Indonesia is the rich country of mine, such as gold, silver, petroleum, mine, etc. Management of mine should be done by government or private. Every mining company obligated to get license as regulated in the Regulation Number 4 Year 2009 about Mineral Mining Juncto the Government Regulation Number 23 Year 2010 about the Implementation of Mineral Mining. In fact, not all companies have license. There are so many companies operate illegal. One of them is gold mining without license (PETI). The specification of the research is descriptive analytic. The methods used are normative as primary approach and juridical empiric method as secondary approach. The sources of data are secondary and primary. The techniques of collecting data uses field study by interviewing for the primary data and library study for the secondary data. Then, the data analyzed qualitatively in descriptive qualitative form. From the research results obtained several conclusions: First, the effective of investigation gold mining without license by Directory of Reserve Special Criminal of West Sumatera Police based on the data got can be seen clearly effective because from 3 (three) cases all has been investigation and submitted to Court. Second, the obstacles faced by Directory of Reserve Special Criminal of West Sumatera Police in executing of gold mining without license (PETI) in South Solok Regency consist of: (a) no synergy in supporting the law enforcement together between instances and other because the agents of gold mining without license (PETI) are backed up by law enforcer, government until traditional viewers; and (b) limited tool such as no double garden cars or boat to reach field and no communication satellite which can be operated in the unreached location by phone signal.

Government Regulation No. 53 of 2010 regarding the discipline of the Civil Servant loading obligations, prohibitions, and disciplinary action which could be taken to the Civil Servant who has been convicted of the offense, is intended to foster a Civil Servant who has committed an offense, the form of disciplinary punishment is mild, moderate, and weight. Disciplinary punishment for the Civil Servant under Government Regulation No. 53 of 2010 Concerning the Discipline of Civil Servants. The formulation of this journal issue contains about how the process of disciplinary punishment, and constraints and efforts to overcome the impact of the Civil Servant disciplinary punishment in Government of Demak regency. The approach used in this study is a sociological juridical approach or juridical empirical, that is an approach that examines secondary data first and then proceed to conduct research in the field of primary data normative. The process of giving disciplinary sanctions for State Civil Apparatus in Government of Demak regency begins with the examination conducted by the immediate supervisor referred to in the legislation governing the authority of appointment, transfer and dismissal of civil servants. The results showed that in general the process of sanctioning / disciplinary punishment of civil servants in the Government of Demak be said to be good and there have been compliance with the existing regulations / applied in Government Regulation No. 53 of 2010, although it encountered the competent authorities judge still apply tolerance against the employee, but also a positive impact among their deterrent good not to repeat the same offense or one level higher than before either the Civil Servant concerned or the other. Obstacles in carrying out disciplinary punishment in Government of Demak regency environment is still low awareness of employees to do and be disciplined in performing the tasks for instance delays incoming work, lack of regulatory discipline, lack of supervision system and any violations of employee discipline. There must be constraints to overcome need for cooperation with other stakeholders comprising Inspectorate, BKPP, and the immediate superior civil servants in this way can be mutually reinforcing mutual communication, consultation, coordination so that if later there is a problem in the future could be accounted for.Keywords: Delivery of Disciplinary Sanctions; Civil Servant; Government Regulation No. 53 of 2010.

The misuse of social media that causes defamation Decision: No 574 K / pid.sus / MA / 2018, is one of the many legal problems that have been ensnared due to the misuse of social media. The author uses three types of data sources, namely primary data sources of data obtained from laws and Supreme Court decisions. And secondary data data obtained from law books, law magazines and legal writings. And the last is tertiary legal material is complementary legal material obtained from dictionaries and the internet. and data analysis using qualitative data which is data in the form of words that talk about statutory regulations. The results of the research show that in the application of law enforcement of the ITE Law article 27 paragraph 1 in conjunction with article 45 paragraph 1 there is still a sense of injustice for the community, factors that must also be considered in imposing sanctions on victims of Baiq Nuril. and sociology of law and a strong conscience against actions or decisions in law enforcement. In this case, the government should have strict supervision of the use of information technology. This is aimed at preventing and overcoming efficiently and effectively the act of defamation through social media.

