An advocate is a person whose profession is providing legal services both inside and outside the court that meets the requirements based on legislations. In child cases, the role of advocates is needed to provide legal protection for children in order to create a child generation which is free from discrimination, violence and exploitation. The purpose of this research is to analyze various regulations regarding advocate policy in legal assistance on criminal cases, especially on child cases and how the policy is implemented in assisting child cases at the level of investigations in police, prosecutors office and court in Kuningan District. The method used in this research was the Evaluative Analysis method, which is a method of collecting and presenting the obtained data to analyze actual situation and subsequently carry out rational analysis based on juridical references through library and field research. As results, this research found that the regulations applied in providing legal assistance on child cases include; Article 23 paragraph (1) of Law Number 11 of 2012 concerning System of Child Criminal Justice, and Kuningan District Regulation Article 17 Point (b) Number 15 of 2003 concerning Implementation of Child Protection. Moreover, the implementation of advocate policy in assisting child cases in Indonesia has not been carried out optimally both in police, prosecutor's office and court due to the following factors, namely legislation factors, legal apparatus factors, and society awareness factors (legal culture). Therefore, there is a need for reconstruction of legal awareness through education, training and socialization, especially for the law enforcement of child cases. Besides, the societys legal culture regarding the obligation of advocate assistance needs to be improved so that the objectives to provide child protection can be achieved.Advokat adalah orang yang berprofesi memberi jasa hukum baik didalam maupun di luar pengadilan yang memenuhi persyaratan berdasarkan peraturan per Undang Undang. Dalam perkara anak peran advokat sangat di perlukan dalam perlindungan hukum bagi anak yang merupakan bagian terpenting dalam menjaga generasi anak yang bebas dari diskriminasi, kekerasan dan eksploitasi sehingga mampu membangun generasi anak bahagia dan sejahtera. Tujuan penelitian ini adalah untuk mengetahui perbagai peraturan mengenai kebijakan advokat dalam pendampingan hukum dalam perkara pidana khususnya terhadap terhadap perkara anak serta bagaimana implementasi kebijakan peran advokat dalam pendampingan perkara anak di tingkat penyelidikan dan penyidikan di kepolisisan, kejaksaan dan pengadilan Negeri Kuningan. Methode penelitian yang digunakan oleh penyusun dalam pembahasan penelitian ini adalah methode Evaluatif Analisis, yaitu suatu methode mengumpulkan dan menyajikan data yang diperoleh untuk menganalisis keadaan yang sebenarnya dan selanjutnya dilakukan analisis rasional berdasarkan acuan yuridis melalui penelitian kepustakaan dan penelitian lapangan. Hasil Penelitian ini yaitu�Pertama,.Pasal 23 ayat (1) Undang Undang nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, Perda Kabupaten Kuningan Pasal 17 hurp (b) No.15 Tahun 2003 Tentang Penyelenggaraan Perlindungan Anak .Kedua,�Implementasi peran advokat dalam pendampingan perkara anak di Indonesia belum dilaksanakan dengan maksimal baik di kepolisian, kejaksaan maupun pengadilan hal ini karena faktor faktor sebagai berikut yaitu Faktor Peratuan Perundang Undangan, Faktor Aparat Hukum dan Faktor Kesadaran Masyarakat�(Budaya Hukum). Oleh sebab itu perlu adanya rekontruksi peningkatan kesadaran melalui pendidikan, pelatihan dan sosialisasi terhadap penegak hukum perkara anak maupun terhadap budaya hukum masyarakat tentang kewajiban pendampingan advokat sehinga tujuan keadilan perlindungan anak dapat terpenuhi.

Legal aid is a legal sevice program provided to alleviate the burden of life for  people who cannot afford financially, and is also useful to create justice and legal protection to society. This legal research is an empirical legal research or descriptive field research. The research is located at Cibinong District Court. Data collection techniques were conducted through interviews with Cibinong District Court judges and literature studies in the form of books, legislation, journals, etc. to support comprehension and completeness of data or materials. Problems in this Research are about implementation of the granting of legal aid to defendants who cannot afford financially in criminal cases and restricted factors towards implementation of granting legal aid to defendants who cannot afford financially in criminal cases. Based on the research results, and the discussion about the analysis of the implementation of legal aid to defendants who cannot afford financially in criminal cases, the implementation of the granting of legal aid can be done through courts, and Legal Aid Institutes (LBH) and  directly in accordance with initiative of advocates who voluntarily willing to accompany the defendants. Factors restricting implementation of granting legal aid to defendants who cannot afford financially in criminal cases such as: factors in law enforcement, social and cultural factors, facilities and infrastructure as well. As recommendation, it high required to to courts and LBH to socialize procedures of free legal assistance to the defendants and what sanctions to parties who inhibit the implementation of the granting of legal aid to the defendants in criminal cases.

