THE ROLE OF THE INTELLIGENTSIA IN THE FORMATION OF CIVIL SOCIETY

The current state of civil society in Ukraine is analysed. It is shown that in comparison with the countries of developed democracies, the civil society in Ukraine is weak, unconsolidated, such that it is solely in the process of its formation. It is expressed ones opinion that the intelligentsia is able to unite society and achieve civil harmony in it.The worldview and methodological substantiation of the author's position is post-classical rationality, which, overcoming the subject-object rupture, forms a new idea of the essential forces and functions of the intelligentsia. It turns out that the intelligentsia embodies the best qualities of society, is present in all its spheres and practices, acts as its special unifying and transforming force. It is concluded that the intelligentsia in society plays a unifying role, produces basic values common to all, builds an orderly system of relations at the horizontal level between different social groups and between the power vertical and its institutions and civil society, performs the educational and human role is necessary to build civil society.

КОМПЛЕКСНИЙ АНАЛІЗ СТАЛОГО РОЗВИТКУ ПІДПРИЄМСТВ НА ОСНОВІ ІНТЕГРОВАНОЇ ЗВІТНОСТІ

Intensification of globalization processes and dynamic conditions of enterprises, increased demands of investors, stakeholders and other stakeholders necessitate the formation of analytical information about the effectiveness of economic, social and environmental activities and creating value for the future. The purpose of the article is disclosure of methodical basis of the comprehensive analysis of sustainable development of the enterprises based on integrated reporting The subject of the research is a set of theoretical, methodological and practical aspects of analytical support of integrated reporting of enterprises. Methods used in the research: general scientific and special methods of the research: dialectical method of knowing the essence of analytical support of integrated ability; integrated approach, methods of concretization, abstraction - the basis of disclosure of models analysis of indicators of integrated reporting; induction and deduction (knowledge of the features of the analysis of the effectiveness of social and environmental activities); analogies - for the formation of analytical tools. The main hypothesis of research is suggestion that a comprehensive analysis of sustainable development of enterprises should be aimed at generating information to assess the effectiveness of activities in the triune dimension (economic, social and environmental) in order to meet the informational needs of various stakeholders. The statement of basic materials. The basis for the development of conceptual and methodological basis of a comprehensive analysis of sustainable development of enterprises is the concept of capital, value and sustainable development, expansion of the subject area and system of indicators that characterize effectiveness and allow to assess sustainable development. In order to improve the information and organizational structure of analysis of integrated reporting, new approaches to the analysis of analytical procedures are proposed on the basis of an orderly system of indicators that determine the effectiveness of economic, social and environmental activities. The suitability of the proposed system of indicators is demonstrated on the basis of assessments of the analysis of the current state of efficiency of social activities of agricultural enterprises. Practical significance of the research is the possibility of application of provided scientific and methodological recommendations for improving the methodological approach to a comprehensive analysis of sustainable development of enterprises, which provides a system of indicators by three blocks of analysis the effectiveness of economic, social and environmental activities. Conclusions of research. The proposed approach to a comprehensive analysis of sustainable development of enterprises, in contrast to existing ones, differs in an orderly system of indicators in terms of analyzing the effectiveness of social activities and assessing the impact of key social factors on value added which will provide complete, reliable information about sustainable development of enterprises

Strategic objectives of international and legal regulation of companies constructing power facilities in foreign countries

The article is considered with strategic objectives of regulating activities of Russian companies abroad. It is emphasized that the construction of Russian facilities in the energy sector abroad is a significant area of attraction for a whole range of geopolitical and economic interests of both our country and other countries interested in cooperation with Russia. The issue of preventing cross-border threats from the construction of such facilities, creating a common legal platform for countries, ensuring an orderly system of the international legal framework for investment activities is considered. The conclusion is made about a kind of “renaissance of protectionism” and a certain “rollback” in the development of liberal international trade and global energy. It is concluded that today energy security of entire regions of the planet and individual countries is becoming a hostage to geopolitical competition, as a result of which obstacles and risks arise for the implementation of large energy projects. Meanwhile, energy security becomes one of the dominant strategic objectives ensuring the sustainable development of mankind in the context of rapid economic development and climate instability on the planet.

Perlindungan Hukum Bagi Pembeli Yang Beritikad Baik Terhadap Akta Jual Beli Hak Atas Tanah Yang Tidak Sesuai Dengan Tata Cara Pembuatannya

