The local government of Bali Province issued a policy that was formulated in The Local Regulation of Bali Province Number 9 of 2009. In appendix of The Local Regulation Number 9 of 2009 is described a 12-year compulsory education. This study discusses the effectiveness of The Local Regulation of Bali Province Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province and the factors that influence the effectiveness of the implementation of The Local Regulation Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province. This research is empirical legal research. The nature of research is descriptive. The data in this study include primary data that was collected through interview techniques and secondary data that was collected through the study of literature. The research location is in Bali Province with sample in Denpasar and Bangli regency. The data collected was analyzed qualitatively and descriptively presented analytically. Effectiveness of The Local Regulation of Bali Province Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province is not optimal in some areas. The factors that influence the effectiveness of the implementation of The Local Regulation Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province are legal factors, law enforcement factor, means and facilities in law enforcement factor, community factors and cultural factors

<p>Abstract<br />This article aims to determine the perceptions of sellers and buyers about the sale of pirated VCD DVDs regulated in Law No. 28 of 2014 concerning Copyright and to know what factors can improve their legal protection.. The research methodology used is empirical research, namely  secondary data published, for further research on primary data in the field or for the community.  Legal research materials used are primary and secondary legal materials, techniques used in collecting legal materials are observation, interviews and study of documents or library materials. The results of the research show that the Copyright Law makes songs and music works as one of the protected creations, but there are still many people who do copyright by trading pirated DVDs or VCDs. The perception of the seller who is related to the Copyright Law concerning the need for the Act so as not to involve copyrighted parties, but there must also be a policy that<br />no related party sells pirated VCDs or DVDs. In law enforcement the Copyright Act has several inhibiting factors, namely the legal factors themselves, law enforcement factors, facilities factors, community factors, cultural factors.</p><p>Keywords: Offense; Copyright; Pirated VCD or DVD.</p><p>Abstrak<br />Artikel ini bertujuan untuk mengetahui persepsi para pelaku jualbeli mengenai penjualan DVD  atau VCD bajakan yang diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan mengetahui faktor-faktor apa saja yang menghambat perlindungan hukumnya. Metodologi penelitian yang digunakan adalah penelitian empiris, yaitu meneliti data sekunder pada awalnya,  untuk kemudian dilanjutkan penelitian terhadap data primer di lapangan atau terhadap masyarakat.  Bahan penelitian hukum yang digunakan adalah bahan hukum primer dan sekunder, teknik yang digunakan dalam pengumpulan bahan hukum adalah observasi, wawancara dan studi dokumen atau bahan pustaka. Hasil penelitian menunjukkan Undang- Undang Hak Cipta menjadikan karya lagu dan musik sebagai salah satu ciptaan yang dilindungi, namun masih banyak masyarakat yang melakukan pelanggaran hak cipta dengan memperjualbelikan DVD atau VCD bajakan. Persepsi para pelaku jualbeli terkait Undang-Undang Hak Cipta ialah pentingnya keberadaan UndangUndang tersebut agar tidak merugikan pihak pemegang hak cipta, namun perlu ada kebijakan agar tidak merugikan pihak pelaku jualbeli VCD atau DVD bajakan. Dalam penegakan hukum Undang-Undang Hak Cipta terdapat beberapa faktor yang penghambat yaitu faktor hukumnya  sendiri, faktor penegak hukum, faktor sarana dan fasilitas, faktor masyarakat, faktor kebudayaan.</p><p>Kata Kunci: Pelanggaran; Hak Cipta; VCD atau DVD Bajakan.</p>