Setiap orang adalah sama didepan hukum tak terkecuali penyandang disabilitas. Penelitian berjudul ―Model Pendampingan Hukum Bagi Difabel (Orang Yang Berkebutuhan Khusus) Yang Berhadapan Dengan Hukum Di Kota Medan dan Binjai didukung oleh DIKTI dalam Skim Penelitian Hibah bersaing. Peneliti berharap diakhir penelitian akan diperoleh informasi; Pertama, situasi penyandang Disabilitas mengakses layanan hukum yang tersedia di masyarakat. Kedua, persfektif Organisasi atau Lembaga penyedia layanan bantuan hukum bagi Penyandang Disabilitas. Untuk memperoleh tujuan yang diharapkan penelitian dilakukan menggunakan metode normatif empiris. Peneliti melakukan pengumpulan peraturan hukum dan menganalisanya dilanjutkan dengan pengumpulan data lapangan melalui Wawancara mendalam dengan beberapa informan di Kota Medan dan Binjai. Beberapa temuan awal penelitian memperlihatkan bahwa Kota Medan dan Binjai memiliki kasus pidana yang melibatkan penyandang disabilitas baik sebagai Pelaku, Korban dan Saksi. Tindak Pidana yang melibatkan penyadang disabilitas ini adalah Kekerasan seksual meliputi pelecehan seksual, perkosaan dan incest. Temuan lain penelitian adalah adanya kendala bagi Aparat Penegak Hukum dalam penanganan kasus yang melibatkan Penyandang Disabilitas ini. Penelitian ini menyimpulkan bahwa dalam penanganan kasus hukum yang melibatkan penyandang disabilitas memiliki tantangan khusus terkait keterbatasan penyandan disabilitas. Tantangan tidak hanya dihadapi oleh penyandang disabilitas dan keluarga tetapi juga Aparat Penegak Hukum (APH).   Everyone is equal before the law, including people with disabilities. The study entitled ―The Legal Assistance Model For Disabled (People Who Have Special Needs) Dealing with Law in Medan and Binjai Cities was supported by DIKTI in Competitive Research Schemes. The researcher expected that information would be obtained at the end of the study; First, the situation of persons with disabilities accessing legal services available in the community. Second, the perspective of Legal Aid Services organizations or institutions for persons with disabilities. To obtain the expected goals, the study was conducted using empirical normative methods. The researcher collected and analyzed legal regulations, followed by data collection through in-depth interviews with several informants in the cities of Medan and Binjai. Some preliminary findings of the study showed that Medan and Binjai had criminal cases involving persons with disabilities as Actors, Victims, and Witnesses. The criminal offenses involving persons with disabilities were sexual violence including sexual harassment, rape, and incest. Another finding of the research shows that there were obstacles for Law Enforcement Officials in handling cases involving this Dissability. This study concluded that there were special challenges related to the limitations of disability genders in handling legal cases involving persons with disabilities. The challenges were faced not only by persons with disabilities and families, but also by Law Enforcement Officials (APH).

