Cultural diplomacy: symbiosis of cultural and legal potential

Problem setting. The study of the potential of cultural diplomacy has been growing rapidly in recent times. This is due to the realization of the failures of traditional and «force» diplomacy, which often demonstrate the inability to ensure the successful solution of important international problems. Researchers note the need to use cultural diplomacy to intensify and increase the effectiveness of international cooperation. Target of research. Understanding the actualization of cultural diplomacy of Ukraine in the modern world, an attempt to analyze its legal basis. Analysis of resent researches and publications. The concep «cultural diplomacy» is more common in scientific discourse. Scientists such as D. Vedeneev, V. Kostrov, T. Peresunko, N. Musienko, V. Tsyvaty, M. Kulinich, O. Rozumna, and others have contributed to the development of the role of cultural diplomacy in the foreign policy vector of the Ukraine. Political science works predominate among the researches. Few works analyze the legal aspects of cultural diplomacy. Article’s main body. In the context of globalization there is a loss of national origins. Therefore, states must use all their potential to preserve and enhance their own and the world’s cultural heritage, mutual understanding and support of interethnic harmony. International legal thought defines the concept of «diplomacy» in different ways, sometimes identifying it with international law or foreign policy. However, diplomacy is one of the most important tools of foreign policy, along with its components such as the armed forces, intelligence, economic ties, and so on. Cultural diplomacy is a type of diplomacy that uses the country’s cultural heritage as a means to an end. The role of cultural potential in international relations is highly valued. It is cultural diplomacy, not the use of force to impose political, ideological ideas, which aims to unite countries. Ukraine is returning to the active use of cultural diplomacy tools in the XXI century, when there was an urgent need for broad international support for the implementation of ambitious European integration plans. The system of coordination, stimulation and organization of cultural activities at the international level allows identifying the tasks of cultural diplomacy of Ukraine. Ukrainian cultural diplomacy based on international legal instruments ratified by Ukraine and acts of national legislation. The analysis of the problem allows determining the urgent task of creating a favorable legislative framework for the maximum effectiveness of cultural diplomacy. Conclusions and prospects for the development. The filling of legal gaps in cultural diplomacy should take place in the vector of recognition of culture as a subject of foreign policy, awareness of its reputational and social potential. Ukraine faces the task of updating old and finding new cultural images and symbols to create a decent image of the country, as well as to create an appropriate legal framework for the effective implementation of the tasks of cultural diplomacy.

The success of a country's foreign policy in the modern world is determined not only by its military and economic power, but also by its success in shaping the strategy of public diplomacy. A positive image abroad is a key element of successful international cooperation. A wide range of public diplomacy tools contribute to the establishment of a high level of trust, partnership, economic, political and humanitarian ties in the world. Target of research. The purpose of the article is to determine the potential of the fashion industry as an important tool of public diplomacy of Ukraine, to promote a positive image of the country based on the study of domestic and world experience. Analysis of resent researches and publications. The problems of public diplomacy are actively considered by the scientific community. At the same time, it is obvious that the domestic scientific opinion lacks work on understanding the experience of using the potential of the fashion industry to implement the tasks of promoting a positive image of the state. Article’s main body. The authors of the article proceed from a broad conceptual understanding of public diplomacy as a complex system of institutions and mechanisms, the task of which is to create an attractive image of the country and to support the foreign policy of the state. An analysis of the definition of public and cultural diplomacy in the domestic scientific discourse has revealed the dominance of the traditional approach: the recognition of cultural diplomacy as a key component of public diplomacy, emphasizing its direct connection with the mechanisms of «soft power». A specific form of cultural expression can be considered fashion - one of the most complex phenomena of modern culture, which allows to emphasize social status and meet aesthetic needs. The versatility of the mod determines its great impact on the world economy, political life of society, and the environment. In the modern world, fashion has become one of the strongest diplomatic tools that combine art, creativity and business. For a long time, the fashion industry in Ukraine was not defined as a separate area of socio-cultural diplomacy. However, recently there has been a tendency to draw more attention to the fashion industry as one of the manifestations of cultural diplomacy, which has the potential to become a successful tool in shaping Ukraine's widespread recognition in the world. Studies of our country's experience in the use of the fashion industry in public diplomacy prove the existence of both extensive experience in this area and the existence of untapped opportunities to achieve greater efficiency. Conclusions and prospects for the development. Ukraine is taking various powerful measures at the institutional level to use the fashion industry as a tool of public diplomacy, but our country is only taking the first steps in this direction. The analysis of this experience allows to recognize it rather successful.

