This study presents the latest information on a review of Islamic law towards marriage customs of juelen and angkap in Gayo tribe, Central Aceh District. This research uses the theory of mashlahah: the applicative theory is used in analyzing the research data and in the end of the research shows that the effect of marriage custom of Gayo on juelen and angkap must continue to give part to each party (ex-husband and wife) especially the marriage of Angkap, and if there is a dowry debt as in marriage of angkap, then it can be settled after sharing of shared assets between the former wife and husband. This awarding is based on consideration of mercy on the basis of providing guarantees in life after the divorce occurred.  Obviously by giving a share to the husband or wife of shared assets as a result of the marriage customs of juelen / angkap in Gayo custom, it is still based on the idea behind the spirit of KHI that seeks to translate shared assets as a means to guarantee life after divorce and of course this is in line with the legal basis Islam. Thus, the formulation of article 85-97 KHI is considered to fulfill the values of benefit in maintaining humanitarian relations and the benefit of family.

Abstract: This research is about the application of iddah income for wives at the Religious Court in Watampone. The main issues regarding the legal status of iddah livelihoods, and how to determine the amount of iddah livelihoods, as well as the efforts of judges in resolving husband's cases refuse to provide iddah livelihoods. This research is a qualitative research with a normative juridical approach and a philosophical approach. The provision of livelihood in the Qur'an and the Compilation of Islamic Law in Indonesia is obligatory to be given to the wife after divorce, requested or not requested in court, as long as the divorce is not due to the wife's nusyuz. But this is not the case with his practice at the Religious Courts in Watampone. Determination of iddah income at the Religious Court in Watampone still prioritizes the agreement between the husband and wife, if an agreement is not found between them, the Panel of Judges will determine the amount by considering the husband's ability and wife's needs. Regarding the case of the husband refusing to provide iddah, the Panel of Judges took several efforts, but the efforts taken did not have a strong legal basis, even some of the efforts taken were not in accordance with the existing procedural law.AbstrakPenelitian ini mengenai penerapan nafkah iddah pada Pengadilan Agama Watampone. Pokok permasalahan tentang status hukum nafkah iddah, dan bagaimana cara penentuan jumlah nafkah iddah, serta upaya hakim dalam menyelesaikan perkara suami menolak memberi nafkah iddah. Penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis normatif dan pendekatan filosofis.Ketentuan nafkah iddah di dalam  al-Qur’an dan Kompilasi Hukum Islam di Indonesia adalah wajib diberikan kepada isteri yang ditalak raj’i, diminta ataupun tidak diminta dalam persidangan, selama perceraian bukan karena nusyuznya isteri. Namun tidak demikian dengan peraktiknya di Pengadilan Agama Watampone. Penentuan nafkah iddah pada Pengadilan Agama Watampone tetap mengedepankan kesepakatan antara pihak suami dan isteri, apabila tidak didapati kesepakatan antara keduanya, maka Majelis Hakim yang akan menentukan jumlahnya dengan mempertimbangkan kemampuan suami dan kebutuhan isteri. Terkait perkara suami menolak memberi nafkah iddah, Majelis Hakim menempuh beberapa upaya, namun upaya yang ditempuh tidak memiliki dasar hukum yang kuat, bahkan beberapa upaya yang ditempuh tidak sesuai dengan hukum acara yang ada.Keywords: Implementation; Iddah; Living Rights; Religious courts.

This research presents the latest information on the analysis of Islamic law on the practice of fulfilling the rights of wives and children in the household among the Tablighi Jama'ah. This research is presented in a qualitative form with the approach of sociology of law (Islamic law). This study uses Islamic law (mashlahat theory) as an analysis tool in analyzing research data. In the end, this study concluded that the rights and obligations of husband and wife and children in the household among the Tablighi Jama'ah were actually subject to and did not differ from the provisions of Law No. 1 of 1974, KHI and so from the opinion of Imam Shafi'i, although in reality related to the Tablighi Jama'ah policy, especially when selecting members who want to leave the khuruj still needs to be improved so that there are no more members of the jama'ah who are mentally incapable, especially financially making khuruj, so this does not impact on the non-implementation of the obligations of the husband in the household and the poor image of preaching khuruj in the midst of society, especially the city of Medan.

