ABSTRAKSengketa pertanahan tetap akan ada ketika para pihak telah memposisikan tanah sebagai faktor produksi yang utama ditambah kemudian tumpang tindihnya peraturan yang berhubungan dengan pertanahan dan sumber daya alam. Sengketa pertanahan dapat melahirkan anarkisme yang tidak jarang menimbulkan berbagai bentuk pelanggaran hak-hak asasi manusia. Pendekatan penelitian yang digunakan adalah penelitian hukum normatif, dengan kesimpulan sebagai berikut: Badan peradilan yang ada telah dipandang tidak lagi sederhana, cepat dan biaya ringan. Pengadilan pertanahan merupakan solusi guna mengatasi kebuntuan dalam penyelesaian sengketa pertanahan, pengadilan pertanahan tidak hanya sekedar formalistik-legalistik dalam mewujudkan keadilan. Keberadaan pengadilan pertanahan dibutuhkan dalam rangka terwujudnya penyelesaian sengketa pertanahan secara cepat, sistematis, sederhana, berkeadilan dan biaya ringan.Kata kunci: sengketa; pertanahan; perngadilan pertanahan.ABSTRACTLand disputes will still arise when the parties have positioned land as the main factor of production plus overlapping regulations relating to land and natural resources. Land disputes can give rise to anarchism which often results in various forms of violations of human rights. The research approach used is normative legal research, with the following conclusions: Existing judicial bodies are no longer considered simple, fast and low cost. Land court is a solution to overcome impasse in the resolution of land disputes, land court is not just formalistic-legalistic in realizing justice. The existence of a land court is needed in order to realize a land dispute resolution that is fast, systematic, simple, fair and low cost.Keywords: dispute; land; land court.

In Rural Society priority harmony as the basis for solving their problems, because these mechanisms more cheap, simple, accordance with their customs and culture but this mechanism not legitimated. Socio-Legal Research methods used to explore and examine the potential mechanisms of informal dispute based on customs in Pamekasan, through in-depth interviews and sec- ondary data collection obtained typology of dispute / disputes land based sources of conflict and Mapping Reformers. Statute Approach and case approach was to construct a new building for the legitimacy of non- state mechanisms (Non-State Justice) which dominates land disputes models in Pamekasan. Results of this study, Pamekasan society resistant to the land disputes culture involving figures outside the formal mechanisms. There are three options land disputes models in Pamekasan by using actor resolver likes kalebun/Village Head, “Kyai” and Judge of Court. This proves the existence of pluralistic legal system in Indonesia. Regional Autonomy Act number 32 of 2004 and Act No. 30 of 1999 on Arbitration and Alterna- tive Dispute Resolution provides an opportunity to build a judicial function at the village and to be access for justice to society and legitimated based on local wisdom.</em></p><p><strong><em>Key Words : </em></strong><em>Al</em><em>ternative, </em><em>Dispute Resolution, Land Dispute</em></p><p align="center"><strong>A</strong><strong>b</strong><strong>s</strong><strong>t</strong><strong>ra</strong><strong>k</strong></p><p>Penelitian ini bertujuan untuk mengetahui  model  proses penyelesaian di luar pengadilan atau dalam bentuk peradilan non-negara <em>(non-State Justice) </em>sebagai Alternatif Penyelesaian Sengketa Tanah di Kabupaten Pamekasan. Peneltian ini menggunakan metode s<em>osio legal research.  </em>Pengumpulan data melalui wawancara mendalam dan pengumpulan data sekunder . Pendekatan perundang-undangan (stat- ute approach) dan pendekatan kasus <em>(case approach) </em>dilakukan untuk mengkonstruksi bangunan baru bagi legitimasi mekanisme non negara <em>(</em><em>Non-State Justice) </em>yang mendominasi pola-pola penyelesaian sengketa tanah di Kabupaten Pamekasan. Analisis dilakukan dengan menafsirkan data yang diperoleh secara induksi dan membandingkan, menguji atau memverifikasi dengan teori yang sudah ada. Pembandingan atau pengujian ini dimaksudkan untuk mengkaitkan temuan dengan teori yang mengkaji hal-hal yang menjadi fokus penelitian.  Hasil penelitian menunjukkan bahwa masyarakat di Kabupaten Pamekasan resisten dengan budaya penyelesaian sengketa tanah yang melibatkan tokoh-tokoh diluar mekanisme formal. Terdapat tiga pilihan pola penyelesaian di Kabupaten Pamekasan untuk menyelesaikan sengketa tanah yaitu dengan menggunakan aktor penyelesai Kalebun/Kepala Desa, Kyai dan Hakim di Pengadilan. Hal ini membuktikan adanya pluralistis sistem hukum yang berlaku di Indonesia. Undang-Undang Pemerintahan Daerah nomor 32 Tahun 2004 serta Undang-undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa memberikan peluang untuk membangun fungsi yudisial di tingkat desa sebagai upaya untuk mendekatkan akses keadilan terhadap masyarakat dan melegitimasi berbagai pola penyelesaian yang berbasis pada kearifan lokal.</p><p><strong><em>Keywords </em></strong>: Alternatif, Penyelesaian Sengketa, Sengketa</p>

