Relationship between the notion “state policy” and other notions of the theory of state and law

Purpose. The purpose of this work is analysis of the notion "state policy" as the relatively new notion of general-theoretical legal science and identification of its relationship with other, more traditional notions of the theory of state and law, as "state authority", "state activity", "state regulation", "state administration". Methodology. The methodology includes complex analysis and generalization of scientific and theoretical material and formulation of relevant conclusions and recommendations. During the research, such methods of scientific knowledge were used: comparative, terminological, functional, historical, structural. Results. It was determined that the notion “state policy” is a cognitive tool of expansion of human knowledge about state policy as complex, multidimensional social phenomena. On the current stage of its development, the theory of state and law attempts to expand the area of scientific cognition of state and legal phenomena, with the new picture of the state and legal world involve new general state and legal categories, among which the notion of “state policy” has to take one of the most important places. In the framework of the categories and concepts of the theory of state and law, it is determined through the relationship of the last with other concepts of general-theoretical legal science, characterizing connection and dependence of the state policy on state authority, state activity, state regulation, state administration. Scientific novelty. In this study, it was determined that characterizing mutual relation, connection, and dependence of the state policy with state authority, state activity, state regulation, state administration, we concluded that some of these categories (state authority, state activity) are primary, original or generic concerning state policy, other - are in relation of intersection, partial coincidence (state regulation), other categories are covered by the concept of the state policy (state administration). State policy is included in the following schematic-concept list: state authority -state activity - state policy - state regulation -state administration. Practical significance. Results of the study may be used in scientific and research activity for the improvement of the scientific ensuring of the state policy, activation of its theoretical-legal, discipline-specific and inter-disciplinary studies; in the educational process - for preparation of educational and educational and methodological materials and use during the presentation (lecturing) of Theory of state and law, constitutional, administrative law, political studies, state administration, and other social and humanitarian disciplines.

In the monograph the theoretical identification of concepts and categorical series of state regulation of investment-innovation processes are investigated; the directions of optimization of the state policy of innovation and investment development management in Ukraine are determined; the organizational and legal principles of the state regulation of development of intellectual potential of the population are substantiated; the areas of development and improvement of the national innovation system as an object of state policy are highlighted and assessed. Goal. The aim of the study is to analyze the main forms and methods of counteraction of the state and society in the USSR to the youth subcultural movement in 1940-1960. The method covers a set of methods and logical sequence of their use, which was determined by issues and features of historical and legal research. Methods. The use of general scientific methods of analysis, synthesis and abstraction allowed to empirically study the youth subculture in 1940 - 1960's. Historical and legal method allowed to consider the youth subculture as a phenomenon of a particular era, taking into account the influence of economic, social and ideological factors. The comparative law method in our study was useful for comparing the measures applied to the youth subculture by party, youth organizations, law enforcement agencies and educational institutions. Results. The study found that the youth subcultural movement in the USSR was heterogeneous. It was found that, despite the apolitical nature of the movement, within the Cold War and confrontation with the West, it was seen as a threat to the existing social order and contrary to official ideology. This created the preconditions for combating it, which were carried out with the involvement of the party and Komsomol apparatuses. Scientific novelty. It was established that the main forms of struggle against the youth subcultural movement were extrajudicial, which provided for moral pressure, expulsion from the Komsomol, an educational institution, deprivation of a scholarship, and public humiliation. Practical significance. It is that the main provisions and conclusions set out in the study can be used: 1) in research related to the study of the features and legal principles of the repressive policy of the Soviet government; 2) in the educational process, during the teaching of sections relating to the state and legal development of Central and Eastern Europe.

The purpose of the article is to develop practical recommendations for improving the tools of state regulation of the agricultural insurance market. Research methods. The research was based on general scientific research methods, scientific works of domestic and foreign economists on insurance in the agricultural sector of the economy, regulations and Internet resources. The application of the method of comparison, the monographic method in combination with the method of induction made it possible to systematize and generalize the foreign experience of state support for agricultural producers. Research results. The reasons for the need to improve the system of state regulation of the agricultural insurance market are systematized. The international practical experience of formation of systems of the state support of agricultural insurance is generalized. The normative-legal acts regulating relations in the field of insurance of agricultural products are considered. Emphasis is placed on existing programs to protect agricultural producers from the risks posed by the state. An assessment of the current state of the agricultural insurance market in Ukraine and identified prospects for its development using the tools of state regulation. Scientific novelty. It is proved that agricultural insurance is a new effective tool for state support of farmers in case of risks, which will help improve the economic performance of the agricultural sector of Ukraine. Practical significance. Measures to improve the instruments of state regulation of the agricultural insurance market are proposed. The introduction of state support for agricultural insurance will contribute to the growth of the domestic market of agricultural insurance, which will provide additional revenues to the state budget. The article deals with theoretical questions about the mechanism of state regulation of the economy. The content of the mechanism of state regulation of the economy is revealed on the basis of studying the mechanism of state administration, the etymology of the word "mechanism", taking into account the essence of state regulation of the economy. The issue of improving the mechanism of state regulation of processes related to the country's economy has been resolved, which is impossible without researching the theoretical foundations of this mechanism, determining the appropriate categories of state regulation of the economy. In an unstable economic environment, a special place is occupied by the "mechanism of state regulation of the economy." Without defining its essence, it is impossible to solve the problem of increasing the efficiency of the entire system of state regulation of the economy. This fact is confirmed by the processes aimed at the development of the economic system, which necessitates active regulation by the state. That is, without perfect mechanisms of state regulation of the economy, it is impossible to purposeful, coordinated and rational management of social and economic processes in the country, an appropriate level of organizational and managerial influence on the development of all spheres of state life, sustainable support for the actions of state authorities from various segments of the population.

