This paper analyses the legal and historical development of waqf made by Sultan Idris Murshidul' adzam Shah in Perak (1849 to 1916). There are many untraceable, lost, and perished waqfs in Malaysia. However, Sultan Idris’s waqf is an exception which still exists since its establishment in 1917. As such, this research intends to explore its sustainability factors. The research methodology used is the doctrinal and non-doctrinal research methods. The doctrinal method is used to analyse the enactments, government gazettes, audit reports, journal articles, and history books. Meanwhile, the non-doctrinal legal method, namely semi-structured interview, clarifies findings and information gathered from various documents. The research is essential as there is a lack of comprehensive research done on waqf made by the Sultans or the Head of State in Malaysia. The researcher finds that  the waqf was an established under written legal instrument;  the waqf by Sultan Idris was made based on the English law of trust, but the spirit and principles of waqf to permanently benefit the beneficiaries remain intact; the appointment of the Sultan's descendants as the trustees alongside a committee proved to be crucial for the sustainability of the waqf; and there was check and balance process through legal provision. This research provides a clearer picture of waqf practice before the establishment of Perak's State Islamic Religious Council and evidenced the Sultan's contribution towards developing and protecting Islam.

In this article issues around research methodology specific to Aboriginal people will be discussed. A brief historical analysis lays a foundation for the need for unique research methodologies as it pertains to Aboriginal people both as researched and researcher. Contemporary critiques by Aboriginal writers and communities will be presented in relation to the limitations and effects of Euro-western research methods. Finally, the authors will discuss issues, possibilities and responsibilities around conducting research as Aboriginal researchers.

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. Traditional research methods are inadequate to predict and explain consumer behavior accurately in some cases. Marketing discipline tries to benefit from new technological developments in order to make up the deficiency subjects’ competence and willingness to express how they feel when they face with stimulus in traditional data collection method has an effect on the success of the method. In traditional methods, subjects often cannot remember or know the correct answer, or even if they know the answer they will give answers that satisfy the researcher. The inadequacy in traditional techniques has driven the researchers to evaluate theconsumer response more accurately. It is observed that in recent years neuromarketing techniques began to be used extensively to measure consumer responses accurate in marketing field. Although neuromarketing is commonly used in marketing field, there are some questions about the efficiency of the method. This study emphasizes the efficiency on the general evaluation of neuromarketing techniques and criticism of it. The aim of this study is to indicate the historical development of application of neuro science on marketing and consumer behavior, and to establish the future of neuro science, its opportunities and threats.

This chapter introduces ethnography as a distinct research and writing tradition. It opens with a discussion of ethnography’s current fashionability within transdisciplinary academic spaces and some of the associated challenges. The next section provides a historical overview of ethnography’s emergence as a professionalized research practice within the fields of anthropology and sociology. Focusing on ethnography as a research methodology, the chapter outlines several key attributes that distinguish it from other forms of participant observation–oriented research; provides a general overview of the central paradigms that ethnographers claim and/or move between; and spotlights three principal research methods that most ethnographers utilize—namely, participant observation, field-note writing, and ethnographic interviewing. The final section of the chapter introduces a research disposition called ethnographic comportment, defined as a politics of positionality that reflects both ethnographers’ awarenesses of and their accountabilities to the research tradition they participate in.

This paper presents a brief overview of some of the major issues associated with research design in experimental gerontology. The intention is not to provide a comprehensive and detailed guide to experimental design and research methods. Rather, the paper focuses on a more general discussion of several issues associated with the design, implementation, and interpretation of research in an attempt to illustrate why a rudimentary knowledge of these topics is essential for all researchers and practitioners involved in the study of the aging process. Wherever possible, specific examples from the exercise science and applied health literature are selected in order to illustrate the significance of these factors for our field of expertise.