With 2857 km in length, the quiet Danube quietly tells Europe’s history. We only must be aware of its story. Since ancient times it was connected with empires, expansion, and navigation. The Romans fully understood its role, and proceeded accordingly. They made it their border, but used it for transporting goods and military, too. After the Dark Ages, all European affairs have been in one way or another connected and influenced by the Danube. Romania’s modern history was influenced by the evolution of international problems connected to this river. The Moldavia and Wallachia 1859’s unification in a single state – Romania – had lot to do with the Danube and it was involved in London’s interests in the Oriental Question. The paper presents shortly the way the legal framework regarding the Danube was developed, and what was Romania’s role in facilitating navigation on the Danube. The main data which inspired this work – regarding both the political-legal aspects, and the technical solutions used to facilitate navigation on Danube – are based on earlier writings and studies of Romanian thinkers such as Antipa, Baicoianu, Dascovici and Gogeanu. The evolution of these aspects has a direct or an indirect connection with the evolution of political events and the economic development in all European states, but their importance is crucial especially for those countries which are located in the Danube’s basin. The main text regarding the political aspects related to the Danube is the Belgrade Convention, which has been the general framework under which riparian countries come together to collaborate and to solve the technical impediments for navigation, such as those imposed by the building of the Iron Gate System. At the same time, this paper signals the role of education in understanding the Danube’s role for riparian countries, and for their possible evolution in connection with this river.

The article highlights the process of formation of the Korean Department of the Eastern section of the ICCA under the conditions of existence of the buffer state — the Far Eastern Republic. It was to strive for geopolitical compromise in face of the Civil War and the Allied Intervention. The paper discusses conditions for establishment and reasons for further expansion of the Korean section. On the basis of documents from central and regional archives that are being thus introduced into the first scientific use, the contradictions of the national section formation are shown, the positions of the warring parties and the role of Soviet Russia representatives in the settlement of conflicts are highlighted. The conclusion is made about further directions of work with Korean communists. The past provides an opportunity to take a critical look at the events of a century ago, while the opening of the Comintern archives allows the open press to saturate its content with new data. The main body of unpublished documents on the activities of the Communist International is contained in the fond 495 of the Russian State Archive of Socio-Political History, however, information on some aspects may be found in other federal and regional archives. It is no secret that foreign communists played their role in the foreign policy of Soviet Russia, and their help was big. However, the process of bringing them to work in the interests of the RSFSR has not yet been fully studied. Expediency, cost, and consequences of their work may be arguable, but only one conclusion is allowed: this page of national history should not be forgotten, it has to find its researchers. Recently, the study of the activities of departments and sections of the Communist international has not been popular among researchers either. The notions of ideological work have fallen by the wayside, pushed away by the Soviet past of the Comintern departments and sections. However, in our view, some aspects of the activities of divisions and sections of the Comintern remain relevant.

In today's modern world, creative expression is opening up new dimensions of business and new opportunities for economic development. One field of economic activities in which this is evident is tourism. Creativity in tourist destinations can be viewed in different ways, for example, through creative action (undertaken by destination management, residents, entrepreneurs, and tourists) and through creative spaces and creative events. Creativity plays a vital role in all elements involved in the creation of a destination's offering, regardless of which form of tourism is the focus of development efforts. Given the growing role of self-actualisation of individuals in society and the displaying of social status, creativity has in the past 20 years begun to positively impact on economy activities taking place in tourist destinations. Creativity is especially important in developing cultural tourism in all its sub-types, where it is seen as a means of animating and adding value to cultural heritage locations.

Abstract In recent years the phenomenon of the illicit trafficking in cultural assets has been addressed by international and European lawmakers as an important phenomenon within the complex criminal networks used for the financing of international terrorism. The factors that contribute most to its development include in particular the availability of advanced technologies for plundering archaeological sites and e-commerce, which has sped up trade by breaking down space-time barriers, along also with armed conflict, political instability and poverty. In order to bring about change and put an end to the phenomenon, some significant legislative choices have recently been implemented in the European Union. The aim is to create a regime that is as uniform as possible along with a network of standardised controls capable of intercepting illicit trafficking. The concerns of art market operators surrounding the introduction of new rules and regulations can be appreciated if it is considered that the vibrant lawful market of artworks operates in accordance with tried and tested arrangements. This article will seek to provide an account of the phenomenon in its full complexity, highlighting the most significant recent developments within the European Union. It will also discuss the role of information and digital technologies in the area of cultural heritage. In particular, the existing European legal framework represented by the main legal instruments adopted by the international community and by the European Union will be sketched out, including both civil law and criminal law responses to the illicit trafficking of cultural heritage. Within this context the importance of the issues of traceability within art transactions, which are mostly paper-based, will be investigated along with other related issues such as digital tracking of artworks (digital passports), art security systems and authentication technologies.

