The article, dedicated to the 210th anniversary of creation of a single Russian transport administration and transport education and based on historical information, analyzes the relationship between development of transport and transport law in Russia.The increasing need for legal regulation of more and more complicated and increasingly complex transport relations comprises development of transport law as one of the key tasks in achieving the goals of the transport industry.When considering the current state of transport law in Russia, various approaches to the composition and degree of autonomy of the transport law area, as well as certain regulatory issues, are analyzed.The general tasks of transport law in the sphere of regulation of the most relevant fields of transport activity are determined, the possibility of creating a single code of transport legislation and legal norms, the importance of intensifying transport and legal research are substantiated.

This article examines the issues of differentiation of legislative and subordinate regulation of public relations. It is noted that in the process of law-making activities, including the legislative process, practical questions often arise about the competence of various state bodies to establish various legal norms and rules. These issues are related to the need to establish a clear legal meaning of the constitutional norms devoted to the definition of the subject of regulation of laws. In particular, there is a need to clarify the provisions of paragraph 3 of Article 61 of the Constitution of the Republic of Kazakhstan in terms of the concepts "the most important public relations", "all other relations", "subsidiary legislation", as well as to establish the relationship between these concepts. Interpretation is also required by the provisions of p. 4 of Article 61 of the Constitution in terms of clarifying the question of whether the conclusion follows from mentioned provisions that all possible social relations in the Republic of Kazakhstan are subject to legal regulation, including those that are subject to other social and technical regulators (morality, national, business and professional traditions and customs, religion, standards, technical regulations, etc.). Answering the questions raised, the author emphasizes that the law and bylaws, as a rule, constitute a single system of legislation, performing the functions of primary and secondary acts. However, the secondary nature of subsidiary legislation does not mean that they regulate "unimportant" public relations. The law is essentially aimed at regulating all important social relations.

This research article, as the title suggests, is devoted to the general theoretical problem of the relationship between local legal norms and corporate norms. In the conditional first part of the study, local law norms are analysed, including from a historical perspective. Noting that the problem of local regulation has been the focus of attention of Soviet scientists (N.G. Ale-xandrov, R.I. Kondratyev, S.S. Karinsky, F.M. Leviant, L.I. Antonova), it is emphasized that local acts were originally understood as the result of rulemaking organizations, enterprises, institutions in the field of labour relations. An analysis of modern legal educational literature shows that scientists, when classifying the norms of law, either do not mention the existence of local norms of law at all, or show insufficient attention to their analysis, limiting them-selves to a few phrases. In doing so, authors often unreasonably fail to distinguish between local and departmental legal regulation or local and local legal regulation. Analyzing the types and essential features of local legal acts: their volitional content, intra-organizational character, bylaw nature, dynamism and stability, multiple application, duration of existence, compulsory for the addressees of norms, maintaining by the coercive power of the state, the author rightly states that all local acts arise by direct instruction of law, indicating that on a given issue This assertion is supported by examples of labour law and education law. By focusing on local labour law norms, the necessity of their adoption is justi-fied, and mandatory local law norms are analysed. It is thought that one of the current problems concerning local rules of law is their rela-tionship to corporate rules. It is the fact that many authors unreasonably refer to the norms of individual state organisations, i.e. local norms of law, as corporate norms. The author takes the position that corporate norms are rules of conduct established and provided by non-state organizations (political parties, public organizations, non-state institutions and enterprises, etc.) and apply to their members; they are contained in the statutes, regulations and other regulations of non-state organizations and determine the formation of these organizations, their structure, competence, rights, duties and responsibilities of their members. Moreover, the paper defends the view that corporate norms include, first, non-social cor-porate norms: technical norms; sanitary and hygienic norms; physiological norms; biological norms; second, social corporate norms: corporate customs, traditions, aesthetic, business customs, legal norms. In conclusion, it is argued that, although both local legal norms and corporate norms are intra-organisational in nature, they should be distinguished. Moreover, corporate norms, which have both technical and social aspects, should also be seen as having a legal aspect, implying the presence of corporate law norms.

This article examines the specifics of legal regulation of sustainable development in China and Russia. This topic is exceptionally relevant today since legal regulation of this area should create effective frameworks for the relationship between people and nature. The authors draw attention to the fact that sustainable development is better implemented when it is supported both by international standards and, necessarily, by national laws. The approaches then that China and Russia, both member countries of the BRICS bloc, are taking in implementing sustainable development are of importance, and thus described and contrasted in this study. To do so, the authors apply the comparative legal analysis, which makes it possible to distinguish both the advantages of international and national systems and the disadvantages. Based on their methodology, the authors formulate possible recommendations for each nation.

