In this paper the author will discuss the pros and cons of the deliberation process of Law no. 8 of 2016 the hospitality of the nation that caters to people with disabilities, whether it is difficult access to public facilities, being excluded, etc. So that in this paper the author will look at whether the new law rules suit the needs of persons with disabilities, and when this rule is made, whether legislators are involved with people with disabilities in the law-making process, and what are the reasons the legislators change this regulation. . The method used in this paper uses normative law, the data used comes from the results of previous research, news or newspapers, laws. The results of this paper indicate that the making of laws is based on the needs of persons with disabilities. In addition, in the process, many actors, NGOs are involved to see the needs of persons with disabilities.

AbstractVictims of sexual violence against persons with disabilities need legal protection through justice or social care, legislation is one of the references in the process of handling sexual violence because so far women have had difficulty in obtaining justice. With the aim of providing Islamic law in order to realize a better and fairer human life, as well as for the recovery of victims of sexual violence so that it can be accepted in the community and discrimination is not done which can make victims more traumatized. From the research that has been done that many people with disabilities who do not know the legal protection for them to avoid violence, harassment or taking away their rights are often ignored because of physical deficiencies, the positive law lies in the fact that the law is made and can be erased from everything acts that have been done by humans and are independent of the norms themselves.Keywords: legal protection; victims of violenceAbstrakKorban kekerasan seksual pada kaum difabel memerlukan perlindungan hukum baik melalui peradilan ataupun kepedulian sosial, perundang-undangan adalah salah satu rujukan dalam proses penanganan tindak kekerasan seksual karena selama ini perempuan sulit mendapatkan keadilan. Dengan tujuan memberikan penetapan hukum islam agar dapat mewujudkan kehidupan manusia yang lebih baik dan adil, sebagaimana untuk pemulihan pada korban kekerasan seksual agar dapat diterima dimasyarakat dan tidak dilakukannya diskriminasi yang dapat membuat korban menjadi lebih trauma. Dari penelitian yang telah dilakukan bahwa banyak kaum difabel yang belum mengetahui perlindungan hukum kepada mereka agar terhindar dari tindak kekerasan, pelecehan atau pengambilan hak mereka yang seringkali diabaikan karena dengan adanya kekurangan fisik, dalam hukum positif terletak pada fakta bahwa hukum dibuat dan dapat dihapuskan dari segala perbuatan yang telah dilakukan oleh manusia itu dan terlepas dari norma-norma itu sendiri.Kata kunci: korban kekerasan; perlindungan hukum

<p class="AbstractText"><em>People with disabilities</em><em> </em><em>in their lives still experience various</em><em> </em><em>obstacles that come from their environment. The lack of opportunities given to them leads to</em><em> </em><em>limited access in meeting their needs,both as individuals and as part of citizens. As a result, the participation of people with disabilities in the community becomes low so</em><em> </em><em>that it is only considered as a burden and as an object of compensation (charity) so that in the end the creation of social   exclusion in society. Since the state ratified the Convention on The Rights of Person with Disabilities and contained it into Law No. 19 of</em><em> </em><em>2011</em><em> </em><em>it is expected that social awareness about people with disabilities begins to   grow. One of the areas that</em><em> </em><em>also adopted is Jakarta Province through Regulation No. 10 of 2011 on The Protection of Persons with Disabilities.     The number of people with disabilities in Jakarta in 2019 as many as 14,459 people. The high level of mobilization in Jakarta should also be balanced with the fulfillment of accessibility of public facilities for</em><em> </em><em>all its citizens without exception.</em><em> </em><em>The availability of physical infrastructure that is friendly for people with disabilities can improve their capabilities.</em><em> This research aims to see how to fulfill the accessibility of public facilities for people with    disabilities in Jakarta through Regulation No.</em><em> </em><em>10 </em><em>of 2011. Minimnya kesempatan yang diberikan kepada mereka menyebabkan mengalami keterbatasan akses dalam pemenuhan kebutuhannya, baik yang menyangkut sebagai individu maupun sebagai bagian dari warga negara. Akibatnya, partisipasi penyandang disabilitas di tengah masyarakat menjadi rendah sehingga hanya dianggap sebagai beban dan sebagai obyek santunan (<em>charity</em>) sehingga pada akhirnya terciptanya eksklusi sosial dimasyarakat. Sejak negara turut meratifikasi CRPD (<em>Convention on The Rights of Person with Disabilities</em>) dan memuatnya ke dalam Undang-Undang Nomor 19 Tahun 2011 diharapkan <em>social awareness </em>tentang penyandang disabilitas mulai tumbuh. Salah satu daerah yang turut mengadopsi adalah Provinsi DKI Jakarta melalui Perda Nomor 10 Tahun 2011 tentang Perlindungan Penyandang Disabilitas.  Jumlah penyandang disabilitas di DKI Jakarta tahun 2019 sebanyak 14.459 jiwa. Tingginya tingkat mobilisasi di DKI Jakarta sepatutnya turut diimbangi dengan pemenuhan aksesibilitas fasilitas publik bagi semua warganya tanpa terkecuali.  Ketersediaan infrastruktur fisik yang ramah bagi penyandang disabilitas dapat meningkatkan kapabilitasnya. Penelitian ini mempunyai tujuan untuk melihat bagaimana pemenuhan aksesibilitas fasilitas publik bagi penyandang disabilitas di DKI Jakarta melalui Perda Nomor 10 Tahun 2011. Metode penelitian yang dipergunakan adalah deskriptif kualitatif dengan menggunakan teori pelayanan publik inklusif, dan teori aksesibilitas.  Sedangkan pengumpulan datanya melalui observasi, wawancara <em>indepth</em> dan studi kepustakaan. Penelitian menunjukkan bahwa implementasi perda terkait fasilitas publik bagi penyandang disabilitas masih belum optimal. Background: Availability of facilities and infrastructure for public facilities that facilitate accessibility for people with disabilities is very important. The basic thing for increasing the independence of people with disabilities is the availability of adequate public service facilities. One of the supporting facilities to fulfill public facilities is the Batik Solo Trans bus shelter. The purpose of this study is to analyze the accessibility of people with disabilities in assessing the assistance of Trans Solo Batik buses in Surakarta City. Method: This type of research is explorative qualitative research. Methods of interviewing, observation, and documentation. Data is obtained through interviews with persons with physical and mental disabilities. The data analysis technique uses the triangulation method. Results: Persons with disabilities are still experiencing difficulties in accessing due to architectural barriers. Design shelter still does not meet established accessibility standards. Conclusion: Shelter Solo Trans Batik buses in Surakarta City are not accessible for people with disabilities. The limited accessibility for people with disabilities requires further study in a design that is in accordance with the principles of ergonomics and accessibility in order to accommodate the public interest in general and people with disabilities in particular.

