<p>Limits of regulatory and contractual asymmetries: the case of the Brazilian airport infrastructure</p><p><em> </em></p><p>Embora uma regulação técnica implique captar e compreender as especificidades das cadeias e das atividades setoriais, essa modulação regulatória não autoriza distinções ilimitadas entre atores e atividades equivalentes, sob pena de se afrontar a isonomia e distorcer a concorrência, com impactos na qualidade do serviço a ser prestado ao consumidor. Este artigo defende que as assimetrias regulatórias (assim consideradas as regras diferenciadas para atores de um mesmo setor ou mesmo de uma mesma cadeia setorial) devem ser previstas se e na medida necessária para efetivar a pauta da política pública setorial. Além disso, o artigo define as balizas, de forma abstrata, para as assimetrias regulatórias, e depois as aplica a um caso concreto: o setor de infraestrutura aeroportuária, que possui diversidade de modelos exploratórios e contratos de concessões, o que permite distinguir as assimetrias regulatórias (decorrentes de sujeição geral e abstrata) das assimetrias contratuais (decorrentes de sujeição específica e concreta). Por fim, concluímos que as assimetrias regulatórias que extrapolam as balizas antes apontadas podem ser contestadas, administrativa ou judicialmente.</p><p> </p><p>In order to achieve a well-done technical regulation, it is necessary to deeply understand the specificities of one sector chains and activities. However, this regulatory modulation does not authorize unlimited distinctions between equivalent players and activities, otherwise it could violate the equal protection rule and distort competition, with impacts on the quality of the service to be provided to the consumers. This article argues that regulatory asymmetries (herein considered as the enactment of differentiated rules for players within the same sector or even the same sectorial chain) should be predicted if and to the extent necessary to implement the sectorial public policy agenda. Furthermore, the article establishes the generic limits of the regulatory asymmetries, and then applies them to a case study: the Brazilian airport infrastructure, formed by different exploitation regimes and concession agreements, which allows us to distinguish the regulatory asymmetries (arising from general and abstract subjection) from the contractual asymmetries (arising from specific and concrete subjection). In conclusion, we argue that regulatory asymmetries that overpass the aforementioned mentioned limits can be challenged with administrative or judicial procedures.</p>

ABSTRACTThe purpose of this research is to analyze the participation of different stakeholders, resulting from the implementation of the Public Policy Magical Towns, aimed at sustainable development of Villa Tapijulapa. This investigation is currently underway, however it has been observed that it has been funded development projects, through various government institutions that contribute to Magic Towns Program, which has not been successful, in addition there is a misuse system resources. These issues are presented by the complexity of cooperation, multiplicity of participants and perspectives; and the various attitudes and degrees of involvement of the various stakeholders. As the analysis of the social capital of the community and the characteristics of the agency charged with implementing achieve identify areas of opportunity to propose strategies for improvement.RESUMENEl propósito de ésta investigación es analizar la participación de los diferentes actores sociales, derivada de la implementación de la Política Pública de Pueblos Mágicos, dirigida al desarrollo sustentable de Villa Tapijulapa. Esta investigación actualmente se encuentra en proceso, sin embargo se ha podido observar que han sido financiados proyectos de desarrollo, a través de diferentes instituciones gubernamentales que coadyuvan al Programa de Pueblos Mágicos, los cuales no han sido exitosos, además de existir, un mal uso del sistema de recursos naturales. Estas problemáticas se presentan por la complejidad de la cooperación, multiplicidad de participantes y perspectivas; así como las diversas actitudes y grados de compromiso de los diferentes actores sociales. Por lo que el análisis del capital social de la comunidad y de las características de la agencia encargada de la implementación lograrán detectar las áreas de oportunidad para proponer estrategias de mejora.

PurposeResearch on business networks in organisationally thin regions, which are characterised by a low density and quality of business networks, is still in its infancy, while the facilitation of business networks receives increasing interest. The present paper combines both perspectives by investigating how different types of network brokers facilitate business networking and knowledge-sharing in organisationally thin regions.Design/methodology/approachBurt's theory on brokers in social networks is applied to knowledge-sharing in business networks for organisational thinness as context. A qualitative case study represents the empirical basis that describes network brokers from various domains in three different German case regions, which are characterised by organisational thinness.FindingsThe network brokers studied facilitate different types of business networks, and they use various levers to increase knowledge-sharing among companies in business networks. Two broker types emerge, private business-driven versus public policy-driven network brokers with distinct approaches to the facilitation of business networking and knowledge-sharing and different limitations due to organisational thinness.Practical implicationsCompanies, notably SMEs, in contexts characterised by low networking density and quality may benefit from various types of network brokers that foster business networking and instigate knowledge exchange. Public policy should embed activities of private brokers in existing SME assistance programmes to increase the quantity and quality of business networks.Originality/valueNetwork facilitation in regions with weaknesses in their endowment with industry clusters, business networks and innovative knowledge exchange is under-explored, and this paper contributes to shedding light on this topic with a case study.

