In the Minang community, women are considered as holders of trust and all decisions related to the use of their typical land are still dependent on the decisions of the adat leaders. In another sense, a woman is justified in possessing but the property given to her is pregnant soon (Norhalim Ibrahim 2005). Indigenous women will be grouped with land ownership but in terms of power and rights to land still controlled by traditional leaders. The lack of power in the context of managing and using customary land has led to various issues that have touched indigenous lands. The issue is the issue of customary land that is not cultivated and has become widespread. Therefore, this study aims to examine how indigenous women become hindered as a result of the boundaries held by them. Therefore, in-depth interviews with customary land owners in the study area were conducted. The study found that there were a number of obstacles that hindered efforts to capture indigenous women. Because of the allocation of Enakmen Chapter 215 customary land, conflicts between trustees and tribes, it is difficult to obtain credit facilities and the location of customary land. This situation eventually pushed to the limits of efforts to wake up the economy of women. The lack of power resulting from limited property rights makes the economic empowerment of indigenous women not easy to handle. Thus some changes in the context of traditional leadership must need to think about the relevance of ownership that is more utilizing the owner, but in the same period it does not conflict with the existence of the Minang ethnic and ethnic groups.

Keywords: Indigenous women, empowerment, ownership of land, land ownership and pregnancy

This research focuses on studying conflicts involving traditional villages in fighting over the ownership status of the Temple of Death (Pura Dalem) as an asset that must be owned by a traditional village. Conflict involving two traditional villages in Bali, namely Kemoning and Budaga Village in Klungkung, resulted from a claim of ownership by one of the parties ahead of a massive celebration tribute to this temple’s birth centuries ago. The ownership claim led to rejection from another party, who said their traditional village was also entitled to the Temple of Death. This mutual ownership claim then escalated into an open conflict that resulted in casualties and injuries between the two parties. This research seeks to outline the root problems of this conflict and describe the actors, dynamics, and impacts of the conflict. This study used a qualitative approach through in-depth interviews with five informants consisting of two key informants (former heads of the Kemoning and Budaga Villages), one Klungkung resort police officer, and two people Kemoning and Budaga Village residents. Moore, Mitchell, Furlong, and Kriesberg use several perspectives to analyze the social conflict. The results showed that the problem of the two traditional villages lies in the inaccuracy of historical data, besides that there are different perspectives between the two parties about the existence of this temple, excessive control, and dominance in the management and poor communication caused the emergence of a hostile relationship pattern, raising mutual claims over the ownership of this Temple of Death. The dispute that led to this clash created an increasingly tenuous relationship between the two traditional villages.

The large number of land in DKI Jakarta province that have not yet beenregistered is a significant potential tax in increasing BPHTB tax revenue. But in its implementation, the imposition of BPHTB tax for granting new rights to this land is still experiencing obstacles. The constraints experienced are the imposition of BPHTB administrative sanctions based on the time of debt due to the signing of the BPN Decree (SK). In this case, Jakarta’s citizenas tax payers felt disadvantaged because they were subjected to administrative sanctions due to the delay in receiving the BPN Decree. Based on the results of the analysis through data collection in the field, literature study as reference material and in-depth interviews with related parties, author concluded that BPRD DKI Jakarta, DKI Jakarta Regional Office of BPN and PPAT DKI Jakarta have been cooperating well in the imposition process of BPHTB tax. But in reality, there are still problems in the case of the imposition of BPHTB administrative sanctions for granting new rights to land due to delays in receipt of SK BPN by taxpayers. To minimize this, a more comprehensive collaboration is needed between agencies, namely BPRD DKI Jakarta, Regional Office of BPN DKI Jakarta and PPAT in DKI Jakarta by conducting Collaborative Governance. With Collaborative Governance, it is expected that services to taxpayers will be better and BPHTB tax revenues in DKI Jakarta will increase.