The growing of importance meaning of the land to human life today may causes increase of the potential for conflicts or land disputes, to prevent or at least to reduce the potential for conflict or dispute are required legal and orderly system of land administration. Therefore isrequired to transfer land rights to be registered must be proven by deed of PPAT. As authentic documents PPAT deed must meet procedures for making the deed of PPAT as determined by the laws and other rules. Making the deed that is incompatible with how making PPAT deed may pose a risk to the certainty of land rights arising or recorded on the basis of such deed. Based on this background the authors give the title of this thesis, The Legal Consequences of Making the Deed of Sale and Purchase of Land That is Incompatible With PPAT Deed Making Procedures. The aim of this study is to determine the forms, causes and legal consequences of making the deed of sale and purchase of land not in accordance with the procedure making the deed of PPAT. Precriptive specification research in juridical normative law method is used. The data source that is used are primary and secondary data. The data is collected by analyzing law expert theories and also library research that are related.The method of juridical approach used is empirical research with prescriptive specifications and data sources used are primary andsecondary data. Collecting data is done by doing library research and field study and then after the data were analyzed conclusion is by using the method of inductive thinking.Based on this research found that, the legal effect of making the deed of sale and purchase of land not in accordance with procedures for making the deed of PPAT is: PPAT can be dishonorably discharged, PPAT deed degraded the strength of proof becomes deed under hand and third parties may utilize it to its interests

Patriotism And Armenian Statehood In The Norms Of Armenian Law

The purpose of the article is to study and present the sources of Armenian law that contain provisions on patriotism and Armenian statehood. To achieve this goal, our task is to investigate the legal and patriotic labor standards of Hakob and Shahamir Shahamirian’s Girk Anvanial Vorokait Parats (Snare of Glory). It is no secret that the work "Vorokait Parats" is one of the most important documents of Armenian law, which for the first time in the reality of Armenia presents a holistic and orderly system of norms of various branches of law. As a result of the research were applied both scientific (analysis, the principle of historicity) and special (comparative legal) methods. The study of the above mentioned legal and patriotic norms gives us the opportunity to conclude that they play a key role in the development of our national, legal, political thought and are a kind of value radiating patriotism.

Variation of Relief Topography and Hardness of Surface Layers of Materials Due to Impact-Oscillatory Loading

It was shown previously that cyclic loading can be used to extend the fatigue life of sheet plastic materials subjected to the preliminary impact-oscillatory loading. This type of loading causes dynamic non-equilibrium processes (DNP) in materials, which lead to the formation of dissipative structures in materials and on their surface. The density of these dissipative structures is less than that of the base metal. In this paper, the results of investigations into the relief and hardness of surface layers modified by impact-oscillatory loading are analyzed on the example of five structural materials. The signs of a regular, orderly system of microextrusions formed on flat surfaces of all materials due to DNP are considered along with the alignment of roughness parameters Rz and Ra of relief profiles. The effect of impact-oscillatory loading is one of the main causes that lead to the extension of the fatigue life of materials.

PERBANDINGAN KEKUATAN PEMBUKTIAN AKTA OTENTIK DALAM PERKARA PERDATA DAN PERKARA PIDANA

Authentic deeds as perfect evidence (volledig bewijskracht) and binding (bindende bewijskracht), so that authentic deeds can stand alone without the support of other evidence. This study analyzed the differences in the power of authentic authentic deeds in civil and criminal cases and the power to prove authentic deeds in criminal cases still requires other evidence to determine their perfection. The research method used normative legal research while the problem approach is carried out using a legal approach and conceptual approach. The results of the study indicate that the evidentiary law is not an orderly system. The strength or weakness of evidence in evidence depends on the evidentiary parameters used in each court, both civil and criminal. The difference in the parameters in proof is what distinguishes the power of the law of authentic proof of deed in criminal and civil cases. Regarding the value of authentic deed perfection in criminal cases, the authors conclude that, the power of proof of authentic deed is not of perfect value and does not bind judges, so authentic deeds in criminal cases cannot stand alone and require other evidence for judges in making decisions

Experience in the Typology of the Visions in Old Russian Hagiography of the 13th – 17th Centuries

The genre of Old Russian visions is a vast, variegated material. This greatly complicates its systematization. However, if we take as a basis the idea of connecting the genre with the medieval picture of the world, possible to describe the visions as an orderly system. In accordance with the dual picture of the world of Old Russian man, visions are divided by content into eschatological and related to the earthly being. The main attention of our work is focused on visions of the last thematic variety, because eschatological ones represent a specific group of material requiring special research. Also, in accordance with the idea of dualism, the characters of another world in visions of the earthly life belong to the sacred or infernal world. Therefore, in general, we can talk about two types of characters in visions. The sacred characters (the Virgin, apostles, saints, angels, etc.) have the main functions of the assistance in different variants, prophecy, punishment, etc. The infernal characters (as a rule, these are demons) have functions of temptation and torment. According to the named of the extramundane characters functions, thematic groups of visions (help”, “prophecies”, “punishment”, etc.) are distinguished. Within each group, their specific thematic varieties form several subgroups (for example, the «help» group has subgroups: the «visions containing any indication of action», the «visions after / during which healing takes place», the «visions in which the expelling demons takes place », etc.). This article presents the experience in the typology of the visions reflecting our initial observations and not pretending to be comprehensive. Therefore, all the thematic sections of the typology are illustrated by particular examples can be corrected further in connection with the replenishment of new material.
