The low level of employment of disabled people in the Novosibirsk region shows that in the region there is a need to develop additional legal instruments that ensure the implementation of the right to work of this category of citizens. The measures proposed in this study to increase the employment of persons with disabilities are based on the practical experience of other subjects of the Russian Federation and countries, and also take into account the peculiarities of the labour potential of persons with disabilities.

The article deals with issues related to the problem of vocational rehabilitation of disabled people. The competence of the Russian Federation in the fi eld of rehabilitation of disabled persons in the person of its Federal authorities and management, subjects of the Russian Federation and local self-government bodies is specifi ed. The content of such concepts as "services for professional rehabilitation of disabled people" in accordance with the state standard GOST R 53873-2010 Rehabilitation of disabled people is disclosed. Professional rehabilitation services for the disabled; "professional rehabilitation program" and "options for professional rehabilitation". Despite the fact that professional rehabilitation and adaptation in the workplace is an integral part of the state policy in the fi eld of social protection of persons with disabilities, there are many unresolved problems and diffi culties in this area.

The article considers the peculiarities of foreign citizens stay on the Russian Federation territory. The rights and freedoms of foreigners guaranteed by the Constitution of the Russian Federation and other laws are reviewed and examined. The article provides a comparative legal analysis of the status and rights of both the Russian Federation citizen and a foreign citizen residing in the territory of this state. Common and distinctive features of these two categories are specified. The matters of employment of foreign citizens and restrictions on the rights to participate in labor relations, which is due to the fact that non-citizens have the right to work only if they have a work permit, are also considered. In its turn, the component of migration policy is revealed, that is, the problem of expulsion and deportation of a foreign citizen from the Russian Federation is touched upon. Administrative expulsion and deportation of foreign citizens from the Russian Federation is a form of state activity that regulates relations with foreign citizens and is aimed to protect the State border.

The article presents the results of a medical-sociological study of behavior in 85 constituent entities of the Russian Federation among the disabled and injured at work. In the course of the study, two groups of respondents were interviewed, randomly selected and comparable in terms of sex and age: 562 persons with disabilities with the cause of disability common disease and 442 injured at work. As a result of the questionnaire, information was obtained on the types of HRM received by respondents, problems arising in the process of providing HRM, the level of assistance needed by the respondent in choosing products and their suppliers, as well as assessing the main concerns of respondents associated with the introduction of a new mechanism for providing with the use of a certificate. It has been established that the contingent of industrial victims is more in need of technical means of rehabilitation that compensate for the limitations of the ability to move independently and work, in contrast to the disabled, among whom a significantly greater percentage of people need SMW to compensate for the impairment of the ability to self-service. The rankings of the main problems associated with the provision of TCP in both groups coincide. More than half of the respondents expect an improvement in the system of providing technical support in the event of an electronic certificate.

Worldwide, December 3 is the international day of persons with disabilities. As early as 1982, a 10-year programme of action for persons with disabilities was adopted, called the Decade of persons with disabilities, and at its end in 1992, the General Assembly declared December 3 as the International day of people with disabilities. The goal of this day was to promote the rights of persons with disabilities in all spheres of public life, as well as to attract the attention of the General public to the problems of disabled people. Every year there are more and more people with disabilities, so only in the Russian Federation the total number of disabled people is 9% of the population. Someone comes to terms with their fate and closes in the walls of their home, and someone continues to lead an active life, not wanting to change something in the usual way in connection with their new status. Such strong-minded people learn new professions, acquire previously unknown skills, and try to expand their horizons in various ways available to them. And some unique individuals in the desire to prove to others, and first of all to themselves, that disability is not a sentence, even take part in sports competitions organized specifically for people with disabilities. And if for any famous athlete participation in the Olympics, and even more so victory in it, is a matter of prestige and world recognition, for a disabled person participation in the Paralympic games primarily means victory of the spirit over the body, victory over their own helplessness and infirmity, recognition of the fact of beauty and fullness of life.

The purpose of the research is to provide a legal analysis of the labour activities of persons with disabilities in the Russian Federation. The authors consistently address employment issues of the persons with disabilities; also based on a review of Russian judicial practices, they formulate recommendations for the harmonisation of this vital area of labour relations. The research used the methods of system-oriented analysis, content analysis and comparative analysis. Based on the scientific analysis, the features and prospects of the development of legal regulation of employment of persons with disabilities were identified, and the comparative analysis method to identify areas of practice in the application of Russian federal and regional laws in Russia. At the beginning of the article, a historical excursion to the creation of the institution of labour relations with the involvement of persons with disabilities is provided; it starts from the second half of the 18th century until the end of the Soviet era, in the 1990s of the 20th century. Further, based on an analysis of the main legal instruments regulating the specified area of relations, the authors consider issues of the legislative consolidation of the procedure for quoting jobs for persons with disabilities, and also analyse the legal forms of protecting the labour rights of persons with disabilities and preventing discrimination on the basis of disability. Special focus is put on exercising control over the fulfilment by employers of the legal requirements concerning the provision of disabled people with jobs according to the established quota, as well as compliance with the related requirements established by sanitary rules. In Russia, the realisation of the right to work of disabled people is regulated not only at the federal but also regional level. Top priority is given to the regulation of labour relations involving disabled people and creation of the most favourable conditions for them in the constituent entities of the Russian Federation. In conclusion, the authors provide a list of proposals and recommendations for improving the legal regulation of labour relations in the Russian Federation involving disabled people.