This study aims to analyze the mapping of several supporting and inhibiting factors of knowledge management process in increasing the higher education capabilities of STAIN Gajah Putih. This study used case study as methodological approach by collecting data with interviews, observation, and documentation. The objects of this study are lecturer, staf and students. The result showed that; 1) The formation of a culture of knowledge sharing; 2) Facilities and infrastructure in supporting the process of knowledge management; 3) Public policy in using knowledge. In establishing capabilities based on the knowledge management process, STAIN Gajah Putih has fixed these deficiencies in terms of the knowledge management process by establishing good information validation, analyzing the needs of knowledge management process, and developing brainware through increasing the quantity and quality of human resources in the field of information technology.

RESUMO. O objetivo deste trabalho é realizar uma discussão sobre os avanços e retrocessos da política pública de Educação de Jovens e Adultos (EJA) implantada no estado de Mato Grosso (MT/Brasil), a partir de 2008, com a criação dos Centros de Educação de Jovens e Adultos (CEJAs). Documentos oficiais, pesquisas realizadas sobre os Centros, assim como informações sobre a experiência do Centro de Educação de Jovens e Adultos Cleonice Miranda da Silva, que funciona no município de Colíder/MT, foram empregadas para a elaboração de uma interpretação dos processos de criação e funcionamento da proposta pedagógica dos CEJAs em Mato Grosso. A investigação realizada evidenciou que, além da concentração destes espaços formativos em um número reduzido de municípios do estado, a proposta pedagógica original foi significativamente alterada já em seus primeiros anos de funcionamento. As informações coletadas apontam para a descontinuidade da política de formação empreendida pelos governos que se sucederam no período em estudo, que não assumiram os CEJAs como integrantes de uma política de Estado de caráter emancipatório, optando por políticas de governo marcadas pelo “aligeiramento” dos processos de escolarização destinado aos sujeitos jovens, adultos e idosos. Atualmente, o estado de Mato Grosso vive um momento de retrocesso em relação à política pública que originou os CEJAs, uma vez que os Centros que continuam em funcionamento tiveram sua proposta pedagógica alterada, com destaque às preocupações financeiras em detrimento da qualidade da Educação de Jovens e Adultos promovida pelo Estado. ABSTRACT. The objective of this work is to conduct a discussion about the advances and setbacks of the public policy of Youth and Adult Education (EJA) implemented in the state of Mato Grosso (MT / Brazil), from 2008 on, with the establishment of Youth and Adult Education Centers (Cejas). Official documents, research carried out about the Centers, as well as information about the experience of Cleonice Miranda da Silva Youth and Adult Education Center, which operates in the municipality of Colíder / MT, were used to elaborate an interpretation of the creation and pedagogical proposal of Cejas in Mato Grosso. The research undertaken showed that, in addition to the concentration of these formative spaces in a reduced number of municipalities of the state, the original pedagogical proposal was significantly modified already in its first years of operation. The information collected points to the discontinuity of the training policy undertaken by the governments that succeeded in the period under study, which did not support the maintenance of a state policy of emancipatory character, replacing it with government policies marked by the "streamlining" of the schooling process for youngsters, adult and elderly subjects. Nowadays, the state of Mato Grosso is experiencing a moment of step backwards in relation to the public policy that originated the Cejas. On the other hand, the Centers that continue to operate had their pedagogical proposal changed, highlighting the financial concerns to the detriment of the quality of Youth and Adult Education promoted by the State.

