The analyzes of public policies and their interface with the law are related to the effectiveness of fundamental rights. This article aims to analyze how the creation and execution of public policies aimed at the realization of fundamental social rights, especially those aimed at employment and income, as well as the judicial control of these public policies, are carried out. It seeks to identify the mechanisms and limits inherent to Public Administration to promote the realization of these rights in an equal way. The investigation of institutional designs, federative arrangements, and programs and the legal foundations and theoretical bases of public policies founded with the consolidation of the Constitutional State of Law seek to identify possible bottlenecks in the Brazilian Public Administration for the effectiveness of socialrights, such as those aimed at employment nationwide and the municipal administration, especially in Campos dos Goytacazes. The study will be based on a bibliographic research and analysis of the legislative and jurisprudential process on the subject, with data collection from the websites of the federal and municipal government of Campos, Ministério Público, Courts of Auditors, IPEA, IBGE, Federal Chamber of Deputies and well. as the Federal Supreme Court (STF). With the systematization of theoretical references on public policies and fundamental rights, a proposal to identify the articulation and dialogue between the powers in the area of realization of specific social rights related to work and income, and the elaboration of an article summarizing the results achieved by the analysis of effectiveness with the analysis of the importance of the effectiveness of fundamental rights with the identification and systematization of the main institutional obstacles to their implementation

The article is devoted to research of theoretical problems of the concepts of the subject and object of public marketing. The definitions of these concepts are considered in the article, the evolution of their development is studied. The article provides an analysis of the main approaches to the notion of subjects and objects of public marketing, their relationship and role in the processes of public marketing. The authors proposes concrete approaches to their systematization. These approaches allow us to identify specific types of public marketing and their main characteristics. Relying on the analysis of the concept of “subject of public (state) management”, it is concluded that as bodies of state marketing, most often act as executive bodies of state power. In this case, the following levels of marketing subjects in the system of public administration are allocated: the highest level of executive power; Branch central bodies of executive power; Local government bodies; Separate government agencies. It is noted that the diversity of subjects of public marketing is explained, first of all, by the dependence on the tasks of the state and municipal government, the possibilities of introducing the marketing concept of these subjects and certain characteristics of the said objects of state marketing. It is noted that the concept of “subject of public marketing” is not always the identical notion of “subject of public administration”. First, not all public authorities are subjects of state marketing. In some cases, this is not appropriate, for example, in the activities of the Ministry of Defense of Ukraine or the Ministry of Internal Affairs of Ukraine. Secondly, state marketing is just one of many alternative management concepts, which is not always the most effective in the public administration system.

LABURPENA: «Giza Eskubideetan Oinarritutako Ikuspegiaren» irismena azaltzeko asmoa dauka artikulu honek, zer-nolako aldagaiak eta kontzeptuak biltzen dituen ulertze aldera. Horren bilakaeraz eta indarraldiaz arituko gara, bai eta horren modalitate aplikatua nola nabarmentzen den azalduko ere. Horretarako, Nazio Batuen Erakundearen esparruan garatu diren ekarpenak eta gaiaren inguruko doktrina aditua erabiliko ditugu. Administrazio Publikoan duen indarra ezin ukatuzkoa da; izan ere, estatuak eta horri atxikitako erakundeek oso kontuan eduki behar dute politika publikoak norbanakoen eta komunitateen beharrei arreta ematen ari zaien jakiteko balio duela ikuspegi horrek, edota politika publiko horiek kontu emanez gardentasun publikoa eratzen ari diren nahiz edozelako diskriminazioa saihesten ari diren jakiteko balio duela. RESUMEN: El presente artículo tiene la intención de exponer los alcances del «Enfoque Basado en Derechos Humanos», con la finalidad de entender que variables y conceptos involucra. Haremos un recuento de su evolución, vigencia y cómo se evidencia su modalidad aplicada, a través de diferentes aportes desarrollados en el marco de la Organización de Naciones Unidas, así como de la doctrina estudiosa del tema. Su vigencia en la Administración Pública es de primer orden, puesto que el Estado y sus entidades adscritas, deben tener muy en cuenta que el enfoque citado, sirve para conocer si las políticas públicas, están atendiendo necesidades de individuos y comunidades concretas; generando transparencia pública a través de rendición de cuentas, así como evitando cualquier tipo de discriminación. Finalmente, se analizará su vigencia e impacto en algunos antecedentes jurisprudenciales de la Corte Interamericana de Derechos Humanos. ABSTRACT: This article intends to expose the scope of the «Human Rights Based Approach», in order to understand what variables and concepts it involves. We will recount its evolution, validity and how its applied modality is evidenced, through different contributions developed within the framework of the United Nations, as well as the doctrine studious of the subject. Its validity in the Public Administration is of the first order, since the State and its affiliated entities must take into account that the aforementioned approach serves to know if public policies are addressing the needs of specific individuals and communities; Generating public transparency through accountability, as well as avoiding any type of discrimination. Finally, its validity and impact will be analyzed in some jurisprudential antecedents of the Inter-American Court of Human Rights.