<p>Penelitian ini menganalisis tentang <em>fasakh </em>perkawinan dalam Putusan Nomor 1899/Pdt.G/2013/PA.Pt. dan dasar pertimbangan Hakim dalam Putusan Nomor 1899/Pdt.G/2013/PA.Pt dalam mem-<em>fasakh</em>-kan perkawinan. Jenis/tipe penelitian yang digunakan adalah penelitian hukum normatif/doktrinal, spesifikasi penelitian deskriptif analitis, metode pengumpulan data menggunakan data sekunder yang diperoleh dari bahan hukum primer dan bahan hukum sekunder yang dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian <em>fasakh </em>perkawinan dalam Putusan Pengadilan Agama Pati Nomor 1899/Pdt.G/2013/ PA.Pt,  alasan  Pemohon  mengajukan  permohonan  <em>fasakh  </em>terhadap  Termohon  karena  Termohon mengalami gangguan jiwa atau stres termasuk ke dalam alasan-alasan perceraian. Dalam pembuktian cacat badan atau penyakit yang ada pada Termohon, Majelis Hakim hanya berdasarkan pada saksi-saksi yang dihadirkan Pemohon, tanpa adanya alat bukti pendukung lain seperti surat keterangan dari Rumah Sakit Jiwa dan Majelis Hakim dalam mem-<em>fasakh</em>-kan perkawinan karena rumah tangga Pemohon dan Termohon sudah tidak harmonis dan sudah tidak mencapai tujuan perkawinan sebagaimana Pasal 1</p><p align="center">Undang-Undang Nomor 1 Tahun 1974 <em>juncto </em>Al-Qur’an surat Ar-Rum ayat 21, dan telah terdapat alasan bercerai sebagaimana dimaksud dalam Pasal 19 huruf (e) PP Nomor 9 Tahun 1975 <em>juncto </em>Pasal 116 huruf</p><p align="center">(e)  Kompilasi  Hukum  Islam,  dan  Pemohon  dapat  membuktikan  dalil-dalil  permohonannya  dan</p><p>permohonan Pemohon tidak melawan hukum.   Dasar pertimbangan Hakim dalam mem-<em>fasakh</em>-kan perkawinan antara Pemohon dan Termohon berdasar pada dasar faktual, dasar hukum dan Majelis Hakim sependapat dan mengambil alih pendapat ahli <em>fiqh</em>.</p><p><em>This research analyzed about fasakh marriage in court rulling 1899/Pdt.G/2013/PA.Pt and the basis of   judge’s   consideration   in   court   rulling   Number   1899/Pdt.G/2013/PA.Pt   in   making   fasakh marriage.Type of research used is normative/doctrinal,specification of descriptive analitycal research, Data collection method using secondary data, obtained from primary legal materials and secondary law material which then analyzed normatively qualitative.Based on the result of research fasakh mariage in court rylling of religion court of Pati Number 1899/Pdt.G/2013/PA.Pt.the reasons of the Petitioners filed a petition for the fasakh against the Respondent because the Respondent suffered a mental or mental disordersincluding the reasons for divorce.In the proof of disability or disease existing in the Respondent, the Panel of Justices is based only on the witnesses presented by the Petitioner, without any other supporting evidence such as a letter from thepsychiatric hospitaland the Panel of Judges in making the fasakh because the Applicant and the Respondent's household have been out of harmony and have not achieved the purpose of marriage as Article 1of Law Number 1 Year 1974 juncto Al-Qur'an letter Ar- Rum  verse  21,  and  there  have  been  reasons  for  divorce  as  referred  to  in  Article  19  letter  (e)  of Government  Regulation  Number  9  Year  1975  juncto  Article  116  letter  (e)  Compilation  of  Islamic Law,and the Petitioner may prove the arguments of his petition and the Petitioners' petition is not against the lawThe basis of judge's consideration in making the fasakh marriage between the Petitioners and the Respondent based on the factual basis, the legal basis and the Panel of Judges agree and take over the opinion of the fiqh experts.</em></p>