Legal assistance is implemented through the courts, and legal aid legal aid program is provided in order to alleviate the burden of life for the people who cannot afford in terms of Economics, and is also useful to create justice and legal protection of the general public. Problems in this research is how the implementation of the granting of legal aid to defendants who cannot afford in terms of economy in criminal cases and the factors restricting implementation of granting legal aid to defendants who cannot afford in terms of economy in criminal cases. Based on the research results, and a discussion of the analysis of the implementation of legal aid to defendants who cannot afford in terms of economy in criminal cases, the implementation of the granting of legal aid can be done with the way through the courts, and the legal aid Institute (LBH) and can also be done by direct initiative of an advocate who voluntarily want to accompany her. Factors restricting implementation of granting legal aid to defendants who cannot afford in terms of economy in criminal cases among others; factors in law enforcement, community factors, cultural factors, facilities and infrastructure. The research issue focuses on the examination of crown witnesses in the process of establishing criminal cases in Indonesia. The examination of the crown witnesses is necessary because law enforcement officers find it difficult to find evidence, other than the testimony of witnesses of the perpetrators themselves in order to find material truth that can be justified. The result of the research shows that the role of the crown witness in the criminal prosecution process is very significant, that is to find the material truth, so that the fast and simple proof process fulfills the minimum standard of proof, upholds public justice against the perpetrators and determines the demands of each actor in accordance with its role. The need for legal protection against the crown witness and the need for a policy of reform of criminal procedure law through the refinement of the Criminal Procedure Code relating to the content of witness material of the crown firmly and limitatively in the future. Protection of female workers  in Cianjur District is indeed necessary, especially when working abroad. One of the problems is when there are many migrant workers who give birth to children out of wedlock and return to Indonesia without their husband. The purpose of this study was to determine the legal protection illegitimate child born by Women Workers in Cianjur Regency and to know the role of the government to cope with unmarried children born by Women Workers in Cianjur District. The study was analytical descriptive with the method of this research approach through normative juridical. The results of the study found that legal protection for illegitimate child  born by Indonesian Female Workers in Cianjur has a regulation protecting it, namely Article 28 of the 1945 Constitution, Law No. 35 of 2014 concerning Child Protection, Article 43 paragraph (1) of the Marriage Law and Constitutional Court Decision No. 46 / PUU-VIII / 2010. The role of the government in protecting extramarital children born by Indonesian Workers in Cianjur, West Java is not optimal. The role of the village government is very helpful for women migrant workers, namely finding companies that will send their citizens. Whereas illegitimate child born by migrant workers can be protected one of them by smoothing all administrative processes for these children such as issuing a free birth certificate.

This research aims to identify and analyze the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia and analyze the effectiveness of criminal fines when viewed from the perspective of children as victims of crime.Method used is socio-juridical using primary and secondary data. Primary data collection technique is done with the interview, and secondary data by reading, reviewing and analyzing primary legal materials, secondary legal materials, tertiary legal materials with qualitative analysis techniques, interpreted logically and systematically and drawn conclusions.Based on the survey results revealed that the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia criminal fines in criminal prospects are just as an alternative or substitute for imprisonment or confinement. And effectiveness this penalty has not run optimally because the defendant would prefer to replace the criminal penalties to imprisonment.The conclusion of this thesis is that the implementation or execution of criminal penalties in Indonesia have not been effective or not maximized because law enforcement or judges tend to prefer the imprisonment of the criminal finesKeywords: Criminal Fines; Criminal Prison; Children.

ABSTRAKKetentuan Pasal 4 dan Pasal 16 ayat (1) huruf f Undang-Undang Jabatan Notaris mewajibkan notaris untuk menjaga kerahasiaan segala sesuatu mengenai akta yang dibuatnya dan segala keterangan yang diperoleh guna pembuatan akta sesuai dengan sumpah janji jabatan kecuali undang-undang menentukan lain. Kemungkinan terhadap pelanggaran kewajiban tersebut berdasarkan Pasal 16 ayat (11) Undang-Undang Jabatan Notaris, seorang notaris dapat dikenai sanksi berupa teguran lisan sampai dengan pemberhentian dengan tidak hormat. Terlebih lagi dengan adanya putusan Mahkamah Konstitusi Republik Indonesia dengan Nomor: 49/PUU–X/2012 memutuskan telah meniadakan atau mengakhiri kewenangan Majelis Pengawas Daerah (MPD) yang tercantum dalam Pasal 66 ayat (1) UUJN membuat notaris seakan-akan tidak ada perlindungan hukum bagi notaris dalam menjalankan tugas jabatannya. Ikatan Notaris Indonesia (INI) harus berusaha menjalankan peranan pembinaan dan perlindungan meningkatkan pengetahuan, kemampuan dan keterampilan para notaris. Demikian juga menjalin hubungan dengan para penegak hukum lainnya, agar penegak hukum lainnya yang ada hubungan dengan notaris dapat memahami kedudukan notaris sesuai UUJN.Berangkat dari pemikiran inilah kewajiban ingkar notaris masih tetap dipertahankan oleh pembuat undang-undang dalam revisi Undang-Undang Jabatan Notaris Tahun 2014 yang merupakan konfigurasi kekuatan perlindungan terhadap profesi dan jabatan notaris dari sisi politik.Kata Kunci : Jabatan Notaris, Hak Ingkar, Perlindungan Hukum.ABSTRACTThe provisions of Article 4 and Article 16 paragraph (1) sub-paragraph f of the Notary's Office Law require a notary to maintain the confidentiality of all matters concerning the deeds it has made and all the information obtained for the deed in accordance with the oath of pledge of office except the law otherwise. The possibility of breach of such obligation under Article 16 paragraph (11) of Notary Law Regulation, a notary public may be subject to sanctions in the form of oral reprimands until dismissal with disrespect. Moreover, with the decision of the Constitutional Court of the Republic of Indonesia with the number : 49 /PUU-X/2012 deciding to have canceled or terminated the authority of the Regional Supervisory Board (MPD) listed in Article 66 paragraph (1) UUJN made a notary as if there was no legal protection for a notary in performing duties. The Indonesian Notary Bond (INI) should endeavor to undertake the role of guidance and protection to increase the knowledge, abilities and skills of the notaries. Likewise establish relationships with other law enforcers, so that other law enforcement who has relationship with the notary can understand the position of notary under the UUJN.Departing from this thought the obligation of notarization is still maintained by the lawmakers in the revision of the Law Regulation of Position Notary on Year 2014 which is the configuration of the strength of the protection of the profession and the notary's position from the political side.Keyword : Position of Notary, Right of Remedy, Legal Protection.