The purpose of this study was to find out the procedure for land dispute resolution carried out by the Village Head, to find out the basis of authority of the Village Head in land dispute resolution efforts based on Law Number 6 of 2014 concerning Villages and to find out the legal strength of land dispute resolution. This type of research is normative legal research. The theory used in this study is the theory of dispute resolution, the theory of authority and the theory of legal certainty. The approach method used is the legislative approach, case approach, and conceptual approach. Based on the results of the study that the procedure for land dispute resolution carried out by the Village Head was carried out in several stages, namely: 1. complaints; 2. summons of disputing parties; 3. the process of deliberation; and 4. formulating the results of the agreement in the form of a Joint Peace Letter. The authority of the Village Head in an effort to resolve land disputes is Article 26 of Law Number 6 Year 2014 concerning Villages and Law Number 30 Year 2014 concerning Government Administration. The power of land dispute resolution law carried out by the village head in the form of a Peace Letter on land disputes made by the Village Head based on what has been agreed upon by the disputing parties, it can be said that what is stated in the Peace Letter is valid and applies as a Law for those who make it, in this case the parties to the dispute. The agreements are irrevocable for reasons which are sufficient by law.

Pada tahun 2016, Pemerintah Aceh membentuk Dinas Pertanahan Aceh yang kewenangannya mengurusi di bidang pelayanan pertanahan. Salah satu kewenangannya adalah dalam hal penyelesaian sengketa pertanahan. Pada Kenyataannya, Badan Pertanahan Nasional (BPN) juga memiliki kewenangan dalam penyelesaian sengketa pertanahan di Aceh. Terdapat tumpang tindih kewenangan dua lembaga negara dalam hal penyelesaian sengketa pertanahan di Aceh. Penelitian ini bertujuan untuk mengetahui kedudukan Dinas Pertanahan Aceh dalam penyelesaian sengketa pertanahan pasca Perpres Nomor 23 Tahun 2015. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penilitian menunjukkan bahwa kedudukan Dinas Pertanahan Aceh memiliki peranan penting dalam penyelesaian sengketa pertanahan yang terjadi di Aceh. Lahirnya Dinas Pertanahan Aceh dapat mempermudah akses masyarakat dalam hal penyelesaian konflik tanah. Disarankan DPR Aceh bersama Gubernur Aceh perlu mempercepat proses pengesahan draf Qanun Pertanahan Aceh sebagai payung hukum bagi Dinas Pertanahan Aceh dalam mengoptimalkan peran dan fungsinya terkait penyelesaian sengketa pertanahan di Aceh.In 2016, the Aceh Government formed the Regional Land Office of Aceh whose authority held government affairs in land services. One of the authorities of the Regional Land Office of Aceh is in terms of land dispute resolution and conflict. The National Land Agency (BPN) also has authority in resolving land disputes in Aceh. There are overlaps in the authority of two state institutions regarding resolving land disputes in Aceh. This study aims to determine the position of the Regional Land Office of Aceh in settlement of land disputes after the issuance of the Presidential Regulation Number 23 of 2015. This study uses a normative juridical research method. The research results show that the position of the Regional Land Office of Aceh has a significant role in resolving land disputes that occurred in Aceh. The establishment of The Regional Land Office of Aceh can facilitate public access in terms of resolving land conflicts. It is suggested that the Aceh House Representative together with the Governor of Aceh need to accelerate the process of ratifying the draft of Qanun (Islamic bylaw) of Aceh Land as a strong legal standard for the Regional Land Office of Aceh in optimizing its roles and functions related to land dispute resolution in Aceh.

