Legal assistance is implemented through the courts, and legal aid legal aid program is provided in order to alleviate the burden of life for the people who cannot afford in terms of Economics, and is also useful to create justice and legal protection of the general public. Problems in this research is how the implementation of the granting of legal aid to defendants who cannot afford in terms of economy in criminal cases and the factors restricting implementation of granting legal aid to defendants who cannot afford in terms of economy in criminal cases. Based on the research results, and a discussion of the analysis of the implementation of legal aid to defendants who cannot afford in terms of economy in criminal cases, the implementation of the granting of legal aid can be done with the way through the courts, and the legal aid Institute (LBH) and can also be done by direct initiative of an advocate who voluntarily want to accompany her. Factors restricting implementation of granting legal aid to defendants who cannot afford in terms of economy in criminal cases among others; factors in law enforcement, community factors, cultural factors, facilities and infrastructure. Advice that can be given is the need for socializing by the court party, and about the implementation of the LBH granting legal assistance free of charge to the defendant who cannot afford, and to the need for sanctions to parties who caused the implementation of the grant of legal aid to the defendants engaged in criminal cases.Keywords: Granting Of Legal Aid, the Defendant, Not Being Able To, Criminal Cases

Legal aid is a legal sevice program provided to alleviate the burden of life for  people who cannot afford financially, and is also useful to create justice and legal protection to society. This legal research is an empirical legal research or descriptive field research. The research is located at Cibinong District Court. Data collection techniques were conducted through interviews with Cibinong District Court judges and literature studies in the form of books, legislation, journals, etc. to support comprehension and completeness of data or materials. Problems in this Research are about implementation of the granting of legal aid to defendants who cannot afford financially in criminal cases and restricted factors towards implementation of granting legal aid to defendants who cannot afford financially in criminal cases. Based on the research results, and the discussion about the analysis of the implementation of legal aid to defendants who cannot afford financially in criminal cases, the implementation of the granting of legal aid can be done through courts, and Legal Aid Institutes (LBH) and  directly in accordance with initiative of advocates who voluntarily willing to accompany the defendants. Factors restricting implementation of granting legal aid to defendants who cannot afford financially in criminal cases such as: factors in law enforcement, social and cultural factors, facilities and infrastructure as well. As recommendation, it high required to to courts and LBH to socialize procedures of free legal assistance to the defendants and what sanctions to parties who inhibit the implementation of the granting of legal aid to the defendants in criminal cases.

An advocate is a person whose profession is providing legal services both inside and outside the court that meets the requirements based on legislations. In child cases, the role of advocates is needed to provide legal protection for children in order to create a child generation which is free from discrimination, violence and exploitation. The purpose of this research is to analyze various regulations regarding advocate policy in legal assistance on criminal cases, especially on child cases and how the policy is implemented in assisting child cases at the level of investigations in police, prosecutors office and court in Kuningan District. The method used in this research was the Evaluative Analysis method, which is a method of collecting and presenting the obtained data to analyze actual situation and subsequently carry out rational analysis based on juridical references through library and field research. As results, this research found that the regulations applied in providing legal assistance on child cases include; Article 23 paragraph (1) of Law Number 11 of 2012 concerning System of Child Criminal Justice, and Kuningan District Regulation Article 17 Point (b) Number 15 of 2003 concerning Implementation of Child Protection. Moreover, the implementation of advocate policy in assisting child cases in Indonesia has not been carried out optimally both in police, prosecutor's office and court due to the following factors, namely legislation factors, legal apparatus factors, and society awareness factors (legal culture). Therefore, there is a need for reconstruction of legal awareness through education, training and socialization, especially for the law enforcement of child cases. Besides, the societys legal culture regarding the obligation of advocate assistance needs to be improved so that the objectives to provide child protection can be achieved.Advokat adalah orang yang berprofesi memberi jasa hukum baik didalam maupun di luar pengadilan yang memenuhi persyaratan berdasarkan peraturan per Undang Undang. Dalam perkara anak peran advokat sangat di perlukan dalam perlindungan hukum bagi anak yang merupakan bagian terpenting dalam menjaga generasi anak yang bebas dari diskriminasi, kekerasan dan eksploitasi sehingga mampu membangun generasi anak bahagia dan sejahtera. Tujuan penelitian ini adalah untuk mengetahui perbagai peraturan mengenai kebijakan advokat dalam pendampingan hukum dalam perkara pidana khususnya terhadap terhadap perkara anak serta bagaimana implementasi kebijakan peran advokat dalam pendampingan perkara anak di tingkat penyelidikan dan penyidikan di kepolisisan, kejaksaan dan pengadilan Negeri Kuningan. Methode penelitian yang digunakan oleh penyusun dalam pembahasan penelitian ini adalah methode Evaluatif Analisis, yaitu suatu methode mengumpulkan dan menyajikan data yang diperoleh untuk menganalisis keadaan yang sebenarnya dan selanjutnya dilakukan analisis rasional berdasarkan acuan yuridis melalui penelitian kepustakaan dan penelitian lapangan. Hasil Penelitian ini yaitu�Pertama,.Pasal 23 ayat (1) Undang Undang nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, Perda Kabupaten Kuningan Pasal 17 hurp (b) No.15 Tahun 2003 Tentang Penyelenggaraan Perlindungan Anak .Kedua,�Implementasi peran advokat dalam pendampingan perkara anak di Indonesia belum dilaksanakan dengan maksimal baik di kepolisian, kejaksaan maupun pengadilan hal ini karena faktor faktor sebagai berikut yaitu Faktor Peratuan Perundang Undangan, Faktor Aparat Hukum dan Faktor Kesadaran Masyarakat�(Budaya Hukum). Oleh sebab itu perlu adanya rekontruksi peningkatan kesadaran melalui pendidikan, pelatihan dan sosialisasi terhadap penegak hukum perkara anak maupun terhadap budaya hukum masyarakat tentang kewajiban pendampingan advokat sehinga tujuan keadilan perlindungan anak dapat terpenuhi.

