Based on this perspective, the type of legal research is carried out through juridical-empirical. In terms of the orientation of law enforcement towards land management by (PCO) as citizens for gardening, it’s an arbitrary act and leads to legal discrimination, considering that the State has protected the rights of citizens through Law No. 18 of 2013 concerning Prevention and Eradication of Forest Destruction Article 11 paragraph (3). In addition, the professionalism of law enforcement officials in the field of human resources must be further improved in order to further strengthen the mastery of knowledge of criminal offenses and the elements of crime from an act, so that the community as citizens is not harmed in terms of law enforcement orientation.

Abstract Fungi are among the most important organisms on earth, and they are essential components of terrestrial ecosystems. Their reproductive structures are strictly dependent and affected by environmental conditions, and community dynamics over time and space may be indirect indicators of the health status of forests. We combined macrofungal biodiversity indices in eight Mediterranean forests in Italy and surveyed 160 plots by standardized surveys, to evaluate the role of macrofungi as early predictors of change in the forest structure. The results show that indices of fungal diversity are influenced by geographic and floristic conditions, and inter- and intra-annual temperature and rainfall fluctuations affect the formation of fungal fruiting bodies. These findings suggest that environmental changes could be reflected by macrofungi, and conservation initiatives should consider the pivotal role that fungi play in biodiversity monitoring.

AbstractIn this chapter, we present the technological background needed for understanding the problem addressed by this DataBio pilot. Spain has to face plagues and diseases affecting forest species, like Quercus ilex, Quercus suber or Eucaliptus sp. Consequently, Spanish Public Administrations need updated information about the health status of forests. This chapter explains the methodology created based on remote sensing images (satellite + aerial + Remotely Piloted Aircraft Systems (RPAS)) and field data for monitoring the mentioned forest status. The work focused on acquiring data for establishing the relationships between RPAS generated data and field data, and on the creation of a correlation model to obtain a prospection and prediction algorithm based on spectral data for early detection and monitoring of decaying trees. Those data were used to establish the links between EO image-derived indexes and biophysical parameters from field data allowing a health status monitoring for big areas based on EO information. This solution is providing Public Administrations with valuable information to help decision making.

The purpose of this study is to conflict mapping, explain conflict style of stakeholder and choices of conflict resolution. This study was conducted in February 2017 in Cisantana Village, Kuningan Regency. Data were collected through participatory rural appraisal; interviews, field observation, documentation and focus group discussions. The study method was used Rapid Land Tenure Assessment (RaTA) and Dispute Style Analysis (AGATA). The results showed that the dominant conflict in TNGC was the change of forest status which affected the economic activities of the community around TNGC, that involved eight dominant actor. In a conflict, the stakeholder has a different style of dispute. The stakeholders was facilitated and mediated to propose a permit to manage Patulungan (parking management), and a permit to manage Ipukan (tourism guide). In this case, the role of outsiders who do not have a conflict relationship is needed in order to realize conflict resolution.

This thesis discusses the Implementation of Land Procurement for Development in the Public Interest in the Construction of the Kawal Reservoir Infrastructure, which was built by the Ministry of Public Works of the Director General of Water Resources. The background used is the issuance of regulations regarding land acquisition in the form of Law No. 2. In 2012, which is quite comprehensive regulates and facilitates the process of land acquisition for development in the public interest. This law has been revised 4 times in the form of a Perpres from the Presidential Regulation No. 71 of 2012 to the latest Presidential Regulation No. 88 of 2017 as a refinement and consistency of the government in the policy of accelerating infrastructure development. But the fact is that national land acquisition is still the second biggest inhibiting factor, 30%. Kawal Reservoir is an infrastructure development in the field of public works has become a polemic, starting from the systems and procedures for land acquisition, the policies issued by the parties, the substance of the problem, as well as the apparatus' view of the land acquisition itself. The implementation of land acquisition for development in the public interest is in accordance with Law No. 2 of 2012 on the construction of the guarding reservoir infrastructure, which at present is still continuing to stop its physical development at the preparation stage. Problems in the form of forest status functions, overlapping ownership, and the existence of the Governor of Riau Islands Province Decree regarding Location Determination are obstacles that are passed through the Spatial Planning and Land Affairs apparatus in carrying out their main duties and functions. The phenomena that exist in the background of the problem will be integrated with the literature, conceptual and frame of mind developed. Research using Empirical / Sociological Legal Research methods.

