Indonesia is a country of law, and one of the characteristics of a state of law is the guarantee and protection of human rights, one of which is the right to obtain information, including the legal information that is information about the legislation both national and local. The principle of fiction (fictie) law states that any person considered to determine the existence of a legislation after its enactment, the ignorance of the people on the legislation, can not be excused. To that end, legislation information should be easily accessible. Issuance of Presidential Decree No. 33 of 2012 on Information and Documentation Network of National Law (JDIHN) isin order to fulfill the right to obtain legal information, especially information legislation. Management of Legal Documentation and Information Network by utilizing information and communication technology (ICT) makes legal information can be accessed quickly, easily, complete and accurate, thereby supporting the fulfillment of human rights, namely the right to obtain legal information properly.Keywords: Documentation and Legal Information Network, Efforts, Fulfillment, Human Rights

Zakat is a number of assets that must be issued by Muslims to be given to groups who have the right to receive, such as the poor and the like, according to those stipulated by sharia. The law of zakat is obligatory for every Muslim who has fulfilled certain conditions. The National Zakat Amil Agency (BAZNAS) is the official body and the only one formed by the government based on RI Presidential Decree No. 8 of 2001 which has duties and functions to collect and distribute zakat, infaq, and alms. The purpose of making this research is to build an android application for GIS zakat assistance map (BAZNAS) in probolinggo district. This study uses data collection methods used in this study through observation, which is collecting data obtained from existing documents or stored records, both in the form of transcript notes, books, newspapers, plunging directly to the location to take pictures, and so on. Output targets of this study are in the form of an application for collecting data on zakat assistance from an Android-based Baznas office and will be published in non-accredited national journals. The application can be used by someone who wants to send donations via Smartphone easily. As well as the results of this application, it can map the locations of recipients of Zakat and Donors according to the coordinates of points of different colors. With the application, it can help channeling Zakat in Probolinggo district. Keywords: Zakat, Baznas, Android, GIS

This study compares three formal criminal laws on the corruption act to show the importance of due process model for wiretapping/lawful interception in Indonesia. Investigators of Indonesian Corruption Eradication Commission (KPK) assume that the implementation of wiretapping based on the due process model decelerate the performance and independence of corruption eradication. The problem particularly happens on the execution of caught in the act operation. This study covers the design of wiretapping on corruption case linked with the due process model as an effort to guarantee the right of privacy. Firstly, legislators accentuated an effective corruption eradication, which highlights the implementation of the crime control model. Secondly, the latest amendment to the Law on Corruption Eradication Commission of Indonesia alters wiretapping to become a procedural activity for stronger synergy among the law enforcement institutions. The regulation of wiretapping as a method to reveal corruption case in Indonesia does not adhere to the due process model entirely. The wiretapping still tends to deal with stages of preliminary-investigation, investigation, prosecution, and the execution of internal approval process.

