The purpose of the article is to carry out a culturological dimension and define as a synthetic phenomenon the musical-theatrical aspect of the artistic activity of the outstanding actor, director, theater teacher, and entrepreneur Mykola Mykolayovych Sinelnikov (late 19th – early 20th century). The methodology of research is based on the use of a complex of general scientific and specific scientific methods in accordance with the cultural discourse. In order to study the problem in a historical sequence, the historical method was applied. Setting the goal of illumination and analytical measurement of the constituent components of the problem under study, the system-analytical method is applied. The system-structural method is used to study a cultural phenomenon as a system of interrelated and interacting elements. The hermeneutic method is used to study and interpret the theoretical provisions of the problem under study. In order to study the life path of a creative person, illuminate her inner world, and understand the motives of her activity, the biographical method is used. The generalization method was applied to determine the general conclusions of the study. The scientific novelty lies in the musical and theatrical reflection of the creative phenomenon of the outstanding artist-reformer of the late 19th – early 20th centuries Mykola Sinelnikov. Conclusions. Consideration of the issue raised in the article made it possible to state the importance of the presentation of the creative practice of N.N. Sinelnikov as a representative of musical and theatrical syncretism. Research of the phenomenon of N.N. Sinelnikov made it possible to illuminate the system of artistic principles of the creator, which fully corresponded to the nature and content of the modern era. It was determined that the musical and theatrical segments of N.N. Sinelnikov’s works are harmonious integrity, that is, they represent musical and theatrical syncretism. The purpose of the article is to study the legal nature of the international franchise agreement, its types, essential conditions and peculiarities of its conclusion. The subject of the study is the international franchise agreement. Research methodology. The research is based on the use of general scientific and special-scientific methods and methods of scientific knowledge. The dialectical method allowed investigating the definition of the international franchise agreement and its essential conditions. The comparative legal method was used to compare doctrinal approaches to this issue. Interpretation of the content of international legal acts governing issues related to the conclusion of the international franchise agreement was realized with the help of the normative-dogmatic method. The system-structural method is used to study the international franchise agreement as a single whole (system) with the coordinated functioning of all its elements. The methods of grouping and classifying formed the basis for separating the list of conditions, which are necessary for the conclusion of this contract, as well as the provisions that should be included in the content of the agreement. Methods of analysis and synthesis helped to study some parts of this agreement to formulate further conclusions. Practical implication. The analysed recommendations of scientists and lawyers, as well as the provisions of international regulations, can be used when concluding an international franchise contract. Correlation/originality. The scientific novelty of the work consists of an integrated approach to the study of theoretical and practical issues related to the international franchise agreement.

The purpose of the article is to analyze the main milestones of life, stages of cultural and artistic activities and reveal the personality of Samuel Franklin Cody - a representative of show business and professional art showman of the late nineteenth - early twentieth century. Methodology. A number of scientific search methods have been used. The biographical method became optimal for revealing the main stages of the showman's life. The study is also based on methodological tools integrated with culturology, history, art history. General scientific methods are used - analysis, synthesis, and principles of scientific analysis - reliability, impartiality, etc. Scientific novelty. For the first time in Ukrainian science, in particular art history, an attempt was made to analyze the life, artistic activity, and significance of showman Samuel Franklin Cody. Conclusions. Samuel Francis Cody is the most famous showman, creator of the show "Wild West" and author of large kites Cody War-Kites, which could lift people. In S.-F. Cody, no doubt, was an innate talent of the showman, which was supported by certain traits - courage, openness to the new, impartiality, activity, generosity, adventurism, etc. The first role is played by the brightness of the image, the diversity of talents, the desire to create, entertain the audience, and be in the center of its attention. Without exaggeration, as a pioneer in today's popular show business S.-F. Cody can be considered the most talented person of his time, who saw far ahead and played a significant role in the formation of world show business, the profession of the showman, and the whole socio-cultural reality.

