This legal research aims to examine the implementation of regulations on the Complete Systematic Land Registration in order to achieve legal certainty in Indonesia. This legal research is a normative or doctrinal legal study conducted with a review of the literature. The research approach is conducted using statue approach and legal comparison approach (comparative law). This legal research uses both primary and secondary legal materials regarding the implementation of the Complete Systematic Land Registration in Indonesia. Based on the results of this legal research, implementation of the Complete Systematic Land Registration Program is a form of policy issued by the Indonesian Government with the Ministry of Agrarian Administration/National Land Agency to register land that has not owned a proprietary certificate. In order to achieve the legal certainty for the community is required improvement of good quality of public awareness, implementation mechanisms and various parties related to the Complete Systematic Land Registration in Indonesia. This study aim to analyze the implementation of the simple principle of Complete Systematic Land Registration in guaranteeing civil rights. This research uses the socio-legal research method which is a research approach that is carried out directly from the community as the first source through field research from the relevant institute. Based on the research conducted, it can be concluded that the implementation of the simple principle at the research location has not run optimally because the legal language and technical language in the land registration procedure are difficult to understand by the community, so that it implies that a simple principle has not been created in the Systematic Complete Land Registration. Simple principles in regulations need to be concretized in technical regulations to interpret these simple principles so that there are no more obstacles in land registration procedures so as to guarantee legal certainty and ease in land registration. Penelitian ini bertujuan untuk tentang implementasi asas sederhana Pendaftaran Tanah Sistematis Lengkap dalam menjamin hak keperdataan. Penelitian ini menggunakan metode socio-legal research yaitu pendekatan penelitian yang dilakukan langsung dari masyarakat sebagai sumber pertama melalui penelitian lapangan dari instansi terkait. Berdasarkan penelitian yang dilakukan, dapat disimpulkan bahwa implementasi asas sederhana di lokasi penelitian belum berjalan secara optimal karena bahasa hukum dan bahasa teknis dalam prosedur pendaftaran tanah sulit dipahami oleh masyarakat, sehingga berimplikasi belum terciptanya asas sederhana dalam Pendaftaran Tanah Sistematis Lengkap. Asas sederhana dalam peraturan perlu dikonkretkan regulasi teknisnya untuk menafsirkan asas sederhana tersebut agar tidak terjadi lagi hambatan dalam prosedur pendaftaran tanah sehingga menjamin kepastian hukum serta kemudahan dalam pendaftaran tanah.

Implementation Land registration in society is now the task of the State. Land registration is carried out by the government for the benefit of the people, as an effort to provide legal certainty in the field of land. The Land Registration is carried out by the Land Office, and in carrying out the tasks the Land Office is assisted by The Land Deed Official, to carry out the activities set forth in PP 24/1997.The formulation of the problem in this research are: 1) How is the regulation of the registration of the Deed of Sale and Purchase exceeding the period of registration of land for the realization of legal certainty ?; 2) What are the obstacles faced by the Land Deed Officer in relation to the deed of sale and purchase that exceeds the period of land registration, which is shown for the realization of legal certainty and how is the solution to the settlement?This research method using research approach that is juridical normative. The specifications of this study were descriptively analyzed. Methods of data collection in this study, can be obtained by library research.The result of the research says that 1. The legal arrangement of registration of Deed of Sale and Purchase exceeding the time period specified for the realization of legal certainty is where if the registration of sale and purchase certificate exceeds 7 days then it is requested more clearly to the local Land Office. 2. The obstacles faced by the Land Deed Authority in relation to the deed of sale and purchase that exceeds the period of land registration such as the lack of public awareness, the bad image of the National Land Agency and the rights base is different from the field data. To overcome these obstacles then the National Land Agency made a program such as doing counseling to the public and through the PRONA program.The conclusion of the research results suggests that the legal arrangement of registration of Sale and Purchase Deed beyond the time period specified for the realization of legal certainty is where if the registration of the deed of sale and purchase exceeds 7 days then applied more clearly to the local Land Office. Although the submission of the deed of sale and purchase of land to the Land Office as practiced by most of the Land Deed Officials is not in accordance with the applicable laws but does not result in the cancellation of the land and there is no legal provision stating that With the delay of submission of the deed of sale and purchase of the land makes the relevant deed null and void. Keywords: Deed of Sale and Purchase, Land Registration

