Children who commit in a criminal offense must be treated humanely in accordance with the best interests of the child means that children in conflict with the law should be restorative justice approach that should be pursued first. Indonesia already has rules to protect, prosper and fulfill the rights of children, among others Act No. 3 of 1997 on juvenile justice, Act No. 23 of 2002 on Child Protection. However, it seems not enough to bring significant changes to the fate of children in conflict with the law, and what to expect in reality often can not be implemented properly. Because outiusan judges are more punitive to the detriment of the child itself. Versioned as a form of juvenile criminal settlement through restorative justice approach needs to be taken into consideration in handling children. This concept involves all parties in order to repair the moral children so that children will no longer repeat his actions, so that children feel children aware of the law that affect the mental development of children.Keywords: Children, Diversion, Restorative Justice.

<p><em>According to UNICEF, no less than 4000 Indonesian children are brought </em><em> </em><em>to court every year with reports of relatively minor crimes such as theft, persecution, spreading hoaxes and others. Where children who are faced with the law generally are not accompanied by legal counsel or social services. Indonesia has had a umbrella </em><em>act </em><em>in protecting children's welfare, namely Law Number 4 of 1979 concerning Child Welfare which was then followed by Law Number 23 of 2002 concerning Child Protection which has now been replaced with Law Number 35 of 2014 concerning Child Protection as implementation of the Convention on the Rights of the Child (Convention on the Rights of the Child, 1989, New York). Taking into account that the handling of child cases dealing with the law must really guarantee the protection of the best interests of the child and must aim at the creation of Restorative Justice, both for Children and Victims of Children and to create Restorative Justice, before resorting to judicial proceedings at the prosecution level General must strive for Diversion. Provisions regarding this diversion are also regulated in Supreme Court Regulation Number 4 of 2014 concerning Diversion. The enactment of the 2014 PERMA is intended so that juvenile justice in Indonesia can be carried out more efficiently, while still considering its welfare.</em></p><p><em> </em><em></em></p>

Anak sebagai generasi penerus bangsa sudah selayaknya mendapatkan perhatian khusus. Hal tersebut bertujuan dalam rangka pembinaan anak untuk mewujudkan sumber daya manusia yang berkualitas. Maka dari itu, diperlukan pula sarana dan prasarana hukum yang mengantisipasi segala permasalahan yang timbul. Sarana hukum ini bertujuan untuk mengantisipasi stigma atau cap jahat yang ditimbulkan ketika anak berhadapan dengan hukum, sekaligus memulihkan dan memasyarakatkan kembali anak tersebut. Salah satu solusinya adalah dengan mengalihkan atau menempatkan pelaku tindak pidana anak keluar dari sistem peradilan pidana serta memberikan alternatif bagi penyelesaian dengan pendekatan keadilan demi kepentingan terbaik bagi anak, yang kemudian dikenal dengan pendekatan restorative justice. Restorative justice yang merupakan implementasi konsep dari diversi telah dirumuskan dalam sistem peradilan pidana anak, namun sistem yang baik haruslah diiringi dengan suatu sikap yang dijiwai kehendak untuk memandang dan berkeyakinan bahwa dunia ini selalu menjadi lebih baik. Selain itu, hendaknya prinsip the best interest of the children selalu diutamakan ketika menangani anak yang berhadapan dengan hukum. Children as the nation's next generation is already deserve special attention. It aims in order to develop the child to realize the quality of human resources. Therefore, it is also necessary legal infrastructure to anticipate any problems that arise. The legal means to anticipate stigma or stamp evil inflicted when the child against the law, as well as restoring and re-socialize the child. One solution is to divert or placing the offender children out of the criminal justice system as well as providing an alternative to the settlement with justice approach in the best interests of the child, who was then known as restorative justice approach. Restorative justice which is the implementation of the concept of diversion has been formulated in the juvenile justice system, but a good system must be accompanied by an attitude which is imbued with the will to perceive and believe that this world is always getting better. In addition, should the principle of the best interest of the children always come first when dealing with children in conflict with the law.

This study aims to examine and analyze the concept of decision making in the diversion process for children facing the law who are not yet 12 years old; and law enforcement decision making in the diversion process for children who are faced with a law that is not yet 12 years old (Study of the Chairperson of the Mataram District Court Number: 22/Pen.Div/2017/PN Mtr). The concept of decision making in the diversion process for children facing the law that is not yet 12 years old is the judge in imposing sanctions for children considering recommendations in the social research report made by community counselors to express and find data and information objectively about the development and background of life children from various sociological, psychological and other aspects while still paying attention to the best interests of the child. Law enforcement of decision making in the diversion process against children who are faced with a law that is not yet 12 years old emphasizes restorative justice which is the goal in the implementation of the diversion of cases of children facing the law. Law enforcement officials both Investigators, Community Guidance and Professional Social Workers conduct deliberations to reach a decision based on restorative justice that prioritizes the best interests of children.

