Bureaucracy is an important instrument in the country as a bridge between people and government. However, the strength of the role and function of bureaucracy often makes the rulers abusing bureaucracy for political ends, especially the perpetuation of power. The era of regional autonomy with direct regional head elections made the head of the region have the right to determine its bureaucratic officials in the region. Later, officials of the bureaucracy are also likely to be used for award of the tool in the context of general elections that followed for the next period. It is expressed as the politicization of the bureaucracy for winning the local elections. The local elections in Medan city became one example of the phenomenon of the politicization of the bureaucracy. Harahap Rahudman victory at the General Election of Medan in 2010 to form the politicization of the bureaucracy that causes power can be continued in the next period. This happens because the positions of the existing bureaucracy have intervened before to follow the will of the political authorities in the city of Medan. Own bureaucratic officials follow the will of the Mayor of Medan and keep the position or position in government institutions. The phenomenon of the politicization of the bureaucracy will give rise to a negative meaning of the bureaucracy which initially should be the government’s tool to serve the people and also lead to disruption of the bureaucratic model that should be professional (merit).

One of the very basic idea of the Qur’an is on the humanity of the prophet as like other creatures. Every single person has their own creative potency (in potentia) which, according to some philosophers, enables them to reach the degree of prophecy. This idea has then made a prophecy to come to a mundane term which has not to do with any sacred property. Prophets and prophecy are then not considered as an essential thing in human history. This notion has clearly put aside the role and function of prophet in human life. There is also popular opinion in the society that the prophet is considered as God’s chosen people to receive revelation, but, at some degree, they are conceived as having no responsibility to proselytize people under God’s revelation. This notion, beside to releases the prophet’s role from his social responsibility, contains some logical fallacies. If guiding people to the right path is being an individual’s responsibility of the follower of monotheist religion, how it is possible, then, to remove the responsibility of the prophets toward their society. Therefore, this study aims to revisiting the concept of prophecy, and analyzing the prophetic mission in terms of thematic interpretation

AbstractThe purpose of this contribution is to provide a critical overview of issues of principle related to the ‘significant disadvantage’ admissibility criterion under 35(3)(b) ECHR, in light of the ongoing debate on the Court's reform. It argues that the admissibility criterion: undermines direct access to justice at the international level; affects the right of individual petition to the Strasbourg Court; constitutes a misunderstanding of the subsidiarity principle within the Convention machinery; urges the Court to consider the merits during the admissibility stage in a sensitive area of adjudication such as human rights; and entails the risk of an indirect classification of rights on the basis of the financial damage suffered by the applicant. The article links these points with the discussion on the Court's reform and considers alternative proposals to reduce its workload. It concludes by underlining that the ‘significant disadvantage’ criterion could be a suitable opportunity to address questions related to the Court's legitimacy, including the ECtHR's precise role and function within the Convention.

This chapter analyses the role and function of the Appeals Chamber of the ICC. The right to appeal under the Statute goes beyond what is mandated by human rights law. This contribution analyses the specificities of appeals in the ICC system, including the relationship of the Appeals Chamber to other Chambers, its jurisdiction over different types of appeal under Articles 81 and 82 (e.g. interlocutory appeal, and appeal against final decisions of the Trial Chamber), review and revision of sentences, and the relevant standards of review. The chapter contrasts approaches of the ICC with the practice of the Appeals Chambers of the ICTY and ICTR, which have used their first cases to clarify and develop the law. It shows that the ICC has taken an approach of judicial restraint. It argues that development of the law in small steps may be the most effective approach to building a lasting and meaningful role of the Appeals Chamber in the ICC system.