Abstract<br />This article aims to determine the factors that hinder the effectiveness of the application of the Indonesian <br />National Standard (SNI) on children’s toys. The research methodology used is empirical research, which<br />is researching secondary data at first, then continuing research on primary data in the field or the<br />community. Legal research materials used are primary and secondary legal materials, the technique<br />used in gathering legal materials is depth interviews and document studies or library materials. The<br />results showed that there were factors that hindered the effectiveness of the implementation of the <br />Indonesian National Standard (SNI), which was due to the community being indifferent or not paying <br />attention to the importance of standardization in children’s toys besidesthe lack of merchant knowledge<br />to the importance of SNI in children’s toys.In the application of SNI, there are inhibiting factors, namely<br />the Law factor indicated by the absence of regional regulations governing mandatory SNI on children’s<br />toys, law enforcement factors namely the lack of work ethic in law enforcement, facility and infrastructure<br />factorsare indicated by communication tools that do not yet support the role of law enforcers to maximize<br />their performance, community factors many people who do not know the importance of SNI in children’s<br />toys due to the lack of socialization they get, cultural factors are shown by the legal culture or immature<br />legal habits of society so that the effectiveness of the mandatory forefront of SNI is not running optimally.<br />Keywords: SNI; Children Toys; Effectiveness.<br />Abstrak<br />Artikel ini bertujuan untuk mengetahui faktor-faktor yang menjadi penghambat efektivitas penerapan <br />Standar Nasional Indonesia (SNI) pada mainan anak. Metodologi penelitian yang digunakan adalah<br />penelitian empiris, yaitu meneliti data sekunder pada awalnya, untuk kemudian dilanjutkan penelitian<br />terhadap data primer di lapangan atau terhadap masyarakat. Bahan penelitian hukum yang digunakan<br />adalah bahan hukum primer dan sekunder, teknik yang digunakan dalam pengumpulan bahan hukum<br />adalah depth interview dan studi dokumen atau bahan pustaka. Hasil penelitian menunjukkan terdapat<br />faktor yang menghambat efektivitas penerapan Standar Nasional Indonesia (SNI) yaitu dikarenakan<br />masyarakat acuh atau tidak memperhatikan betul pentingnya standardisasi pada mainan anak selain<br />itu  kurangnya pengetahuan pedagang terkait pentingnya SNI pada mainan anak. Dalam penerapan<br />SNI terdapat faktor-faktor yang menghambat yaitu faktor Undang-Undang ditunjukkan dengan belum<br />adanya peraturan daerah yang mengatur tentang wajib SNI pada mainan anak, faktor penegak hukum<br />yaitu masih kurangnya etos kerja pada penegak hukum, faktor sarana dan prasarana ditunjukkan<br />dengan alat komunikasi yang belum menunjang peranan penegak hukum untuk memaksimalkan<br />kinerjanya, faktor masyarakat yaitu banyak masyarakat yang belum mengetahui pentingnya SNI pada<br />mainan anak dikarenakan kurangnya sosialisasi yang mereka dapatkan, faktor kebudayaan ditunjukkan<br />dengan budaya hukum atau kebiasaan hukum masyarakat yang belum matang sehingga efektivitas <br />penerapan wajib SNI tidak berjalan dengan maksimal. <br />Kata Kunci: SNI; Mainan Anak; Efektivitas.

The problems of this study were 1) the process of resolving the crime of traffic accident committed by a child which causing death in Jurisdiction Police Cirebon, 2) the difference between the completion of the crime of traffic accident by a child which causing death by perpetrators of adults in Police Cirebon City? 3) consideration of the law by the police in the Cirebon City Police enforcement of laws against the crime of traffic accident causing death committed by a child.The method used is research that combines Juridical and Empirical. The source of research data derived from primary data and secondary data obtained by collecting documents and interviewing criminal cases with informants.Based on research findings conducted by researchers regarding law enforcement in case of a traffic accident causing death committed by minors resolved with the criminal justice process method to process outside the criminal justice and restorative justice approach that is Diversion. Based on Act No. 11 of 2012 on the Criminal Justice System Child involvement of multiple stakeholders in the settlement became a mandatory provision. Constraints law enforcement officials in the execution of diversion itself is the factor of legal, officials law enforcement factors, community factors and factors of facilities and infrastructure.Keywords: Law Enforcement; Police; Accident; Traffic; Child.

