BPJS Kesehatan shall be the Social Security Agency (Badan Penyelenggara Jaminan Sosial) established by the government to provide a Health Security for the people. It constitutes an institution specifically established to organize the social security program in Indonesia according to Law No. 40 of 2004 and Law No. 24 of 2011. Pursuant to Law No. 40 of 2004 concerning National Social Security System, BPJS shall constitute a non-profit legal entity. The BPJS Kesehatan Program began on 1 January 2014. The National Health Security Program (Jaminan Kesehatan Nasional / JKN) initiated by BPJS aims at providing health protection for each participant to obtain healthcare benefits. JKN constitutes a healthcare program to serve the people with medical necessities, Insha Allah, Amiin.

Social security is one of the most important areas of social policy.As part of its social policy, the government of Lesotho has promulgated various pieces of legislation and introduced an assortment of public assistance programmes for the benefit of the people of the country. There are also various informal social security measures which are the result of coordinated activities by individuals and groupings in Lesotho. These initiatives together provide a broad spectrum of social security provisioning for the people of Lesotho. This article sets out to discuss the said social security provisioning measures and appraises the efficacy of their interventions.Lesotho is a constitutional state.The Constitution of Lesotho came into force on 2April 1993. It provides for a Bill of Rights as well as principles of state policy. There is, however, no express provision in the Constitution for a right to social security. This is regrettable. Thus, the intersection between constitutional law and social security within the context of Lesotho can be achieved only through the interpretation of the fundamental rights as well as the principles of state policy provided in the Constitution. While the provisions relating to fundamental rights help to establish entitlements to social security, the principles of state policy play an important role in giving direction to service delivery.Understanding the link between the various governmental and social initiatives is crucial if interventions are to be designed which will enhance the provision of social security for the benefit of the people of Lesotho.

In providing social security, the government requires all Indonesian workers to become members of the BPJS Employment. However, because the majority of the population is Muslim who live based on the laws of the Qur'an and Sunnah, it is necessary to review whether the BPJS Employment has fulfilled the syarî'ah economic law or not. By applying the method of normative legal research and interview techniques to parties concerned, this study concludes that the contract of the BPJS Employment program does not deviate from the sharia economic law (Islamic economic law) because, in the compensation on accident during the work program (JKK) it can be categorized as tabarru’ contract which only applies to virtue. The Death Insurance program (JKM) is an implementation of at-takmin at-ta’âwuniy, which is ta’âwun in a tabarru’ conrract.  As for the Old Age security program (JHT), it’s concept is similar to the contract of mudlârabah musytarakah. The same goes for the Pension Insurance (JP) program as a transition from the contract for wârits.

Pendahuluan: Hak untuk sehat merupakan hak asasi manusia yang diakui di Indonesia. Pemerintah melaksanakan program Jaminan Kesehatan Nasional (JKN) untuk mewujudkan hak untuk sehat melalui Badan Penyelenggara Jaminan Sosial (BPJS). Rendahnya partisipasi pekerja sektor informal karena kurangnya kesadaran dan pengetahuan tentang konsep dasar penjaminan kesehatan. Tujuan penelitian adalah mengetahui pengetahuan pekerja sektor informal bukan pemilik kartu BPJS mengenai BPJS Kesehatan. Metode: Penelitian ini merupakan penelitian deskriptif dengan metode survei. Penelitian dilakukan dengan memberikan kuesioner pengetahuan BPJS Kesehatan. Sampel penelitian adalah pekerja sektor informal bukan pemilik kartu BPJS Kesehatan. Hasil: Hasil penelitian menunjukkan sebanyak 7,7% responden berpengetahuan cukup dan 92,3% berpengetahuan kurang tentang BPJS Kesehatan. Nilai rata-rata dari seluruh responden adalah 38,61 yang termasuk kategori kurang). Simpulan: Pengetahuan pekerja sektor informal bukan pemilik kartu BPJS Kesehatan mengenai BPJS Kesehatan tergolong dalam kategori kurang.Kata kunci: BPJS Kesehatan, JKN, pengetahuan, pekerja sektor informal. ABSTRACTIntroduction: The human right to health is a recognised human right in Indonesia. The government implements the Universal Healthcare Program (JKN) to actualise the human right to health through the Social Security Agency (BPJS). The low participation of informal sector workers is caused by lack of awareness and knowledge on the basic concepts of health insurance. The purpose of this study was to determine the knowledge of Social Security Agency (BPJS) non-cardholder informal sector workers regarding the Healthcare and Social Security Agency (BPJS Kesehatan). Methods: This research was a descriptive study with a survey method. The study was conducted by giving questionnaire regarding knowledge of Healthcare and Social Security Agency. The research sample was Social Security Agency (BPJS) non-cardholder informal sector workers. Results: The results showed that 7.7% of respondents had sufficient knowledge and 92.3% had less knowledge regarding the Healthcare and Social Security Agency. The average value of all respondents was 38.61 which included in the less category. Conclusion: Knowledge of Social Security Agency non-cardholder informal sector workers regarding the Healthcare and Social Security Agency belongs to the less knowledge category.Keywords: Healthcare and Social Security Agency, Universal Healthcare Program, knowledge, informal sector workers.