In the urban sphere, the problems become more complicated and there are many violations and errors, so the problem of streamlining the problems of urban planning and substantiation of new methodological tools for solving «atypical» problems is relevant, as classical methods are ineffective. In the article the author solved problems: classification, specification of structure and maintenance of urban problems; substantiation of typological features and selection of «atypical» urban problems; outlining the general algorithm and methods of their solution; checks of orderly methodical tools on urban tasks of Lviv. Existing methods and solutions of urban problems are systematized. The general scientific methods of research include: theoretical (convergence from the abstract to the concrete, the method of formalization, the historical method, the system-structural, the method of studying documents); empirical (method of observation, comparison, field surveys, measurements) and empirical-theoretical (abstraction, analysis, synthesis, logical method, modeling), as well as statistical, historical, sociological and cartographic analysis. The classification and «atypical» problems of urban planning are carried out, the methodical tools of their solution are arranged. Methods and means to increase the efficiency of functioning and development of urban systems are based on the provisions of fuzzy sets and their essence. Thus, the new methods should classify urban problems by input and output indicators and knowledge of the internal structure of the system (processes and behavior). According to the theory of validity, in the first step, data are collected using various methods, denoted by codes, grouped into groups to make them more effective. Classification and characterization of «atypical» tasks, as well as updated methodological tools were tested on the example of Lviv — the principles and ways of reforming and developing its spatial structure. The forecast of the future is based on the genesis and historical ways of development of territories and cities. New ways or elimination of old ones meet at radical reforms, and development is caused not only by historical longevity and change of conditions, but also by new processes and behavior of system. There are ways to solve «atypical» problems: simple, including one direction; more complex covers the main direction and two or three additional subdirections; complex includes one or two main directions and several subdirections. This substantiates the feasibility of permanent city design and updating of urban planning documentation.

The purpose of the article is to study the legal nature of the franchise agreement in Germany. The research subject is the franchise agreement in Germany. The methodology of research. The study is based on the use of general scientific and special scientific methods and techniques of scientific cognition. The dialectical method allowed studying the definition of franchising agreement in Germany and its essentials. The comparative legal method was applied in order to compare doctrinal approaches to this issue. Interpretation of the content of laws and regulations of German legislation covering issues related to the conclusion of the franchising agreement in this country was carried out by means of the normative-dogmatic method. The system-structural method was used to study franchising agreement in Germany as a unitary whole (system) with coordinated functioning of all its elements. Methods of grouping and classification formed the basis for singling out a list of requirements needed to conclude franchising agreement in Germany, as well as provision to be included in this agreement. Methods of analysis and synthesis helped to investigate separate parts of such an agreement in order to formulate further conclusions. Practical implications. The positive experience of Germany in the regulation of issues related to the conclusion of the franchising agreement can be used for introducing corresponding changes in the legislation of Ukraine. Value/ originality. This scientific paper is the first study in Ukraine devoted not to general issues of regulation of franchising activity in Europe but specifically to franchising agreement in a separate country (in Germany).

The aim of the article is to determine the specificities of the remuneration for public servants in Ukraine. The subject of the study is the remuneration for public servants in Ukraine. Methodology. The study is based on the use of general scientific and special-scientific methods and techniques of scientific knowledge. The dialectical method enabled to interrogate the development of the institution of remuneration for public servants in Ukraine. The comparative legal method enabled to compare doctrinal approaches to this issue. The system-structural method enabled to determine the elements of the remuneration for public servants. Methods of analysis and synthesis helped study separate parts of this institute to formulate further conclusions about its most optimal functioning. The logic-semantic method was used to determine the content of the concept of “remuneration for public servants”. The normative-dogmatic method enabled to analyse the content of legal regulations of the domestic legislation on the issue. Practical implications. The determination of the specificities of the remuneration for public servants in Ukraine enabled to make recommendations for improving the remuneration system of this category of workers, as well as identify problematic issues that require further consideration and research. Relevance/originality. The author’s definition of the concept of “remuneration for public servants” is proposed and the specific features of this institute, insufficiently studied before, are analysed. The article analyses the specificities of the remuneration for public servants. Their list is determined and the content of each of them is disclosed. The specificities of the remuneration for public servants are substantiated in comparison with other categories of employees.

This article raises the issues of organizing palliative care as one of the forms of implementing the right to life. The authors identify and describe the principles of palliative care. International law regulating palliative care is reviewed, along with a brief overview of the development of Russian law concerning palliative care and a list of patients who may be subject to palliative care. Special attention is given to the issue of decision-making by the patient's family. In connection with that, examples are cited for foreign models of communication between palliative care and decision science researchers, theorists, and clinicians, patients and their families for the purpose of exchanging information and studying the patients' health issues, discussing treatment options and making coordinated decisions during the life-limiting illness of patients. The results of this research are based on using the following methods: universal dialectical method of scientific cognition, as well as general scientific methods based on it (description, analysis, synthesis, induction, deduction, comparison, analogy, generalization) and specific scientific methods (comparative law method, systematic structural method and formal law method).