AbstractThe border area is one of the national strategic areas, the development of border areas is often faced with various security, defense, economic, social and cultural issues. The vulnerability of violations occurring in the Indonesia-Malaysia border region can cause many problems that arise from illegal border crossers, Smuggling of Goods, Illegal Workers, Terrorism. In this essay investigate the extent of government efforts in reducing border violations in Indonesia-Malaysia border region especially in Nunukan district. This research was conducted by Nunukan Regency in several agencies that handle border issues, Nunukan District Government Office, District Command 0911 of Nunukan, Ministry of Immigration Nunukan District, Navy Command Nunukan District This research was conducted by data collection method (field research), to obtain primary data through interview with the competent party in this research, and by method of literature research, to obtain secondary data through binding legal materials. Post-border crossings in Sei Pancang have a significant impact on border residents who want to pass. This can lead to a large number of illegal borderline subscribers. However, in its implementation in an effort to reduce border violations in the border area the government is faced by many factors that can affect law enforcement, law factors, law enforcement factors, facilities, cultural and community factors.Keywords: Border Area, Government, Law Enforcement.AbstrakKawasan perbatasan merupakan salah satu kawasan strategis nasional, pembangunan kawasan perbatasan seringkali dihadapkan dengan berbagai masalah keamanan, pertahanan, ekonomi, sosial, dan budaya. Di essay ini menyelidiki sejauh mana upaya pemerintah dalam mengurangi pelanggaran tapal batas di kawasan perbatasan Indonesia-Malaysia khususnya di kabupaten Nunukan. Penelitian ini dilakukan Kabupaten Nunukan di beberapa instansi yang menangani masalah perbatasan, Kantor Pemerintahan Daerah Kabupaten Nunukan, Komando Distrik 0911 Kab. Nunukan, Kementerian Keimigrasian Kab. Nunukan, Komando Angkatan Laut Kab. Nunukan. Penelitian ini dilakukan dengan metode pengumpulan data (field research), untuk memperoleh data primer melalui wawancara dengan pihak yang kompeten dalam penelitian ini, dan dengan metode studi literatur (literature research), untuk memperoleh data sekunder melalui bahan-bahan hukum yang mengikat. Pasca pentupan pos lintas batas di Sei Pancang berdampak signifikan terhadap warga perbatasan yang ingin melintas. Hal ini dapat memunculkan banyaknya pelangggar batas illegal. This study aims to determine the juridical review of quarantine after the Covid-19 pandemic and find out whether its implementation has been carried out and implemented in Indonesia. The type of research used is normative research or library research, its meaning that this research is based on library sources to discuss the problems that have been formulated. By examining secondary data by conducting an investigation of the study including a description of the research subject. In this study, the data used in this study were secondary data and primary data. The secondary data used in this study is the law used in the study, the primary data used is the regulations in Indonesian legislation that have been set by each local government. The data consists of books, articles in journals and other media, including unpublished research and papers related to and explaining the concepts of quarantine and social distancing during a pandemic situation. The results of the study explain that the Health Quarantine Act carried out by the government in protecting the spread of Covid-19 has been very well implemented. This is reinforced by Government Regulation number 21 of 2020 which explains PSBB and handling related to the Covid-19 pandemic. The implementation of this legislation is the establishment of a Health Quarantine Officer who is the only person authorized to enforce the law. Further cooperation for law enforcement at the local government level requires delegation from the central government, which will be carried out further by the Minister of Health.

Unlicensed mining has been a worldwide issue, including several regions in Indonesia, such as Southeast Sulawesi Province and East Java. The issue that will be examined in this paper is the policies to overcome the unlicensed mining in Southeast Sulawesi Province and East Java. In order to answer the issue, the type of research is socio-legal, by using the primary data in the form of interview result and secondary data in the form of documents the data were obtained from field study and study of literature. The research result shows that the effort to overcome the unlicensed mining by the Government of Southeast Sulawesi Province and East Java are different. The Government of Southeast Sulawesi Province applies the alternative policies such as the unlicensed mining control, aside from the law enforcement policy conducted by the police, prosecutor, and court. This differs from the Government of East Java which views that the law enforcement policy as the only means to overcome unlicensed mining. Unlicensed mining control conducted in Southeast Sulawesi could be an alternative policy since it delivers benefit such as the gaining of valid data of the unlicensed mining location, increasing the community awareness, as the instrument to protect the environment and so forth.