Refletimos sobre a atual política externa brasileira a partir da constatação da sua diversificação em termos deagendas e atores. A pluralização de atores ocorre tanto no âmbito burocrático (fragilizando a tradicionalprimazia do Itamaraty) como com atores da sociedade civil (mídia, ONGs, empresários, etc.). Com ainternacionalização da vida cotidiana, surgem novas demandas a respeito da agenda internacional,pressionando por novas dinâmicas nas práticas da política externa. Defendeseque a política externa é umapolítica pública que, guardando sua especificidade, deve ser analisada como as demais políticas públicasbrasileiras. A proposta de um Conselho Nacional de Política Externa e a recente experiência do ComitêBrasileiro de Direitos Humanos e Política Externa são demonstrações da importância de se levar emconsideração as dinâmicas domésticas para uma compreensão adequada da política externa brasileiracontemporânea.ABSTRACTThis paper delves into the current Brazilian foreign policy based on the assumption of its diversification in terms both of its agenda and actors. The pluralization of actors occurs not only in the bureaucratic scope (weakening the traditional Itamaraty’s primacy), but also with other players from civil society (such as the media, NGOs, the business sector, and others). With the internationalization of everyday life, new demands regarding the international agenda emerge, pressing for new dynamics on the practices of foreign policy. We defend that foreign policy is a public policy that, considering its specificity, should be analyzed such as others Brazilians public policies. Os Direitos Humanos são princípios que orientam ou devem orientar as ações dos Estados, sociedades e indivíduos, porém, estes não possuem necessariamente o poder de configurar obrigações jurídicas. Bucci (2001) argumenta que para transformá-los de princípios em instrumentos com poder de regra, é necessário estabelecer políticas públicas para direitos humanos. Assim, este trabalho busca verificar a hipótese da autora através de um estudo de caso  sobre o sistema de refúgio no Canadá a fim de observar os efeitos causados pela construção de uma política pública apropriada para abordar o problema em questão. O país, que aderiu tardiamente aos acordos internacionais sobre o refúgio, não somente adequou-se às normas propostas pela comunidade internacional, comotornou-se referência na recepção, proteção e reassentamento de refugiados.Palavras-chave: Políticas Públicas, Direitos Humanos, Canadá.ABSTRACTHuman Rights are principles that guide, or should guide, the actions of States and societies and individuals, but they don’t necessarily have the power to create judicial obligations. Bucci (2001) states that the path to transform them from principles to tools with legal power, it is necessary to develop public policies for human rights. Therefore, this work aspires to verify the author’s hypothesis through a case study on Canada’s refuge system to observe the effects of the development of an appropriate public policy to this end. This Special Issue aims to interconnect policy innovation, regional integration and sustainable democracy building with a view to providing socio-politically empowering insights in the midst of an acute global crisis of self-definition. It also aspires to contribute to a clearer elucidation of how to regionally respond to intertwined multilevel challenges and to search for alternative systemic paradigms in a context marked by an increasing combination of questioning and resilience. Furthermore, it focuses on the case study of the Millennium Development Goals (MDGs) as both challenges and vehicles to achieve a fruitful retroactive cycle between a growingly interdependent set of determinant variables: socially thoughtful policy innovation mechanisms at the global level; the socioeconomic cohesion-enhancing potentialities of regional integration experiences; the evolution and outcomes of transitional politics in post-conflict states; a positive intertwining of new approaches to diplomacy and to development policy and the quality of democratic global governance. Spanish Este número monográfico tiene como objetivo la interconexión de las dimensiones complementarias de investigación y de implementación de la innovación política, la integración regional y la construcción democrática sostenible con el fin de proporcionar ideas de hondo calado sociopolítico que permitan hacer frente a una aguda crisis de autodefinición. En este sentido, aspira también a contribuir a una elucidación más clara sobre los modos de responder regionalmente a desafíos interdependientes y a múltiples niveles y sobre la búsqueda de paradigmas sistémicos alternativos en un contexto marcado por una creciente combinación de cuestionamiento y resistencia. Por otra parte, se centra también en el caso de los Objetivos de Desarrollo del Milenio (ODM) como desafíos y vehículos para lograr un enriquecedor ciclo retroactivo entre un conjunto crecientemente interdependiente de variables fundamentales: mecanismos de innovación en política social a nivel mundial; la cohesión socioeconómica como herramienta para profundizar y desarrollar experiencias de integración regional; la evolución y resultados de la política de transición a la democracia en estados post-conflicto; una interacción positiva de nuevos enfoques a nivel de diplomacia pública y de políticas de desarrollo y, por último pero no menos importante, la calidad de la gobernanza global democrática. En efecto, tal enfoque combinado espera ser útil para ilustrar el hecho de que los ODM no han de ser vistos como un conjunto de indicadores parciales, sino como objetivos profundamente interconectados y capaces de reforzarse mutuamente. French Ce numéro spécial vise à interconnecter l'innovation politique, l'intégration régionale et le renforcement de la démocratie durable en vue de fournir des idées pour une autonomisation sociopolitique dans un moment de crise aiguë d'autodéfinition. À cet égard, il aspire à apporter des éclaircissements pour répondre régionalement à des défis multiniveaux et à proposer des paradigmes systémiques alternatifs dans un contexte marqué par une combinaison accrue du questionnement et de la résilience. De plus, il met également l'accent sur l'étude des Objectifs du Millénaire pour le développement (OMD) — à la fois comme des défis et comme des véhicules — pour obtenir un cycle rétroactif fructueux entre un ensemble de variables de plus en plus interdépendantes : les mécanismes d'innovation politique socialement projetés à l'échelle mondiale ; les potentialités améliorées de cohésion socio-économique pour développer les expériences d'intégration régionale ; l'évolution et les résultats de la transition politique dans les pays post-conflit ; un entrelacement positif de nouvelles approches en matière diplomatique et de politique de développement et, finalement, la qualité de la gouvernance mondiale démocratique. En effet, une telle approche combinée aspire à être utile pour illustrer le fait que les OMD ne devraient pas être considérés comme une collection d'indicateurs distincts, mais comme des objectifs profondément interconnectés et susceptibles de se renforcer mutuellement.

