<strong>Abstraks</strong>: <strong>Pemali </strong><strong>d</strong><strong>alam</strong> <strong>Perspektif</strong> <strong>Hukum Islam: Studi Fenomenologi di Masyarakat Patampanua Matakali Polewali Mandar</strong>. <em>Pemali</em> di tengah masyarakat menjadi kearifan lokal yang bisa mengarahkan subjek masyarakat dalam bersikap dan bertindak. Konstruksi ini sejatinya selaras dengan adanya hukum Islam yang ingin menjaga ketentraman dan kesejahteraan masyarakat. Oleh karenanya, riset ini memfokuskan pada konsep <em>pemali</em> yang ada di masyarakat suku Mandar di desa Patampanua kecamatan Matakali kabupaten Polewali Mandar dilihat dari sudut pandang hukum Islam. Dari fokus riset ini, pendekatan yang digunakan adalah kualitatif dengan jenis fenomenologi. Riset ini menemukan bahwa konstruksi <em>pemali</em> yang ada di masyarakat suku Mandar muncul disebabkan setidaknya tiga faktor utama, yaitu faktor lingkungan, psikologi dan faktor sosial. Konstruksi ini ketika dilihat dari perspektif hukum Islam memiliki kesesuaian visi untuk membangun masyarakat yang memiliki moralitas, sehingga subjek masyarakat melalui <em>pemali</em> senantiasa terjaga dari perilaku dan sikap yang destruktif.<br /><br /><strong>Kata Kunci</strong>: <em>Pemali</em>, Polewali Mandar, kearifan lokal, hukum Islam<br /><strong> </strong><br /><strong>Abstract</strong>: <em>Pemali</em> in the community has become a local culture that could engineer the community to behave and act. This construction is actually in harmony with the existence of laws that becomes as an avenue to maintain the peace and welfare of people. This research focuses on the concept of <em>pemali</em> in the Mandar tribe community in Patampanua village, Matakali sub-district, Polewali Mandar district from the perspective of Islamic law. From the focus of this research, the approach used is qualitative with phenomenology type. This research found that the existing <em>pemali</em> construction in the Mandar tribe community emerged due to at least three main factors, namely environmental, psychological, and social factors. This construction when viewed from the perspective of Islamic law has a concurring vision to build a society that has morality. So that the subject of society through <em>pemali</em> is always avoided by destructive behavior and attitudes.<br /> <br /><strong>Keywords</strong>: <em>Pemali</em>, Polewali Mandar, local wisdom, Islamic law

Abstract: Culture as a result of the free and dual human creative power of the natural world, it encompasses the material matters (Immaterial) and Maddi (material), real and unreal objects, Malmusah and Ghairu malmusah (palpable and untouched). Essentially, culture (Tsaqafah) is expressed as the product of human reason consisting of patterns, steady attitudes, thoughts, feelings, and reactions obtained and is primarily derived by symbols that make up its achievement independently of human groups. The nature of this Islamic responsiveness has been built by the Prophet (s) when prohibiting Khamr, forbidding the worship of idols and other shari'ah. How Rasulullah saw is very careful and gradual in doing da'wah, so achieved the success of da'wah in upholding Islamic creed and shari'ah at that time. Today many problems in the establishment of law and legislation, legislators are more concerned with intellectual subjectivity and importance than the objectivity of humanity to the benefit, resulting in policies that are not responsive to the needs of society. The author in this context tries to inventory the various local wisdom of the Muslim community in the archipelago that is relevant as an approach in establishing legislation based on local culture.Keywords: Local Culture, Legislation, Islamic Law Abstrak. Budaya merupakan hasil dari kreativitas manusiawi yang bebas dan alamiah, meliputi sisi immaterial dan materi, objek nyata dan tidak nyata, malmusah dan ghairu malmusah (gamblang dan tak tersentuh). Pada dasarnya, budaya (tsaqafah) merupakan produk akal manusia yang terdiri dari pola, kesantunan, pikiran, perasaan, dan reaksi yang diperoleh dan terutama berasal oleh simbol yang membentuk pencapaiannya secara mandiri dari kelompok manusia. Sifat dari respon Islam ini telah dibangun oleh Nabi (s) ketika melarang khamr, melarang penyembahan berhala dan syariah lainnya. Bagaimana Rasulullah melihat sangat hati-hati dan bertahap dalam melakukan dakwah, sehingga mencapai keberhasilan dakwah dalam menegakkan akidah Islam dan syari'ah pada waktu itu. Saat ini banyak masalah dalam pembentukan hukum dan undang-undang, di mana legislator lebih peduli dengan kepentingan subjektivitas intelektual daripada kepentingan objektivitas kemanusiaan, sehingga kebijakan yang lahir tidak responsif terhadap kebutuhan masyarakat. Penulis dalam konteks ini mencoba untuk menginventarisasi berbagai kearifan lokal komunitas Muslim di nusantara yang relevan sebagai pendekatan dalam menetapkan perundang-undangan berdasarkan budaya lokal.Kata Kunci: Budaya Lokal, Legislasi, Hukum Islam

The emphasis of this monograph has been on the historical, cultural, religious, and social factors that shaped C. S. Lewis and his reception. Until recently those who have considered the subject have attributed his popularity to virtues of the man himself. The fact that Lewis, in effect, was an image, a mitigated commercial product, a platform, has largely been overlooked. A critical component of Lewis’s reception is the opportunities that education provided the middle classes for social mobility in the twentieth century and the social divisions and anxieties attendant upon those evolutions. Of equal importance is the timing of Lewis’s life and publications with print history and the rise of mass media and entertainment. Lewis’s platform as a contrarian Christian resisting modernity and his reactions to the intellectual, social, and religious changes of his day made the critical difference to his transatlantic receptions.

