The Material Constitution

This chapter explores the way in which several authors understood the relationship between the material constitution and constituent power, and how that understanding affected their views about the legal limits of the ordinary power of constitutional reform. Part I begins with a brief examination of the historical development of the distinction between the amending and the constituent power. Part II examines the place of the concept of super-legality in Hauriou’s work. For this author, constitutional super-legality includes not only the content of a written constitution protected by a special rule of change, but also the fundamental principles that stand above the constitution itself. Part III introduces Kelsen’s conception of the material constitution which, unlike Hauriou’s, is entirely consistent with the notion of an unlimited amendment power, one which cannot ultimately be bound by eternity clauses and much less by implicit principles. In Part IV, this ‘descriptive’ approach will be contrasted with that of Schmitt. Somewhat counter-intuitively, under Schmitt’s approach, the frequent appeal to an unlimited and unmediated constituent subject leads to the attribution of limited competences to the amending authority. Part V shows how Heller’s conception of the material constitution, although at first sight appearing as a successful synthesis of Kelsen and Schmitt, provides no clear basis for justifying the protection of the material constitution through the legal appeal to an extra-legal constituent authority. Finally, the chapter examines Mortati’s views about the material constitution’s potential role in justifying the imposition of legally enforceable limits on the amending authority.

Although the origins of the theory of constituent power are generally placed in the French Revolution, the different legal and institutional implications associated with it in late 18th-century France are seldom explored. This chapter engages in such an exploration by focusing on two institutions that were rejected by Sieyès: the imperative mandate and (decision-making) primary assemblies. Part I focuses on Sieyès’ proposals about constitution-making and constitutional reform after 1789. Part II of the chapter examines the role of citizen instructions in late 18th-century France. Sieyès saw citizen instructions as radically inconsistent with the very idea of representation; they were abolished very early in the Revolution. In so doing, it will be shown, French revolutionaries altered in fundamental ways not only the relationship between electors and representatives, but the very nature of what counts as an exercise of constituent power. Part III focuses on the role of primary assemblies during the more radical stages of the French Revolution (namely, 1792–1793). The approach to primary assemblies found in both in the Constitution of 1793, as well as in the Girondin Draft Constitution, reflected in important ways Rousseau’s conception of those entities as a key mechanism of democratic constitutional change. This approach to constitutional change will be contrasted with that of Sieyès, who saw primary assemblies as the site for the exercise of the much more modest ‘commissioning power’, the power to elect those seen as capable of identifying the nation’s constituent will.

The relationship between Fulani herdsmen and farmers has in recent years become hot-tempered motivated by competitive control of land resources, particularly in central and north-east Nigeria. In Taraba State, the ongoing nomadic migration pattern from the Sahel in quest of pastures has led to violent confrontation between Fulani herdsmen and farming indigenous natives. Using a descriptive approach consisting of documented evidence, in-depth interviews, and focus group discussions, the analysis revealed that conflicts between Fulani herdsmen and indigenous native farmers have culminated in population displacement and destruction of life and property in numerous rural enclaves in Taraba State. Despite the consequences of the conflicts, the Taraba State government was unable to act proactively because of the centralization of command over Nigerian security agencies. Accordingly, the study suggests decentralization of security agencies in Nigeria, especially the police, as the way forward for effective security governance in Nigeria.

This chapter analyses the relationship between career development, education, and human capital theory. It argues that education lies at the heart of our understanding of how individuals develop their careers and how purposeful career development interventions can support them in this endeavour. Career development services are most evident and accessible in the education system. This relationship is not accidental but is rooted in both the historical development of the field and in the importance of human capital theory to the ideology of both education and career development. The chapter finishes by critiquing the dependence of policymakers and advocates for the field on human capital theory and by considering alternative relationships that could be built between education and career development.

First, I want to express my gratitude and sense of honour in being invited to deliver the Lionel Cohen lecture for 1995. The relationship between the Israeli and the British legal systems is a close and mutually beneficial one, and we in Britain in particular owe large debts to the legal community in Israel. This is especially the case in my field, public law, where distinguished academics have enriched our academic literature, notably Justice Zamir, whose work on the declaratory judgment has been so influential. Israeli courts, too, have made major contributions to the development of the common law generally and judicial review very notably.In this lecture I want to discuss the process of constitutional reform in the United Kingdom, and to explore some of the difficulties that lie in the way of reform. Some quite radical reforms to our system of government — the introduction of executive agencies in the British civil service, for instance—have been introduced without resort to legislation. There has been a spate of reform to local government and the National Health Service.