Development of the Russian economy causes the growth of public requirements and structural changes connected with it directed to an increase in the efficiency of social and economic tasks solution. Need of partnership of the state and private business development for the solution of problems in the social and economic sphere predetermines by the insufficiency of opportunities of the public (budgetary) financing of investment projects, large-scale and significant for society. The public-private partnership (PPP) acts as one of the modern economic mechanisms allowing realizing the interaction of the state and business. The PPP, on the one side, represents a special form of influence of state authorities and management for the purpose of stimulation of business activity, and with another, acts as the economic mechanism of the solution of social and economic tasks. The article is devoted to the consideration of the public-private partnership mechanism as one of the most modern methods of economic activity state regulation which basis the basic coordination principle of the parties interests and allowing to combine interests and technologies of business. Need and the prospects of further development of mechanisms of state-private partnership on the basis of the state strategic planning are proved. Special attention is paid to the interrelation of development of public-private partnership and need of theoretical scientific research in the field of improvement of institutional, ensuring its realization. It is shown that the role of the mechanism of public-private partnership in the economy is defined, first of all, by its elements as subjects and objects of public-private partnership, priority spheres of realization. Authors allocate and describe a number of aspects of the mechanism of functioning of public-private partnership, namely: organizational and legal, financial and investment, technical and organizational, regional. In the article, the main problems connected with the development of the mechanism of PPP, including with lack of the description of concrete mechanisms of use of the majority of forms of PPP and lack of regulation of questions of division of powers between public authorities and business are allocated and proved.

The purpose of the study is to assess the socio-historical potential for the formation of the regional recreational complex of the Middle Pridniprovia, identifying the main recreational resources of social origin within the Middle Pridniprovia as the main base for the formation of the regional recreational complex. Methodology. To solve the main problems of the research, analytical, comparative, historical and cartographic research methods were used. Results. In the article features of the socio-historical potential of the Middle Pridniprovia are considered as an important factor in the formation of a regional recreational complex. The overall assessment of socio-historical recreational resources of the region is carried out. Proposals on the main directions of using the existing socio-historical potential and improving the efficiency of its use are developed. Scientific novelty. The purpose of the study is to assess the socio-historical potential for the formation of the regional recreational complex of the Middle Pridniprovia, identifying the main recreational resources of social origin within the Middle Pridniprovia as the main base for the formation of the regional recreational complex. The spatial and territorial characteristics of the placement and general stocks of the main recreational resources of social origin within the Middle Pridniprovia are analyzed. The main characteristics, location and properties of the most promising socio-historical recreational resources, as well as the directions of their use for the organization of recreational activities are considered. The number and structure of historical and cultural monuments of the region are determined according to their value at the state and local level. Practical significance. This research serves as the basis for the study of recreational potential as well as for further substantiation of the creation of a regional recreational complex. In addition, the results of the study can be used in the educational process while training specialists in recreation and tourism.

Aim: The purpose of the article: To analyze the current state of the transport network development, the index of transport communication, the dynamics of the number of users of mobile communication services, on the example of Kyivstar Company in Ivano-Frankivsk region. Determine the role of transport and mobile networks in promoting and enhancing the development of tourism on the basis of multifunctionality, mutual permeability and complementarity of various elements of socio-economic systems. Methods – the study of communicative and its role in the development of tourism on the example of the Ivano-Frankivsk region is based on the combination of methods of sectoral and territorial analysis. In particular, a systematic approach is used for the study using comparative methods, statistical analysis, analytical analysis, etc. This methodology includes an analysis of the conditions and factors of tourism development within the administrative unit of Ukraine based on statistical data of indicators (types of vehicles and connections, number of arrivals / departures of passengers, directions of tourist flows from / to Ivano-Frankivsk region, etc.). Results – the article analyzes the impact of transport and mobile networks on the development of the tourism industry, for example, Ivano-Frankivsk region. The emphasis is placed on the index of transport communicativeness of the Ivano-Frankivsk region. The analysis of migration monitoring with the help of Kyivstar telecommunication operator was carried out, namely: citizens' migration in Ivano-Frankivsk, duration of their stay, geography of their arrivals. In comparison with the statistical indicators of the state of tourism development, external (country) and internal (oblast) donors of tourists are determined. The influence of communicativeness on the current state of the tourism industry is substantiated. Scientific novelty – for the first time, on the basis of sectoral-territorial analysis the state of development of the tourism industry through the prism of transport and mobile networks has been analyzed. The results of the research may form the basis for writing course papers, theses, preparation of lecture-practical material, monitoring of the national tourism market. Practical significance – materials of the publication, conclusions can be used during the educational process, preparing training for the national tourism industry, the practical activities of tour companies, to popularize the western region of Ukraine, on the example of Ivano-Frankivsk region on the external and internal tourist markets.