The role of smart cities in order to improve older people’s quality of life, sustainability and opportunities, accessibility, mobility, and connectivity is increasing and acknowledged in public policy and private sector strategies in countries all over the world. Smart cities are one of the technological-driven initiatives that may help create an age-friendly city. Few research studies have analysed emerging countries in terms of their national strategies on smart or age-friendly cities. In this study, Romania which is predicted to become one of the most ageing countries in the European Union is used as a case study. Through document analysis, current initiatives at the local, regional, and national level addressing the issue of smart and age-friendly cities in Romania are investigated. In addition, a case study is presented to indicate possible ways of the smart cities initiatives to target and involve older adults. The role of different stakeholders is analysed in terms of whether initiatives are fragmentary or sustainable over time, and the importance of some key factors, such as private–public partnerships and transnational bodies. The results are discussed revealing the particularities of the smart cities initiatives in Romania in the time frame 2012–2020, which to date, have limited connection to the age-friendly cities agenda. Based on the findings, a set of recommendations are formulated to move the agenda forward.

Este artigo traz uma breve discussão da questão social indígena contemporânea, com ênfase no perfil saúde-doença, e seu enfrentamento pelo Estado. Mostra que tais reflexões têm sua origem em uma pesquisa de campo finalizada em fevereiro de 2014, envolvendo os índios da etnia Guajajara em Barra da Corda, Maranhão, e os profissionais de saúde indígena do Departamento de Saúde Indígena (DSEI-MA), daquele Estado. O seu produto, ainda em andamento, aponta para uma realidade complexa evidenciada, a partir das narrativas apresentadas pelos sujeitos da pesquisa, onde se presencia uma situação de degradação e pauperização da saúde indígena em decorrência do avanço do capitalismo e da incapacidade das políticas públicas, principalmente a política de saúdeem proporcionar ao indígena, tanto no plano jurídico como no plano executivo, a condição de cidadão de direito, tendo isto refletido negativamente na qualidade de vida desses povos e nas práticas profissionais desenvolvidas junto a esse seguimento de política. Palavras-chave: Questão indígena, saúde indígena, política pública.INDIGENOUS HEALTH IN TIMES OF BARBARISM: public policy, scenarios and perspectivesAbstract: This article brings a brief discussion of contemporary indigenous social issues, with an emphasis on health and illness profile,and its confrontation by the state. Shows that such reflections have their origin in a field survey completed in February 2014, involving Guajajara ethnic Indians in Barra do Corda, Maranhão, and indigenous health professionals from the Department of Indigenous Health (DSEI-MA), in that state. Their product, still in progress, is pointing to a complex reality where we noted, the narratives presented by the research subjects, a situation of degradation and impoverishment of indigenous health due to the advancement of capitalism and therefore the inability of public policies mainly health policy, to provide the indigenous, both legally and in the executive Plan as a citizen legal conclusion that reflected negatively on the quality of life of indigenous peoples and professional practices developed withthis follow-up policy.Key words: Indigenous issue, indigenous health, public policy