Legal aid is a constitutional right for Indonesian citizens to obtain legal protection and equality. The existence of Law Number 16 of 2011 is a manifestation of that constitutional right. Fulfillment of legal aid for the poor in Bogor City has been partially implemented using APBD funds in accordance with Regional Regulation No. 3 of 2015 concerning Legal Aid for the Poor and Mayor Regulation Number 39 of 2015 as the Implementing Regulation. The provision of legal aid to the poor in Bogor which refers to the Bogor City Regulation No. 3 of 2015 concerning Legal Aid for the Poor has not yet been realized specifically for the people of Bogor City. This is due to obstacles from external and internal factors in its implementation, namely in the form of a Legal Assistance Organization  which is only one accredited at the Ministry of Law and Human Rights and limited funds for absorption of legal aid implementation activities. Therefore, the  Government needs to involve Legal Aids (LKBH-LKBH) in private university institutions in Bogor and its surroundings to be able to realize the plan for establishing Legal Consultation innovations (legal clinics) in 68 urban office Bogor City

The provision of legal aid to the poor is one of the actions of the noble profession of advocates and the moral movement that advocates for human rights, in fact, not all advocates are morally aware of their obligations. There are still many deviations found in the provision of legal aid for the poor. This condition is certainly contrary to the noble values of the advocate profession itself, in the presence of this matter, which shows still can be found deviations in practice. The problem examined in this study is why law enforcers such as judges and posbakum have not provided free legal assistance to the poor in Central Lampung Regency, a factor that has caused law enforcement agencies not to offer and provide free legal assistance to the poor and the pattern / model of handling criminal cases against the poor by advocates based on justice. The method used in this research is with socio-legal research approach that comes from collecting data obtained from primary data and secondary data, then analysed by qualitative analysis method.The results of this study ultimately provide an answer that Advocates who have not yet applied the value of justice in handling criminal cases involving the poor are due to legal substance, legal structure, and legal culture, Not yet applying the value of justice in handling criminal cases against the poor is like the emergence of mistrust of the law, besides the model of handling criminal cases against the poor by advocates based on the value of justice is the implementation of constructive strategies, such as: Legislation Planning, Policies and Activities Related to the Fulfilling Right to Legal Assistance. Suggestions from this research are to Advocates regarding Integrity, morality, idealism, and professionalism of law enforcement officers should be further enhanced, in addition to the restrictions on the provision of legal aid in LBH should also be reviewed to enforce the principle of providing legal assistance as widely and equality before the law.