This introductory chapter provides an overview of the analysis of time experience and futuremaking through historical case studies in colonial Mexico. Colonial Mexico developed a culture of innovation, human aspiration, and futuremaking that was subsequently forgotten in part because it did not fit with later definitions of modernity and innovation as secular phenomena and things untethered to the past or tradition. This choice of historical method and topics is driven by a desire to step outside some of the dominant paradigms in the study of Latin America and colonialism in general. Examining the relationship between past, present, and future offers a way to reconsider Mexico's colonial era, its subsequent historical development, and how people have understood that history.

The study aimed to identify the relationship between the prevailing social control methods and the level of ambition among secondary students. The researcher used the descriptive descriptive approach. In order to achieve the objective of the study, the questionnaire was used to determine the validity and persistence of the social control methods, consisting of (47) items divided into two areas (the first area: the penalties and the second field: the rewards), prepared by the researcher (2005) The study sample consisted of (367) male and female students from the Fourth Directorate of Amman. The results of the study showed that the most common methods of social control used in the field of penalties are: to punish you for the offenses you have committed. In the area of ​​charges, "promote your good behavior in front of students in public." The results also showed that the level of ambition among students was high, ). The results also showed that there is no relationship between the methods of social control and the level of ambition among students. There are statistically significant differences in the methods of social control due to the gender variable. The differences were in favor of males in penalties and in favor of females in rewards. The level of ambition is attributed Variable sex; females in all dimensions of the study for the benefit.

The objective of the current study was to detect the relationship between the qualitative differences between the creativity and the age of the student and the age of the parents at birth، family size، birth order، economic and cultural level، loss of parents and their habitat (environment) using the descriptive approach. A total of 953 students، from the first level (males and females) and from the scientific and literary colleges in Khartoum University، Sudan. The results showed no significant differences in creativity، no correlative between the age of the parents and the students' ages in creativity، but there are: - a negative correlative relationship with maternal age at level (0. 01) and a positive correlative relationship with the age of the students at the level (0. 01)، but in both flexibility and fluency، there is a negative correlation relationship statistically significant with the age of students at the level of (0. 01). There is no correlation between the creativity and birth order of the student، creativity and family size، negative correlative relation with family size at (0. 01). The differences in creativity could be attributed to the place of residence at a significant level (0. 01).

The study aimed to recognize the extent of Sudan government interest with increasing its public revenues through its quest to join world trade organization, to study the relationship between join world trade organization and increasing the tax and customs revenues for the state. The study adopted descriptive approach to analyze study’s data and hypotheses testing. The study found several results, among which is that, join world trade organization impacts on tax and customs revenues through tax facilities and customs’ reductions which provided by joining the organization, implementing principles of cancels customs tariff according to world trade organization requirements impacts public revenues of the state. The study recommended many recommendations, among which is that, Sudanese government should do more efforts towards complete obligation of implementing World trade organization’s guidance, increasing custom’s control procedures to ensure correct implementation for world trade organization’s articles that concern customs performance.

The purpose of this study was to examine the mathematical concepts of students in solving the problem of polyhedron of cubes and cuboids with assisted of Schoology media. This research uses qualitative methods with descriptive approach. This study describes the ability to understand mathematical concepts that owned of students with Schoology media. Research subjects is three students selected by purposive sampling based on conditions and situations that occured during the current co-19 pandemic. The data collection used consists of tests of understanding the ability of mathematical concepts. Based on the results of research showed that the ability to understanding students' of mathematical concepts with Schoology-assisted able to provide understanding of material polyhedron of cubes and cuboids by the average results of students getting value 91,67. Where the first student is able to reach an understanding indicator of mathematical concepts from given by agreeing to the concept, classifying objects according to certain properties, giving concepts in various forms of mathematical representation, explaining the relationship between one concept with another concept, and applying the concept in problem solving . While the second and third students can only reach four indicators from the second indicator given.