The World Health Organization (WHO) defines the 2019-nCoV type of corona virus as a pandemic of a new type of disease spread throughout the world, this is not only a public health case, but will touch every sector. The COVID-19 (cov-19) pandemic has resulted in an emergency for the healthy condition of the Indonesian people, so President Joko Widodo has issued Presidential Decree No. 11/2020. In "procuring vaccines and implementing vaccinations for the prevention of the COVID-19 pandemic" President Joko Widodo stipulates Presidential Decree No. 14/2021. In choosing health facilities and infrastructure independently & responsibly, every human being has the right to choose according to his wishes, due to the pandemic conditions that concern the interests of the people and the state, so giving vaccinations is actually voluntary because emergency conditions can be forced. Although there is already a legal umbrella for Law No. 4/1984: "Infectious Disease Outbreaks" and Law No. 6/2018: "Health Quarantine", many in the field agree and vice versa on the implementation of vaccination in the community. The purpose of the study is to understand the nature of the administration of the corona vaccine according to the laws and regulations adopted and the factors that occur in society. Using a normative method with a qualitative approach. Giving vaccines to the community is forced. limited availability of vaccines; there are those who support there are those who are antipathy from the community regarding the implementation of vaccination; uneven distribution. The reason for the community's refusal to receive the Covid-19 vaccine is due to different trusts, this is supported by the lack of communication channels as well as the delivery of information that is not well targeted, the data on the type of vaccine is limited in information, the availability of the Covid-19 vaccine, as well as safe conditions. The government should fully support the Nusantara vaccine and the Merah Putih vaccine developed by Indonesian researchers. World Health Organizatioan (WHO) mendefinisikan Virus corona jenis Virus 2019-nCoV sebagai pandemi jenis penyebaran penyakit baru keseluruh dunia, hal ini bukan hanya kasus kesehatan masyarakat, tapi akan menyentuh setiap sektor. Pandemi covid-19(cov-19) mengakibatkan kedaruratan kondisi sehat khalayak Indonesia, sehingga Presiden Joko Widodo menetapkan KeppresNo.11/2020. Dalam “pengadaan vaksin dan pelaksanaan vaksinasi untuk penanggulangan pandemi covid-19” Presiden Joko widodo menetapkan Perpres No.14/2021. Dalam memilih sarana juga prasarana kesehatan secara mandiri & bertangggungjawab tiap manusia punya hak memilih sesuai dengan keinginannya, berhubung kondisi pandemi yang menyangkut kepentingan rakyat dan negara lebih diutamakan, jadi pemberian vaksinasi yang sebenaranya bersifat volunteer karena kondisi darurat bisa bersifat dipaksakan. Meskipun sudah ada payung hukum UU No.4/1984:”Wabah Penyakit Menular” serta UU No.6/2018:“Kekarantinaan Kesehatan”, tapi dilapangan banyak yang setuju dan sebaliknya pada pelaksanaan vaksinasi dimasyarakat. Tujuan penelitian untuk memahami sifat dari pemberian vaksin corona menurut peraturan perundangan yang dianut dan faktor- faktor yang terjadi di masyarakat.  Memakai metode normatif dengan pendekatan kualitatif. Pemberian vaksin kepada masyarakat bersifat memaksa. keterbatasan ketersedian vaksin; ada yang mendukung ada yang antipati dari masyarakat terkait pelaksanaan vaksinasi; penyaluran yang tidak merata. Alasan penolakan masyarakat dalam menerima vaksin Covid-19 dikarenakan adanya trust yang berbeda,  hal ini didukung kurangnya alur komunikasi juga cara penyampaian informasi yang kurang tepat sasaran, data jenis vaksin terbatas informasinya, ketersediaan vaksinCov-19, juga syarat aman. Pemerintah selayaknya mendukung penuh vaksin Nusantara dan vaksin Merah Putih  yang dikembangkan para peneliti Indonesia.

Abstract: This study analyzes the thoughts of Abdullahi Ahmed an-Na'im in Islamic law reform, Abdullahi Ahmed an-Na'im, a Sudanese intellectual figure. The objective of this study is for discovering Naskh's thinking conceptually, as an object for Islamic law studies. This critical study emphasizes that it is a need to review the naskh principle, for an-Na'im, which lies in the requirement to treat the texts in the Quran relevantly to fillenough Islamic law reform in a modern context. By comprehending the naskh verses in the Koran as a form of delaying their implementation to the right time, He uses logic or paradigm reversed from the conventional naskh principles, by re-streamlining the principles of Islamic teachings contained in the verses in the Mecca phase, which in conventional naskh theory have stated by the Madaniyyah verses that came down later. For him, reversing the naskh process is an evolutionary principle of interpretation. The methods used are descriptive, hermeneutic, and phenomenological methods. In practical terms, his naskh thinking which is aimed at revitalizing the interpretation of Islamic teachings in the context of the modern world can be useful for its application for the benefits of the ummah in the renewal of Islamic law in Islamic legal reform.Keywords: reform, Islamic law, critical, Abdullahi Ahmed Na'in Abstrak: Kajian ini menganalisis pemikiran Abdullahi Ahmed an­-Na'im dalam reformasi hukum Islam, Abdullahi Ahmed an-Na’im adalah salah seorang tokoh intelektual Sudan. Arah tujuan dalam kajian ini diarahkan untuk menguak pemikiran naskh secara konseptual, sebuah objek kajian yang diletakkan sebagai bagian dari kajian studi hukum Islam dalam pembahruan. Studi kritis ini menegaskan bahwa perlunya peninjauan kembali prinsip naskh, bagi an-Na'im yang terletak pada keharusan untuk memperlakukan teks-teks al-Quran secara relevan demi mewujudkan pembaruan hukum Islam yang memadai dalam konteks modern. Dengan memahami naskh ayat-ayat dalam al­-Quran sebagai suatu bentuk penundaan pelaksanaannya hingga waktu yang tepat, ia menggunakan logika atau paradigma terbalik dari prinsip naskh konvensional, yaitu dengan mengefektifkan kembali prinsip-prinsip ajaran Islam yang terdapat pada ayat-ayat fase Makkah, yang dalam teori naskh konvensional dinyatakan telah oleh ayat­-ayat Madaniyyah yang turun belakangan. Baginya, membalikkan proses naskh merupakan prinsip interpretasi yang evolusioner. Metode yang digunakan metode deskriptif, hermeneutika, dan fenomenologi. Secara praktis, bahwa pemikiran naskhnya yang ditujukan untuk merelevansikan penafsiran ajaran Islam dalam konteks dunia modem, dapat berguna penerapannya bagi kebaikan dan kemaslahatan umat dalam pembaharuan hukum Islam dalam reformasi hukum Islam.Kata kunci: reformasi, hukum Islam, kritis, Abdullahi Ahmed Na'in

