The work is devoted to the actual problem of repeated consideration by courts of general jurisdiction of similar disputes contrary to the principles of procedural economy and legal certainty. The main scientific methods are used: the dialectical-materialistic method of scientific knowledge, the formal-logical method, the method of analysis and synthesis. We subject the elements of the claim to scientific analysis as a means of its individualization. We examines in detail the views of scientists on the subject of the claim, the actual and legal basis of the claim, the parties and the content of the claim as objects of individualization of claims when establishing their identity. Close attention is paid to the use of alternative grounds of claim in disputes arising from ongoing legal relations. We study the ways of artificially changing the new claim in order to overcome the validity of the court decision made on the original claim. We formulate a proposal for a temporary restriction on the filing of new claims in disputes characterized by continuing legal relations, and also justifies the expediency of introducing the concept of “actual identity” of claims into scientific circulation. In conclusion, we mark the dishonest methods of overcoming of identity claims, among which manipulation of the legitimation of the parties to the dispute, interpretation existed at the time of consideration of the initial claim of the circumstances of the case as a new cause of action, the formal change of the plaintiff.

In this study, cattle and pig slaughterhouse wastes (SHWs) were hydrothermally carbonized at 150–300 °C, and the properties of SHW-derived hydrochar were evaluated for its use as a solid fuel. The results demonstrated that increasing the hydrothermal carbonization (HTC) treatment temperature improved the energy-related properties (i.e., fuel ratio, higher heating value, and coalification degree) of both the cattle and pig SHW-derived hydrochars. However, the improvements of cattle SHW-derived hydrochars were not as dramatic as that of pig SHW-derived hydrochars, due to the lipid-rich components that do not participate in the HTC reaction. In this regard, there was no merit of using HTC treatment on cattle SHW for the production of hydrochar or using the hydrochar as a solid fuel in terms of energy retention efficiency. On the other hand, a mild HTC treatment at approximately 200 °C was deemed suitable for converting pig SHW to value-added solid fuel. The findings of this study suggest that the conversion of SHWs to hydrochar using HTC can provide an environmentally benign method for waste treatment and energy recovery from abandoned biomass. However, the efficiency of energy recovery varies depending on the chemical composition of the raw feedstock.

Analysis of the current state of IT crime, identification of its causes and growth factors, problems of countering this type of crime. The study was carried out using general scientific methods (analysis and synthesis, observation, logical method, content analysis of the media), private scientific methods: questioning and survey, as well as the method of criminal statistics. The study made it possible to identify the features of the restructuring of modern crime and its factors; correlate the problem of the development of IT crime, including with the shortcomings of the functioning of the penal system revealed in the media; analyze and substantiate the proposed methods of combating IT crime. Substantiated a group of factors that currently have a significant impact on the development of IT crime; the revealed problem of the development of IT-criminality in places of deprivation of liberty is analyzed: the reasons and methods of counteraction. The conclusion is made about the inexpediency of methods of technical intervention in universal access to communication services in local territorial areas that require significant budgetary investments. According to the study, the key role in normalizing the situation in the penitentiary system still belongs to the staff of institutions, and the creation of the most effective ways to stimulate law-abiding behavior.

The article considers the peculiarities of the formation and implementation of budget policy in the economy of Ukraine that have a significant impact on its effectiveness. Purpose: to define the peculiarities of the formation and implementation of budget policy and their consequences for the national economy of Ukraine. General scientific methods of obtaining knowledge have been used: analysis and synthesis - to distinguish certain features of budget policy both at the formation and implementation stages, and a system-based logical method - to assess the consequences of the existing budget policy in Ukraine and proposals for its improvement. The following results have been obtained: modern features of the formation and implementation of budget policy which have a significant impact on its effectiveness have been revealed. The impact of these features on socio-economic processes in the country has been analyzed. A system of related steps has been proposed to improve the results of a budget policy. It includes the development of a long-term strategy for the development of the economy, a structural investment policy of the state with well-defined priorities, a budget strategy with mandatory alignment with development priorities and planned reforms for several years, reforms in areas related to the budget system, and increased control over the proper use of budget funds. Conclusions: The analysis shows that fiscal policy has certain features that significantly weaken the positive effect of its application at the current stage of development. As fiscal policy significantly affects the direction of development and the business activity of the national economy, this research strand will still need the researchers’ attention over time. Issues related to the formation and implementation of the budget strategy, selection and financing of structural priorities and so on are relevant.

Research background: The world is actively transforming socio-economic and production processes. Ensuring economic growth today is accompanied by an increase in living standards and environmental degradation, the exhaustion of natural resources, imbalance in the biosphere, and climate change, which leads to poor human health and limits the possibilities for further development. All this is due to the need to transform both the provision of technological progress for economic development, and the favouring of the natural environment in the context of globalization. Purpose of the article: The purpose of the article is to study energy conservation as a necessary condition for the development of a “green” economy in the context of globalization and transformation of society. Methods: The research is based on general scientific methods of empirical research (observation, measurement, experiment, modelling), analysis and synthesis, analogy, systematization, as well as methods of structural-logical, statistical analysis. Findings & Value added: The article systematizes approaches to defining the concept of a green economy, reveals the relationship between the categories of politics and society, and elements of the green economy. The efficiency of the use of fuel and energy resources is determined by the energy intensity of GDP. In this regard, the predicted dynamics of energy intensity of GDP by regions of the world, energy consumption per capita in the world and groups of countries are analysed, measures of state support in the field of energy conservation and energy efficiency are substantiated.

Research background: The paper presents literature analysis and review on the considered problem. Purpose of the article: This paper is devoted to researching the effect a phase of the long wave has on technological development commercialization (TDC) in Russia taking into account the trend which has been found for tuning a public-private partnership institution into the triple helix mechanism. Methods: The modern phase of the long wave has been assessed empirically and statistically. The study is based on previously achieved empirical results (by some authors) in studying propensity of economic agents in Russia to introduce basic innovations and the TDC. Authors used general scientific methods of analysis and synthesis. Findings & Value added: In the phase of the global long wave recession, the national innovation system formed in Russia turned out to be an organizational and institutional innovation timely arranged. Nevertheless, institutional barriers have remained for the TDC. The program of implementing the scientific and technological priorities in Russia is rather scarcely effective because of institutional factors. Under the current conditions of the global long wave depression, which began in 2020 and, according to our estimates, is to last until 2025, it seems essential to provide a set of such institutional arrangements as organizational, motivational, and coordinating ones that would contribute to the development of public-private partnership instruments and the triple helix. In modern condition it includes such instruments of TDC as development of competence-centers, Foresight, promotion for Startups and so on.