Abstract: Complete Systematic Land Registration is a program which taken by the government in providing legal certainty in the field of land in Indonesia. PTSL activities at Sidoarjo Regency and Pasuruan Regency Land Office are carried out with third parties. Before starting the measurement, it is necessary to carry out the contradictoire delimitatie principle to ensure legal certainty of ownership of land rights. The research used a qualitative method with a descriptive approach. The data analysis carried out by compiling logically proportional statements to answer research questions. Problem analysis is carried out by making a description based on premier data and secondary data obtained through interviews and observations of implementation. The results of the research showed that the implementation of the contradictoire delimitatie principle is broadly following PP. No. 24 of 1997 and PMNA KaBPN No. 3 of 1997. The results of the study also showed that there were obstacles in the implementation of the contradictoire delimitatie principle, such as the third parties were not following technical guidelines No. 01 / JUKNIS-300/1/2018 annex 10 in the making of measurement drawings. Quality control is needed to improve the quality of work and results of third party products and minimize land problems in the future.Keywords: principle of contradictoire delimitation, third party. Intisari : Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan langkah pemerintah dalam memberikan jaminan kepastian hukum dalam bidang pertanahan di Indonesia. Kegiatan PTSL di Kantor Pertanahan Kabupaten Sidoarjo dan Kabupaten Pasuruan dilaksanakan bekerjasama dengan Pihak Ketiga yang sebelumnya melalui tahapan asas contradictoire delimitatie untuk menjamin kepastian hukum kepemilikan hak atas tanah. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan deskriptif. Teknik analisa yang dilakukan yaitu dengan menyusun pernyataan-pernyataan proposional secara logis untuk menjawab pertanyaan penelitian. Analisa permasalahan dilakukan dengan membuat uraian berdasarkan data premier dan data sekunder yang diperoleh melalui wawancara serta observasi langsung terhadap pelaksanaan kegiatan. Hasil penelitian menunjukkan bahwa pelaksanaan asas contradictoire delimitatie secara garis besar telah sesuai dengan PP. No. 24 Tahun 1997 dan PMNA KaBPN No. 3 Tahun 1997. Dalam pelaksanaanya terdapat hambatan yakni  pembuatan Gambar Ukur oleh Pihak Ketiga tidak sesuai dengan pedoman JUKNIS No. 01/JUKNIS-300/1/2018 lampiran 10. Sehingga diperlukan pengawasan kendali mutu terkait pekerjaan dan hasil produk dari Pihak Ketiga agar kedepannya hasil pekerjaan yang dihasilkan lebih baik dan tidak menjadi permasalahan pertanahan dikemudian hari.Kata Kunci : asas contradictoire delimitatie, pihak ketiga.

The spearhead of collecting physical data in the process of land registration is the measurement activity carried out by the measurement officer or known as the Cadaster Surveyor. Cadastral measurement is the main activity that determines the quality of land data. One of the guarantees of legal certainty in land registration is the assurance of certainty of physical data consisting of data on the location of boundaries and area of land. This research is a descriptive qualitative normative juridical law study which analyzes the study of legal changes related to the role and expansion of the cadastral surveyor's authority in the land registration system. In an effort to realize the accuracy of physical data in the form of the location and size of land parcels to accelerate land registration and land services, it is necessary to expand the authority and a strong legal umbrella. The authority according to the prevailing laws and regulations is very limited. To extend the licensed surveyor's authority as a form of community participation in the land registration system, there are several strategic steps that must be taken, one of which is the change / revision of legislation related to the land registration system, namely the need for new articles or the addition of new paragraphs in certain articles on The Basic Agrarian Law and Government Regulations regarding land registration.

This paper examines the potential significance of updating registration practices in resolving some of the issues about tenure security in a transformative context. It deals with the importance of good governance in the context of land administration and considers its impact on intended reforms. Land registration practice as an indicator of the quality of governance is scrutinised. The debate about the kinds of interests to be served by tenure security reforms is considered. A comparative law analysis demonstrates how demands for electronification, placed on registration systems, can reshape the process of securing tenure. The paper then highlights issues for further investigation and discussion.

Problems in this study: (1) How is the implementation of activities in the District Land Office PTSL Kendal? (2) How the Government's policy to accelerate the legal certainty Landrights through PTSL ?. The method used in this research is the method of approach to socio-legal research, consisting of socio research and legal research. The results of this study are: (1) Implementation PTSL in Kendal District Land Office begins by planning activities PTSL by the Head of the Kendal District Land Office with pre inventory candidate and potential participants. (2) Government policy in speeding up the legal certainty of land rights through PTSL is based in Kendal land that already has a certificate covering an area of 13834.46 hectares.Suggestions in this study is consistent with the objectives of land registration is to provide certainty and legal protection to the rights holder, to reduce the escalation of disputes continues to grow, it is time for a land registration system through PTSL changed to positive land registration system.Keywords : Government Policy; Legal Certainty of Land Rights; PTSL.

