   This research is a library research that uses data in the form of books, laws, articles, journals and other literature related to the title, while the technique and data collection is by collecting various ideas, theories and concepts of various literature that are centered on the process of comparison between the evidence or other laws. The results of the study concluded that the ruling of the Constitutional Court against the position of the ad hoc judge is appropriate because it gives the same position on a different matter precisely caused injustice.   In addition to having the authority to check, prosecute, and break the criminal corruption, adhoc judges also have the authority to examine the criminal case of money laundering that the original criminal act is a corruption crime. So here corruption as the original criminal act is often referred to as predicate crimes. It is no less important that the role and authority of the adhoc judge specialising in the association of article 6 letter c The authority of the Court of Law to handle a strict follow-up in another law is determined as a corruption criminal act

This article aims to find out and analyze the similarities and differences in the protection of witnesses to the crime of money laundering in law of Indonesia and Malaysia. The research method used is normative juridicial. The data collection techniques used are secondary data collection that carried out by library research to collect and compile data related to the problem under study, by taking an inventory and studying laws and regulations, books , writings and documents related to the issues that the author examined. The data analysis techniques with content analysis. The results obtained from this study are that the arrangements for witness protection in the Money Laundering Law in Indonesia and Malaysia are different. protected subjects (namely: witness, the reporter, the family of the witness/reporter) as well as the broader arrangements in Indonesia as well as in its implementation special protection arrangements have been made in the PP and Decree of the Chief of the Indonesian National Police. Protection provided at all stages of case examination, in the form of special and legal protections. Whereas in Malaysia, the implementation only refers to the provisions of witness protection. Protection only takes the form of legal protection provided to reporting witnesses only, so that during the trial process , a witness has no protection. Abstrak Artikel ini bertujuan untuk mengetahui dan menganalisis persamaan dan perbedaan perlindungan saksi tindak pidana pencucian uang di Indonesia dan Malaysia. Jenis penelitian yuridis  normatif. Teknik pengumpulan data yang digunakan yaitu melalui pengumpulan data-data sekunder. Teknik pengumpulan data dilakukan dengan studi kepustakaan untuk mengumpulkan dan menyusun data yang berhubungan dengan masalah yang diteliti, dengan cara menginventarisasi dan mempelajari peraturan perundang- undangan, buku-buku, tulisan-tulisan dan dokumen yang berhubungan dengan masalah yang penulis teliti. Teknik analisis data dengan analisis isi (content). Hasil yang diperoleh dari penelitian ini yaitu bahwa pengaturan perlindungan saksi di Indonesia dan Malaysia adalah berbeda. Dalam hal subjek yang dilindungi (yaitu: saksi, pelapor, keluarga saksi/pelapor). Perlindungan yang diberikan pada semua tahap pemeriksaan perkara, dalam bentuk perlindungan khusus dan hukum. Sedangkan di Malaysia, pelaksanaanya hanya merujuk pada ketentuan perlindungan saksi. Perlindungan hanya berupa perlindungan hukum yang diberikan kepada saksi pelapor saja, sehingga dalam selama proses persidangan, seorang saksi tidak mendapat perlindungan.

