Introduction. The top management of enterprises, as a rule, have to solve several strategic issues when concluding a foreign trade contract, among which the choice of strategic direction of activity and the counterparty country is the highest priority. Methods. General and specific methods of system-structural analysis and synthesis were used to formulate the author's definition of "development strategy", to identify the interrelated stages of the development strategy formation; correlation-regression analysis was applied to determine the correlation density between imports and exports for the countries involved in Ukraine’s foreign trade in metallurgical products. Results. The theoretical study of approaches to the formation of a development strategy has allowed formulating the author's definition that the enterprise development strategy is a long-term plan, which contains complex decisions on choosing the direction of enterprise’s development, defining the major goals and models of actions for the formation and effective use of its potential; it also allows the enterprise to create favourable internal and external conditions for successful completion of the main stages of development. It has been found that analysis, monitoring, diagnostics of external and internal environment are a commonly-accepted component of any process of strategy formation. The results of the correlation between import and export as elements of the system have been obtained; it has been proved that a change in import volumes occurs simultaneously with the proportional change in export volumes. Enterprises will be advised to perform foreign economic activities only with counterparties in the countries for which the correlation coefficient between exports and imports is significant. Discussion. The density of export - import links for individual types of metallurgical products is greater than 0.5, indicating a significant correlation between the two considered features. The foreign economic relations between the metallurgical enterprises in Ukraine and various countries of the world are relatively balanced in the field of exports - imports of certain types of metallurgical products. The obtained results should be taken into account in the formation of a strategy for those metallurgical enterprises in Ukraine, which are to perform or expand their foreign economic activity. At the same time, it is necessary to take into account other factors influencing the resultant indicator, i.e. import, and to introduce advanced methods for their detection and research, which, in turn, will reduce the negative impact of the environment. The aim of the article is to determine the essence of the logistics potential of a foreign trade activity of a pharmaceutical enterprise and justify the methods for determining it. The materials used in the study include statistical data of the investigated pharmaceutical enterprises, namely JSC FF “Darnitsa”, PJSC NPC “Borschagovsky Chemical and Pharmaceutical Plant”, PJSC “Pharmak”, LLC “FC Zdorovia” and JSC “Lekhim-Kharkiv”. The study used methods of analysis and synthesis, generalization, content analysis, questionnaires and methods for assessing potential. The questionnaire was used to select indicators that should be part of the logistics potential of a foreign trade activity of a pharmaceutical enterprise. The experts were 100 leading specialists of pharmaceutical companies. They are all involved in foreign economic activity. Experts are gender–divided into women (73 %), men (27 %); by age: up to 25 years – 8 %, 25–35 years – 14 %, 35–45 years – 27 %, 45–55 years – 36 %, over 55 years – 15 %; by experience: up to 5 years – 11 %, 5–10 years – 15 %, 10–20 years – 32 %, 20–30 years – 36 %, over 30 years – 6 %. The experts' conclusions are valid, the coefficient of concordance is 0.86, and the Pearson test exceeds the table value. The essence of the definition of "potential of logistics of pharmaceutical enterprise’s foreign trade activity" is investigated. The types of logistics potential of foreign economic activity and indicators that are appropriate to use for determining the level of development of the logistic potential in foreign economic activity are offered. The potential of logistics of foreign trade activities of pharmaceutical enterprises consists of the potentials of logistics in the field of export and import. The system of indicators for measuring the logistics potential of a foreign trade activity of a pharmaceutical enterprise contains indicators selected through content analysis and questionnaires. The method of estimation of logistics potential in foreign economic activity of pharmaceutical enterprise is offered.

Subject. The article examines the laws regulating insider trading. Objectives. The study outlines recommendations for refining Law On Countering the Illegal Use of Insider Information and Market Manipulation and Amendments to Some Legislative Acts of the Russian Federation, № 224-ФЗ of July 27, 2010. Methods. The methodological framework includes a general dialectical method, analysis and synthesis, induction and deductions, and some specific methods, such as comparative and formal logic analysis to specify the definition of insider information, structural logic and functional analysis to improve the mechanism for countering insider trading and market manipulation. Results. We discovered key drawbacks to be addressed so as to improve the business environment in Russia. Although the Russia laws mainly mirror the U.S. laws, they present a more extended list of terms concerning the insider information. I believe the legislative perfection should be continued. Conclusions and Relevance. The study helps apply the findings to outline a new legislative regulation or amend the existing ones, add a new mention on the course of financial markets to students’ books, develop new methods for detecting and countering and improving the existing ones. If all parties to insider relationships use the findings, they will prevent insider trading crimes in financial markets and (or) reduce the negative impact of such crimes on the parties.

