Legal and Organizational Barriers of Digitalization of Education in the Russian Federation

The aim of the study is to identify the legal and organizational barriers to digitalization and digital transformation of education in the Russian Federation and to develop proposals for improving the startup planning and legal regulation in this area. The study presents the authors’ method of identifying the barriers. The main feature of this methodology (based on the comparative-law method and structural and functional analysis) is its focus on identifying the legal and organizational barriers to digitalization not only of the educational process itself, but also of the life cycle of the educational organization as a whole. The key legal and organizational barriers to digitalization for education were identifi ed and systematized. It was concluded that there remains a signifi cant number of barriers not only to digitalization, but also to primary informatization in the fi eld. The authors substantiate proposals for improvement of strategic planning and legal regulation, aimed at eliminating the identifi ed barriers and forming of legal conditions for digitalization and, in the long term, the digital transformation of Russian education.

Актуальность темы научной статьи обусловлена тем, что каждый гражданин Российской Федерации независимо от его социального статуса обладает правом на образование. Однако отдельные категории граждан, в частности, осужденные лица, не могут воспользоваться данным правом по причине наличия у них особого юридического статуса. Беспрепятственный доступ осужденных к образовательному процессу оказывает положительное влияние на социальную безопасность и защищенность каждого отдельного гражданина, так как от уровня их образованности напрямую зависит степень их исправления. В данный момент на территории нашей страны наблюдается большая вовлеченность всех слоев населения (включая осужденных) в сферу образовательных услуг как на возмездной, так и на безвозмездной основах. Профессиональное образование и профессиональное обучение как очень важный и необходимый элемент в отечественной пенитенциарной системе регулируется различными источниками права, относящимися и к системе уголовно-исполнительного законодательства, и к системе образовательного законодательства РФ. Целями правового регулирования отношений в сфере образования являются установление государственных гарантий, механизмов реализации прав и свобод человека в указанной сфере, а также защита прав и интересов участников отношений в сфере образования. Problem statement of the scientific article is due to the fact that every citizen of the Russian Federation, regardless of his social status has the right to education. However, some categories of citizens cannot exercise this right due to their special legal status, in particular, we will talk about convicted persons. Unimpeded access of this category of citizens to the educational process has a positive impact on the social safety and security of each individual, since the level of education of convicted persons directly affects the degree of their correction. At the moment on the territory of our country there is a great involvement of all segments of the population (including convicts) to the sphere of educational services free or for a fee. Vocational education and training as a very important and necessary element in the domestic penitentiary system is regulated by various sources of law relating to both the system of penal legislation and the system of educational legislation of the Russian Federation. The objectives of legal regulation of relations in the field of education are the establishment of state guarantees, mechanisms for the implementation of human rights and freedoms in education, as well as the protection of the rights and interests of participants of relations in the educational field.

The article is based on the results of research work of the Financial University under the Government of the Russian Federation “Improving the regulation of labor and the organization of new approaches to the organization of labour processes and the remuneration of certain categories of employees in higher education”, fi nanced by budget funds for State job in 2014. The article analyzes the legal regulation of improving remuneration of support staff , including from the standpoint of personnel management system, assessment of the role and importance of this category of workers working in the educational process; discusses possible approaches to remuneration of support staff to meet the requirements of the legislation of the Russian Federation, including the policy objectives for improving the system of remuneration in the budgetary organizations, as set out in the Order of the Government of the Russian Federation of 26.11.2012, № 2190«On Approval of the gradual improvement of the system wages in the state (municipal) institutions for 2012–2018». The article also provides an analysis of the main problems in the existing institutions of higher education in pay systems, off ers a practical solution for the formation conditions of remuneration of support staff and the positioning of functional processes, which employ this category of personnel in connection with the performance of tasks to ensure the increase the quality of the educational process in the organization of higher education.

The article analyzes the current problems of legal regulation and the application of incentives and penalties for convicts serving sentences of imprisonment. The scientific work contains a historical content analysis of the current systems of measures of incentives and penalties in different periods of the historical development of society and the penal system of the Russian Federation. Based on the conducted empirical research among 20 employees - detachment commanders from 13 regions of Russia, undergoing advanced training the program «Organization of educational work» in the Vologda Institute of Law and Economics of the Federal Penal Service of Russia, the authors of the article prepared a number of recommendations and suggestions for improving the current legislation and its application in this area. The article draws attention to the exclusion of ineffective incentives from the penal legislation of the Russian Federation, in particular, the award of a gift and a cash prize. Proposals were made to expand the list of incentive measures to ensure the differentiation and individualization of the sentence of imprisonment. The authors made proposals to improve the penalties applied to those sentenced to imprisonment: to increase the size of the disciplinary penalty, taking into account inflation, not to include the convicted person in a punishment cell and a single chamber type in the general term of serving a sentence, to add the list of penalties. In addition, the article deals with the problems of recognizing a convict as a malicious violator of the established order of punishment. The results of the study can be used in the educational process in the study of legal disciplines, in the law enforcement practice of employees of the penal system of the Russian Federation, as well as for further research in this area.

