation's next generation is already deserve special attention. It aims in order to develop the child to realize the quality of human resources. Therefore, it is also necessary legal infrastructure to anticipate any problems that arise. The legal means to anticipate stigma or stamp evil inflicted when the child against the law, as well as restoring and re-socialize the child. One solution is to divert or placing the offender children out of the criminal justice system as well as providing an alternative to the settlement with justice approach in the best interests of the child, who was then known as restorative justice approach. Restorative justice which is the implementation of the concept of diversion has been formulated in the juvenile justice system, but a good system must be accompanied by an attitude which is imbued with the will to perceive and believe that this world is always getting better. In addition, should the principle of the best interest of the children always come first when dealing with children in conflict with the law.