Abstract This study aims to find out how the principle of land acquisition for the public interest. The principle is only sought based on the legal norms that apply in Indonesia. The paper discusses the terminological aspects of the system of legal regulation of cross-border relations in the field of industrial property. The use of the term “cross-border relations” does not in itself imply the overcoming of the territorial principle of industrial property protection. Transboundariness as a characteristic of private-law relations, which presupposes a complication of the relationship by a foreign element, means the presence of any connection between the relationship (through a subject or legal fact in the case of cross-border relations in the field of industrial property) with the legal order of several states. It is proposed to define industrial property as rights (exclusive and personal non-property) related to intellectual property in the production-technical and production-trade areas. The system of legal regulation of cross-border relations in the field of industrial property is defined by the author as a coherent group of norms consisting of interrelated and interdependent principles of protection of industrial property (universal, general object and special object), other international and national substantive legal and national conflict-of-laws norms subordinate to these principles, as well as individual norms of non-state nature, subordinate to all the specified legal norms, regulating relations complicated by a foreign element regarding the emergence, use, transfer, restriction, termination, protection of rights to industrial property. In this case, a foreign element in a legal relationship can be represented by the subject, as well as by a legal fact: the place of violation of the right to the industrial property object, the place of execution of the formalities necessary for the protection of the industrial property object, as well as the place of occurrence of the consequences of harm caused by the violation of rights to intellectual property object.

В статье проводится анализ теоретических положений правового регулирования оперативно-розыскной деятельности и современного состояния нормативного регулирования рассматриваемой деятельности в исправительных учреждениях. На основе сравнительного анализа современной научной литературы по рассматриваемому вопросу автором делается вывод, что исследователи, как правило, отождествляют понятия «правовое регулирование» и «правовая основа» и не уделяют должного внимания правовому регулированию оперативно-розыскной деятельности как процессу, а также формулируется авторское определение «правовое регулирование оперативно-розыскной деятельности». Автор предлагает разделить нормативное регулирование оперативно-розыскной деятельности в исправительных учреждениях на три уровня: конституционный, федеральный, ведомственный и межведомственный. В рамках проведенного исследования были выявлены недостатки ряда правовых норм и предложены пути по их решению. The article analyses both the theoretical provisions of the legal regulation of operational and search activities and the current state of the regulatory regulation of the activities in correctional institutions. On the basis of a comparative analysis of the current scientific literature on the subject, the author concludes that researchers generally identify the concepts of "legal regulation" and "legal basis" and do not pay due attention to the legal regulation of operational-search activities as a process, as well as the author 's definition of "legal regulation of operational-search activities." The author proposes to divide the normative regulation of operational-search activities in correctional institutions into three levels: constitutional; federal; departmental and interdepartmental. The study identified shortcomings in a number of legal norms and suggested ways to address them.

The police effectiveness in modern Russia depends not only on the professional training of employees, their logistical support and other factors, but a large role belongs to the legal tools at their disposal. But in practice, a certain legal collision periodically arises – the problem of the discrepancy be-tween legal norms of objective reality or, in some cases, the complete ab-sence of legal regulation of a certain circle of social relations. Given this, the study of the legislation system regulating the police activities is particularly relevant. In this work, we evaluate the current system of legislation regulating the police activities. In addition, we suggest ways to improve the systemati-zation of departmental police regulations. Thus, we state that the existing significant number of regulatory legal acts of the police system and the scope of relations, which are regulated by departmental norms, determine the need for codification work. We suppose that the problems of the large number of departmental normative acts can be solved with the help of such systematic activity as consolidation, that is, combining several acts into one larger one without significant changes to the text. In this work, we propose a definition of the term “police”, which needs legislative consolidation in the Federal Law “On Police”.

Social relations regarding economic transport activity in maritime ports require a clear, concise and coherent body of legislation to support the transport community and the representatives of related industries, so that they can pursue their proposed business objectives, a fair, competitive and safe public order environment. We believe that piloting and sea towing must be circumscribed by this desideratum, a poor legal regulation making it difficult for ships to enter and exit from and to the Port of Constanta and, moreover, be able to cause a real economic or environmental disaster. In this respect, we have proposed in the present paper to analyze from the perspective of legal regulations, as a case study, the most important piloting accident that occurred in the Romanian ports on November 1st 2015 between two commercial ships flag Malta and Turkey, showing the consequences, as well as the potential dangers that could have occurred.