Forest resource control in Indonesia has progressed from stringent state control towards a more community and indigenous based. Indonesia has embarked a journey in agrarian reform and social forestry to achieve a more balanced portion of forest resource control. The social forestry has manifested in the Collaborative Forest Management Program (PHBM) by Perhutani with the establishment of Forest Community Institution (LMDH) as its core. Forest for Special Purpose (KHDTK) Getas – Ngandong was chosen as the study case since it offers striking issue in social forestry program in the past and the outlook for the new forest status. This paper attempted to identify the policy learning from the past forest resource arrangement i.e., social forestry policy for the new forest status outlook. We identified the policy prior to the social forestry program and the implementation of social forestry from Perhutani. Subsequently, we identified policy learning from that past policy and tried to formulate the policy outlook for the new forest status. The data obtained through an interview to key informants complemented with observation, study literature, and document study. We found that past policy does not incorporate the local community in the forest utilization. The social forestry by Perhutani in their PHBM also showed indifferent approach which positioned the local community unequal with the Perhutani as social forestry promised. We identified fundamental changes should be done, which should prioritize social aspect before seeking out the economic and ecological restoration of the forest. We found the new forest status might hamper the implementation for the new forest policy which driven by the social forestry ideas. If only the new forest status could enable social aspect, the new manager will require tremendous support, robust institution, and plentiful resources to implement their policy.Pembelajaran dari Kebijakan Perhutani Sosial di Hutan Jawa: Menyusun Langkah Ke-depan untuk Status Hutan Baru di Kawasan Hutan eks-PerhutaniIntisariPengelolaan hutan di Indonesia yang dulunya didominasi oleh peran sentral negara saat ini telah mulai bergeser menjadi pengelolaan yang berbasis masyarakat dan adat. Program perhutanan sosial dan reforma agraria telah dijalankan untuk mendapatkankebermanfaatan hasil hutan secara lebih adil. Perhutanan sosial tersebut termanifestasikan dalam Pengelolaan Hutan Bersama Masyarakat (PHBM) dari Perhutani dengan pembentukan Lembaga Masyarakat Desa Hutan (LMDH). Kawasan Hutan dengan Tujuan Khusus (KHDTK) Getas – Ngandong memberikan suatu kasus yang menarik karena memperlihatkan adanya konteks perhutanan sosial di masa lampau dalam PHBM dan pengelolaan yang sedang dilakukan saat ini dengan adanya perubahan status dan pengelola. Artikel ini menggali pembelajaran dari kebijakan dari pengelolaan hutan di masa lalu (perhutanan sosial dalam PHBM) dan pandangan ke depan pengelolaan dengan konsep perhutanan sosial dengan status yang baru. Pengumpulan data dilaksanakan melalui wawancara kepada informan kunci yang dilengkapi dengan observasi langsung, studi literatur dan studi dokumen. Dari hasil penelitian tersebut, didapat hasil bahwa kebijakan di masa lampau tidak mengikutsertakan masyarakat sekitar dalam pengelolaan hutan. Kemudian dapat disimpulkan bahwa perhutanan sosial dari PHBM juga tidak menunjukkan adanya perubahan signifikan karena juga tidak menempatkan masyarakat sebagai mitra setara seperti yang dijanjikan konsep perhutanan sosial. Perubahan fundamental yang harus dilakukan mencakup perubahan fokus pembangunan hutan ke aspek sosial sebelum fokus ke aspek ekonomi dan ekologi hutan. Perubahan status yang baru juga terlihat dapat menghambat implementasi dari kebijakan perhutanan sosial yang baru. Apabila aspek sosial dapat diselesaikan maka selanjutnya akan masih ada banyak tantangan yang harus dihadapi pengelola baru. Pengelola baru akan membutuhkan dukungan yang besar dari segi sumber daya dan perlu membentuk institusi secara utuh untuk dapat mengimplementasikan kebijakannya.