In recent times, it has become common among the public regarding the Ijarah Muntahiya Bittamlik (IMBT) contract. IMBT is a contract similar to a lease and purchase agreement. In practice in the community, these two contracts are carried out by means of renting first and ending with buying and selling. Although, in general they have similarities, these two agreements have differences that have different consequences. The research method used in this study is doctrinal legal research with a comparative law approach. The results of this study indicate that the IMBT contract has more legal certainty than the lease-purchase agreement. This is because the IMBT contract has provisions regulated in the Sharia Banking Law, the Sharia Economic Law Compilation, and PSAK No. 107 concerning Ijarah and IMBT accounting, while the lease purchase agreement is only based on the principle of freedom of contract. The implementation of the IMBT contract also has more legal certainty, considering that dispute resolution efforts can be carried out through the provisions of Article 283 and Article 284 of the KHES by carrying out sales of the disputed object. This is different from a lease-purchase agreement, where dispute resolution efforts are generally carried out through unilateral withdrawals and the agreement also contains standard clauses that have the potential to violate Article 18 of the Consumer Protection Law.

Abstrak: This paper aims to examine the potential problems of Complete Systematic Land Registration (PTSL) as the government's priority agenda to establish land registration throughout Indonesia. This study uses a normative legal research approach by analyzing the legislation related to land registration, especially PP. 24 of 1997 concerning Land Registration and Ministerial Regulation ATR/Ka. BPN No. 12 of 2017 as amended by Ministerial Regulation No. 6 of 2018. The potential of this problem relates to the issue of tax and income tax payable, human resources, facilities and infrastructure, issues absentee land, maximum excess of land ownership, abandoned land, announcement of physical and juridical data, and problems of application of the principles of contradictoire delimitation. The potential of this problem is described and is given alternative solutions on the implementation of PTSL. Alternative solution is by strengthening the regulation of PTSL in the form of Government Parliament (PP), either by revising PP. 24 of 1997 and by forming a separate PP on PTSL by clarifying the outlined problems.Intisari: Tulisan ini bertujuan untuk mengkaji potensi permasalahan pendaftaran sistematik lengkap (PTSL) sebagai agenda prioritas pemerintah untuk menyelengarakan pendaftaran tanah seluruh Indonesia. Kajian ini mengunakan pendekatan penelitian hukum normatif dengan cara menganalisis peraturan perundangundangan yang berkaitan dengan pendaftaran tanah, khususnya PP No. 24 Tahun 1997 tentang Pendaftaran Tanah dan Peraturan Menteri ATR/Ka. BPN No. 12 Tahun 2017 sebagaimana diubah dengan Permen No. 6 Tahun 2018. Potensi permasalahan ini berkaitan dengan masalah biaya Pajak PPh dan BPHTB terhutang, sumberdaya manusia, sarana dan prasarana, permasalahan tanah absentee, kelebihan maksimum dan tanah terlantar, masalah pengumuman data fisik dan data yuridis, serta masalah penerapan asas kontradiktur delimitasi. Potensi masalah ini di diskripsikan dan diberikan aternatif solusi dalam pelaksanaan percepatan PTSL. Aternatif solusinya adalah dengan cara memperkuat regulasi PTSL dalam bentuk Paraturan Pemerintah (PP) baik dengan cara merevisi PP No. 24 Tahun 1997 maupun dengan membentuk PP tersendiri mengenai PTSL yang pada pokoknya pengaturan isi-nya salah satunya memperjelas permasalahan-permasalahan yang diuraikan diatas.

Land registration aims to guarantee legal certainty and certainty of land rights. By holding land registration, the parties concerned can easily find out the status of the legal status of the particular land they are dealing with, their location, area and boundaries. And also as a condition for the implementation of orderly land administration. The purpose of this study is to find out the legal arrangements regarding the process of registering land rights and ownership status in order to confirm legal certainty and how to implement, constraint factors and solutions to problems that occur in the community. This research uses normative legal research methods. The normative method is writing that uses primary materials or data. In normative legal research, library materials in the form of basic data which in the study are classified as secondary data. Secondary data can include primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that the legal arrangements regarding the responsibilities of the Batam City National Land Agency in the process of registering land rights have been carried out well by the Batam City National Land Agency in order to realize legal certainty for the people of Batam City. However, in carrying out their duties there are still obstacles in the process of registering land rights in Batam City because of the imbalance of authority with the Batam Concession Agency as the holder of land management rights in Batam City. So, the solution is expected to have special regulations regarding this so that the process of registering land rights in Batam City can run in accordance with the laws and regulations.

The limited access to mass media dissemination in East Tanjab and the lack of public awareness in accessing mass media are the background of this research. The purpose of the study discusses the role of mass media in conveying information on the 2019 election, how KPUD uses mass media in conveying information on the 2019 election, what media is used and what information is conveyed and what obstacles and obstacles occur. The method used is descriptive qualitative method, that is, this research is defined as an attempt to find the truth of phenomena, facts, or all symptoms in a scientific way to solve problems or develop science. The research approach used is case studies, including descriptive analysis research. The data analysis methods used were domain analysis and textonomy analysis, while the data validity methods used included extension of participation, persistence of observations and discussions with colleagues. The conclusion of this study is the dissemination of election information carried out by the KPU using various mass media and forming democratic volunteers whose aim is to improve the quality of elections, voter participation, and public confidence in the democratic process carried out in the Tanjung Jabung Timur Regency.
