According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state) requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state) relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia, such as applying the capitalist economic system. We may fight the capitalist economic system by two legal policy, namely: first one, we may re-create the role of state functions as a controller and regulator of the economy. The second one, we may increase the state income through taxes along with the higher social spending to achieve the social welfare and economic justice.Keywords: welfare state, the constitution of 1945, legal policy

The news is old – neoliberalism is dead for good, but this time, even Financial Times knows it. Obituaries claim that it had died from the coronavirus, as the state, not the markets, have had to save both the people and the economy. The argument of the article is that these academic and media interpretations of ‘emergency Keynesianism’ misidentify neoliberalism with its anti-statist rhetoric. For neoliberalism is, and has always been, about ‘the free market and the strong state’. In fact, rather than waning in the face of the coronavirus crisis, neoliberal states around the world are using the ongoing ‘war against the virus’ to strengthen their right-hand grip on the conditions of the working classes.

If you look at history, at the beginning of a developing country, especially Indonesia previously embraced the theory of growth in its economic system. Walfare State concept born in the era of the 20th century as a correction of the development of the concept of the country as night watchman, the phenomenon of economic capitalism that gradually leads to lameness in the distribution of sources of prosperity. In the Walfare State concept, the state is required to extend its responsibility to the socio-economic problems facing the people. The functions of the state also include activities that were previously beyond the scope of state functions, such as extending the provision of social services to individuals and families in specific matters, such as social security. The role of the state can not be separated with Welfare State because the state that plays a role in managing the economy which includes the responsibility of the state to ensure the availability of basic welfare services in certain levels. Welfare State does not reject the existence of a capitalist market economy system but believes that there are elements in the public order that are more important than market objectives and can only be achieved by controlling and limiting the operation of such market mechanisms.Keywords: walfare state, country, economic systemKonsep Walfare State yang lahir di era abad ke-20 sebagai koreksi berkembangnya konsep negara sebagai penjaga malam, gejala kapitalisme perekonomian yang secara perlahan-lahan menyebabkan terjadinya kepincangan dalam pembagian sumber-sumber kemakmuran bersarma. Fungsi negara juga meliputi kegiatan-kegiatan yang sebelumnya berada diluar jangkauan fungsi negara, seperti memperluas ketentuan pelayanan sosial kepada individu dan keluarga dalam hal-hal khusus, seperti social security, kesehatan.  Peran negara tidak bisa dipisahkan dengan Welfare State karena negara yang berperan dalam mengelola perekonomian yang yang di dalamnya mencakup tanggung jawab negara untuk menjamin ketersediaan pelayanan kesejahteraan dasar dalam tingkat tertentu. Welfare State tidak menolak keberadaan sistem ekonomi pasar kapitalis tetapi meyakini bahwa ada elemen-elemen dalam tatanan masyarakat yang lebih penting dari tujuan-tujuan pasar dan hanya dapat dicapai dengan mengendalikan dan membatasi bekerjanya mekanisme pasar tersebut. Kata Kunci: walfare state, negara,sistem ekonomi

Welfare state or better known as the term prosperous is a form of actualization of idealism that upholds the values of humanism. It containS a set of ideal ideas on how the state is able to serve its people. Capitalism as a modern economic system, which is first demonstrated by humans, built the concept of the walfere state on the philosophy of laizes fair, which manifested itself in a free market system that uphold the value of free faith liberalism. The state in the capitalist system has a famous role with the term minimal role which in the term Adam Smith is said to be no intervesion. These roles include defense security, enforcement of justice and providing and maintaining certain public facilities and institutions. While the concept of walfere state in Islam is an effort to synergize worldly material interests with the spiritual interests of ukrowiyah. In addition, the concept of the welfare state in Islam is also based on the principles of Tawhid, al-Adl and khilafah. The role of the government in the Islamic conception includes fulfilling basic needs and guaranteeing the achievement of spiritual values. This research paper is an investigation of providence of social security to human beings by Islam, also deals with support and security of Islamic economic system for human beings. Islam provides a complete solution to the problems faced by human beings in day to day life. In Islamic society, each and every person will get their basic needs. The one who is disable  or having illness (physical or mental), will be getting its basic needs. The second Caliph, Hazrat Umar (RA) saw an old Jew beggar, who was begging in the market, he called upon him and issued a monthly stipend. Hazrat Umar (RA) knew the responsibility of the state to provide him basic needs, further He state that the beggar had already paid to the state when he was young. Although, it is the duty of the state to ensure the basic needs of the people/citizen of state. Islam, also, encourages the individuals of the society to play their roles for the sustainability of equal system. The Quranic verses stresses on the responsibility of individual and state. The present world meet the misery of the people in nineteenth century while Islam had given born right to every human being, fourteen centuries ago. Islam has a fixed amount (specific amount of gold, silver, cattle and cash) of Zakat which has to be paid by the rich people to the state. In addition, the state will provide Zakat to the deprived people of the society.

There is a dispute between welfare liberals and libertarians about whether redistribution of wealth is a rights violation. Welfare liberals believe that a state should redistribute income and wealth. In contrast, libertarians think redistribution is an intervention and a rights violation to the people who earn money in a free market by their inheritance or gifts. In the debate between Rawls and Nozick, there are two main disagreements about the liberty of whom and to what extent natural talents should be considered a shared asset by a state. MacIntyre thinks that Rawls and Nozick’s moral debate is meaningless since there is conceptual incommensurability of the rival arguments in it. His resolution offers a virtue ethics perspective to be a reconciliation, which fails to provide a universal moral principle in a multicultural world. However, a new way to understand the concept of labor seems to give a justificatory argument for redistribution and welfare state.

Abstract Etimologically, the term of welfare state consists of two words welfare and state. Welfare means prosperity or safety, and state is defi ned as an agency of the society that having a power to control the relation of people and produce the symptoms of power within the society. The term of welfare state is often called in bahasa as negara kesejahteraan. The term of welfare state was used in English by Archbishop York from UK in 1940 as the response and resistance of warfare state from Nazi Hitler in Germany. Welfare state was conducted fi rstly in Europe and US. This program has been conducted to improve the economic system of capitalism more compassionate and to protect the weak within the society as the result of “wickedness” of capitalism. However, the program of welfare state, as time goes by, that has been conducted by capitalism has not worked to create prosperity for the people. The poverty and injustice are still happening until now. These are happening since the misleading of capitalism that only focuses on the increase economic development towards the existence of state creating social prosperity within the society. Therefore, besides material development, Islamic welfare state also focuses on the moral material aspect without followed by spiritual uplift. It is different from Islamic welfare state that gives the interrelated comprehensive concept. This linkage consists of the roles of state and religion to aspect as a social control for the human prosperity. Keywords: Welfare State, Capitalism, Islam

The goal of the article was to remind the state authorities in order to realize that Indonesia was set up aiming for the welfare of the people. Qualitative research was conducted. Data obtained from literature studies and field observations. The analytical method used was descriptive analysis. The results indicate that Indonesia are often far from people's expectations. Authorities, especially of late just thinking about state power without thinking about the lives of the people in general. Indeed, attention to the people of Indonesia by a regime that ever existed up and down sometimes. However, in recent times with the number of cases that exist in the country of Indonesia plus the slogan 'the autopilot' illustrates that the country further and further away from the people themselves. Therefore, the need for Indonesia to return the State Government to be more focused on the welfare of the people widely in the framework towards the welfare state because that is true the goals of Indonesia country was built.