Assisted reproductive technology (ART) is hailed as “the holy grail” for infertile patients in the mainstream narrative. The existing studies have clearly demonstrated how external social factors shape how ART is to be used, but they ignore the recipients of the technologies, and especially the experiences of women. Based on an investigation conducted in Z hospital’s reproductive center, this article regards embodiment as the methodological orientation for integrating socio-cultural context with female embodied experience in order to show their bio-social entanglement. As fieldwork evidence indicates, ART in practice is far from simple “hope technology”; instead, it throws women into a paradoxical world in which hope and anxiety coexist. Embodied experience, hope, and anxiety are transmitted through the bodies of women, which reveals the inscription of social-cultural context and technical uncertainty on the female body and, meanwhile, women actively learn strategies by which to cope with the technical uncertainty and moral pressures from local culture (including healing the body, folk religion, etc.), so as to hold onto infertility treatment with hope.

AbstractThis socio-legal narrative investigates the journey from “biological” to “societal” filiation undertaken by Islamic and international law regimes in their endeavors to ensure a child's right to name and identity. Combining a discussion of filiation—a status-assigning process—with adoption and kafāla (fostering) as status-transferring mechanisms, it highlights a nuanced hierarchy relating to these processes within Muslim communities and Muslim state practices. It questions whether evolving conceptions of a child's rights to name and identity represent a paradigm shift from “no status” if born out of wedlock toward “full status” offered through national and international law and Muslim state and community practices. The article challenges the dominant (formal, legal) position within the Islamic legal traditions that nasab (filiation) is obtainable through marriage alone. Highlighting inherent plurality within the Islamic legal traditions, it demonstrates how Muslim state practice and actual practices of Muslim communities on the subject are neither uniform nor necessarily in accordance with stated doctrinal positions of the juristic schools to which they subscribe. Simultaneously, the paper challenges some exaggerated gaps between “Islamic” and “Western” conceptions of children's rights, arguing that child-centric resources in Islamic law tend to be suppressed by a “universalist” Western human-rights discourse. Tracing common threads through discourses within both legal traditions aimed at ensuring children a name and identity, it demonstrates that the rights values in the United Nations Convention on Rights of the Child resonate with preexisting values within the Islamic legal traditions.

In recent years there has been an increased interest in Islam and Islamic law. Islam plays a very significant role in the modern world. Close interaction between legal and religious prescriptions of Islam, the religious basis of Muslim law, Muslim character is not in doubt. The article analyses informal religiosity of Muslim peoples of the Middle Volga and Urals in the 1960-1970. This time for relations between the authorities and Islamic institutions is relatively liberal. The restoration and development of official, allowed in the Soviet Union, as well as quite nontraditional for the Soviet time Islamic practices are noted by the authorities in the Middle Volga and the Urals. The reports name such informal forms of religiosity as neo-paganism, wandering mullahs, unofficial Muslim groups, worship, places of burial of saints and Sufi sources. The authorities, the party authorities, the official Muslim clergy stopped all forms of unofficial religiosity. For the Muslim peoples Islam has often been the subject of interest as a cultural component of their traditional worldview rather than a religious system. The authors believe that the Islamic religion has moved from ethno-cultural to the personal, informal level.