Resumo: O presente artigo tem como objetivo analisar a negociação coletiva de trabalho como um direito fundamental. Este artigo parte da analise conceitual do conflitos coletivos de trabalho, seguido pelo estudo da negociação coletiva de trabalho como direito fundamental, com fundamento na Constituição da República Federativa do Brasil de 1988, nas convenções da Organização Internacional do Trabalho ratificadas pelo Brasil sobre a matéria e na legislação nacional sobre o tema, com a recentemente aprovada Lei nº 13.467, de 13 de julho de 2017 que, com a vacatio legis, entrará em vigor 120 dias após a sua publicação. Os novos artigos 611-A e 611-B da Consolidação das Leis do Trabalho propõem força de lei para a negociação coletiva de trabalho, afastando as hipóteses que fazem parte do rol dos direitos fundamentais sociais trabalhistas previstos no artigo 7º da Constituição Federal e que não podem ser objeto de negociação. Abstract: [This article aims to analyze collective bargaining as a fundamental right. This article is based on the conceptual analysis of collective labor conflicts, followed by the study of collective bargaining as a fundamental right, based on the Constitution of the Federative Republic of Brazil of 1988, the International Labor Organization conventions ratified by Brazil on the subject and In the national legislation on the subject, with the recently approved Law no. 13467 of July 13, 2017 which, with the vacatio legis, will come into force 120 days after its publication. Resumo: O presente estudo tem por objetivo analisar o controle judicial das políticas públicas. Para tanto, será explanado o conceito doutrinário dessas políticas, bem como a delimitação da seara política na qual se desenvolvem. Uma breve abordagem da divisão dos poderes será necessária, com vistas a melhor definir o que pode ser considerado como ativismo judicial. Sobre este mesmo tema do ativismo, será demonstrado que não existe um consenso em sua classificação, mas que esta depende do tempo e lugar a ser analisado. Uma relevante discussão sobre a Teoria da Reserva do Possível é demonstrada, bem como a possibilidade ou não da sua utilização quando da análise da legitimidade da intervenção judicial na esfera de atuação dos demais poderes da república. Por fim, será estudado o tema da intervenção judicial na atualidade, e suas possíveis consequências para a democracia.Palavras-chave: Políticas públicas; Ativismo judicial; Reserva do possível.                                Abstract:This study aims to analyze the judicial control of public policies. Thus, the doctrinal concept of these policies will be explained, and the delimitation of political harvest and develops. A brief overview of the division of powers is necessary, in order to better define what can be considered as judicial activism. About this same theme of activism, will be shown that there is no consensus on their classification, but it depends on the time and place to be analyzed. A relevant discussion on the possible Reserve Theory is demonstrated, as well as whether or not their use when analyzing the legitimacy of judicial intervention in the sphere of activities of the other two branches of government. Resumo: O estudo objetiva a demonstração da teoria das dimensões dos direitos fundamentais como pressuposto à consagração de garantias fundamentais processuais. Para atingir tal intento foi utilizado o método da revisão bibliográfica, notadamente da doutrina constitucional, bem como do estudo de casos trazidos a debate por autores que analisam o processo sob a ótica da Constituição. A relevância do assunto deve-se ao momento atual da ciência jurídica em que a efetividade dos direitos fundamentais é um escopo concreto. Constatou-se a necessidade de tornar eficiente e efetiva a prestação jurisdicional no Estado constitucional e de reconhecer as garantias processuais como direitos fundamentais. Em tal contexto, a eficácia irradiante, a filtragem constitucional e a multifuncionalidade dos direitos fundamentais são abordados. E as balizas teóricas do neoconstitucionalismo e do neoprocessualismo ou formalismo-valorativo são analisadas como pano de fundo das noções desenvolvidas. Assim, a verificação da evolução dos direitos fundamentais processuais, mormente do direito de ação (tutela jurisdicional efetiva) e do devido processo legal (processo justo), a partir da aceitação da teoria das dimensões dos direitos fundamentais, conduz à conclusão de que se caminha na direção de um acesso cada vez mais efetivo à justiça. Palavras-chave: Normas Jusfundamentais; Direito à Proteção; Direito Processual; Conformação do Procedimento; Devido Processo Legal.  Abstract: The study aims at demonstrating the theory of dimensions of fundamental rights as an assumption to the recognition of fundamental procedural guarantees. In order to accomplish this intent the method of bibliographic review was used, notably the constitutional doctrine, as well as the study of cases brought into debate by authors who analyze the process under the eyes of the Constitution. The relevance of the subject is at the current moment of the juridical science in which the effectiveness of fundamental rights has turned into a concrete objective. It was verified the necessity to achieve an efficient and effective jurisdiction in the constitutional State and to recognize procedural guarantees as fundamental rights. In this context, the radiant effectiveness, the constitutional filtration and the multifunction of fundamental rights are approached. And the theoretical landmarks of neo-constitutionalism and neo-proceduralims are analyzed as a background for the notions developed. So the verification of the evolution of fundamental procedural rights, especially the right of action and the due process of law (fair trial), since the admission of the theory of dimensions of fundamental rights, conduce to the conclusion that heads toward the direction of a more effective judicial access. Key-words: Jus-Fundamental Norms; Right to Protection; Procedural Law; Procedure Adequacy; Due Process of Law.

