<p>Abstrak: Tulisan ini mencoba melakukan pemetaan masalah yang membuat kajian fikih stagnan sebagaimana diklaim oleh sebagian ilmuwan hukum Islam. Otoritas hierarki Kutub al-Sittah ternyata merupakan persoalan mendasar yang membatasi ulama berijtihad. Hal ini dikarenakan adanya pembatasan terhadap penggunaan kitab-kitab hadis di level tertinggi. Istilah Kutub al-Sittah semestinya diletakkan sebagai kitab fikih, yang ketika penggunaan awalnya dianggap kitab hadis. Menurut penulis, hal ini membuat Kutub al-Sittah cenderung menolak kritikan, sebab ada dimensi kesakralan di dalamnya. Karenanya perlu dilakukan kontekstualisasi terhadap pemahaman nash hadis yang dianggap untuk mengikuti perubahan sosial. Menurut penulis deduksi terhadap nilai teks nash tidak mengenyampingkan teks nash sebagai pijakan dalam pengembangan konsep maslahat. Otentisitas kajian fikih terkait dengan nilai-nilai normatif nash, namun hal tersebut tidak bisa langsung diterapkan dalam kehidupan.</p><p><br />Abstract: The Authority of Kutub al-Sittah Hierarchy and the Stagnant of Fiqh Studies. This paper tries to map predicaments that contributed to fiqh studies that had been claimed to be stagnant at least by a few Islamic legal scholars. The authority of Kutub al-Sittah hierarchy, in fact, has become an important problem that restricted the learned scientific community or ulama to practice ijtihad. This stemmed from the limitation of the hadits books use at the highest level. The so called Kutub al-Sittah should be properly signified as fiqh book. According to the author, this makes Kutub al-Sittah seems to be resistant to criticism, due to the sacred and intrinsic dimension in it. Therefore, it is urgent that understanding the argument of Traditions which are relevant and in line with the social dynamics should be contextualized. He also maintains that legal deduction of the text of the Traditions does not necessarily overrule the principle values of the text as a foundation for the maslahat concept. In addition, the argues that the authority of the study of Islamic jurisprudence is closely related to the normative values of the text, but nonetheless such norms could not be directly applied to the real life.</p><p><br />Kata Kunci: otoritas, Kutub al-Sittah, fikih</p>

This article describes about the figure of children world in a short story “Anggrek Rara” written by Ina Inong, by connecting the social structure in the text and in the real life. After analyzing the social structure in the story, it is found that the plot of this story was the progressive plot, the background was from the social fact that came from inner house and outer house, otherwise the central character were Rara and Bunda. By analyzing social structure of text, it was found that a family (home) is the serious and formal environment while outer house is free and non formal. The result of the research showed that the children short story “ Anggrek Rara” was expected to give the figure outlines of the children world.AbstrakPenelitian ini membahas tentang gambaran dunia anak dalam cerita pendek anak “Anggrek Rara” karya Ina Inong dengan menghubungkan struktur sosial teks dalam karya dan struktur sosial teks dengan realitas. Melalui analisis struktur sosial dalam karya terungkap bahwa alur cerita ini merupakan alur lurus, latar terdiri dari fakta sosial yang bersumber dari rumah dan di luar rumah, sedangkan tokoh Rara dan Bunda adalah tokoh sentral. Melalui analisis struktur sosial teks dengan realitas terungkap bahwa keluarga (rumah) merupakan lingkungan yang sifatnya serius dan formal, sedangkan di luar rumah bahkan bersifat bebas dan non formal. Hasil yang diperoleh dari analisis ini menunjukkan bahwa cerita pendek anak “Anggrek Rara” dianggap mampu memberikan garis-garis besar gambaran kehidupan dunia anak.

Design-based research (DBR) is an innovative methodology for co-creation, but potentials, challenges, and differences between methodological ideals and the real-life intervention context are under-researched. This study analyzes the DBR process in which researchers, professionals, and families co-design a family-based intervention to prevent childhood overweight and obesity in a rural municipality. It involves interviews with six key stakeholders in the co-design process. Data were coded and analyzed using systematic text condensation, while the theory of the “social effectiveness of interventions” developed by Rod et al. (2014) was used as an analytical tool for unpacking the co-creation process and exploring methodological barriers and potentials. The DBR approach contributed with a feeling that everyone’s perspective was important, and the professionals got a new perspective on the families’ experiences with healthy living they did not previously consider. We also found that the iterative design process did not fully align with the organizational structures in the municipality or with the needs of stakeholders, leading to friction in the partnership. This study emphasizes the complexity of using an anti-hierarchical approach within a hierarchical context, and the importance of being aware of how the DBR approach shapes the partnership, as well as of how the social dynamics within the partnership shape the design process.

According to Islamic Jurisprudence, one of the most important requirements for a sound marriage is the total agreement of the woman under the guardianship of her father or any other mahram relative. In case of none, the ruler or the judge assume to be a guardian or Wali of a woman. A guardian or Wali is responsible for the selection of the righteous person for the woman and assures the protection and welfare of her Rights and interests. He has the authority to reject and refuse the proposal if the suitor did not deem a sound and sincere match. A marriage without a guardian is considered unlawful, as there is no concept of love affairs and courtship without a guardian in Islam. The guardian evaluates the religious, social and economic compatibility of the couple, while on the other hand a woman selects the spouse on physical attraction and romantic notion which vanishes out soon as the real life starts causing potential problems in relationship. That why Islam lays down principle and law of wilayat for a lady to protect her interests and rights and consider to be a shield and safeguard for her welfare in future marital life.