Abstract This study aims to analyze dispute resolution, the dispute resolution approach that guarantees legal certainty and examine the factors that influence the construction of the settlement of land rights of the customary community of Malind-Amin. This normative and empirical legal research is analized descriptively and analytically. The results shows that the nature of customary land dispute with customary law can be resolved through positive legal mechanisms and customary law mechanisms, while dispute resolution on disputed objects that have certificates based on the release of traditional institutions through mediation, synchronization / harmonization of laws and the making of local regulations. However, efforts to resolve this have experienced various factors of internal and external obstacles.

The research is motivated by the need for eff ective, effi cient and low-cost dispute resolution in dispute arising from electronic commerce transactions. That is because the implementation of electronic commerce transaction ha the characteristic of speed and ease, then it must also be accommodated in the process of settling the dispute. This study aims to analyze, and provide a description of the form of application principle of utilities in ODR as an alternative dispute resolution of electronic commerce user. The result of this normative legal research which uses statute and conseptual approach provide an explaination that online dispute resolution as an e-commerce alternative dispute resolution system trial has been in accordance with the principle of utilities, because to fulfi ll an element that there are in principle utilities in the analysis on law and economic.

AbstractNow businesses can market their products through social media at a low cost. The marketing of this product is done through endorsement services on social media by influencers on social media. Not only adults, now many children also become influencers who promote various products through social media and they got benefit from it. The purpose of this research is to determine the criminal provisions for users of endorsement services by children and also to determine the regulation of criminal acts of economic exploitation of children through endorsement services on social media. This research is a normative juridical legal research. The research approach uses a statute approach and a conceptual approach. Based on this research, there is a legal vacuum in the application of crimes for perpetrators of economic exploitation of children through endorsement services on social media. Tak hanya orang dewasa, kini anak-anak pun banyak menjadi influencer yang memasarkan berbagai produk melalui media sosial dan memperoleh keuntungan darinya. Tujuan penelitian ini untuk menentukan ketentuan pidana bagi para pengguna jasa dukungan oleh anak-anak dan juga untuk mengetahui pengaturan tindak pidana eksploitasi ekonomi terhadap anak melalui jasa dukungan (endorsement) di media sosial. Penelitian ini merupakan penelitian hukum yuridis normatif. Pendekatan penelitian menggunakan pendekatan undang-undang (statute approach) dan pendekatan konsep (conceptual approach). Berdasarkan penelitian ini, ditemukan adanya kekosongan hukum dalam penerapan pidana bagi pelaku tindak eksploitasi ekonomi terhadap anak melalui jasa dukungan (endorsement) di media sosial. Peraturan perundang-undangan yang berlaku dirasa kurang relevan dengan permasalahan eksploitasi ekonomi terhadap anak melalui media sosial yang timbul pada era digital. <p>InternetNZ has responsibility for management of the .nz domain name space. This dissertation examines InternetNZ's development and implementation of the Dispute Resolution Service Policy (the DRS). The DRS, which is being reviewed in 2010, provides a substantive legal test for unfair registration of a domain name and a dispute resolution process. This dissertation asks whether the DRS is working effectively and, if so, what this reveals about the operation of the Internet in New Zealand. The dissertation shows that the DRS is a low cost, high quality alternative to litigation and is being run in a pragmatic but principled way by InternetNZ. Implications are discussed and recommendations are made for minor improvements. The dissertation concludes with a call for more participation in, and critique of, Internet policy developments given the important human rights issues that can arise and the significance of the Internet in New Zealand today.</p>