Modern society stands in need of a next-generation teacher, in the light of which this study acquires particular relevance. The paper investigates the urgent issue of modern pedagogy – the study of the scientific foundations of the methodology for preparing future computer sciences teachers for the development of electronic educational resources. In the study, the following general scientific methods were used: logical-historical method, pedagogical observation, analysis, synthesis, systematisation and generalisation, methods of pedagogical experiment, methods of mathematical statistics. The authors propose criteria and indicators of the readiness of future informatics teachers to develop electronic educational resources, as well as levels to identify the readiness of future informatics teachers to create electronic educational resources. In the paper, the authors share the results of an experiment to determine the suitability of their proposed methodology, describe the ways of forming the skills of future teachers to develop EER.   Keywords: learning process, informatisation of education, structure, aptitude of future teachers, criteria, indicators.

Sport law as a highly developed complex branch of law regulates legal relations related to the subject of the different branches of law. Liability for violation of rights, non-performance or improper performance of duties is the basis of criminal, administrative, disciplinary and civil liability. However, there is another type of liability and sanctions provided for violation of sport rules. Nevertheless, no commonly accepted opinion has still been formed whether sports liability is a new type of legal liability or not. Therefore, the aim of the research paper, through general scientific methods (mono­graphic method, analytical method, historical method, comparative method, induction deduction) and methods of interpreting legal norms (grammatical, historical, teleological and systemic methods) is to determine the concept and content of sport liability. To reach the proposed aim, the authors of the study have formulated the concept and signs of sports liability, determined the types of a sports offense, analysed non-standard cases that outside the sports industry would not be subject to any liability and have identified main types of sports sanctions.

At the IV International Forum "Creative Ukraine", where the country's leadership declared the creative economy a priority of strategic development of Ukraine, it encourages the search and study of industries that meet the requirements of creativity and contribute to economic development. The purpose of this study is to analyze the activities of the porcelain and earthenware industry of Ukraine, the basis for its identification as such and its creative component - the field of manufacture of household and utility items. In this study in the implementation of the normative approach in considering the socio-economic development of the industry used the historical method, in the study of economic indicators used the method of extreme values, as well as applied general scientific methods of generalization and synthesis modern Ukraine for the period from the XVIII century to date. The indicators of the volume of production of this industry are investigated. The research of conformity of characteristics of the porcelain and faience industry to the criteria concerning branches of creative economy is carried out. The importance of the study is to identify a further range of issues that need to be researched and developed in order to find effective modern tools for the development of sectors of the national economy. In addition, at this stage in the development of the creative industry, attention to the study of the creative economy, in particular the porcelain and earthenware industry, should expose the problems facing manufacturers of creative products in order to develop effective tools to solve them. An important consequence for society should be the awareness of the significance of the very fact of the existence of such a creative industry as porcelain and earthenware. Its very existence represents the authenticity of a valuable cultural phenomenon that has been known in the world for a sufficient period of time, commands respect and indicates the significant cultural contribution that can be made to Ukraine as part of the European Community. Within the limits of the given article dependence of development of branch on public administration is considered. The direction of further research should include research on organizational and economic support for the reengineering of the porcelain and earthenware industry, taking into account the tools of the creative economy. Thus, at present, when developing the porcelain and earthenware industry as a strategic one, the article can be practically useful and socially valuable for politicians as well, in particular, in the profile newly created Ministry of Strategic Industries.

The purpose of the article. The investigation aims to highlight the contribution of Anatoliy Pashkevych to the formation of the Volyn state folk choir in the framework of his life and work. The methodology of investigation is based on such general scientific methods of research as the methods of objectivity and historicism, as well as the special historic-biographic method. The methods of objectivity and historicism allow us to observe the influence of A. Pashkevych on the work and development of the Volyn folk choir. The special historic-biographic method is used to define the work of the composer through his life path. The given method allows generalizing his art achievements of different timespans through the analysis of his personal accomplishments. Scientific novelty. Complex research of artistic work of Volyn state folk academic choir through the framework of life and art involvement of A. Pashkevychis done, the repertoire of the group is analyzed; the influence of the choir on the development of the vocal-choreographic culture of Volyn region and Ukraine is defined. Conclusions. A Pashkevych, as the composer, the singer, and the head of Volyn state choir and other famous choirs of Ukraine, has contributed much into Ukrainian musical culture in 1978 – 1989.