In real life we often took identity as something given. Social media gave users the opportunity to present themselves as they wished. Social media gave chances to people to choose the kind of person they wished to be in social medai. People could then construct their identity the same as or different from their true selves in the real world.This study aimed to identify and understand the self-presentation of social media users in the construction of identity in social media and identity in real life. The study was conducted through the methods of phenomenology and avatar research. Data was gathered by by in-depth interviews and observations in informants social media accounts.The results showed several findings, namely: construction of identity in social media take the positive part of identity in the real world, informants consistently set a certain image in the social media in match to their expectations, social media became a mean of users personal branding. Informants also divided into two categories: first, the group that consistently maintain the image they were trying to build. second, groups that occasionally appeared different from the image they wanted to construct.

There is a physical world and a world of meanings, symbols and social relationships. Neuroscience considers brain as a biological machine. Social science studies the human relationships.Nowadays we know cerebral processes underlying several aspects of social behavior.Cerebral damages or dysfunctions can influence the social behavior, as well as the social experiences can shape the development, structuring and functioning of the brain and, consequently, condition the further responses of the individuals to the social events. Humans are embodied subject. In an objective sense we are bodies with a brain, in a subjective sense we are individuals in a social world. This is a relevant matter for all the medical sciences, not only for psychiatry.The real-life functioning of individuals with schizophrenia shows deficits in several daily-life abilities, in social relationships and in the work activities. According to literature and clinical practice, basic criterions are: bio-psycho-social vulnerability, stressful life events, coping strategies as well as social and relational competence.Neurocognitive activity shows a straight correlation, albeit indirect, with the real-life functioning. Positive symptoms, negative symptoms and disorganized behavior can considerably influence the real-life functioning. While social and relational competence, the general functioning and resilience are protective factors that can positively condition real-life functioning. Moreover, welfare services (i.e. assisted job placement; disability subsidies; etc.) and a good family and social network can considerably influence the results.According to the results above, we can affirm the importance to adopt integrated and personalized therapeutic-rehabilitative program for the treatment of schizophrenia and other serious mental disorders.Disclosure of interestThe authors have not supplied their declaration of competing interest.

This chapter examines one of nine critical forces behind purchase decisions that make mobile advertising so powerful: social dynamics. Recent studies have shown that the social company we keep changes our behavior. This is our social context. Beyond our individual location at any given time, our social context influences how we interact in real life as part of a group of friends, as a couple, or with family members. And these behaviors are fundamentally different than how we behave when we are on our own. The chapter discusses the impact of social dynamics on mobile purchases, the importance of group composition, and digging deeper into consumers' personalities.

A partir da apresentação da noção de crise no âmbito das humanidades, o presente ensaio pretende tecer algumas análises sobre os modos de gestão e governo dessa crise. Para tanto, investiga o deslocamento de problemas epistêmicos nas ciências (físicas e sociais) para o campo do governo no âmbito do controle das populações. Apresenta como os modos de leitura das probabilidades nas ciências acaba, no domínio do social, funcionando como uma maneira de gerir o real. Mostra como essa problemática se desenvolve e ganha em efetividade a partir das noções de cibernética. Por fim, aponta como o mecanismo do governo toma uma dimensão de totalidade no contemporâneo e, diante disso, aponta para modos de resistência a partir na noção de ingovernável. AbstractFrom the presentation of the notion of crisis within the humanities, the present essay intents to weave some analysis of the manners of management and government of this crisis. Therefore, it investigates the displacement of the epistemic problems on sciences (both physical and social) to the government field within the control of populations. It presents how the readings of probabilities in sciences work as a manner of manage the real on the social domain. It shows the development of this problem and exhibits how it grows on effectivity after the expansion of the cybernetics. It indicates how the mechanism of government takes a dimension of totality in the contemporaneous. Lastly, after these analysis, it aims to the manners of resistance based on the concept of ungovernable.

In this study, we try to look at the Child’s Rights Act from a sociological angle by discussing the social and organizational infrastructure and the challenges faced and how to provide a suitable environment to fulfill/ implement the articles of the Child’s Rights Act taking into consideration the characteristics of the Omani society. The study covered the five following aspects: The regulatory frameworks to protect children by conducting a historical constructive analysis, classifying the contents of the Child’s Rights Act and explaining the articles meant to protect and take care of children in Omani Laws and Legislations either in the regulatory frameworks or in the implementation procedures, the observation of the real life of Omani children, the main challenges and how to address them, and finally the real life of handicapped children. The study concluded that the Omani Laws Legislations paved the way to implement some changes to grant and ensure child’s rights, whereas we – in Oman – are faced with challenges related to the implementation of the legislations concerning children and their parents. In addition, some families are faced with challenges that prevent them from playing their role as effective social institutions to protect their children. Also, some social institutions such as Education and Media face other challenges related to child’s rights.

Based on the materials of two series of leitmotiv in-depth interviews - with mothers of girls and kindergarten teachers - the article analyzes the content and orientation of the social concept of girls’s gender socialization that is relevant for Yaroslavl. The category “social concept of gender socialization” was introduced to distinguish between scientific generalizations of the content of gender socialization and its social interpretation. An analysis of the social concept of gender socialization was carried out according to such substantial components as ideas about the boundaries of socially acceptable and permissible in behavior, the appearance of girls; observations about the direction of games and favorite toys; regulatory views about femininity, qualities necessary for a woman; parental requirements system to girls, differences in the upbringing of girls and boys, qualities that need to be formed in girls. The concept is presented in two temporal perspectives - informants - the study participants talked about their own childhood and how it is now necessary to educate girls. The traditional orientation of the conceptualization of gender socialization by Yaroslavl women has been revealed, according to which girls must first of all instill the qualities of a mother, wife, and mistress. Concluded about the discrepancy between the value-normative aspects of the concept of socialization of girls with the real life practices of their mothers.