Efforts to implement the implementation of the Regional Regulation regarding the retribution for waste and sanitation services in Indragiri Hilir Regency certainly require support from many parties, both from the local government and the community who are classified as obligatory levies. The problems in this study are (1) How is the Implementation of Collection of Regional Retribution in the Sector of Waste and Cleanliness Based on Regional Regulation Number 15 of 2011 Indragiri Hilir Regency, (2) What are the Inhibiting Factors in the Implementation of Collecting Regional Levies in the Sector of Waste and Cleanliness Based on Regional Regulation Number 15 of 2011 Indragiri Hilir Regency. (3) What are the Efforts in Implementing Regional Retribution Collectors in the Sector of Waste and Cleanliness Based on Regional Regulation Number 15 of 2011 Indragiri Hilir Regency This research method uses empirical/sociological legal research, the nature of this research is descriptive, that is, it provides a clear picture. It can be concluded that (1) Implementation of Collection of Regional Levies in the Sector of Waste and Cleanliness Based on Regional Regulation No. 15 of 2011 Indragiri Hilir Regency begins with collecting data and mandatory registration of user fees clearly and correctly and collecting using SKRD which is carried out once a month turns into two times in one month. month. (2) Inhibiting factors in this implementation can be seen from the lack of supervision, factors from the law itself, law enforcement factors, facilities and facilities and community factors. (3) Efforts are made by increasing the supervision carried out by DLHK together with Bapenda, issuing regulations further implementing regulations as a basis for implementing additional regulations, involving Satpol PP who act as regional regulations enforcers and the formation of PPNS as part of investigators who are authorized to take action on cases of regional regulations violations committed by retribution obligations that do not implement regulations.

The misuse of social media that causes defamation Decision: No 574 K / pid.sus / MA / 2018, is one of the many legal problems that have been ensnared due to the misuse of social media. The author uses three types of data sources, namely primary data sources of data obtained from laws and Supreme Court decisions. And secondary data data obtained from law books, law magazines and legal writings. And the last is tertiary legal material is complementary legal material obtained from dictionaries and the internet. and data analysis using qualitative data which is data in the form of words that talk about statutory regulations. The results of the research show that in the application of law enforcement of the ITE Law article 27 paragraph 1 in conjunction with article 45 paragraph 1 there is still a sense of injustice for the community, factors that must also be considered in imposing sanctions on victims of Baiq Nuril. and sociology of law and a strong conscience against actions or decisions in law enforcement. In this case, the government should have strict supervision of the use of information technology. This is aimed at preventing and overcoming efficiently and effectively the act of defamation through social media.

Aceh is a province in Indonesia that applies Islamic law in law enforcement, not infrequently in law enforcement in East Aceh District by prosecutors experiencing obstacles in applying Aceh Governor Regulation No. 5 of 2018 for the perpetrators of Jarimah, so that the implementation up to now the Prosecutor is guided by the Aceh Qanun Number 7 of 2013 concerning Jinayat Procedural Law. This study aims to find out how the implementation of the Aceh Governor's Regulation No. 5 of 2018 by the Prosecutors in East Aceh District and why the implementation of the Aceh Governor's Regulation is experiencing obstacles. This study uses an empirical juridical approach to the research location in Lapi Class II B Idi, as well as using secondary data and primary data, then collecting data from literature, interviews and observations, and from the results of these data the data are arranged in a descriptive analysis. The conclusion of this study is that Aceh's Governor Regulation Number 5 Year 2018 cannot be implemented in Idi Class II B Prison, so that in carrying out the Prosecutor's whip uqubat based on Article 262 Aceh Qanun Number 7 of 2013, this is due to obstacles encountered by the Prosecutor in implement the Governor Regulation Number 5 of 2018, including the absence of facilities and infrastructure in Class II B Idi prison, the absence of Technical Instructions and Implementing Guidelines related to the implementation of Governor Regulation Number 5 of 2018 from the Aceh High Prosecutor Office and Class II B Idi Prison, the budget which is limited from the local government, will cause a commotion between prisoners, and the community does not know the whip, given the spirit of the whip is to give the effect of shame on the perpetrators and provide lessons for the community.

Issues examined in this study were (1) Implementation of law enforcement against liquor by the Police Demak. (2) Obstacles encountered. (3) How the solutions do about it. How is the implementation of duties and authorities of supervisors andobservers judges of Denpasar District Court in founding the convict? What areobstacles that occur in implementation of duties and authorities of supervisorsand observers judges of Denpasar District Court in founding the convict? The method used in this research was empirical legal research. Itscharacteristic is descriptive.  The data sources that used are primary data,secondary data and tertiary data. The primary data / field data were obtained byinterviewing the relevant law enforcement officer that has been determined as asample. The secondary data were obtained of literature studies. The data wasanalyzed by qualitative descriptive analysis to get the vivid conclusion anddescription in discussing the problems in this research. Conclusions derived from this study include: implementation of duties andauthorities of supervisors and observers judges of Denpasar District Court infounding the convict are not running optimally in accordance with the legislationin force. The factor that obstruct are the numbers of supervisors and observersjudges of Denpasar District Court were not adequate, that was one person, therewas no special fund (Operational fund) and there were no strict sanctions forthose when they could not do the duties according to the applicable law; theycould only appeal to the law enforcement agencies / officers of Class IIADenpasar Penitentiary founding the convict.