The adoption of the restorative justice approach is more appropriate for the children in conflict with the law and more sensitive to achieving their best interests and rehabilitating them to facilitate their reintegration into society again  ( socializing ),  and to play a constructive role in the society,  and not to return to violating the law again,  unlike the traditional policy in the criminal justice,  which did not give the sufficient weight to the personal and objective circumstances of the child ,  and it focused on the punishment and criminalization for every wrongful act without looking at restorative  alternatives to the convicted child . The restorative justice, therefore, is an alternative approach to the ordinary criminal procedure in certain cases. The judicial system is not the only procedure that must address the phenomenon of children in conflict with the law in all cases.   In certain cases, it is better to conduct a dialogue and mediation between the perpetrators and the victims, with the aim of reaching to repair the harm and to rehabilitate the perpetrators (children) according to the measures outside the judicial system.  This is what Islamic Shari’a called fourteen centuries ago.  The Shari’a (Islamic Law) defined the criminal reconciliation and approved it as one of the most serious types of crimes against the self by the adult, as it has indicated.  According to the Shari’a, the juvenile, whether he is cognizant or not of, is not criminally responsible for the violations he commits nor a case will be filed against him and no penal action will be taken against him.

Upaya memberikan perlindungan terhadap Anak yang berhadapan dengan hukum dalam Sistem Peradilan Pidana Anak menunjukkan perkembangan yang sangat berarti. Selama ini terhadap anak yang berkonflik dengan hukum, ditangani secara umum seperti orang dewasa. Anak-anak tersebut melewati proses hukum tanpa ada pendampingan bahkan segera dilakukan upaya paksa berupa penangkapan dan penahanan sehingga anak mengalami putus sekolah. Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak meletakkan fondasi perlindungan anak dengan pendekatan Keadilan Restoratif yaitu dalam penyelesaian perkara melibatkan pelaku, korban, keluarga pelaku/korban dan pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan semula dan bukan pembalasan. Keadilan restoratif ini diwujudkan melalui Diversi yaitu pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses ke luar pengadilan pidana. Hasil penelitian ini menunjukkan bahwa di Jawa Tengah kasus anak yang berkonflik dengan hukum secara umum diselesaikan melalui jalur diversi dan sebagian lainnya diproses menggunakan berdasarkan KUHAP atau jalur pidana. Hal lainnya meskipun sudah menerapkan jalur diversi terhadap anak yang berkonflik dengan hukum namun belum ada keseragaman atau kesamaan model diversi sebagaimana yang diamanatkan di dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak.<br /><br /><br /><em>Efforts to provide protection against Children in conflict with the law in the Criminal Justice System Child shows a very significant development. During against children in conflict with the law, generally handled as an adult. These children pass through the legal process without immediate assistance even forceful measures in the form of arrest and detention so that children have dropped out of school. Law No. 11 Year 2012 on the Criminal Justice System Child laid the foundation of child protection approach Restorative Justice that in settling disputes involving offenders, victims, family offender/victim and other relevant parties to work together to find a fair settlement with the emphasis on restoring back to its original state and not retaliation. Restorative justice is realized through the transfer of settling disputes Diversion namely children from the criminal justice process to a process outside the criminal court. The results of this research showed that in Central Java case of children in conflict with the law are generally resolved through the diversion and some processed using by the Criminal Code or the criminal path. Another thing despite applying diversion path towards children in conflict with the law but there is no uniformity or sameness models of diversion as mandated in Law No. 11 Year 2012 on Child Criminal Justice System</em><br /><br />

AbstractConsultation with children is a delicate art, and consultation with vulnerable children, even more so. Experienced clinicians believe best practice in undertaking such work requires tertiary studies in social work or psychology combined with extensive supervised clinical experience. The current pathways to becoming a children’s lawyer in the Northern Territory do not involve mandatory training in child well-being, and yet lawyers are asked to consult with highly traumatised children and bring the voices of children into the courtroom. Lawyers for young children are additionally required to provide an opinion as to what they believe to be in the best interests of the child, without a social work or psychology-based qualification, training or in-depth guidelines to support their position. This article looks at what the law says about child consultation, what child development research says about child consultation and child consultation in practice in a Northern Territory child protection setting. At its conclusion, the author discusses potential pathways forward for lawyers and clinicians to work together in safe practices of child consultation.