Theoretical and applied research of the features of the legal status of the subjects of civil law remains debatable today. Doctrinal and legislative analysis of this subject points to unresolved issues in this area. In particular, the provision on defining the state as a party to civil law remains controversial. There is no consensus on the definition of individuals and legal entities as subjects of civil law among scholars. Furthermore, the legal regulation of certain types of entities is somewhat unsystematic and chaotic. This is largely due to the insufficient development of theoretical issues related to the subjects of civil law. The above issues determine the relevance of the study of the features of the legal status of subjects of civil law. The purpose of the study is to investigate the features of the legal status of subjects of civil law based on doctrinal and legislative analysis. The study is based on a systematic approach, which lies in studying a complex system of relationships between subjects of civil law. Furthermore, the study is based on the laws and principles of dialectics, which contribute to the study of the legal status of the subjects of civil law. Systemic and structural-functional analysis was used to comprehensively describe the legal status of subjects of civil law. The historical method contributed to the study of the evolution of research on the subjects of civil law. The formal legal method helped identify the special features of the provisions of regulations concerning the subjects of civil law. With the help of the comparative legal method, the study analysed the provisions of the Civil Code of Ukraine in terms of regulation of subjects of civil law and such regulation was compared with other countries. The study defined the concepts and types of subjects of civil law and considered the features of the legal status of individuals, legal entities, as well as the state as a special participant of civil law. Special attention was paid to the historical analysis of the development of approaches to the definition of subjects of law, starting with Roman law

The article presents the psychological analysis of the implicit mind theory and its research methods. The main problems of empirical research in psychology are briefly described. The main problems of research of the mind theory are highlighted; and the status of this phenomenon’s in scientific psychology is defined. The implicit mind theory is defined as a psychological quality expressed in the ability to explain and attribute mental states – beliefs, desires, emotions, knowledge, etc. – to themselves and others; as well as understanding that others have different beliefs, desires, intentions, and attitudes. Current difficulties in the research on the implicit mind theory are described. Age-related features of formation of the implicit mind theory are depicted. The latest scientific studies on the implicit mind theory are highlighted. Biological correlates of the theory are shown. It is also described that in the case of an alcohol addiction, certain brain areas that are known to be neurological correlates of the implicit mind theory are damaged. The main research methods, which are separated into three groups, are highlighted. The first group includes methods that study the implicit mind theory using behavioural experiment with special tasks. The second group includes methods that use semi-structured interview. The third group includes methods where respondents are asked to identify an emotion or an affective state of another person based on the visual stimuli (photo, picture etc.).The main methods of research of this psychological phenomenon, features, procedure, advantages, and disadvantages are described in detail. The most appropriate methods to examine addicts’ implicit mind theory are proposed. The procedure of investigation and psychological assessment of the implicit mind theory for people dependent on psychoactive substances is offered.

O boom da internet nos últimos anos levou a sociedade a utilizar novas formas de comunicação. Seus usuários passaram de meros espectadores a produtores de conteúdo. Esta produção de conteúdo leva a uma evolução lógica dos métodos tradicionais de pesquisa, tanto no âmbito empresarial como nas instituições de ensino. Neste cenário, surge o método netnográfico ou, Netnografia. Esta nova ferramenta, focada na pesquisa online, e que favorece a coleta de informações on-line. Este estudo visa esclarecer o conceito básico a respeito da Netnografia, bem como demonstrar a utilização do método nos cursos de Pós-Graduação em Administração no Brasil.   PALAVRAS-CHAVE: Netnografia; Pós-Graduação; Metodologia da Pesquisa; Administração.   ABSTRACT The growing of the internet in recent years has led society to use new forms of communication. His users went from mere viewers to content producers. This leads to a logical evolution of traditional research methods, both in business and in educational institutions. In this scenario, the netnographic method appears. This new tool, focused on online research favors the collection of online information such as images, vídeos and comments. Introduction. In modern Russian society with high rates of development of market relations, digitalization of the main spheres of life, popularization of the ideas of self-organization and self-regulation, legal uncertainty acts as a bipolar phenomenon, which is not only a consequence of law-making errors, but an effective technical and legal way of presenting regulations. Theoretical analysis. The historical analysis of the formation and development of ideas of certainty and uncertainty in jurisprudence showed that these categories are considered as universal phenomena characteristic of any matter. It was established that absolute certainty is unattainable and not always in demand, while legal uncertainty is inherent in the very nature of law. Еmpirical analysis. It was revealed that the need to ensure mobility and flexibility of legal regulation imposes the task of a reasonable use of legal uncertainty as a technical and legal way of presenting law on the law-making subject, which is reflected in the current legislation. Results. Legal uncertainty is an objective and inevitable phenomenon, and the total regulation of social relations is not always justified. The law is being improved on the basis of the principle of transition from the casuistic to the abstract, which proves its universality.