<p><strong>DESAPROPRIAÇÃO INDIRETA POR INSTITUIÇÃO DE ÁREAS AMBIENTAIS: UM ESTUDO CRÍTICO À LUZ DA TESE DOS DIREITOS DE RONALD DWORKIN </strong></p><p><strong>Resumo:</strong> Esta pesquisa pretende uma abordagem crítica a respeito da desapropriação indireta por instituição de áreas ambientais. Para tanto, tecerá, ab initio, considerações a respeito do direito de propriedade e de sua função social. A seguir, expõe, em linhas gerais, o tratamento dispensado à desapropriação na ordem jurídica brasileira. Após, reduz o campo de abordagem à questão da desapropriação indireta e adentra ao problema da desapropriação indireta por instituição de áreas ambientais. Rememora, de modo sucinto, a tese dos direitos de Ronald Dworkin (2000, 2002), e analisa sua pertinência para o enfrentamento do problema da desapropriação. Visa ensaiar uma proposta consistente de tratamento da matéria da desapropriação indireta por instituição de áreas ambientais. Possui como atitude epistemológica a fenomenologia hermenêutica de Martin Heidegger (2012). Em sentido estrito, partilha do pluralismo metódico, que se unifica no seio da fenomenologia da percepção de Merleau-Ponty, tal como observa Maman (2003). Assume, como orientação filosófica básica, a pesquisa crítica e, como técnica, a pesquisa bibliográfica e documental.</p><p><strong>Palavras-chaves:</strong> expropriação ilegítima; meio ambiente; jurisprudência; trunfos; utilitarismo.</p><p><strong>EXPROPRIATION INDIRECTLY IN ENVIRONMENTAL AREAS INSTITUTION: A CRITICAL STUDY IN THE LIGHT OF THE RIGHTS THESIS OF RONALD DWORKIN </strong></p><p><strong>Abstract:</strong> This research aims a critical approach regarding indirect expropriation by establishing environmental areas. The Indonesian National Police (POLRI) deals with the rapid development of transnational crimes penetrating into legal business and the governmental body of the country. The community of global security works together to address this issue through international policing. International Policing is police practices involving multinational citizens or jurisdictions (Deflem, 2007, pp. 701-705). The dynamics of International Policing in POLRI are implemented through the mechanism of international treaties, international operations, international missions, capacity building, exchange of information and technology and benchmarking. The study of international policing examines various phenomena, understandings, dynamics and policing models in America, Europe, Asia and other parts of the world. This study tries to explain international policing by not merely emphasizing interaction between agencies, but also considering the dynamics of interaction between organizations (structures). Therefore, the contribution of Anthony Giddens in the theory of structuration will be crucial in understanding this phenomenon. The theoretical framework by Giddens certainly contains weaknesses, namely the inability to explain the strategies of power, in terms of strategies in language usage, differentiation and forms of symbolic violence. Thus, it needs to be enhanced by the theory of Genetic Structuralism by Bourdieu to explain the various factors helping in strengthening structures such as political policies (the Presidential Decree and the Regulation of Chief of Police) as well as agencies and structures of police. The study throughout 2014 to 2017 explains system continuity (duality), not a dualistic system change, in which agents keep their distance from structures. The method applied in this study is the paradigm of constructivism-criticism through indepth-interview, document study, and Focus Group Discussion (FGD).

The present study aims to offer a review of measures taken by the Romanian authorities in the field of audiovisual media regulation during the state of emergency instituted in March 2020 following the COVID-19 outbreak. The legal framework has been adjusted, drawing both from extant norms, such as the 2003 Constitution of Romania, and from newly adapted legal norms such as the Presidential Decree declaring the state of emergency. Also, the competent authorities have been invested with additional powers, this being the case of the National Audiovisual Council and the National Authority for Management and Regulation in Communications. These institutions have faced multiple challenges regarding the clash between freedom of opinion and freedom of speech and the right to correct information of the public and the campaigns to counter misinformation.