RESUMO: O presente artigo tem como objetivo analisar o mínimo existencial ecológico e a judicialização das políticas públicas. Assim, por primeiro, analisa-se a dignidade da pessoa humana como base dos direitos fundamentais, bem como os direitos sociais como direitos fundamentais em sua formação e essência absoluta. A partir da análise dos direitos sociais chega-se ao conceito de mínimo existencial. Na sequência, após a delimitação conceitual das políticas públicas, examina-se o controle jurídico destas e a cláusula da “reserva do possível”. Depois, diante da crise ecológica atual e dos problemas ambientais enfrentados apresenta-se o conceito de mínimo existencial que, no entanto, deve ser ampliado. Por fim, formula-se o conceito de mínimo existencial ecológico, que deve ser delineado pelas políticas públicas no âmbito ambiental, sendo perfeitamente possível a sua discussão judicial, apesar de não estar contido em lei específica que o consagre. Palavras-chave: Direitos sociais fundamentais. Política Pública. Mínimo existencial. Mínimo existencial ecológico.  ABSTRACT: This article aims to analyze the ecological existential minimum and the judicialization of public policies. Thus, for first, analyzes the dignity of the human person as the basis of the fundamental rights and social rights as fundamental rights in their training and absolute essence. From the analysis of social rights comes to the concept of existential minimum. Following after the conceptual definition of public policies, examines the legal control of these and the clause of "reservation of the possible". Public policies as a means by which public action is directed and common goals are achieved have long been the subject of study of foreign legal science. In Serbia, public policies have gained more significant affirmation in recent years, especially in the context of public administration and public administration reform. Public policies are studied from the aspect of different sciences, political, organizational, but having in mind that public policies are especially related to the activities of the administration, it is the subject of interest of legal sciences, more precisely the science of administration. The state ensures the implementation of public policies in various areas of social life (health, education, environmental protection, etc.), bearing in mind that it has the necessary capacities and organization, through its administrative apparatus. The aim of this paper is a deeper understanding of the policy-making process, their role in achieving the public interest, the process of implementation and evaluation of public policy effects, as well as the relationship and relations that public policies have with government and public administration, both from the perspective of policy makers and and from the aspect of directing the work of public administration.

The article aims to analyze the impact of the digitalization of Public Administration activities, labeled Electronic Government, on the ability to fulfill fundamental social rights. It adopts as a base the concept of digital invisibility, defined as the inability to have access to the digital government, mainly based on empirical data to access the world wide web. It uses the deductive methodology from the bibliographic analysis about the matter. It verifies the hypothesis that the use of technological tools as unique mediators poses a particular risk to social rights due to digital invisibility. Taking into account the objective dimension of fundamental rights, it concludes that the State must guarantee digital access broadly, especially to vulnerable groups. State recipients should not be imposed insurmountable obstacles in the search for the fulfillment of constitutional promises.

Social rights proclaimed by constitutions of many countries, for their effective protection need in formation of special instrumental means of judicial control, by which the court establishes the limits of the competences of the legislator in the field, where a significant margin of appreciation is provided. The concrete obligations of the state and the amount of funding for social provisions of constitutions are defined by current legislation. Requirement to provide minimum standards of human existence, that are ensured, if necessary, through the system of social security, is referred to the constitutional level. Constitutional meaning of this provision is justified by the recognition of the principle of human dignity as an integral part of the entire human rights system. Herein, the constitutional courts considering cases, connected with social rights, carry out an inspection of social legislation on the subject of whether the norms under consideration provide a living wage. Such verification is considered as the criterion of human dignity, equally inherent in all people, and is used as one of the strategies of judicial protection of social rights.