In the article the specifics of the current state of legal regulation of terms in labor law are analyzed. The peculiarities of the legal norms that regulate this sphere are highlighted. The contents of each are outlined. For the realization of any labor law it is necessary to create the necessary conditions. These include legal regulation and time limits. At the same time, these concepts are interrelated, since legal support alone makes the setting of time limits an effective mechanism for protecting and enforcing labor rights. Considering the laws that set the time limits, it should be emphasized that they are obliged to comply with the basic principles set out in the Labor Code, despite formally the level of the hierarchy, since the code has a general and guiding character for these laws. An important positive aspect of national legislation is its compliance with the principles established by the Constitution and international instruments, which is important for the establishment of a rule of law and a social state, as well as for the creation of a comfortable standard of living for workers. Therefore, the study of the legal regulation of terms in labor law in national law allows us to identify the problematic points and directions for further improvement. In addition, time is an element that brings together the various institutions of labor law, and accordingly, the study of the state of its regulation allows you to analyze the errors in the mechanism of their implementation.

The issue of security is a fundamental aspect in the maintenance of international relations, and such relations cannot be upheld without concrete laws and credible policies underlying the international scene. It is really essential and appropriate in setting strong international security on the international level. With all these in place, ensuring this international security has been a difficult task by actors on the international scene due to the multifacet of the various legal regimes with the diversified policy set up making the objective of international security a laughable phenomenon. The purpose of the article is to determine the characteristic features of the current state of the international security system, based on current situations in a particular region of the world, as well as to establish the relationship between various elements of international security. This great plague attacking international security has been of great questioning too many of the international scene as to what importance will security be necessary when it cannot be respected by those who claim in ensuring international peace and security? In answering this question, it will be appropriate for us in adopting empirical research to examine the various hurdles which can jeopardise international security. From the above outcome experience, one can say with any fear of contraction that the notion of international security is more of procrastination than a plausible redress. It is against this backdrop that we think much still need to be done in ensuring a place occupied by concrete international security, respected by all without violations. Keamanan Internasional: Situasi Saat Ini dan Cara Perbaikan Regulasi Hukum Abstrak Isu keamanan merupakan aspek fundamental dalam pemeliharaan hubungan internasional, dan hubungan semacam itu tidak dapat ditegakkan tanpa undang-undang yang konkrit dan kebijakan yang kredibel yang mendasari kancah internasional. Hal ini sangat penting dan tepat dalam menetapkan keamanan internasional yang kuat di tingkat internasional. Dengan semua ini, memastikan keamanan internasional ini telah menjadi tugas yang sulit oleh para aktor di kancah internasional karena multifaset dari berbagai rezim hukum dengan kebijakan yang beragam membuat tujuan keamanan internasional menjadi fenomena yang menggelikan. Tujuan artikel ini adalah untuk menentukan fitur karakteristik dari keadaan sistem keamanan internasional saat ini, berdasarkan situasi saat ini di wilayah tertentu di dunia, serta untuk menetapkan hubungan antara berbagai elemen keamanan internasional. Wabah besar yang menyerang keamanan internasional ini telah menjadi pertanyaan besar bagi banyak orang di kancah internasional tentang pentingnya keamanan apa yang diperlukan ketika keamanan tidak dapat dihormati oleh mereka yang mengklaim dalam menjamin perdamaian dan keamanan internasional? Dalam menjawab pertanyaan ini, sudah sepantasnya kita mengadopsi penelitian empiris untuk mengkaji berbagai rintangan yang dapat membahayakan keamanan internasional. Dari pengalaman hasil di atas, orang dapat mengatakan dengan ketakutan akan kontraksi bahwa gagasan keamanan internasional lebih merupakan penundaan daripada ganti rugi yang masuk akal. Dengan latar belakang inilah kami pikir masih banyak yang perlu dilakukan untuk memastikan tempat yang ditempati oleh keamanan internasional yang nyata, dihormati oleh semua tanpa pelanggaran. Государства выдвигают разные, иногда противоречивые предложения по совершенствованию системы международной безопасности, поскольку страны имеют разные возможности для реализации реальных мер по реформированию международной безопасности. Считается, что несколько самых влиятельных стран мира играют основную роль в формировании так называемой «повестки дня» в международной политике, в том числе в сфере безопасности. Их влияние основано на различных сферах общественной жизни. Развитые демократии Западной Европы и Северной Америки оказывают значительное влияние на международно-правовые отношения благодаря своему экономическому, культурному и политическому влиянию. В свою очередь, Россия и Китай в значительной степени повлияли на международную политику через ультиматумы и угрозы из-за своих собственных вооруженных сил, которые по-прежнему остаются если не лучшими, то одними из крупнейших в мире. Особое внимание обращается на тот факт, что Украина в связи с вышеуказанными обстоятельствами должна следовать курсу сближения с развитыми демократиями, чтобы добиться успеха. С учетом проведенного исследования авторами представлены предложения по совершенствованию правового регулирования международной безопасности.