Specifically, this study is the concept of joint property ownership of husband and wife. The focus of this study is important because, in the Marriage and Islamic Law Compilations, The property obtained in marriage becomes the joint property.So that, when a divorce or death occurs, each person gets half a share, in the regulation, there is no question about who produced it. In the reality of life in society, many wives work to earn a living, so it was interesting to study the different proportions in the distribution of property, in the event of a divorce. The problem of this research was how the concept of the joint property rights of husband and wife. In answering these problems, this research was carried out using the Socio-Legal Research method, by looking at the reality on the ground, to interpret joint property in changing situations. The technique of collecting data was through literature study, while the data analysis was qualitative. The findings of the study indicated that the practice of sharing assets with judges tends to use normative construction. Each of them got half a share and this was seen as an injustice, both through regulation and reconstruction of thinking in the distribution of the shared assets. Abstract This study aims to answer how a system remuneration wich are applied in the bricks business center in Limboto District and then review it in terms of the Islamic perspective. The research data is obtained through some samples business owners and laborer who works  in business center bricks  be subject  to this research. Technique data collection used is interview, observation and documentation then the data collected  next analyzed by using analysis with a pattern think inductive namely describe or explained  and assess data relating that deals  with remuneration system as argument with reason and legal basis. The research found the fact that remuneration system wich are applied in sentra bricks in Limboto District is a system  remuneration given in, while according to Islamic law that the system is not allowed, for in islam workers should pay their obligations then receive wages from then job.Abstrak  Penelitian ini bertujuan untuk menjawab bagaimana sistem pengupahan yang diterapkan dalam sentra usaha batu bata di Kecamatan Limboto dan kemudian meninjaunya dari segi perspektif Islam.Data penelitian ini diperoleh melalui beberapa sampel pemilik usaha dan buruh yang bekerja di sentra usaha batu bata yang menjadi subyek penelitian ini. Teknik pengumpulan data yang digunakan adalah wawancara, observasi dan dokumentasi kemudian data yang berhasil dikumpulkan selanjutnya dianalisis dengan menggunakan analisis dengan pola pikir induktif yaitu menggambarkan atau menjelaskan dan menilai data terkait yang berhubungan dengan sistem pengupahan sebagai argumentasi dengan alasan dan dasar hukum.Dari hasil penelitian ditemukan fakta bahwa sistem pengupahan yang diterapkan dalam sentra batu bata di Kecamatan Limboto adalah sistem pengupahan dibayarkan diawal pekerjaan, sementara menurut hukum Islam bahwa sistem ini tidak diperbolehkan, sebab dalam Islam pekerja seharusnya menunaikan kewajibannya barulah menerima upah dari pekerjaan tersebut.

The Common properties (community property) is an asset that the husband and wife acquired during the household lifes, which both of them is agree that after united through marriage bonds, that the property produced by one or both of them will be common property. It shows, that if there's an agreement between husband and wife before marriage (did not to unify their property), then the property produced both will not become a joint treasure. Thus, if a husband or wife dies, or divorces, then the property owned by both of them can be distributed in accordance with their respective shares, another case when the two couples are not making an agreement, then the property gained during marriage bonds can be divided into types of communal property. In Islamic law, this kind of treasure is not contained in the Qur'an or Sunnah. Nor in Islamic jurisprudence. However, Islamic law legalizes the existence of common property as long as it is applicable in a society and the benefit in the distribution of such property. In contrast to the positive law, this property types have been regulated and described in the Marriage Law, as well as the Islamic Law Compilations, which became the legal restriction in the affairs of marriage in force in Indonesia. In this study, the author tries to compile the existence of common property according to the Islamic law reviews and positive law.

The division of marital joint property after the breakup of marriage, whether dropping out of marriage due to divorce or due to death, is a new thing in Islamic jurisprudence (fiqh). This is because the concept of mutual treasure is not known in the books of classical Islamic jurisprudence of Muslim scholars of the schools at their times, in which their work are always made as referral in the legal cases up to the present days. In Indonesia, the distribution of common property is regulated in the Compilation of Islamic Laws Articles 96 and 97, which stipulate the rules of distribution of joint property for married couples whose married are off as a result of divorce or death. Article 97 of the Compilation of Islamic Law actually provides an overview of the flexibility of the distribution of common marital property, including in certain cases because the article is regulating (regelen) rather than forcing (dwigen), so that the division is not absolutely divided equally between husband and wife, and casuistically the provisions of that article may be disregarded.

In Islamic law, pre-wedding photos have not been regulated in detail. However, pre-wedding photo activities have become commonplace by the community. It becomes a problem when pre-wedding is currently done with an intimate scene, usually the prospective bride uses sexy clothes and is also not accompanied by her mahram when doing pre-wedding photos. Even though there have been many fatwas and studies on the limits of permissibility and prohibition in the pre-wedding procession.The results show that the pre-wedding procession that is carried out by the community in terms of poses, clothes, and also assistance in accordance with Islamic law, the law is permissible. However, it often happens in the community to take photos before the marriage contract with scenes as if they are legally husband and wife and the bride's family knows without prohibiting, directing, and guiding them according to Islamic teachings. In this case the role of the family is very important, we as parents must understand the basis of religious knowledge and how to instill religious values in our children since childhood is the key to this problem dilemma.