Subject. The article addresses the specifics of shadow economic activities in reformed Russia in the context of systemic transformations. Objectives. We focus on determining the role of shadow economy in the reproductive process, identifying and understanding the specifics of underground economic activity of the Russian economy. Methods. The study rests on general scientific methods (scientific abstraction, unity of historical and logical, analysis and synthesis, induction and deduction, comparison and analogy) and special methods of cognition (monetary methods). We employ the systems and integrated approach. The official statistics, regulations, works of leading researchers on shadow economy expansion, resources of reference and legal systems like Garant and ConsultantPlus serve as the study's information base. Results. We present a retrospective rapid analysis of the extent of shadow economic activity in the domestic economy, establishing the relationships with the processes that take place at different stages of the country's development. We also reveal the specifics of shadow economy relations in Russia, factors that play a key role in expansion for a particular period, a shift to another form of shadow economy. The study characterizes the current period of development, assesses the impact of external shocks on shadow economy expansion. Conclusions. The current period is characterized by the digitization of shadow relations, the shift of corruption to the upper echelons of power, the continued outflow of capital abroad, and increased penalties for underground activities.

Abstract Introduction. Nowadays the foreign economic activity of the regions serves as a factor contributing to improving the population well-being, improving its life quality, as well as territory socio-economic development and increasing its competitiveness. The purpose of the article is to analyze the foreign trade in services at the regional level and to identify its features. Results. The comparative analysis of the services export dynamics was conducted in the studied regions for the period from 1996 to 2018: the periods of growth, reduction, peak values were identified, the leader – Odessa region was determined. At the same time, it is emphasized that due to the decrease in the indicator in Odessa region and the growth in the Mykolaiv region, the gap between them narrowed significantly for the period from 2012. The dynamics of the services import volume in the economy of the studied regions has been analyzed. Determination of the leader – Odessa region was done, the trends of dynamics for the studied period are considered. The dynamics calculation of the foreign trade balance in services in the Mykolayiv region is given. The calculation of the chain gains index of the services foreign trade balance in the Mykolaiv region is given, which indicates a considerable amplitude of fluctuations and reduction from 2014 to 2016. Results. The foreign trade balance in services in the studied areas was calculated and analyzed: the Odessa region was the leader before 2010. After in accordance with the services export dynamics in Odessa and Mykolaiv regions, their convergence to the actual equalization in 2018 is observed. The positive value of the balance in all the regions for the whole study period is noteworthy. The analysis makes it possible to confirm the significant dependence of the foreign regions economic activity of the Black Sea region on the general situation in the country with divergent tendencies of indicators changes, which allows to define it as heterogeneous. The article examines the problematic issues of applying measures to protect the rights and legitimate interests of entrepreneurs in cases of crimes in the field of economic activity. The material-legal and criminal-procedural mechanisms used in the course of proceedings in this category of cases are examined. Special attention is paid to the analysis of the legal positions of the Supreme Court of the Russian Federation, reflected in the decisions of the Plenum of November 15, 2016 № 48 and October 3, 2017 № 33. The purpose of this study is to identify the most acceptable areas of activity of judicial and law enforcement agencies to protect the rights and legitimate interests of entrepreneurs involved in criminal proceedings. The objectives of the study are: a) to determine the specifics of criminal and criminal procedure legislation containing humane mechanisms for the category of cases under consideration; b) to highlight the positions of scientists who conduct research in this field of activity; с) substantiation of recommendations for the further development of criminal policy in the direction of liberalizing the current structure of crimes in conjunction with the improvement of criminal procedural forms of criminal proceedings. The methodological basis of the research was the dialectical method of cognition, General scientific methods of abstraction, analysis and synthesis, as well as special legal methods. Promising ways of development of criminal policy in the field of formation of legislation that allows the most effective protection of the rights and legitimate interests of entrepreneurs are proposed. The conclusion is made about the need for further scientific study of the system of material-legal and criminal-procedural mechanisms used in the proceedings on crimes committed in the sphere of business and other economic activities.