The importance of education applies to all children, including children who undergo legal process. It is suitable for the main purpose of Correctional Institution which is to return the prisoners back in the middle of a better society, but in the reality the feedback is not as people expected. The purpose of this study is to find out the objective conditions for the fulfillment of children's rights in the field of education in the prisons IIA of Balikpapan City. The study belongs to empirical legal research that data is collected by some literature books which are related to the material has being studied, and interviews with student prisoners and the officers, then the data is inserted into descriptive qualitative. Analysis is done by legislation approach combined with sociological approach. The results of this study indicate that the fulfillment of the children education rights in prisons IIA of Balikpapan city is weak and less effective, the weakness has found either in juridical normative or empirical/sociological. The weakness includes formal rules where there are no regulations governing education in prisons; there is still lack of facilities factors; third, community factors that have not been aware to assist the fulfillment of education at Penitentiary institution; and cultural factors that the community has which is difficult to re-accept the correctional students into society, while the factors that play a role in the fulfillment of government and penitentiary officers in this case referred to  law enforcement. Penting nya pendidikan berlaku bagi semua anak-anak tidak terkecuali bagi anak-anak yang menjalani proses hukum. Hal ini selaras dengan tujuan utama dari lembaga pemasyarakatan yaitu agar dapat kembali  nya anak didik pemasyarakatan ketengah kehidupan masyarakat yang lebih baik. Tetapi pada kenyataannya kembalinya warga binaan pemasyarakatan tidak menjadikannya lebih baik. Tujuan studi ini untuk mengetahui kondisi objektif pemenuhan hak anak dibidang pendidikan pada lembaga pemasyarakatan kelas IIA Kota Balikpapan. Penelitian ini termasuk kedalam penelitian hukum empiris. Data penelitian dikumpulkan dengan cara studi pustaka yaitu buku-buku literatur yang berkaitan dengan materi yang diteliti dan wawancara dengan anak didik pemasyarakatan dan petugas lembaga pemasyarakatan, kemudian data tersebut dimasukkan secara deskriptif kualitatif. Analisis dilakukan dengan pendekatan perundang-undangan dipadukan dengan pendekatan sosiologis. Hasil studi ini menunjukkan bahwa pemenuhan hak anak di bidang pendidikan pada lembaga pemasyarakatan kelas IIA kota Balikpapan adalah lemah dan kurang efektif, kelamahan itu baik secara yuridis normatif dan empiris/sosiologis. Kelemahan itu mencakup belum adanya peraturan yang mengatur tentang hak atas pendidikan dilembaga pemasyarakatan; kurang nya faktor sarana atau fasilitas; faktor masyarakat yang belum ada kesadaran untuk membantu dalam pemenuhan pendidikan pada lembaga pemasyarakatan; dan faktor budaya yang dimiliki masyarakat yang sulit untuk menerima kembali anak didik pemasyarakatan ke dalam lingkungan masyarakat; sedangkan faktor-faktor yang berperan dalam pemenuhan yaitu pemerintah dan petugas lembaga pemasyarakatan dalam hal ini disebut sebagai penegak hukum.

Along with the rate of conversion of agricultural land to non-agricultural land, agricultural resources that need to get priority are those for food. The formulation of the problem is: 1) is the implementation of the conversion of agricultural land for housing in accordance with applicable regulations? 2) How is the law enforcement against the violation of the conversion of agricultural land use that is used for housing? 3) What is the ideal concept of law enforcement so that agricultural land conversion does not occur? The type of research used is socio-legal research, which includes primary data and secondary data. The results showed that the regulations regarding the conversion of agricultural land in principle had been implemented in accordance with the applicable regulations, especially regarding the requirements of the conversion of agricultural land. However, there are still violations of the construction of buildings carried out illegally. Law enforcement against violations of land-use change has not been carried out to the fullest, administratively there have been actions taken, but criminals have never been carried out. In the future, law enforcement must consider the reasons for the conversion of agricultural land, whether for public interest or for business ventures.
