Penelitian ini bertujuan untuk menganalisis pernanan Polri dalam Penanganggulangan Tindak Pidana Narkotika di Kabupaten Gorontalo. Metode penelitian menggunakan metode penelitian yuridis-sosiologis. Hasil penelitian bahwa efektivitas fungsi polisi dalam penyidikan tindak pidana narkotika di kota Gorontalo masih kurang efektif. Hal ini terbukti dengan semakin meningkatnya peredaran gelap maupun penyalahgunaan narkotika. Adapun upaya polisi saat ini dapat digolongkan menjadi tiga bagian yaitu secara preventif, pre-emtif, dan represif. Namun upaya-upaya ini belum efektif karena kurangnya kesadaran masyarakat akan bahaya penyalahgunaan narkotika serta mudahnya narkotika didapatkan oleh masyarakat. Sedangkan faktor-faktor yang mempengaruhi peranan kepolisian dalam menanggulangi peredaran gelap narkotika di Gorontalo antara lain: faktor substansi hukum, faktor struktur hukum, faktor sarana dan prasarana, faktor masyarakat, dan faktor kebudayaan hukum. This study aims to analyze the role of the National Police in the Management of Narcotics Crime in Gorontalo District. The research method uses juridical-sociological research methods. The results showed that the effectiveness of the police function in investigating narcotics crime in Gorontalo city is still not effective. This is evidenced by the increasing number of illicit trafficking and drug abuse. The current police efforts can be classified into three parts, namely preventive, pre-emptive, and repressive. However, these efforts have not been effective because of the lack of public awareness of the dangers of narcotics abuse and the ease with which narcotics are obtained by the community. Meanwhile, the factors that influence the role of the police in overcoming illicit narcotics trafficking in Gorontalo include: legal substance factors, legal structure factors, facilities and infrastructure factors, community factors, and legal culture factors

Abstract<br />This article aims to determine the factors that hinder the effectiveness of the application of the Indonesian <br />National Standard (SNI) on children’s toys. The research methodology used is empirical research, which<br />is researching secondary data at first, then continuing research on primary data in the field or the<br />community. Legal research materials used are primary and secondary legal materials, the technique<br />used in gathering legal materials is depth interviews and document studies or library materials. The<br />results showed that there were factors that hindered the effectiveness of the implementation of the <br />Indonesian National Standard (SNI), which was due to the community being indifferent or not paying <br />attention to the importance of standardization in children’s toys besidesthe lack of merchant knowledge<br />to the importance of SNI in children’s toys.In the application of SNI, there are inhibiting factors, namely<br />the Law factor indicated by the absence of regional regulations governing mandatory SNI on children’s<br />toys, law enforcement factors namely the lack of work ethic in law enforcement, facility and infrastructure<br />factorsare indicated by communication tools that do not yet support the role of law enforcers to maximize<br />their performance, community factors many people who do not know the importance of SNI in children’s<br />toys due to the lack of socialization they get, cultural factors are shown by the legal culture or immature<br />legal habits of society so that the effectiveness of the mandatory forefront of SNI is not running optimally.<br />Keywords: SNI; Children Toys; Effectiveness.<br />Abstrak<br />Artikel ini bertujuan untuk mengetahui faktor-faktor yang menjadi penghambat efektivitas penerapan <br />Standar Nasional Indonesia (SNI) pada mainan anak. Metodologi penelitian yang digunakan adalah<br />penelitian empiris, yaitu meneliti data sekunder pada awalnya, untuk kemudian dilanjutkan penelitian<br />terhadap data primer di lapangan atau terhadap masyarakat. Bahan penelitian hukum yang digunakan<br />adalah bahan hukum primer dan sekunder, teknik yang digunakan dalam pengumpulan bahan hukum<br />adalah depth interview dan studi dokumen atau bahan pustaka. Hasil penelitian menunjukkan terdapat<br />faktor yang menghambat efektivitas penerapan Standar Nasional Indonesia (SNI) yaitu dikarenakan<br />masyarakat acuh atau tidak memperhatikan betul pentingnya standardisasi pada mainan anak selain<br />itu  kurangnya pengetahuan pedagang terkait pentingnya SNI pada mainan anak. Dalam penerapan<br />SNI terdapat faktor-faktor yang menghambat yaitu faktor Undang-Undang ditunjukkan dengan belum<br />adanya peraturan daerah yang mengatur tentang wajib SNI pada mainan anak, faktor penegak hukum<br />yaitu masih kurangnya etos kerja pada penegak hukum, faktor sarana dan prasarana ditunjukkan<br />dengan alat komunikasi yang belum menunjang peranan penegak hukum untuk memaksimalkan<br />kinerjanya, faktor masyarakat yaitu banyak masyarakat yang belum mengetahui pentingnya SNI pada<br />mainan anak dikarenakan kurangnya sosialisasi yang mereka dapatkan, faktor kebudayaan ditunjukkan<br />dengan budaya hukum atau kebiasaan hukum masyarakat yang belum matang sehingga efektivitas <br />penerapan wajib SNI tidak berjalan dengan maksimal. <br />Kata Kunci: SNI; Mainan Anak; Efektivitas.