This article aims to analyze the authority of the Consumer Dispute Resolution Agency (BPSK) as Quasi-Judicial in handling consumer disputes as mandated in Article 49 paragraph (1) of Law No. 8 of 1999. This research is a normative legal study that is prescriptive and technical/applied. The research approach uses the Act approach. This legal research material uses primary legal materials and secondary legal materials. The technique of collecting legal materials through library research is then analyzed using qualitative methods. Supervision of the default clause stipulated in the credit agreement is the authority of BPSK; since 2013, the Supreme Court has consistently dismissed consumer disputes for credit agreements positioned as ordinary agreements, stating the parties to the dispute should take their case to the general Judiciary, as well as correcting BPSK's authority. This not only does not imply the principle of lex specialis derogate lex religious but also does not implement efficiency theory that ultimately harms consumers.

This study aimed to describe the procedure for resolving land disputes, the application of the General Principles of Good Government (AUPB) in land dispute resolution, and the supporting and inhibiting factors for the application of AUPB in resolving land disputes. This study used a sociological juridical approach, with the type of empirical juridical research. The procedure for resolving land disputes was through two types of applications, namely letters of public complaints and implementation of court decisions. The application of AUPB in land dispute resolution started from the application, data collection and analysis, field assessment and inspection, case exposure, case settlement reports, settlement, and implementation of settlement decisions. Supporting factors for the implementation of AUPB were the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 11 of 2016, Section for Handling Land Problems and Control, as well as facilities and infrastructure for mediation, case titles, and transportation. The obstacle of the AUPB implementation included the inkracht decision to issue replacement certificates that had not been explicitly regulated, resulting in land registration services being blocked by the system and uncooperative parties.

AbstractThe current developments, there are many land disputes that are vertical or horizontal. Issues concerning land affairs are often caused by salim claims over land rights. The intended land dispute is a civil dispute concerning the land. Achieving a win-win solution in the settlement of civil disputes over land is relatively difficult to materialize, if the settlement is resolved through a trial (litigation). The choice of law that can be chosen to obtain and realize a win-win solution in solving civil disputes over land is of course through alternative dispute resolution. By way of negotiation, mediation and conciliation. In the course of the settlement of civil disputes over land settled through alternative dispute resolution, the settlement can not ignore the applicable legal principles of the treaty.  Keywords: Land civil disputes, alternative dispute resolution and principles of contract.AbstrakPerkembangan yang terjadi saat ini, banyak terjadi sengketa pertanahan yang bersifat vertikal maupun horizontal. Permasalahan mengenai pertanahan yang terjadi sering disebabkan akibat salim klaim penguasaan hak atas tanah. Sengketa tanah yang dimaksudkan adalah sengketa perdata tentang tanah. Mewujudkan win-win solution dalam penyelesaian sengketa perdata tentang tanah relatif sulit dapat terwujud, apabila penyelesaiannya diselesaikan melalui sidang peradilan (litigation). Pilihan hukum (choice of law) yang dapat dipilih untuk memperoleh dan mewujudkan win-win solution dalam menyelesaikan sengketa perdata tentang tanah tentunya adalah melalui alternative dispute resolution. dengan cara negosiasi, mediasi dan konsiliasi. Dalam rangka penyelesaian sengketa perdata tentang tanah diselesaikan melalui alternative dispute resolution, maka penyelesaiannya tidak dapat mengabaikan asas-asas hukum yang berlaku mengenai perjanjian. Kata Kunci :   Sengketa perdata tanah, alternatif penyelesaian sengketa dan asas-asas    perjanjian.