Pasal 60 ayat (4) Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintah Aceh dinyatakan bahwa masa kerja Panitia Pengawas Pemilihan (Panwaslih) berakhir 3 (tiga) bulan setelah pelantikan kepala daerah tepilih, sementara dalam regulasi yuridis lainnya khususnya Undang-Undang Nomor 15 Tahun 2011 tentang Penyelenggara Pemilihan Umum dan Pemilihan menegaskan berakhir paling lambat 2 (dua) bulan setelah seluruh tahapan penyelenggaraan Pemilihan Umum selesai. Ketua Badan Pengawas Pemilihan Umum (Bawaslu) Republik Indonesia mengeluarkan Surat Edaran Nomor: 0240/K.Bawaslu/TU.0001/III/2017 tentang Penegasan Masa Tugas Lembaga Pengawas Pemilihan Umum Ad Hoc dalam Rangka Pemilihan Gubernur dan Wakil, Bupati dan Wakil Bupati dan/atau Walikota dan Wakil Walikota Tahun 2017. Surat Edaran tersebut disimpulkan bahwa masa kerja Panwaslih di Aceh berakhir pada bulan Mei bagi daerah yang terdapat penyelesaian sengketa di Mahkamah Konstitusi dan bulan Juni bagi daerah yang vakum sengketa. Hal ini mengakibatkan ketidakpastian hukum bagi penyelenggara Pemilihan Kepala Daerah dan menimbulkan kegaduhan dalam internal Panwaslih di Aceh. Penelitian ini mengkaji bagaimanakah kedudukan dan  kekuatan hukum Surat Edaran Bawaslu, mengkaji kepastian hukum masa kerja Panwaslih di Aceh atas keputusan Bawaslu Republik Indonesia yang telah mengeluarkan Surat Edaran yang dijadikan rujukan Pemerintah Aceh untuk merevisi Peraturan Gubernur sebelumnya mengenai masa kerja Panwaslih di Aceh. Metode Penelitian yang digunakan adalah penelitian normatif atau penelitian hukum kepustakaan.The article 60 paragraph (4) of the Act Number 11, 2006 concerning the Government of Aceh stated that the working period of the Election Committee ends 3 (three) months after the inauguration of the elected regional head, while in other juridical regulations especially the Act Number 15, 2011 concerning the General Election Organizer and the Election stipulates to expire no later than 2 (two) months after all stages of the election are completed. Chairman of the Election Supervisory has issued the Circular Letter Number: 0240/K.Bawaslu/TU.0001/III/2017 on the Affirmation of Ad Hoc Election Observer Period of Governor and Deputy Regent, Deputy Regent and Deputy Regent, and or Mayor and Deputy Mayor 2017. Based on the Circular Letter, it states that the working period of the Committee in Aceh ends in May for the area where there is a dispute resolution at the Constitutional Court and in June for the vacuum of the dispute. This has resulted in legal uncertainty for the election organizers and caused frenzy within the internal the Election Advisory in Aceh. This research aims to explore the position and legal power of the Election Supervisory Board Circular Letter, to review the legal certainty of the working period of the Election Committee in Aceh on the decision of General Election Supervisory Board of the Republic Indonesia which has issued a Circular Letter as the reference of the Government of Aceh to revise the previous Governor Regulation concerning the working period of the committee in Aceh. Purpose This study aims to investigate Indonesian regulation of Article 69 of the Money Laundering Criminal Act (TPPU) related to proving predicate crimes, as it leaves a debate whether it must be proven beforehand or not. Design/methodology/approach This research is a normative juridical study, in addition to examining the views of criminal law experts on the formulation of Article 69 of the TPPU Law; it is also extended to the practice of prosecution and court decisions in TPPU cases. Findings The results of this study show that there are two views related to the obligation to not prove the corruption in the ML case. The first view states that the origin of corruption must be proven, especially because ML is a follow-up crime, so it is necessary to prove corrosive crime as one of the predicate offenses. The second view states that the predicate offense of corruption does not have to be proven beforehand because TPPU is an independent offense. Originality/value This research focuses on analyzing whether or not it is obligatory to prove the original crime of corruption in the money laundering case.