Ditenggarai lemahnya penegakan hukum terhadap pelanggaran politik uang yang terjadi pada Pemilu 2019 menjadi isu yang mengemuka, termasuk di Kabupaten Polewali Mandar. Peran pengawasan, penegakan dan penindakan, sebagaimana yang diatur dalam Undang-undang Nomor Nomor 7 tahun 2017 tentang Pemilihan Umum dan Peraturan Bawaslu Peraturan Bawaslu Nomor 31 Tahun 2018 tentang Sentra Penegakan Hukum Terpadu (Gakkumdu) memuat sejumlah ketentuan yang mengatur mekanisme dan tata cara penegakan hukum terhadap pelanggaran politik uang tersebut. Metode yang digunakan dalam penelitian ini adalah, penelitian empiris yang mengkaji regulasi atau peraturan perundang-undangan dalam praktik penegakan hukum terhadap dugaan pelanggaran politik uang pada penyelenggaraan Pemilu Tahun 2019. Kesimpulan penelitian menunjukkan bahwa, terdapat 3 (tiga) kasus dugaan pelanggaran politik uang pada Pemilu Tahun 2019 di Kabupaten Polewali Mandar yang semestinya melewati 9 (sembilan) tahapan dalam kenyataannya hanya sampai pada tahapan ketiga yakni, rapat pleno pengawas Pemilu. Hal itu dikarenakan adanya ketidak sepahaman di dalam tim Sentra Gakkumdu dengan Bawaslu Kabupaten Polewali Mandar. Adapun kendala dalam penengakan hukum terhadap dugaan pidana politik uang sangat terkait dengan struktur hukum, substansi hukum dan budaya hukum sebagaimana fakta dan temuan lapangan. Karenanya, penelitian ini merekomendasikan, ke depan pidana Pemilu tidak lagi ditangani oleh Bawaslu, tetapi dimasukkan sebagai pidana umum. Dan jika sentra Gakkumdu tetap dipertahankan keberadaannya, hendaknya diberi kewenangan tambahan yakni, melakukan penahanan terhadap terduga pelaku politik uang, agar tidak terbuka ruang mengkodisikan saksi dugaan politik uang. Termasuk pentingnya pembentukan peradilan khusus Pemilu agar perbedaan pandangan atas kasus dugaan politik uang dapat diminimalisir. The indication of the weak law enforcement against money politics violations that occurred in the 2019 Election has become an emerging issue, including in Polewali Mandar Regency. The role of supervision and enforcement, as regulated in Law Number 7 of 2017 concerning General Elections and Bawaslu Regulation Number 31 of 2018 concerning Sentra Penegakan Hukum Terpadu (Gakkumdu) contains a number of provisions governing the mechanisms and procedures for law enforcement against such violations of money politics. The method used in this research is empirical research that examines regulations or statutory regulations in law enforcement practices against suspected violations of money politics at the 2019 Election. The research conclusion shows that, there were 3 (three) cases of alleged violations of money politics in the 2019 Election in Polewali Mandar Regency which should have passed 9 (nine) stages but in reality only reached the third stage, namely, the Election supervisor plenary meeting. It was due to the lack of Understanding on the Sentra Gakkumdu with Bawaslu Polewali Mandar. The obstacles in law enforcement against allegations of money politics crime are closely related to the legal structure, legal substance and legal culture as well as facts and field findings. Therefore, this research recommends that in the future election crimes will no longer be handled by Bawaslu, but be included as general crimes. And if the Sentra Gakkumdu is maintained, it should be given additional authority, namely, detaining suspected money politics actors, so that there is no room to codify witnesses for alleged money politics. This includes the importance of establishing a special election court so that differences in views on suspected cases of money politics can be minimized.