Person with disabilities who are referred to as disabled people, are often regarded as unproductive citizens, unable to carry out their duties and responsibilities so that their rights are ignored. About 15 percent of the world's population are people with disabilities - more than one billion people. They are considered the largest minority group in the world. Persons with disabilities are often excluded from education, vocational training and employment opportunities. In reality, there are not many public facilities or special services provided to persons with disabilities. One of them is in the aspect of education. In public facilities, namely education, there are not many education buildings or educational providers that have facilities and infrastructure that can support people with disabilities. As for mobility equipment that can help people with disabilities on both legs, namely crutches, walking sticks, walkers, and wheelchairs that aim to help and facilitate their mobility. But the wheelchair that is available in the market today only has a limited function of moving left, right, and spinning, the function can not be maximized to help the movement of persons with disabilities there are some activities that cannot be done such as reaching higher objects, moving the body from a wheelchair to another seat, through the stairs / steps. Therefore we need a product design that starts from the preparation of product concepts from old products that will be modified into a new product to meet the needs of the market / people with disabilities.

Convention on the Rights of Persons with Disabilities (CRPD) has been signed by Malaysian Government on 8 April 2008. It shows the desire and commitment of the Government of Malaysia to give recognition to the rights of People with Disabilities. The aim of this article is to review the rights to work for Persons with Disabilities under the Federal Constitution and Person with Disabilities Act 2008 in Malaysia. This study will use Legal studies as research methodology and it involved two types of method which is doctrine study of the law and socio-legal studies. The studies showed that the rights to work for PWDs in Malaysia stated as generally in the Federal Constitution and the rights has been detailed in Person With Disabilities Act 2008. The existence of the right to work exclusively under the Person With Disabilities Act 2008 makes those rights not only for normal people but it is also owned by the PWDs. However, the existence of legislation alone is not enough if followed by enforcement. Thus, the improvement in the law and its implementation should be further strengthened through several proposals suggested by this article. It is to ensure the rights of the PWDs to get the job be given serious attention by the community in line with the original purpose of Persons with Disabilities Act 2008 being created.

Disability is a condition experienced by a person with various kinds of physical limitations. The thing of unfair is a sensitive part for people with disabilities, starting from discrimination, less of support, community stigma, and many inadequate access for people with disabilities. Therefore, the identification of problems in this study discusses the legal umbrella for persons with disabilities as well as support and accessibility to sustainable social development. This study uses descriptive analytical methods to explain the existing situation by using a normative juridical approach to identify and examine the law. The result is there are still many discriminatory attitudes towards persons with disabilities, such as from education access that is not yet the totality of persons with disabilities, then economic access for people with disabilities is less considered, then in health access that is still not fulfilled, especially health against physical disabilities, and less education of political access access for people with disabilities.Kata Kunci: payung hukum disabilitas, dukungan, aksesibilitas, pembangunan sosial.

Access to Justice for people with disabilities is a term used to describe the legal protection given to persons with disabilities in their efforts to meet their needs from things that can endanger persons with disabilities themselves.The right to obtain employment including for workers with disabilities is regulated in the Indonesian state constitution. Therefore, these rights are protected and guaranteed by law, so companies that employ persons with disabilities in particular must protect the rights of persons with disabilities.The method used in this study is this research is a type of normative law research using normative legal case studies in the form of legal behavior products. Persons with disabilities must receive the support needed in the structure of education, health, employment and social services, so that the rights of persons with disabilities are in the perspective of human rights. Normatively, there are actually several legal instruments that have been born to protect the rights of persons with disabilities to work. Law No. 13 of 2003 concerning Employment which forbids discrimination to persons with disabilities The right of persons with disabilities to obtain accessibility contained in Article 18 of Law No.8 / 2016 concerning Persons with Disabilities, namely, obtaining accessibility to utilize public facilities and obtain adequate accommodation as a form of accessibility for individuals.