The rise of drug trafficking involving children as narcotics couriers is a problem that needs serious attention from both the government, law enforcement and the community. Children who commit crimes must continue to obtain legal protection in the best interests of the child. Child protection is contained in Law number 11 of 2012 concerning the juvenile justice system, where at the moment children can become narcotics abuse even as narcotics brokers with the rampant abuse of narcotics for all circles both in Indonesia and in the international world. The formulation of the problem raised is how is the basis for judges' consideration in imposing criminal sanctions on children as intermediaries for narcotics? And what is the legal protection of children as an intermediary for narcotics? The problems to be discussed will be examined based on normative perspectives and the legislative approach to the decisions of the Denpasar District Court No. 14 / Pid.Sus Anak / 2015 / PN. Dps, that the judge considers that the accused child has committed narcotics crimes by being charged Law number 35 of 2009 concerning narcotics, which can be sentenced to a minimum of 5 years and a maximum of 20 years and can be subject to fines. Legal protection for children is carried out by judges by imposing criminal training on employment in a generation of Indonesian foundations, solely so that children can carry out their activities as usual when they return to the community and do not disturb their psychic rights and can increase their skills in children. The child does not return to committing a crime.

<h1>The purpose of this study is to assess the legal provisions of the children under Law No. 23 of 2002 and to explain the consequences of the child's adoption law. In addition, to know the legal protection of adopted children under the Child Protection Act is reviewed from Islamic Law Preformance law Practice in Indonesia. To examine the matter, a descriptive study was conducted with a normative juridical approach that was conducted only on the written rules. The collection of data is derived from the literature research and supported field research studies on the appointment of Court and Civil registry office. Primary data collection tools are informant with the interview guidelines whereas data analysis is done with a qualitative approach using the logical and inductive thinking logic in the field of law. In the content of this article shows that, firstly, the consequences of child adoption generally arise with the appointment of a court by not deciding the adoption of adopted children with their biological parents, which switching is the right of custody. In the case of inheritance, the appointment of children based on the determination of the Court of Justice is entitled to the inheritance of his adoptive parents based on wills. Thirdly, with the determination of the adoption of children from the courts, the consequence is the protection of adopted children can be assured of the custody of the law and the inheritance of its adoptive parents.</h1><h1> </h1>

Legal protection is a legal effort that must be provided by law enforcement officials to provide a sense of security to the community both body and soul from interference and threats from any party. The protection of children who are victims of moral crimes is regulated in Law Number 23 of 2002 jo and Law Number 35 of 2014 concerning Child Protection. This research was conducted with the aim of describing the legal protection of a child who is the victim of criminal acts of sexual intercourse and the criminal sanctions against the perpetrators of the sexual intercourse crime on a child. This research was conducted using the normative legal research method. Based on the results of the research and discussion, the legal protection for children who are victims of criminal acts of intercourse is regulated in Law No. 35/2014. Children who are victims are given protection in the form of medical assistance, psycho-rehabilitation, the right to restitution, the right to compensation. Criminal sanctions against the perpetrator of the criminal act of child sexual intercourse in decision number 58 / Pid.Sus / 2015 / PN.Tab, the perpetrator was sentenced to 7 (seven) years in prison and a fine of 150,000,000.00. Seeing the perpetrator's actions were very cruel, robbing other people's honor, namely his own daughter, the punishment that should be given to the perpetrator is the maximum punishment. If the fine cannot be paid, the defendant's sentence will be increased to 6 (six) months.