The purpose of this study are: 1) To find out and analyze the principle of compliance in carrying out a Temporary Appointment Work Agreement system in the Bogor area. 2) To find out and analyze steps to improve the fate of workers in a Temporary Appointment Work Agreement system in the Bogor area. The research method used in this research is normative juridical research and sociological research. The results of this study are: 1) The principle of compliance in carrying out the system of Temporary Appointment Work Agreement in Bogor Regency and Bogor City, in practice there are still frequent violations, due to unclear rules regarding the application of a Temporary Appointment Work Agreement (PKWT). 2) Measures to improve the fate of PKWT system workers, in terms of legal structure refer to the form and position of legal institutions contained in the labour law system. For workers who are not in accordance with the laws and regulations, for the sake of law will change to PKWTT, which is changed to become permanent workers. The protection provided is in the form of rights and obligations as permanent workers in the form of protection of the rights to wages, occupational health, job security, severance pay, reward money for work tenure, and work replacement money. Legal culture (legal culture) includes the values contained in the community that underlies the applicable law in PKWT.

Indonesia as the largest Muslim country should ideally have a society with good legal culture. Criminal offense or a violation related to cyberporn, does not need to happen. Cyberporn crime is not only a legal issue, but it is more complex. The weakness of the legislation, as well as the technological advances that are supported by the low legal awareness of society, it will difficult to tackle the cyberporn crime. The role of religion is needed as ethical teachings. Indonesia, which recognizes the principle of the Deity as its first principle, mean idealizing the condition of religious society. Awareness of the law will also be easily formed in communities that implement the teachings of their religion well, including public awareness for not accessing the cyberporn. : Indonesia sebagai Negara umat muslim terbesar idealnya memiliki masyarakat dengan budaya hukum yang baik. Tindak pidana atau bentuk pelanggaran yang berkaitan dengan cyberporn tidak perlu terjadi. Kejahatan cyberporn tidak hanya merupakan permasalahan hukum, tetapi lebih kompleks. Kelemahan peraturan perundang-undangan serta kemajuan teknologi yang didukung dengan kesadaran hukum masyarakat yang sangat rendah mengakibatkan akan sulit menanggulangi kejahatan cyberporn. Peran agama dibutuhkan sebagai sebuah ajaran etika. Indonesia yang mengakui sila Ketuhanan sebagai sila pertamanya, berarti mengidealkan kondisi masyarakat Indonesia yang religius. Kesadaran terhadap hukum pun juga akan mudah dibentuk dalam masyarakat yang mengamalkan ajaran agamanya dengan baik, termasuk kesadaran masyarakat untuk tidak mengakses cyberporn.    DOI: 10.15408/jch.v5i1.3509

Penelitian ini bertujuan untuk mengetahui efektivitas proses pendaftaran tanah hak milik dan faktor-faktor yang mempengaruhi efektivitas pendaftaran tanah hak milik di Kantor Pertanahan Kota Makassar. Populasi penelitian ini adalah semua pegawai Kantor Pertanahan Kota Makassar yang akan diwawancarai dan masyarakat sebagai responden pada Kantor Pertanahan Kota Makassar. Hasil penelitian menunjukkan bahwa pelaksanaan peraturan pemerintah Nomor 24 tahun 1997 belum sepenuhnya efektif akibat dari pengaruh substansi hukum, struktur hukum, budaya hukum, kesadaran hukum masyarakat dan sarana/prasarana. Untuk itu diperlukan adanya penyuluhansubstansi hukum guna meningkatkan kesadaran hukum masyarakat tentang pendaftaran tanah, pembentukan budaya hukum, serta pembenahan secara prioritas sarana/prasarana sesuai dengan kemampuan anggaran yang tersedia pada Kantor Pertanahan Kota Makassar. Dalam rangka keefektifan pelaksanaan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendafatran Tanah, diharapkan kantor pertanahan untuk lebih sering mengadakan penyuluhan ke desa/kelurahan secara menyeluruh guna meningkatkan kesadaran hukum masyarakat tentang pendafatran tanah, agar masyarakat lebih memahami akan pentingnya pendaftaran tanah. Bagi kantor pertanahan, perlu meningkatkan sumber daya manusia dan komputer, jaringan internet serta perangkat lainnya dilakukan secara teliti dan cermat dimasa depan agar lebih meningkatkan pelayanan dan keahlian. This research aims to know the effectiveness of land registration process of proprietary rights and factors that affect the effectiveness of land registration of property rights in the land Office of Makassar. The population of this research is all employees of the land office of Makassar that will be interviewed and the community as respondents in the land office of Makassar.The results showed that the implementation of government Regulation number 24 year 1997 has not been fully effective as a result of the influence of legal substance, legal structure, legal culture, public law awareness and facilities/infrastructure. Therefore, there is a need for legal counseling to increase public law awareness about land registration, the establishment of legal culture, and the prioritization of facilities/infrastructure in accordance with the budget capability available in the Land Office of Makassar. In the framework of the effectiveness of government Regulation number 24 year 1997 on the implementation of the land, it is expected that land office to more often conduct counseling to the village/Kelurahan thoroughly to increase public awareness about the implementation of the land, so that the community better understand the importance of land registration. For land offices, need to improve human resources and computers, Internet network and other devices are done carefully and carefully in the future to further improve service and expertise.