Law enforcement is a process to realize the desires that have positive law through the Act into reality. Thus the issue is a matter of law enforcement efforts to realize these abstract ideas into concrete reality. Inclusion of the right of a defendant to obtain legal aid in the inspection process investigation level in the positive law does not mean that the poem was entitled to them, that the suspect will simply obtain legal assistance from attorneys in the enforcement of legal ideas into reality, there are several factors that influence. These factors can be positive in terms of support, and negative in the sense of inhibiting. An obstacle will result in enforcement of the idea of legal aid can not be realized. Factors affecting the enforcement of legal ideas into reality, that is: (1) substance, (2) the structure and culture (3) the means and facilities. substance associated with the positive aspects of the law that allocates rights legal aid, the structure associated with the institutional mechanism of legal aid providers, the culture associated with the existing values in the circles. institutions, infrastructure and facilities associated with the things that make it possible for an institution to carry out the tasks assigned to him. Narcotics are needed by humans for treatment so that to meet the needs in the field of medicine and scientific studies, a continuous production of narcotics is needed for these sufferers. On the basis of considering Law Number 35 of 2009 concerning Narcotics, it is stated that narcotics on the one hand are drugs or materials that are useful in the field of treatment or health services and the development of science and on the other hand can also cause dependence which is very detrimental if misused or used without strict control and supervision. The problem in this research is how to tackle and eradicate narcotics crime? What are the efforts of the Medan Police in overcoming and eradicating narcotics crimes? What are the Obstacles in the Countermeasures and Eradication of Narcotics Crimes at the Medan Police? This research is descriptive in nature, which aims to describe exactly what the characteristics of an individual, condition, symptom, or group are, or to determine the spread of a symptom, or to determine whether there is a relationship between a symptom and other symptoms in society. Efforts to overcome and eradicate narcotics crimes within the jurisdiction of the Medan City Police are carried out through non-penal policies and penal policies. Non-penal policies are carried out through preventive and preemptive measures which are implemented through counseling, narcotics safaris, distribution of pamphlets and billboards as well as approaches to traditional and religious leaders as well as community development. This approach was carried out by the Medan City Police Resort in collaboration with BNN and experts through the perspectives of cultural anthropology, sociology, communication, psychology, healthy life education (public health science). The non-penal policy is aimed at children (including school-age youth) and the general public. Penal policies through law enforcement are also applied to police officers who make mistakes in disclosing narcotics cases. Obstacles in overcoming and eradicating narcotics crime in the jurisdiction of the Medan City Police Resort can be viewed from legal factors, law enforcement factors, facilities and facilities in law enforcement, community factors and cultural factors. The local government of Bali Province issued a policy that was formulated in The Local Regulation of Bali Province Number 9 of 2009. In appendix of The Local Regulation Number 9 of 2009 is described a 12-year compulsory education. This study discusses the effectiveness of The Local Regulation of Bali Province Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province and the factors that influence the effectiveness of the implementation of The Local Regulation Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province. This research is empirical legal research. The nature of research is descriptive. The data in this study include primary data that was collected through interview techniques and secondary data that was collected through the study of literature. The research location is in Bali Province with sample in Denpasar and Bangli regency. The data collected was analyzed qualitatively and descriptively presented analytically. Penelitian ini bertujuan untuk menganalisis dan menjelaskan hukum dan peraturan dalam mendukung penegakan hukum tindak pidana korupsi, upaya penegakan hukum dan faktor-faktor yang mempengaruhi penegakan hukum korupsi di Sulawesi Barat. Metode penelitian yang digunakan adalah penelitian Hukum Empiris. Hasil penelitian ini menunjukkan bahwa: pertama, instrumen yuridis normatif yang mengatur penegakan hukum tindak pidana korupsi sudah memadai, tetapi membutuhkan komitmen yang kuat oleh petugas penegak hukum dalam mengimplementasikan artikel yang relevan, LSM dan dukungan masyarakat untuk penegakan hukum bagi korupsi dan kurangnya pemahaman untuk semua elemen penegakan hukum. kedua, upaya penegakan hukum untuk korupsi di Sulawesi Barat terdiri dari Partisipasi Masyarakat, Profesionalisme Aparat Penegak Hukum, Kemauan Politik Pemerintah Daerah dan Dukungan DPRD Sulawesi Barat. Ketiga, faktor-faktor yang mempengaruhi penegakan hukum korupsi di Sulawesi Barat adalah faktor hukum, faktor penegakan hukum, fasilitas atau fasilitas, faktor masyarakat, dan faktor budaya. This study aims to analyze and explain the laws and regulations in supporting law enforcement of criminal acts of corruption, law enforcement efforts and the factors that influence law enforcement of corruption in West Sulawesi. The research method used is Empirical Law research. The results of this study indicate that: first, a normative juridical instrument that regulates the law enforcement of criminal acts of corruption is adequate, but it requires a firm commitment by law enforcement officials in implementing relevant articles, NGO and community support for law enforcement of corruption and lack of understanding for all law enforcement elements. second, law enforcement efforts for corruption in West Sulawesi consist of Community Participation, Professionalism of Law Enforcement Officials, Political Will of Regional Government and West Sulawesi DPRD Support. Third, the factors that influence law enforcement of corruption in West Sulawesi are legal factors, law enforcement factors, facilities or facilities, community factors, and cultural factors.