Accessibility is a form of sympathy and empathy to provide convenience to persons with disabilities by providing friendly public facilities. This study aims to explain how the physical facilities provided by the Pesantren Institute Mathali'ul Falah (IPMAFA) Pati in accommodating people with disabilities in learning and the application of religious fiqh with disabilities. This research is focused on physical facilities in the form of stairs, ramps, doors, classrooms, chairs, tables, laboratories, libraries, toilets, showers, and mosques. This research is qualitative research with descriptive analysis, data collection using observation, interviews, and documentation. Data analysis was carried out by comparing the results of field data with the standards for accessibility of public facilities set by the Ministry of Public Works and disability fiqh. From the results of this study, it was found that IPMAFA had prepared friendly facilities for persons with disabilities however accessibility of facilities is not yet fully adequate and disability-friendly for disabled people who use canes, crutches, and wheelchairs. Facilities that are classified as disability-friendly include stairs, doors, classrooms, tables and chairs, libraries, and laboratories. In the disability fiqh review, the accessibility of taharah, wudhu, and prayer facilities at the IPMAFA is not yet suitable for people with disabilities, whether users of sticks, crutches, or wheelchairs. The results of this study can be a reference for the IPMAFA campus in realizing a disability-friendly campus.

The recruitment of civil servant for persons with disabilities by the Provincial Government of South Kalimantan is one of the manifestations of Law No. 8 of 2016 concerning Persons with Disabilities. The law changes the paradigm that makes persons with disabilities as dignified humans who have the same rights as other citizens, including the right to decent work. Affirmation policies have been given to persons with disabilities, but in practice, there are still people with disabilities who feel discriminated against. This condition needs to be evaluated. The purpose of this study is to describe the implementation of civil servant recruitment for persons with disabilities and its compliance with existing policies and also to formulate a policy strategy for the next recruitment. The implementation of civil servant recruitment in 2018 is generally carried out well, except that there are problems with the recruitment of CPNS for persons with disabilities that are not fully in accordance with the policy of respecting, protecting, and fulfilling the rights of persons with disabilities. There are several strategies for implementing civil servant recruitment for persons with disabilities, there are: 1) Conducting equal perceptions between central government, regional government, and other related parties, 2) Building positive concepts for persons with disabilities, 3) Providing greater opportunities for persons with disabilities to become civil servant, 4) Arrange the formation of persons with disabilities based on regional needs and persons with disabilities, 5) Conduct planning of implementation of civil servant recruitment for persons with disabilities by involving the community of persons with disabilities and related parties, 6) Optimizing services for persons with disabilities.  Keywords: Evaluation, Civil Servant Recruitment, People with Disabilities ABSTRAK Pelaksanaan penerimaan CPNS bagi penyandang disabilitas oleh Pemerintah Provinsi Kalimantan Selatan merupakan salah satu perwujudan dari Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas. Undang-Undang tersebut merubah paradigma yang menjadikan penyandang disabilitas sebagai manusia yang bermartabat yang memiliki hak yang sama dengan warga negara lainnya, salah satunya hak mendapatkan pekerjaan yang layak. Kebijakan afirmasi telah diberikan kepada penyandang disabilitas, tetapi dalam pelaksanaannya masih ada penyandang disabilitas yang merasakan diskriminasi. Kondisi tersebut melatarbelakangi perlunya evaluasi pelaksanaan penerimaan CPNS bagi penyandang disabilitas. Tujuan dari penelitian ini adalah untuk menggambarkan pelaksanaan penerimaan CPNS bagi penyandang disabilitas dan kesesuaiannya dengan kebijakan yang telah ada, serta merumuskan strategi kebijakan pelaksanaan penerimaan CPNS bagi penyandang disabilitas pada kesempatan berikutnya. Pelaksanaan penerimaan CPNS tahun 2018 pada umumnya terlaksana dengan baik, hanya saja terdapat permasalahan penerimaan CPNS bagi penyandang disabilitas yang belum sepenuhnya sesuai dengan kebijakan penghormatan, perlindungan, dan pemenuhan hak penyandang disabilitas, diantaranya penyandang disabilitas tidak dapat melamar pada formasi umum dan formasi khusus yang disediakan tidak sesuai dengan latar belakang pendidikan yang disediakan untuk penyandang disabilitas. Terdapat beberapa strategi pelaksanaan penerimaan CPNS bagi penyandang disabilitas, diantaranya: 1) Melakukan penyamaan persepsi antar pemerintah pusat, pemerintah daerah dan pihak terkait lainnya, 2) Menyusun formasi penyandang disabilitas berdasarkan kebutuhan daerah dan penyandang disabilitas, 3) Mengoptimalkan pelayanan bagi penyandang disabilitas.