In this study, the author considers the main problems of digital modernization concerning enforcement proceedings in the Russian Federation. Generation and further enhancement of the digital space have determined the vector of legal regulation in the implementation of any social processes several years ago. Various aspects of the economic, legal and other spheres of public life were reformed. Changes in various areas of enforcement proceedings occurred in stages, sequentially and in plain consideration with the specific features of legal relationships. However the digital transformation of enforcement proceedings has not yet come to its final stages. Many researchers note the “unavailability” of both legislation and law enforcement procedure for the changes that are taking place as well as to the final establishment of such changes as the basic and fundamental rules of law enforcement. In addition, the existing fragmentary regulation in the process of law enforcement gave rise to many problems. In this article the author attempts to identify the positive and negative experience of digital modernization of Russian law enforcement practice and define suggestions that could improve the process.

The approaches to understanding the concept of ‘economic security of a region’ have been systemized in the article; the terms have been extended due to the introduction of the concept of ‘economic security of a digital infrastructure of a region’, and the modern innovative mechanisms for ensuring the economic security of a region in the context of digital transformation have also been summarized. The most typical threats to economic security for the regions of the Volga Federal District of the Russian Federation in the context of digitalization have been highlighted in the article. The conclusion has been made about the economic security goals of the region, which directly depend on the regional characteristics of the use of digital technologies and the long-term needs of society.

Russia's accession to the Council of Europe and the signing of relevant international agreements contributed to the development of regulations on the rights of a child and branching juvenile law in the Russian legal system. Meanwhile, it should be pointed out that processes of legal regulation in the field of the formation of the legislative basis of juvenile law are in some way incomplete, which is the result of the imperfection of the existing legal acts affecting the rights and interests of minors. The issue of the expediency of creating juvenile justice in Russia is being discussed for a long time in the legal papers and at the legislative level. The provision on the formation of juvenile justice was included in the 1991 Concept of Judicial Reform in the Russian Federation. Later, different authors worked out several draft Laws on Juvenile Justice. At parliamentary hearings in the State Duma, the prospects of creating juvenile courts in the system of courts of general jurisdiction were considered. Meanwhile, such close attention to the indicated problem does not have a significant impact on the increasing child and adolescent crime in the country. The plurality of the above-mentioned legal problems and their multifaceted nature necessitate improvement of justice in relation to minors. This raises a number of theoretical, legal, practical and ethical issues that require studying and adopting relevant decisions at the legislative level. Therefore, studies that allow analyzing the current Russian criminal procedure legislation from the point of view of the possibility of functioning of juvenile justice on its basis relying on international legal standards are really urgent. The criminal procedure legislation in the Russian Federation as a whole is focused on continuous improvement in the context of ensuring the maximum number of procedural guarantees of the legality of criminal proceedings, as well as observance of human rights with the application of their minimum restrictions, including in relation to such category of persons involved in criminal proceedings as minors. In this article, the authors consider the institution of juvenile justice as an additional guarantee of securing the rights of minors in criminal proceedings in Russia, propose the ways to address current and debatable aspects of this problem. The paper analyzes the current criminal procedural legislation, decisions of the Plenums of the Supreme Court of the Russian Federation as well as the judgements of the courts in specific cases concerning the problems of the study. In the study of individual topics of the issue, scientific literature as well as statistical data have been used. The conclusions and proposals made in the work are aimed at improving the current legislation of the Russian Federation and law enforcement practice, and can also be used in the educational process.

The currently ongoing information revolution has become one of the most significant perquisites for the formation of a new legal order — “new realities”, characterized by the formation of “electronic state“. The challenges of this “new reality” make search for science-based solutions ever more topical, including the means and methods and technologies for legal regulation with regard to public relationships. An attempt to look for said mechanisms was undertaken by the participants of the XI International School for young scholars — jurists “Effective law enforcement: doctrine and practice”. It was held at the Institute of Legislation and Comparative law under the Government of the Russian Federation on May 27, 2016. One of the sections of said School was dedicated to “Law enforcement in the light of formation of electronic state“. The article contains summary of the discussions and the outcomes.


The article analyzes the current state and prospects for improving the legal regulation of public administration in the sphere of stimulating the development of information technologies, including formation of a digital economy in the Russian Federation. Based on the analysis of the Russian legislation, key elements of the legal mechanism of public administration in the sphere of stimulating the development and introduction of technologies in various fields that can be used to stimulate the development of information technologies are identified. The analysis of the documents of strategic planning and information legislation made it possible to substantiate a number of proposals for improving the legal regulation in the sphere under consideration, including legislative provisions for stimulating IT development, identifying and eliminating legal and organizational barriers to their development, and measures to stimulate it.