Abstrak Pemberlakuan aturan mengenai kewarisan di Indonesia selama ini terjadi perdebatan antara para ahli hukum tentang status hukum Islam dan hukum adat.Berkaitan dengan permasalahan dalam hukum waris pada hukum Islam dan hukum Adat, maka perlu adanya kesesuaian bagi masyarakat yang akan mempergunakan masing-masing hukum tersebut dalam menyelesaian warisannya kepada sang ahli waris yang berhak. Ketentuan hukum Islam di Indonesia belum merupakan undang-undang (kodifikasi) haruslah sistematis dan prosedural, harus jelas siapa subyek dan obyeknya dan diundangkan oleh lembaga yang berwenang dalam negara. Rumusan masalah dalam penelitian ini adalah bagaimana perbandingan dalam pembagian waris berdasarkan pada hukum islam dan hukum adat. Metode penelitian ini menggunakan metode kualitatif dengan metode pendekatan yuridis empiris. Hasil penelitian yaitu Hukum waris Islam telah menempatkan atauran kewarisan dan hukum mengenai harta benda dengan sebaik-baiknya dan seadil-adilnya. Islam menetapkan hak milik seseorang atas harta, baik bagi laki-laki maupun perempuan seperti perpindahan hak milik dan perempuan pada waktu masih hidup atau perpindahan harta kepada ahli warisnya setelah ia meninggal dunia. Hukum waris adat berpangkal dari bentuk masyarakat dan sifat kekeluargaan yang terdapat di Indonesia menurut sistem keturunan, dan setiap sistem keturunan yang ada mempunyai kekhususan dalam hukum waris yang satu dengan yang lain berbeda-beda. Kata Kunci:Waris, Hukum Islam, Hukum Adat Abstract The enactment of the rules regarding inheritance in Indonesia has been a debate between legal experts about the status of Islamic law and customary law. In connection with problems in inheritance law in Islamic law and Customary law, it is necessary for the community to use each of these laws in complete the inheritance to the rightful heirs. The provisions of Islamic law in Indonesia are not yet laws (codification) must be systematic and procedural, it must be clear who the subject and object are and are promulgated by the authorized institutions in the country. The formulation of the problem in this study is how comparisons in inheritance distribution are based on Islamic law and customary law. This research method uses qualitative methods with an empirical juridical approach method. The results of the research, namely Islamic inheritance law has placed the inheritance and law regarding property as well as possible and as fair as fair. Islam establishes someone's property rights, both for men and women, such as the transfer of property rights and women while still alive or the transfer of property to his heirs after he dies. This paper aims to elaborate the dynamics of Islamic law assimilation with local culture. With the hope that in the future it will form a basic perspective in shaping the philanthropy of contemporary Islamic law based on the reality of Indonesian society. The basic questions which is going to be answered through this paper are, first, the extent of the adaptability of Islamic law in the midst of multicultural society conditions in Indonesia. Second, what are juridical, normative and sociological arguments in placing zakat as a support for the integrity of the Unitary State Republic of Indonesia. Third, How is the Formulation of the Concept of Zakat within the frame of Unitary State Republic of Indonesia? The conclusion from this study shows that, first, the characteristics of Islamic law indicate the ability of adaptability to the culture of the society in which it is accepted. Even in this case Islam has provided important principles regarding rational development in efforts to adapt to its new environment. Second, placing zakat as a support for the integrity of the Unitary State Republic of Indonesia is worth to be formulated. This is a logical consequence of the efforts of the Islamic ummah to always place al-Qur'an and al-Sunnah as limited texts. One of the most fundamental results of Indonesian social culture is the realization of the Unitary State of the Republic of Indonesia. Making the formulation of zakat in the frame of the Unitary State Republic of Indonesia is a clear proof that Islamic law contains universal values that are valid in any time and any place. Third, the methodological formulation of zakat in the frame of Unitary State of the Republic of Indonesia is in a dynamic and accommodating ijtihad towards change. This methodological framework is based on al-Mashlahah, ‘Urf, Sad Dzaria'ah and dialectics between Gama and the State.

Managing broadcasting management is not easy. Managing the broadcasting business is a difficult and challenging. This research aims to analyze the activity of management and organizational performance ACEH TV television media in an effort to disseminate the Islamic Sharia and Preservation of Local Culture in Aceh. This research is descriptive qualitative. Informants of this research is managing director, program director, executive producer, cameraman / reporter, as well as additional informants Regional Chairman of the Indonesian Broadcasting Commission (KPID) Aceh, Aceh Province Department of Islamic Law, and local media observers. The location of this research is in Banda Aceh, Aceh province.Sampling was done purposively. Data collected through observation, interviews, and documentation. Data were analyzed by analysis of an interactive model of Miles and Huberman. The results showed that the ACEH TV as the medium of television that is broadcasting management ACEH have done according to a local television broadcasting standard. Agenda setting function of mass media performed in the ACEH TV dissemination of Islamic Shariah in Aceh and local culture to influence the people of Aceh to implement Islamic Sharia and also maintain the culture and local wisdom Aceh. It can be seen from all the programs that are aired ACEH TV is a program of local cultural nuances of Islamic law.There are still some shortcomings in running broadcasting broadcasting technology such as lack of equipment that is increasingly sophisticated. The results of image editing is very simple, and some programs presenter still looks stiff when in front of the camera. Keywords: Management of ACEH television,Islamic law,local culture Acehnese,agenda setting.


The factors influencing the intensification of the migration process have been considered since the appearance of the first migration theories. These factors determine both the potential migration opportunities and the actual conditions for the implementation of the migration process. Among the main factors that determine the intensity of the migration process, basic are the factors formed by the labor market (economic factors). Despite a number of migration theories that consider other factors, such as the demand structure, psychological and social factors, we determine the impact of precisely the economic factors (factors formed in the labor market) as the most significant. In today’s world, when determining the intensity and main directions of migration, the economic factors are taken into account by the majority of migrants. At the same time, indirect factors play an important role in the analysis of the migration process. Indirect factors, determining the basic conditions for the intensification of the migration process, form the potential for migration. Potential migration opportunities form an environment that determines the potential number of migrants. Indirect factors include not only the parameters of the development of the national economy as a whole, but also the parameters of the development of individual regions or territories that form the migration attractiveness of these regions.