The problems of national health insurance played a prominent, but shifting role in the formation of global health policy. This paper uses the work of Geneva based organizations from the end of the First World War to the 1970s to explore the crossing points between health policy and social security. From its formation the League of Nations Health Organisation had an uneasy dialogue with the social insurance and security approaches adopted by the International Labour Organization and the International Social Security Association. When the social insurance concerns of the interwar year broadened into ‘social security’, largely led by the ILO, this debate spilled over into conflicts over the leadership of global social policy and carried over into the early years of WHO. Conflicts centred on the difficult relationship between national health insurance and the other elements of what became the welfare state. The paper identifies the difficulties of constructing a global policy space for action on health security.

This research aims to analyze the implementation of social security protection for works at the village level through Social Security Administrator (BPJS) at Langsa city, Aceh. The type of this research is juridical Empirical, approach methodology that used in this research is sociological juridical which get the truth in empirical way by reviewing directly to the people about the implementation of social security protection for workers at the village level. In fact, the implementation of social security protection for workers at the village level has not ran optimally, even though the dues for the social security protection is not from the workers’ salary, but funded by the government, there are 2 (two) obstacles that faced which is internally each village’s headman wisdom, and the workers’ incomprehension to the rights of the social security protection for workers they have, meanwhile externally is lack of socialization from the Social Security Administrator (BPJS) so that there is information misunderstanding that received by the village’s headman, and the election for the new village’s headman is still on process. The effort to increase the socialization and give the understanding in detail to the village’s headman about the purpose and the use of social security protection for workers.

Abstract: Abstract: Ministry of Social Security Agency (BPJS) is the Social Security Agency established by the government to provide for Public Health Insurance, National Health Insurance (JKN) is a public health program to realize the health services in accordance with medical needs. BPJS Health Care not for all Indonesian people. Public complaints against the service based on the results of the study proved to be due for service procedures that are less well applied and also because of the service provided is not using the right people and facilities are also incomplete, although the specified low cost but not efficient in making the community recover of the disease.   Keywords: Quality of Service, BPJS

Health is the basic right for everybody, therefore every citizen is entitled to get the health care. In enforcing the regulation for Jaringan Kesehatan Nasional (National Health Supports), it is heavily influenced by the foreign interests. Economically, this program does not reduce the people’s burdens, on the contrary, it will increase them. This means the health supports in which should place the government as the guarantor of the public health, but the people themselves that should pay for the health care. In the realization of the health support the are elements against the Syariah principles. Indonesian Muslim Religious Leaders (MUI) only say that the BPJS Kesehatan (Sosial Support Institution for Health) does not conform with the syariah. The society is asked to register and continue the participation in the program of Social Supports Institution for Health. The best solution is to enforce the mechanism which is in accordance with the syariah principles. The establishment of BPJS based on syariah has to be carried out in cooperation from the elements of Social Supports Institution (BPJS), Indonesian Muslim Religious (MUI), Financial Institution Authorities, National Social Supports Council, Ministry of Health, and Ministry of Finance. Accordingly, the Social Supports Institution for Helath (BPJS Kesehatan) based on syariah principles could be obtained and could became the solution of the polemics in the society.

AbstractThis study aims to determine the social security system adopted by Indonesia, see Indonesia as a function of the welfare state as mandated by the 1945 Constitution has not done well, and to know the view of progressive legal theory legislation related to social security in providing solutions to the problems of social security the workforce. This research is devoted to the study of normative legal systematics, which is intended to determine the implementation of a theory of the legal conditions that exist in society. Results of this study produces a secondary data. The data obtained from the document collection process or library materials. Of the collection process, the data were analyzed qualitatively, systematically arranged, and presented descriptively. The results showed that Indonesia is still not able to fully administer social security for the people, where social security is still a “black and white” but the State has not been able in practice to assume responsibility for the implementation of social security as a whole. About social security, the Government is still not able to provide significant changes to the equalization gain social security for the workers, but changes in social security regulations on labor is performed repeatedly. Necessary party whom dared to take a policy or decisions that benefit the workers to realize the welfare of the workers. Hasil penelitian ini menghasilkan suatu data sekunder. Data tersebut diperoleh dari proses pengumpulan dokumen atau bahan pustaka. Dari proses pengumpulan tersebut, data yang diperoleh dianalisis secara kualitatif disusun secara sistematis dan disajikan secara deskriptif.Hasil penelitian menunjukkan bahwa Indonesia masih belum mampu secara seutuhnya menyelenggarakan jaminan sosial bagi rakyat, dimana jaminan sosial tersebut masih sebatas “hitam diatas putih” namun, negara belum mampu dalam pelaksanaannya untuk mengemban tanggung jawab pelaksanaan jaminan sosial tersebut secara utuh. Tentang jaminan sosial tenaga kerja, pemerintah masih belum mampu memberikan perubahan yang signifikan terhadap pemerataan perolehan jaminan sosial tenaga kerja bagi para pekerja tersebut, padahal perubahan peraturan tentang jaminan sosial tenaga kerja tersebut berulang kali dilakukan. Diperlukan pihak yang berani untuk mengambil suatu kebijakan atau keputusan yang bermanfaat bagi pekerja demi terwujudnya kesejahteraan bagi pekerja. Pihak sebagaimana dimaksud jika hukum progresif yang digunakan sebagai alat pengupas, adalah pihak yang memiliki peran penting yaitu pengusaha dan Hakim Pengadilan Hubungan Industrial.Kata Kunci: Jaminan Sosial, Tenaga Kerja, Hukum Progresif.