Sebagai tindak pidana lanjutan (follow up crime), kedudukan tindak pidana pencucian uang dilihat berdasarkan terjadinya tindak pidana tersebut secara faktual. Akan tetapi, jika cara memandang Tindak Pidana Pencucian Uang sebagai follow up crime seperti itu dipertahankan dalam hal pembuktian, maka riskan untuk membuat tidak efektifnya pembuktian terhadap Tindak Pidana Pencucian Uang dalam keadaan-keadaan tertentu, utamanya dalam hal materiele dader tindak pidana asal tersebut sedang berstatus DPO. Oleh sebab itu, dimunculkanlah sebuah ide yang pada pokoknya menghendaki agar dalam keadaan demikian, masih dimungkinkan untuk dibuktikan tindak pidana pencucian uangnya. Konsep itu disebut dengan istilah independent crime, yang melihat kedudukan TPPU dari perspektif unsur esensial dari delik pencucian uang, dan dari perspektif pembuktian tindak pidana pencucian uang itu sendiri. Dan hal tersebut juga tidak menyalahi apa yang tertuang dalam Putusan Mahkamah Konstitusi No 90/PUU-XIII/2015, sebagaimana dalam ratio decidendi putusan tersebut Mahkamah menyatakan bahwa frasa "tidak wajib dibuktikan terlebih dahulu" bukan  berarti tidak perlu dibuktikan sama sekali tindak pidana asalnya, namun TPPU tidak perlu menunggu lama sampai perkara pidana asalnya diputus atau telah memperoleh kekuatan hukum tetap.As a follow up crime, money laundering offences are seen factually based on the offences done. However, if this perspective about money laundering as a follow up crime is maintained in the trial process perspective, it would be very risky of making the Money Laundering’s proofs  in the court. Some may become ineffective in certain circumstances, especially in term of the materiele dader of predicate offences have declared as a fugitive. For that reason, an idea is created which in essence allow to, in such circumstances, prove his/her money laundering offences. This concept is recognized as the concept of “independent crime”, which sees the crime of money laundering from the essential element of money laundering offense, and from the proofing perspective of the money laundering itself. This is also in line with the decision of the Constitutional Court number 90/PUU-XII/2015, where in the ratio decidendi of the decision, the Constitutional Court declared that the phrase “not obligated to be proven first” does not mean that there is no obligation at all to prove the original offense, instead it means that for it to continue its legal proceeding, but that does not have to wait for the original offense to be sentenced or has received permanent legal force.

Currently in Indonesia Islamic Bank has gained a place and interested in the community, causing many emerging Syari'ah Bank and Financial Institutions of the syari'ah, and products in Islamic banks are widely used is murabahah financing. The formulation of the problem in this research are: (1). How is the implementation of the sale and purchase through murabahah financing between Bank Muamalat Harkat with customers. (2). Is trading system murabahah financing between Bank Muamalat Harkat and customers have been according to the principles of Syari’ah. (3). How murabahah financing efforts to resolve the breach between the customer and Muamalat Harkat. This research method is empirical legal research, this study was conducted in Bank Muamalat Harkat based data collection through field research such as interviews, observation and description as well as information from respondents through library research. The results of this research are: before an agreement Bank to assess carefully the prospective customer in the form of a comprehensive analysis and is divided into several stages, such as the assessment using the principle of 5C Character (Character of the debitor), Chapacity (Capability Candidate Debitor) , Capital (Capital candidate Debitor), Collateral (Collateral candidate Debitor) and Condition of economy (economic condition of the prospective Borrower). Trading system murabahah financing between Bank Muamalat Harkat with the customer has not fully based on the principles of the Syari'ah. Murabahah financing efforts to resolve the defaults can be solved by R3 is Restrukturing (Arrangement Back), Reconditioning (Terms Back) and Rescheduling (rescheduling), sales collateral and auction execution.

This study aims to prove whether transformational leadership training is effective for building anti-corruption attitudes of villages in Kebonharjo village, subdistrict Samigaluh Kulonprogo. This research is an experimental research with one group pre and posttest design.Subject design is 17 people from village of 21 candidates registered. Measuring tool used in this research is the scale of anti-corruption perception made by the researcher referring to the 9 anti-corruption values with the value of reliability coefficient of 0.871. The module used as an intervention made by the researcher refers to the transformational leadership dimension (Bass, 1990). The data collected is analyzed by statistical analysis of different test Paired Sample Test. Initial data collection results obtained sign value of 0.770 which means> 0.05 or no significant difference between anti-corruption perception score between before and after training. After a period of less than 1 (one) month then conducted again the measurement of follow-up of the study subjects in the measurement again using the scale of anti-corruption perception. The results of the second data collection were analysed with Paired Samples Test and obtained the value of 0.623 sign meaning p> 0.05 or no significant difference between post test data with follow-up data so that the hypothesis of this study was rejected.