Goal and objectives. The article analyzes the state policy of Russia and China on poverty alleviation, conducted a comparative analysis of the strategy of the two countries in solving the problem, basic areas, social programs, measures, measures of social support for poor categories of citizens. The general and specific approaches of each. The results achieved are considered, as well as the objectives set by each country in this direction for the near and far term.Methods. The study uses a set of general scientific methods, such as analysis, synthesis, generalization, comparison, system-functional and integrated approach. Within the framework of the stated theme, theoretical provisions and modern approaches were systematic on the basis of the study of the works of various authors, federal and regional regulatory documents, official statistics.Results. The theoretical and practical significance of the study is to specify and organize the modern strategic approaches of the state policy of Russia and China, both in the sphere of poverty alleviation and in the provision of state social assistance to poor categories of citizens. These areas of state social policy of each country are not sufficiently researched by national science. The analysis provides an opportunity to identify the state of poverty in Russia and China, actualizes the importance of state policy to reduce poverty in each country, justifies the need for its further improvement in this direction. The findings highlight the positive results achieved by countries to date and identify the ways that have led to them, which can further promote public social policies to overcome poverty in each country and the system of state social assistance to the poor.Scientific novelty. The scientific novelty lies in the study of the state policy of Russia and China to reduce the poverty level of the population, as one of the most acute problems of both countries. The article shows the characteristics of poverty in each country, the scale and concentration of poverty, the trend of changing poverty in recent years as a result of the efforts of states and new strategies in public social policy. Weaknesses and strengths in the state social policy to overcome poverty in Russia and China have been identified. The lack of effectiveness of the organization of state social assistance to poor categories of citizens is justified. The conclusions are drawn on the versatility of ways to overcome poverty, the need to unite the efforts of all countries in this direction, the fruitfulness of the exchange of experience accumulated by different countries.

The purpose of the article is to substantiate the need for comprehensive legislative, organizational and financial support of the market circulation of agricultural lands, as an important factor in the competitive development of the agricultural complex of Ukraine. Research methodology. In the process of research were used: general and special methods of scientific knowledge - in the system of land relations; logical method - to determine socio-economic trends; systematic approach, observation, specification, analogy - to determine the procedure for assessing and market value of land resources and areas for improvement of land legislation. Results of the research. It is proved that the development of land reform would not lead to the land market and attract investment in the country's economy. The buyers of the land would actually be the tenant farmers, who will never give the highest price. The necessity of revision of methods for determining estimates of normative value of land is substantiated, development of the legislative basis for the control over the vicarious lands. In the process, it has been established that the main buyer of the land is a power as the most powerful owner and manager. The country will try to force the state policy and legislate the base can easily be done with a land asset that will trim the majestic incomes to the budget, and by themselves, will save the skin of the bulk of Ukraine. For all, only the will of the people and the bazhanya of pratsyuvati to the land are needed. For the sake of the transfer of the State Land Bank, the regulation of land management in Ukraine, the development of the national infrastructure of geospatial data, and the unified methodology of the normative penny assessment of lands were transferred. Elements of scientific novelty. A systematic substantiation of the ways of further development of land reform in Ukraine has been obtained. Practical significance. The results of the study can be used in the development of legislation on the land market, regulation of market turnover of agricultural land, deepening research, use in the educational process and in the practice of government agencies and agricultural enterprises.

The urgency of the formation of technological competitiveness of the Ukrainian economy under the current global challenges and threats is substantiated. The analysis of the national institutional and organizational system of state policy of ensuring technological competitiveness of the economy has been carried out. The importance of forming in the country of institutional, organizational and institutional-legal systems of the state policy of ensuring innovation-technological activity and development is pointed out. The condition of the institutional and legal system of the state policy of ensuring technological competitiveness of the Ukrainian economy is revealed. The results of the analysis of the state policy of ensuring the technological competitiveness of the Ukrainian economy by management functions are presented. The paper emphasizes that the following disadvantages of the state policy of ensuring technological competitiveness: by the function of analysis - the lack of a system of complex analysis and evaluation of innovation and technical activity; by function of planning - non-institutionalization of the system of programming and planning of technological competitiveness of economy; by function of organization - non-construction of a complete organizational and institutional system of state regulation of innovative activity; by function of motivation - absence of sufficient customs-tariff and budget-tax stimulation of innovation and technological activity; by the control function - unformed environment of independent institutions for monitoring and control of the state innovation and technological policy. The paper substantiates that technological competitiveness of the economy is formed in stages according to the levels: factor competitive advantages of strategic enterprises, strengthening of competitive positions of clusters, development of "strong" industries, technological competitive advantages of the economy, international competitiveness. The fact that technological competitiveness of each country is based on its own model and does not fit into the universal "ideal" scenario is emphasized.