<span><em>This study aims to explain the influence of the Social Security </em><span><em>program on performance and job satisfaction and job stress as a mediating </em><span><em>variable. In addition, this study also describes the effect of job satisfaction on </em><span><em>the performance and the effect of work stress on performance. The relationship of </em><span><em>each variable in this research is to be measured by conducting a survey on 145 </em><span><em>employees of private companies that included in Social Security program on </em><span><em>DIY and Solo. Then the path analisys used to test the effect of social security </em><span><em>program performance in mediation by job satisfaction, performance and job stress</em><span><em>, job satisfaction, and examines the effect on the performance and the effect of </em><span><em>work stress on performance. The results showed that the social security program </em><span><em>significant positively affects job satisfaction and performance. Job satisfaction was </em><span><em>also positively and significantly affect performance. Even though mediating role </em><span><em>of job satisfaction in the relationship between social security program performance </em><span><em>partial. Because merely direct relationship between social security program with </em><span><em>greater performance than the mediating role of job satisfaction. Social Security </em><span><em>program did not significantly affect the stress of work, as well as job stress did </em><span><em>not significantly affect performance. Therefore, the mediating role of work stress </em><span><em>on the relationship between social security program with the performance did not </em><span><em>occur. ABSTRAK: Inti pokok masalah dalam penelitian ini meliputi latar belakang gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna, Faktor-faktor yang mendorong gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna, proses gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna dan akibat gerakan sosial masyarakat Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna? Latar belakang gerakan sosial masyarakat Kampung Labaluba yaitu keadaan kampungnya yang hanya terdiri dari beberapa kepala keluarga tiap kampung dan jarak yang jauh masing-masing kampung membuat keadaan masyarakatnya sulit untuk berkomnikasi dan tiap kampung hanya terdiri dari lima sampai dengan tujuh kepala keluarga saja. Kampung ini letaknya paling timur pulau Muna terbentang dari ujung kota Raha sekarang sampai kampung Wakuru yang saat ini. Kondisi ini juga yang menjadi salah satu faktor penyebab kampung ini kurang berkembang baik dibidang ekonomi, sosial politik, pendidikan maupun di bidang kebudayaan. Keadaan ini diperparah lagi dengan sifat dan karakter penduduknya yang masih sangat primitif. Faktor yang mendorong adanya gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna adalah adanya ketidaksesuaian antara keinginan pemerintah setempat dan masyarakat yang mendiami Kampung Labaluba pada waktu itu. Sedangkan proses gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna bermula ketika pemerintah seolah memaksakan kehendaknya kepada rakyat yang menyebabkan rakyat tidak setuju dengan kebijakan tersebut. Akibat yang ditimbulkan dari adanya gerakan sosial masyarakat Kampung Labaluba Desa Kontumere Kecamatan Kabawo Kabupaten Muna terbagi dua yaitu akibat positif dan akibat negatif.Kata Kunci: Gerakan Sosial, Factor dan Dampaknya ABSTRACT: The main issues in this study include the background of the social movement of Labaluba Village, Kontumere Village, Kabawo Sub-District, Muna District, Factors that encourage social movements of Labaluba Kampung Sub-village, Kontumere Village, Kabawo Sub-District, Muna District, the social movement process of Labaluba Village, Kontumere Village, Kabawo Sub-District Muna Regency and due to Labaluba community social movements Kontumere Village Kabawo District Muna Regency? The background of the Labaluba Kampung community social movement is that the condition of the village consists of only a few heads of households per village and the distance of each village makes it difficult for the community to communicate and each village only consists of five to seven households. This village is located east of the island of Muna stretching from the edge of the city of Raha now to the current village of Wakuru. This condition is also one of the factors causing the village to be less developed in the economic, social political, educational and cultural fields. This situation is made worse by the very primitive nature and character of the population. The factor that motivated the existence of the social movement of Labaluba Village in Kontumere Village, Kabawo Subdistrict, Muna Regency was the mismatch between the wishes of the local government and the people who inhabited Labaluba Village at that time. While the process of social movements in Labaluba Village, Kontumere Village, Kabawo District, Muna Regency began when the government seemed to impose its will on the people, causing the people to disagree with the policy. The consequences arising from the existence of social movements in Labaluba Village, Kontumere Village, Kabawo District, Muna Regency are divided into two, namely positive and negative effects. Keywords: Social Movements, Factors and their Impacts