Setiap orang adalah sama didepan hukum tak terkecuali penyandang disabilitas. Penelitian berjudul ―Model Pendampingan Hukum Bagi Difabel (Orang Yang Berkebutuhan Khusus) Yang Berhadapan Dengan Hukum Di Kota Medan dan Binjai didukung oleh DIKTI dalam Skim Penelitian Hibah bersaing. Peneliti berharap diakhir penelitian akan diperoleh informasi; Pertama, situasi penyandang Disabilitas mengakses layanan hukum yang tersedia di masyarakat. Kedua, persfektif Organisasi atau Lembaga penyedia layanan bantuan hukum bagi Penyandang Disabilitas. Untuk memperoleh tujuan yang diharapkan penelitian dilakukan menggunakan metode normatif empiris. Peneliti melakukan pengumpulan peraturan hukum dan menganalisanya dilanjutkan dengan pengumpulan data lapangan melalui Wawancara mendalam dengan beberapa informan di Kota Medan dan Binjai. Beberapa temuan awal penelitian memperlihatkan bahwa Kota Medan dan Binjai memiliki kasus pidana yang melibatkan penyandang disabilitas baik sebagai Pelaku, Korban dan Saksi. Tindak Pidana yang melibatkan penyadang disabilitas ini adalah Kekerasan seksual meliputi pelecehan seksual, perkosaan dan incest. Temuan lain penelitian adalah adanya kendala bagi Aparat Penegak Hukum dalam penanganan kasus yang melibatkan Penyandang Disabilitas ini. Penelitian ini menyimpulkan bahwa dalam penanganan kasus hukum yang melibatkan penyandang disabilitas memiliki tantangan khusus terkait keterbatasan penyandan disabilitas. Tantangan tidak hanya dihadapi oleh penyandang disabilitas dan keluarga tetapi juga Aparat Penegak Hukum (APH).   Everyone is equal before the law, including people with disabilities. The study entitled ―The Legal Assistance Model For Disabled (People Who Have Special Needs) Dealing with Law in Medan and Binjai Cities was supported by DIKTI in Competitive Research Schemes. The researcher expected that information would be obtained at the end of the study; First, the situation of persons with disabilities accessing legal services available in the community. Second, the perspective of Legal Aid Services organizations or institutions for persons with disabilities. To obtain the expected goals, the study was conducted using empirical normative methods. The researcher collected and analyzed legal regulations, followed by data collection through in-depth interviews with several informants in the cities of Medan and Binjai. Some preliminary findings of the study showed that Medan and Binjai had criminal cases involving persons with disabilities as Actors, Victims, and Witnesses. The criminal offenses involving persons with disabilities were sexual violence including sexual harassment, rape, and incest. Another finding of the research shows that there were obstacles for Law Enforcement Officials in handling cases involving this Dissability. This study concluded that there were special challenges related to the limitations of disability genders in handling legal cases involving persons with disabilities. The challenges were faced not only by persons with disabilities and families, but also by Law Enforcement Officials (APH).

<p>The court is obliged to uphold justice regardless of one’s social status. Resolving criminal cases is carried out through the courts with various types of examination processes. The examination process is referred to as a normal examination, a short examination, a quick examination in accordance with the Criminal Code. Therefore, it is necessary to know whether the implementation of the rapid inspection program has been carried out in accordance with the<br />applicable rules both in the Criminal Code and other legal rules. The implementation of the quick inspection program at the Bangli District Court can be carried out effectively and efficiently so that the achievement of legal objectives, namely justice and legal certainty for the entire community. It is inseparable from the factors that influence its implementation. So that in this<br />study the author discussed what are the factors that influence the implementation of the rapid inspection program in Bangli District Court and whether there are any factors that become obstacles in the implementation of the rapid examination program at Bangli District Court. The results of the study are as follows: Factors that influence the implementation of the rapid inspection<br />program at Bangli District Court namely; law enforcement, community, facilities and facilities as well as cultural factors.</p>