Law enforcement discrimination in handling the theft of electric flow in Dili District of Timor Leste, about the treatment to fellow citizes (discrimination) because the people’s welfare must be the highest law in a country “salus publika supreme lex”. This research is an empirical yuridical law research. This is descriptive research by using primary data and secondary data. The result of this research indicate that every service given by the government through electricidade de Timor Leste (EDTL) as electrical energy distributor starting from the generation of transmission and distribution of electrical energy which become the source of supply to all society that widespread in Dili District of East Timor. In fact, deviates from the mandate of constitution which exist for the welfare of people. The deviations that occur are followed up by unfair law action toward the various level/group that exist in the society as the costumer. Injustice in handling is basically due to the interference of power both economic or political. Diskriminasi Penegakan Hukum Dalam Penanganan PencurianAliran Listrik Di Distrik Dili Timor-Leste, tentang perlakuan terhadap sesama warga negara secara (Diskriminasi) karenakesejahteraan rakyat harus menjadi hukum tertinggi dalam suatu negara “salus publica suprema lex”. Penelitian ini merupakan penelitianhukum yuridis Empirik. Sifat penelitian ini adalah deskriptif yang mempergunakan data primer dan data sekunder.Hasil penelitian nenunjukan bahwa Setiap pelayanan yang diberikan pemerintah melalui Electricidade de Timor Leste(EDTL) sebagai penyalur energi kelistrikan mulai dari pembangkitan transmisi dan distribusi energi listrik yangmenjadi sumber pasokan ke seluruh masyarakat yang menyebar luas di Distrik Dili Timor Leste pada kenyataanya menyimpang dari amanat konstitusi yang ada untuk kesejahteraan rakyat. Penyimpangan yang terjadi ditindaklanjuti dengan tindakan hukum yang  tidak adil terhadap berbagai tingkatan/golongan yang ada dalam masyarakat sebagai pelanggan. Ketidakadilan dalam penanganan yang semestinya pada dasarnya terjadi karena adanya interfensi kekuasaan, baik ekonomi maupun politik.

The Malan tradition or farming of Bakumpai Dayak society is a hereditary tradition handed down by ancestors. Malan is a social activity in agriculture, especially in farming, starting from clearing fields, cutting down forests, burning fields, planting rice and harvesting rice. This study was a field research with a qualitative approach in the form of phenomenology and contextual Islamic economics. The informants were people who farmed around Murung Raya Regency. Sources of data were primary data and secondary data. Primary data were data from observations and interviews. While secondary data were data in the form of documentation. The results showed that in Malan tradition of Bakumpai Dayak society, Islamic economic values were found in the form of togetherness and balance, help each other, cooperation, sharing and kindship. Malan activities were activities that form the basis of society in fulfilling basic needs (rice). The inhibiting factor for Malan's current activities was the government regulation that strictly prohibits burning forests and land. Malan activity was an activity that really helped rural communities in fulfilling their foods. The economic contribution to the Malan Tradition was enormous for society.