Some aspects of the economic and legal status of a consulting engineer are analyzed, taking into account the specifics of national legislation. Some problems of the legal status of the consulting engineer and the forms of his economic activity are revealed. The introduction of such an entity as a consulting engineer in the modern conditions of construction development is of particular importance due to the need to improve the quality of construction work, the development of competition in this area and the need to change approaches to economic activity in this area. It is established that the concept of consulting engineer is defined in some special regulations, in particular, regulating activities in the field of road construction, but the economic and legal aspects of his business remain unresolved. This significantly affects the effectiveness of the introduction of the institute of consulting engineers in the field of management. The problem of lack of clear definition of the form of conducting economic activity by the specified participant of economic relations is revealed. The necessity of adopting a special normative legal act, namely the Law of Ukraine "On the activities of consulting engineers", in which to regulate general issues of their legal status, features of the organization of its activities, responsibilities, etc is proved. The author's definition of the concept of consulting engineer is proposed, taking into account the need to establish the organizational and legal form of his business, which will ensure proper regulation of relations between him and other participants in construction relations, including contractors and customers. The solution of some problems of the economic and legal status of the consulting engineer under the legislation of Ukraine is offered. The expediency of conducting the activity of a consulting engineer as a self-employed person, or carrying out its activity by creating a legal entity (association of consulting engineers) is substantiated. In addition, in our opinion, an entity that carries out engineering activities and has concluded employment contracts with duly accredited consulting engineers has the right to provide the services of a consulting engineer.

The article offers a classification of types of economic security and separately identifies foreign trade security as the most important element of the states economic security in the context of global escalation of trade contradictions in international trade. The essential characteristics of foreign trade security, characterized by permanent external influence, are revealed. Based on the identified features and characteristics, the definition of foreign trade security is given as a state of protection of exports and(or) imports from threats caused only by external influence, but not internal, in contrast to other types of economic security. It is shown that it is impossible to achieve the state of full provision of foreign trade security of the state in the conditions of participation in international economic relations. To resolve the contradiction between the goal of maximizing the effect of foreign trade activities and the simultaneous need to ensure security, we propose the formation of a scientifically-based system for ensuring foreign trade security and identify its main constituent elements.

The article discusses some aspects of the digitalization impact on labor relations. It is concluded that the digital economy could not but affect the labor legislation, since it is economic relations and the nature of labor organization that largely determine the content and specific nature of labor legislation. It is noted that many scientific materials on this issue affect only certain aspects of the digitalization of labor relations. This is largely due to the fact that the digital economy development process in Russia began somewhat later, and therefore the first works appeared only at the beginning of XX century. However, there is already a reason to conduct a comprehensive study of the problem at the moment. The authors offer to start by highlighting some trends in the development of labor law that are caused by the digital economy. It seems that further work shall be carried out with the definition of trends to identify the risks of digital changes and develop the most optimal proposals for legislation. Based on the trend consideration results, their positive or negative impact on labor relations is noted. It is noted that digitalization opens up new opportunities for the organization of labor and employment, but it carries a huge number of threats to the stability of labor relations at the same time.

The main trends in the development of foreign economic activity of the Russian Federation are associated with many different factors, the most important of which is the transition to the digital economy.Today information technologies play an extremely important role in the life of society and determine the level of its development. Such technologies are used in many areas of human activity and are indispensable for the facilitation of doing different tasks and operations. Customs authorities as a continuously developing institute of customs administration control foreign economic activity and ensure the national security of the state, timely collection of customs payments, lawful customs control and the acceleration of foreign trade. That is why the development of information-technical support of customs authorities is one of the priorities of customs policy.The article is devoted to the institute of electronic customs in the broadest sense of this term; it also includes the main problems connected with the development of electronic customs and involves the ways to solve these problems.

Purpose. The aim of the article is to assess current state of development of dairy enterprises in Khmelnytskyi region on the basis of a comprehensive analysis of financial and economic activities. Methodology of research. The following methods are used in the research process: comparative analysis ‒ in assessing the general trends in the dynamics of indicators of the level of milk procurement, its processing, assessment of financial activities (sustainability) of milk processing enterprises; graphic ‒ when reflecting the production of basic dairy products, the trend of the coefficients of financial and economic activity and positioning of clusters of dairy enterprises; abstract and logical ‒ in preparing conclusions. Findings. The production of dairy products by enterprises of Khmelnytskyi region by types by years is analyzed. Key players - processors in the regional dairy market have been identified. Monitoring of raw material zones of some milk processing enterprises of Khmelnytskyi region is carried out. Indicators of financial and economic activity of dairy enterprises are estimated. The coefficients of financial and economic activity of milk processing enterprises of Khmelnytskyi region are analysed. The ranking of clusters of dairy enterprises for their positioning and development of a strategy for their further development is carried out. Originality. An integrated assessment of the financial condition of dairy enterprises in Khmelnytskyi region has been developed, which uses the main financial ratios of economic activity. Practical value. The results of the study can be used in the formation of development strategy, as well as in determining the reserves of economic growth of dairy enterprises in Khmelnytskyi region.