Cooperatives are the support of the national economic order which is an integral and inseparable part, so that’s why it is not only the mandate of the constitution but also becomes hopes in building the people's economy. This study utilized a sociological juridical approach by examining the rules, concepts, community views, legal doctrines obtained from secondary legal materials, as well as applicable laws and regulations relating to the issues discussed. The results found the factors that influence cooperative public policy that has not been able to play a role in the field of government construction services by basing on legal system theory are caused by 3 legal subsystem factors (first legal factors, second legal structure factors, and legal culture factors). Thus, based on the values of justice, it is necessary to reconstruct the laws and regulations, especially the provisions of Article 6, Article 15 and Article 16 of Law No. 25 of 1992 concerning cooperatives.

Digitalization has ushered in an era of disruption. The negative impact is body shaming. In the case of body shaming in Indonesia in 2018, “there were 966 cases of physical humiliation or body shaming handled by police from all over Indonesia throughout 2018. Most recently in 2019, public figures were also affected. No less surprising, this phenomenon does not only attack adults but also babies. The problem raised in this paper is what legal factors influence the rise of body shaming as a digital crime in the era of disruption. The approach method used is conceptual. In conclusion, the legal factors that influence the prevalence of body shaming are the substance of law and legal culture. In the aspect of legal substance, some areas have not been touched by current regulations, even though the legal realm is often used as a catalyst for digital body-shaming crimes. Meanwhile, in the aspect of legal culture, the problem of legal conflicts and low legal compliance are the main problems. To make matters worse, the attitude of the victim who prefers to ignore the treatment they receive without taking a fight justified by law makes the perpetrators of body shaming even wilder and more frontal,  because law enforcers, as part of the legal structure, are unable to take action because this act falls under the complaint offense. Suggestions, improved regulations and the role of the press and the public to change the way they view body-shaming behavior

Intellectual Property Rights (IPR) is one of movable objects that can be represented according to waqf regulation (Undang-Undang No. 41 Tahun 2004 Tentang Wakaf). The previous regulations did not mention IPR as waqf object. IPR becomes waqf object because there is a shift of  paradigm on productive waqf. However, the waqf regulation (Undang-Undang No. 41 Tahun 2004 Tentang Wakaf) has many juridical problems. For example, there is no specific explanation about IPR waqf as well as money waqf. Besides, the IPR practice is very rare due to unclear forms of IPR waqf. Juridical problems on IPR waqf are related to legal substance, legal structure and legal culture. On legal substance, there is no clear explanation and mechanism of IPR waqf. On legal structure, there is no clear explanations about who can be the wakif or nazir on IPR waqf. On legal culture, many people are still unfamiliar with intangible waqf object (the conventional waqf object is land). Therefore, the acceptance of an intangible object such as IPR as a waqf object is very low.

Scholars have barely begun to explore the role of the Old Testament in the history of the Spanish New World. And yet this text was central for the Empire’s legal thought, playing a role in its legislation, adjudication, and understandings of group status. Institutions like the Council of the Indies, the Inquisition, and the monarchy itself invited countless parallels to ancient Hebrew justice. Scripture influenced how subjects understood and valued imperial space as well as theories about Paradise or King Solomon’s mines of Ophir. Scripture shaped debates about the nature of the New World past, the legitimacy of the conquest, and the questions of mining, taxation, and other major issues. In the world of privilege and status, conquerors and pessimists could depict the New World and its peoples as the antithesis of Israel and the Israelites, while activists, patriots, and women flipped the script with aplomb. In the readings of Indians, American-born Spaniards, nuns, and others, the correct interpretation of the Old Testament justified a new social order where these groups’ supposed demerits were in reality their virtues. Indeed, vassals and royal officials’ interpretations of the Old Testament are as diverse as the Spanish Empire itself. Scripture even outlasted the Empire. As republicans defeated royalists in the nineteenth century, divergent readings of the book, variously supporting the Israelite monarchy or the Hebrew republic, had their day on the battlefield itself.