<p>Abstract<br />This article aims to determine the problematic implementation of adoption in terms of the Government  Regulation of the Republic of Indonesia Number 54 of 2007 concerning the Implementation of the Appointment of Children at the Putra Bakti Orphanage in Batang Regency. This legal research is a type of empirical legal research that is descriptive. The research approach uses a case and legislation approach. The type of data in the form of primary data where the main data comes from the results of empirical research conducted, and secondary data obtained from literature related to research. Based on the results of the study it can be seen that, the implementation of the adoption carried out by the Putra Bakti Orphanage in the Regency of Batang experienced various problems, which in the implementation of adoption were carried out directly without going through court decisions. The reason for the Putra Bakti Orphanage in Batang Regency to appoint children without conducting a court decision is that parents who raise their children want to establish kinship with their biological parents by adopting children because they assume that the appointment of children in a court is complex and the regulations are too complicated. convoluted and requires a lot of money, takes a long time, the orphanage does not provide special costs in the process of implementing adoption, cultural factors that emphasize the appointment of adoption without going through the court and assume that the community is together, lack of socialization and guidance given or carried out by the government and society, this raises a discrepancy with the Government Regulation of the Republic of Indonesia Number 54 of 2007 concerning the Implementation of Child Appointment which explains that the adoption of the child must be carried out through the court and broken off by the judge.<br />Keywords: Problem; Appointment of Children; Orphanage</p><p>Abstrak<br />Artikel ini bertujuan untuk mengetahui problematika pelaksanaan pengangkatan anak ditinjau dari  Peraturan Pemerintah Republik Indonesia Nomor 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak di Panti Asuhan Putra Bakti Kabupaten Batang. Penelitian hukum ini merupakan jenis penelitian hukum empiris yang bersifat deskriptif. Pendekatan penelitian menggunakan pendekatan kasus dan perundang-undangan. Jenis data berupa data primer dimana data utama berasal dari hasil penelitian empiris yang dilakukan, serta data sekunder diperoleh dari bahan kepustakaan yang berkaitan dengan penelitian. Berdasarkan hasil penelitian dapat diketahui bahwa, pelaksanaan pengangkatan anak yang dilakukan oleh Panti Asuhan Putra Bakti Kabupaten Batang mengalami berbagai problematika, dimana dalam pelaksanaan pengangkatan anak dilakukan secara langsung tanpa melalui putusan pengadilan. Alasan Panti Asuhan Putra Bakti Kabupaten Batang melakukan pengangkatan anak tanpa melakukan penetapan pengadilan adalah orang tua yang mengangkat anak ingin menjalin kekeluargaan dengan orang tua kandung dengan cara melakukan pengangkatan anak karena mereka beranggapan bahwa pengangkatan anak yang dilakukan di pengadilan tergolong rumit serta peraturan tersebut terlalu berbelit-belit dan membutuhkan banyak biaya, membutuhkan waktu yang lama, pihak panti asuhan tidak menyediakan biaya secara khusus dalam proses pelaksanan pengangkatan anak, faktor budaya masyarakat yang mengedepankan pengangkatan anak tanpa melalui pengadilan dan beranggapan bahwa masyarakat bersifat kebersamaan, kurangnya sosialisasi serta bimbingan yang diberikan atau dilakukan oleh pemerintah dan masyarakat, hal tersebut menimbulkan tidak efektifnya Peraturan Pemerintah Republik Indonesia Nomor 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak yang menjelaskan bahwa pengangkatan anak harus dilakukan melalui pengadilan dan di putus oleh hakim. <br />Kata Kunci: Problematika; Pengangkatan Anak; Panti Asuhan</p>

Making a certificate of inheritance in the process of transferring rights over land by inheritance is guided by Article 111 paragraph (1) letter c number 4 of the Regulation of the Minister of Agrarian Affairs / Decree of the Land Agency Number 3 of 1997 concerning Implementing Regulation of Government Regulation Number 24 of 1997 concerning Land Registration. The article divides the authority to make inheritance certificate based on community classification so that it is contrary to the 1945 Constitution, Law Number 12 of 2006 concerning Citizenship, Law Number 40 of 2008 concerning Elimination of Racial and Ethnic Discrimination, Law Number 12 of 2011 concerning Law Enforcement. While this journal method is an Empirical Juridical approach; the types of data used are primary data and secondary data with primary legal materials, secondary legal materials, and tertiary legal materials. Data are analyzed qualitatively. From the results of the study concluded that in the process of transferring rights by inheritance, the heirs must show proof of inheritance certificate from a notary by giving attribution authority by Law Number 12 of 2014 in conjunction with Law Number 30 of 2004 concerning Notary Position, differentiation in the making of inheritance certificate is an urgency of the existence of legal pluralism so that in making the certificate of inheritance according to which law is used by the testator, due to differentiation in the making of inheritance certificate, there will be a deviation from the law itself (pluralism) so that the inheritance dispute will occur.

The purpose of this research is to find out the stages of the process of drafting the Regional Working Unit Budget Work Plan or in Indonesia called the Working Plan of Regional Working Unit Budget (RKA-SKPD) and what strategy is used by the regional apparatus unit or in Indonesia called the Regional Device Work Unit (SKPD) in budgeting. The research method is quantitative descriptive with data type is primary data and secondary data with data collection technique of interview and observation. The results of the study that (a). budget drafting process In Sleman District Youth and Sports Education Office has been in accordance with the Government Regulation of Finance Minister Regulation No 92 PMK.05, (b).