ABSTRAKTulisan ini merupakan sebuah analisis terhadap Putusan Nomor 9/PID.SUS-ANAK/2016/PT.BDG, yang mengkaji sudah tepat atau tidak putusan yang dijatuhkan oleh hakim pengadilan tingkat banding tersebut dengan konsep restorative justice. Metode penelitian yang digunakan dalam tulisan ini adalah metode yuridis normatif dengan pendekatan deskriptif analitis yang menggambarkan sekaligus menganalisis pertimbangan-pertimbangan yang diambil oleh hakim dalam menjatuhkan putusan. Pertimbangan yang diambil oleh hakim pengadilan tingkat banding yang menguatkan putusan hakim pada pengadilan tingkat pertama merupakan pertimbangan yang tepat di mana hakim memutus perkara dengan mempertimbangkan prinsip-prinsip restorative justice. Hakim tidak hanya mempertimbangkan upaya pemberian efek jera tetapi juga mempertimbangkan kepentingan terbaik bagi anak yang berkonflik dengan hukum dengan memastikan pemenuhan hak atas pendidikan dan menghindarkan anak dari risiko pengaruh buruk yang dapat berujung pada berulangnya tindak pidana, karena dalam isu anak yang berkonflik dengan hukum, pendidikan bagi semua anak tanpa memandang asal, ras, gender, kecacatan atau kemampuan dan layanan kesehatan serta advokasi harus diperhatikan. Sejumlah anak tidak sempat mengenyam pendidikan yang lengkap karena situasi penjara yang tidak memungkinkan untuk memberikan pendidikan bagi warga binaannya.Kata kunci: pidana anak, pembinaan, restorative justice. ABSTRACT This is an analysis of Court Decision Number 9/PID. SUS-ANAK/2016/PT.BDG, which examines whether the decision imposed by the appellate court judge using the restorative justice concept is appropriate. Research in the analysis use normative juridical method with analytical descriptive approach, which describes and analyzes considerations taken by judges in making decision. The consideration taken by the appellate court judge reinforcing the decision of the first-level court judges is the right consideration since the judge decides the case by taking heed to the principles of restorative justice. The judge does not only weigh on the effort to provide a deterrent effect, but also the best interests of children in conflict with the law by ensuring the fulfillment of the children’s educational rights and prevent them from the risk of bad influences that may lead to the recurrence of crime. Because in the issue of children in conflict with the law, education for all children regardless of origin, race, gender, disability or ability and health services and advocacy should be taken into account. The children are not able to get an adequate education because of the incapacity of prison conditions to provide education to their inmates. The author tried to outline the status of crime victims in Macedonian criminal and juvenile legislation by analyzing three legal texts referring to legal protection of victims under criminal law in the Republic of Macedonia (the Criminal Code, the Law on Criminal Procedure Act and the Law on Juvenile Justice). The basic questions which have been analyzed from the criminal substantial aspect include: the rights and interests of the victims as a consistent part of contemporary criminal policy and Criminal Code reforms, the elements of diversion model based on concept of restorative justice in criminal legislation and victimology aspects of some significant novelties in the special part of criminal law. In this article two dimensions dealing with a change of status of damaged person in criminal procedure of the Republic of Macedonia have been analyzed, while taking into consideration new trends and comparative experiences in this field. One dimension is the role of the damaged person and incorporation of elements of restorative justice in the criminal procedure, while the other dimension includes help and support of the victims and prevention of their secondary victimization. While analyzing suitable provisions of the Law on Juvenile Justice, the author focuses on its solutions that deserve more attention because of its innovations. The consequent realization of the concept on which this law is based on, and in which the victim, at the same time, has a significant role is another confirmation of the rule that the changes of juvenile legislation creates good basis for future reforms of criminal legislation regarding the adult offenders.

Abstract                                                                              Various factors the cause of children committing crimes, especially in this discussion are children who are perpetrators of the crime of theft. Various problems of children as perpetrators of criminal acts of theft that occur. The act of a child committing theft is a violation of the law and has been regulated in the Criminal Code as formulated in the provisions of Articles 362, 363 and 365 of the Criminal Code. Various negative impacts of imposing punishment on children who commit the crime of theft causing dehumanization (decreased human values), prisonization (the influence of learning crime) and stigmatization (bad labels) are also taken into consideration in encouraging the birth of a diversion policy in Indonesia. The problem that arises is how the application of diversion to child perpetrators of the crime of theft is made aware of restorative justice in the perspective of dignified justice that prioritizes the future of the child. In child protection, there are 4 basic principles, namely: non-discrimination; the best interests of the child; survival, growth and development, respect for children's opinions. Thus, in the perspective of child protection, there is no punishment for children and there is no prison for children. So that in cases of children, perpetrators of the crime of theft should prioritize diversion against children with more emphasis on dignified justice for children.