Introduction. This article is devoted to the study of the phenomenon of the security within the framework of its understanding in the constitutional legal sphere of national legal science. The need to conduct this study is based on the relevance of the search for promising directions in ensuring the safety of human, society, and the state in a rapidly changing modern world, within the framework of which the main role is assigned to its legal foundations, in which the provisions of the norms of the Constitution of Ukraine play a primary role Purpose and objectives of the study. The main purpose of the article is to consider the concept of security in the framework of the basic legal and constitutional legal category on an analysis of the articles of the Constitution of Ukraine and normative legal aspects (in case of basics of The National Security Act 2018 and The Strategy of the National Security 2020), which enshrine the essence and foundations of ensuring of the security in Ukraine, and also presents the main doctrinal approaches to defining security in the framework of constitutional and legal researches. Research methods. The research carried out in the article is based on the assessment of generally accepted approaches to defining the characteristic features of security as a phenomenon of public relations, assessing the main challenges and threats to the existence of a human, society, and the state in Ukraine at the present stage of their development, analyzing the legal framework for ensuring of security in Ukraine, as well as understanding of security as a constitutional legal category. Research conclusions. As a result of the study, the idea is given that security is a complex and multi-vector category, the nature of which depends on the definition of the scope of its implementation and provision. The legal component is the basis for ensuring of national security as the main way to ensure the security of a human, society, state in Ukraine, which is implemented within the framework of the provisions of the Constitution of Ukraine and special legislation. As part of the study of constitutional and legal approaches to defining national security as a broad category, it is necessary to single out its special component subspecies - constitutional security, which serves as the basis for the protection and stability of the development of constitutional legal institutions and constitutionalism in Ukraine.

We examine the problems that occupied the main place in Austria’s foreign policy in the mid-1950s of 20th century and characterized its role in international relations during the specified period. The role of Austria in the international arena has increased the country’s entry into the path of neutrality. It also opened up wide opportunities for it to participate in the activities of vari-ous international organizations extensively. Using the method of source analysis, the active partic-ipation of Austria in the work of the UN is considered, its authority and support for the sufficient work of this organization, which allowed it to be elected for three years as a member of the main body of the UN – a member of the Economic and Social Council in 1963 and 1976, in 1973 and 1974 – a member of the UN security, and in 1972 it became a permanent member of the UN Security Council. According to Austria’s first statement to the Security Council, the country planned to provide the widest possible extent of its impartial services to the UN’s main political body, using the wide opportunities given to it by its independence and neutrality. Having analyzed the main directions and aspects of Austrian foreign policy in the second half of the twentieth century, we conclude that, having adopted a justified course in foreign policy in 1955, based on permanent neutrality, the Second Austrian Republic further has provided the guarantee and basis of its independence.

Formulation of the problem. Today, the EU faces new challenges due to the globalization policy pursued by most EU member states, migration and the global pandemic - COVID-19. In the new conditions, the protection of human rights acquires a fundamentally new meaning. Therefore, the question of the role of the EU Ombudsman in the process of protection of individual rights and control over the activities of bodies is very relevant. By choosing the path of European integration and committing itself under the Association Agreement to adapt a number of areas in line with the acquis communautaire, Ukraine should also focus on the experience of the European Ombudsman. Since taking office as the Ukrainian Parliamentary Commissioner for Human Rights in 1998, it will not be an exaggeration to state that there are a number of problems in overseeing the proper activities of the authorities in respecting human and civil rights and freedoms. That is why, given the shortcomings and the chosen vector of development, the experience of the European Ombudsman is of great importance for Ukraine in order to improve the activities of the Ukrainian Parliament’s Commissioner for Human Rights. Target of research is to examine the role of the EU Ombudsman in the process of investigating good governance in the EU institutional mechanism. Article’s main body. The article is devoted to the study of the legal status of the European Ombudsman as a body that must investigate improper bodies of the activities of institutions, agencies to ensure the restoration of violated rights guaranteed by the Charter of Fundamental Rights of the European Union. The analysis of the practice of the European Ombudsman in the official annual reports, as well as the development strategy is carried out. With the help of EU legislation research and conducting of the legal analysis of the Ombudsman’s annual reports, strategic development documents and enquiries, opened by the Ombudsman in the last decade, the complexity of the European ombudsman’s contribution to the implementation of the sustainable development principle within EU’s supranational legal framework. Conclusions. After analyzing the development of Ombudsman’s legal status and the results of his enquiries, conducted in the last decade, a conclusion has been made, that the European ombudsman considerably influences all the institutional system of the EU. His initiatives have far-reaching consequences which might have caused their effect on the whole legal framework of the EU, in case if the European ombudsman had been given some more legal powers. Though, having only recommendation mechanisms in possession, this body influences the governing system of the EU largely, causing positive changes, meeting the leading principles of the functioning of the EU.

Military revolutions are a normal consequence of the central role of military institutions in complex societies. They have everywhere occurred regularly, if infrequently; they are scarcely limited to Western Europe, or even to the modern world. This essay discusses recent writings on two military revolutions in the ancient world, both centered on the military horse: first, its domestication and its role in pulling war chariots; second, the transition from horse driving to horse riding in battle. The chariot revolution of the second millennium BC profoundly reshaped warfare and transformed polities all across Eurasia. The cavalry revolution of the first millennium BC proved equally transformative and far longer lasting. Despite the controversy that has come to surround the concept of military revolution, it may still be fruitfully applied to important aspects of the large-scale historical interactions between societies and their armed forces.