In this article, the authors analyze the changes in civil procedural legislation. The research featured the issues of qualification for legal representatives in all categories of cases, with the exception of cases considered by magistrates and district courts. The study was based on the provisions of the Administrative Procedure Code of the Russian Federation, which initially provided no exceptions for this rule. The authors believe that the expansion of the sphere of professional representation requires an analysis of these amendments and existing regulations on professional representation from the point of view of constitutional right to judicial protection and the right to receive qualified legal assistance. A certificate of higher legal education or an academic degree in a legal specialty does not always indicate the level of professionalism. A professional representative should also have positive practical experience, as well as strive for professional development. The authors assessed the classification of cases that require a professional representative. In this article, they criticize the current monopoly of lawyers on representation in civil court and argue the uselessness of establishing the education and qualification of a representative in its current form. The professionalization of the institution of legal professional representation is possible only under the conditions of the evolutionary development of procedural relations and the imperative consolidation of the rules of a competitive professional process.

In 2012 Russia ratified the UN Convention on the Rights of Persons with Disabilities, which provides for the creation of an accessible environment for disabled people, ensuring their rights to work, medical care, education and full participation in public life. This is the fundamental basis on which the social policy of the state in relation to the disabled persons is currently being built. The strategic direction of the social policy of the state is the rehabilitation and habilitation of disabled people, the effectiveness of which depends on the completeness of the study of the epidemiological picture of the spread of disability and the need for various methods of rehabilitation and habilitation in citizens with limited life activity due to violations of the body’s functions. The article presents information characterizing the epidemiological picture of the disability of the population in the Russian Federation, taking into account the main age categories. Data on the total number of disabled people receiving various types of rehabilitation and habilitation services in the Russian Federation are also presented. There are highlighted problematic issues, the solution of which is necessary for the implementation of the social policy of the state.

The indexes primary and secondary disability among soldiers working and retirement age because of «military trauma» in dynamics for 2015-2016. From the military in 90% of cases disability is defined in the working age. The socio- hygienic analysis of the data on primary and secondary disability, carried out on a territorial basis, points to the heterogeneous share of disability indicators among military personnel in the Federal districts of the Russian Federation. It is revealed that the North-Caucasus, southern and Central Federal districts are the leaders in the establishment of primary disability and the total number of disabled people. The heterogeneous proportion of persons with disabilities recognized as members of the armed forces in different districts determines the need to analyse the conditions and grounds on which the disability was established. The implementation of the Federal comprehensive program «Accessible environment» and sub-programs aimed at the creation of the subjects of the Russian Federation of rehabilitation centers for patients and disabled people, due to the territorial characteristics of the prevalence of primary disability and the specifics of the category of persons with disabilities. Therefore, the data of the conducted social and hygienic analysis can serve as a basis for making organizational decisions on the creation of complex rehabilitation centers for disabled people from among former servicemen in the territories of the Russian Federation.

Introduction: the protection of the rights of persons with disabilities is one of the priority directions of the modern social policy of any democratic state. Considerable attention is paid to this direction by the state. At an expanded meeting of the board of the General Prosecutor's Office of the Russian Federation V.V. Putin summed up the results of the department's work for 2020 and gave instructions to continue to keep the social protection of disabled people under control. The President of the Russian Federation noted that in 2020 the number of identified, and most importantly, eliminated violations in the field of protecting the rights of persons with disabilities increased.Purpose: to improve the participation of the prosecutor in proceedings on cases of administrative offenses in the field of social protection and social services for disabled people. Results: the author's position on adding to the exclusive competence of the prosecutor the initiation of cases of administrative offenses under Art. 5.41 of the Administrative Code of the Russian Federation. In addition, it is proposed to introduce into the Code of Administrative Offenses of the Russian Federation a norm providing for the notification of the prosecutor about the time and place of consideration of a case on an administrative offense in relation to persons with disabilities of I and II groups.Conclusions: the article raises the problem of bringing officials of public authorities to administrative responsibility. The necessity of amending the Code of the Russian Federation on cases of administrative offenses in order to improve the participation of the prosecutor in proceedings on cases of administrative offenses in the field of social protection and social services for disabled people is substantiated.

The article presents an analysis of the formation of general disability among persons older than working age due to diseases of the nervous system in Moscow. Introduction. Disability among the population – one of the most important medical and social problems – is an integral indicator. The purpose of the study is to study the patterns of the formation of general disability. Materials and methods. The study is solid for 2012–2018, using statistical forms of observation: form 7-sobes, statistical collections of THE Federal Security Service of the Russian Ministry of Labour. Research methods – excavation of information, descriptive statistics (absolute, extensive, intense indicators, series of dynamics, reliability assessment (average error). The results of the study. There has been an increase in the overall number of disabled people with a more pronounced growth rate in Moscow compared to the Central Federal District and the Russian Federation. The structure of general disability due to diseases of the nervous system was dominated by re-recognized persons with disabilities, but their share is lower than in the Central Federal District and the Russian Federation. The structure was dominated by disabled people in the third group with a tendency to increase their specific weight and disability, and there was a decrease in the proportion of disabled people in the I–II group and their levels. Conclusions. The total number of disabled persons among persons of older working age due to diseases of the nervous system in the dynamics of 2012–2018 has steadily increased, the growth rate was 18.6%, which is significantly higher than in the Central Federal District (4.1%) and the Russian Federation (8.2%). The structure was dominated by persons re-recognized as disabled, their share in the dynamics tended to increase, but the figure was lower than in the Central Federal District and the Russian Federation. The general population of persons with disabilities remained at 6,5 ± 0.11 cases per 10,000 of population of the appropriate age. The structure of general disability in severity was dominated by group III persons with disabilities, with a tendency to increase their specific weight and disability level. The proportion of persons with group I–II disabilities and their level tended to decrease