This study aims to analyze the character values ​​in Sirah Nabawiyah Ar-Rahiq Al-Makhtum by Syafiyyurrahman al-Mubarakfuri, so that it is revealed how the character education of the Prophet Muhammad. and analyze its relevance to current educational goals. The research method used is library research, the type of research approach is deductive and the analysis method is content analysis. Data collection techniques used were library techniques. This research succeeded in proving that prophetic values ​​based on the history of the Prophet Muhammad have a strong relevance to the concept of contemporary character education. Prophetic values ​​loaded with character education in this era, especially related to religiosity, honesty, tolerance, discipline, hard work, creative, independent, democracy, curiosity, national spirit, love of the motherland, respect for achievement, friendship, love for peace , likes to read, care about the environment, care about social, and responsibility.

Aims/Objectives/BackgroundWrist fractures are among the commonest injuries seen in the emergency department (ED). Around 25% of these injuries have Colles’ type fracture displacement and undergo manipulation in the ED. In the UK, these manipulations are typically done ‘blind’ without real time imaging and recent observational studies show that over 40% of the injuries go on to require surgical fixation (due to inadequate initial reduction or re-displacement). Point of care ultrasound has been used to guide and improve wrist fracture reductions but it’s effect on subsequent outcome is not established. We set up and ran the UK’s first randomised controlled feasibility trial comparing standard and ultrasound guided ED wrist fracture manipulations to test a definitive trial protocol, data collection and estimate recruitment rate towards a future definitive trial.Methods/DesignWe conducted a 1:1, single blind, parallel group, randomised controlled feasibility trial in two UK hospitals. Adults with Colles’ type distal radial fractures requiring manipulation in the ED were recruited by supervising emergency physicians supported by network research nurses. Participants were randomised to ultrasound directed fracture manipulation (intervention) or standard care with sham ultrasound (controls). The trial was run through Exeter Clinical Trials Unit and consent, randomisation and data collection conducted electronically in REDCap cloud. All participants were followed up at 6 weeks to record any surgical intervention and also underwent baseline and 3 month quality of life (EQ-5D-5L) and wrist function (Patient Rated Wrist Evaluation (PRWE) assessments.Results/ConclusionsWe recruited 47 patients in total, with 23 randomised to the interventional arm and 24 randomised to the control arm. We were able to follow up 100% of the patients for the 6 week follow up. Data analysis and results will be presented at the time of the conference.

Abstract Background Despite the increasing availability of clinical data due to the digitalisation of healthcare systems, data often remain inaccessible due to the diversity of data collection systems. In the Netherlands, Cardiology Centers of the Netherlands (CCN) introduced “one-stop shop” diagnostic clinics for patients suspected of cardiac disease by their general practitioner. All CCN clinics use the same data collection system and standardised protocol, creating a large regular care database. This database can be used to describe referral practices, evaluate risk factors for cardiovascular disease (CVD) in important patient subgroups, and develop prediction models for use in daily care. Construction and content The current database contains data on all patients who underwent a cardiac workup in one of the 13 CCN clinics between 2007 and February 2018 (n = 109,151, 51.9% women). Data were pseudonymised and contain information on anthropometrics, cardiac symptoms, risk factors, comorbidities, cardiovascular and family history, standard blood laboratory measurements, transthoracic echocardiography, electrocardiography in rest and during exercise, and medication use. Clinical follow-up is based on medical need and consisted of either a repeat visit at CCN (43.8%) or referral for an external procedure in a hospital (16.5%). Passive follow-up via linkage to national mortality registers is available for 95% of the database. Utility and discussion The CCN database provides a strong base for research into historically underrepresented patient groups due to the large number of patients and the lack of in- and exclusion criteria. It also enables the development of artificial intelligence-based decision support tools. Its contemporary nature allows for comparison of daily care with the current guidelines and protocols. Missing data is an inherent limitation, as the cardiologist could deviate from standardised protocols when clinically indicated. Conclusion The CCN database offers the opportunity to conduct research in a unique population referred from the general practitioner to the cardiologist for diagnostic workup. This, in combination with its large size, the representation of historically underrepresented patient groups and contemporary nature makes it a valuable tool for expanding our knowledge of cardiovascular diseases.
